Decision of the EEA Joint Committee No 211/2019 of 27 September 2019 amending Annex I (Veterinary and phytosanitary matters) and Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2023/16]
This EEA Joint Committee Decision No. 211/2019, dated September 27, 2019, amends Annex I (Veterinary and phytosanitary matters) and Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement. The amendment incorporates Commission Regulation (EU) 2019/38, which modifies Annexes II and V to Regulation (EC) No 396/2005 regarding maximum residue levels (MRLs) for iprodione in specific products, into the EEA Agreement. This decision will not apply to Liechtenstein due to its existing trade agreement with the Swiss Confederation on agricultural products. The Decision adds Regulation (EU) 2019/38 to point 40 of Chapter II of Annex I and point 54zzy of Chapter XII of Annex II of the EEA Agreement. The authentic text of Regulation (EU) 2019/38 in Icelandic and Norwegian will be published in the EEA Supplement to the Official Journal of the European Union. The Decision entered into force on September 28, 2019, following notification under Article 103(1) of the EEA Agreement. The decision will be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.

amending Annex I (Veterinary and phytosanitary matters) and Annex II (Technical regulations,
standards, testing and certification) to the EEA Agreement [2023/16]
THE EEA JOINT COMMITTEE,
Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98
thereof,
Whereas:
(1) Commission Regulation (EU) 2019/38 of 10 January 2019 amending Annexes II and V to Regulation (EC)
No 396/2005 of the European Parliament and of the Council as regards maximum residue levels for iprodione in or
on certain products(1)is to be incorporated into the EEA Agreement.
(2) This Decision concerns legislation regarding feedingstuffs and foodstuffs. Legislation regarding feedingstuffs and
foodstuffs shall not apply to Liechtenstein as long as the application of the Agreement between the European
Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified
in the sectoral adaptations to Annex I and the introduction to Chapter XII of Annex II to the EEA Agreement. This
Decision is therefore not to apply to Liechtenstein.
(3) Annexes I and II to the EEA Agreement should therefore be amended accordingly,
HAS ADOPTED THIS DECISION:
Article 1
The following indent is added in point 40 (Regulation (EC) No 396/2005 of the European Parliament and of the Council) of
Chapter II of Annex I to the EEA Agreement:
‘— 32019 R 0038: Commission Regulation (EU) 2019/38 of 10 January 2019(OJ L 9, 11.1.2019, p. 94).’
Article 2
The following indent is added in point 54zzy (Regulation (EC) No 396/2005 of the European Parliament and of the
Council) of Chapter XII of Annex II to the EEA Agreement:
‘— 32019 R 0038: Commission Regulation (EU) 2019/38 of 10 January 2019(OJ L 9, 11.1.2019, p. 94).’
Article 3
The text of Regulation (EU) 2019/38 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to
the Official Journal of the European Union, shall be authentic.
Article 4
This Decision shall enter into force on 28 September 2019, provided that all the notifications under Article 103(1) of the
EEA Agreement have been made(*).
