Decision of the EEA Joint Committee No 219/2019 of 27 September 2019 amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2023/24]
**Summary:**
EEA Joint Committee Decision No. 219/2019, dated 27 September 2019, amends Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement. The decision incorporates two Commission Regulations into the EEA Agreement:
1. Commission Regulation (EU) 2019/650 of 24 April 2019, amending Annex III to Regulation (EC) No 1925/2006 of the European Parliament and of the Council as regards Yohimbe (Pausinystalia yohimbe (K. Schum.) Pierre ex Beille). (OJ L 110, 25.4.2019, p. 21).
2. Commission Regulation (EU) 2019/651 of 24 April 2019, refusing to authorise a health claim made on foods and referring to children's development and health (OJ L 110, 25.4.2019, p. 23).
This decision does not apply to Liechtenstein due to the extension of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products to Liechtenstein.
Article 1 of the Decision amends Chapter XII of Annex II to the EEA Agreement by adding the regulations mentioned above. The Icelandic and Norwegian language texts of Regulations (EU) 2019/650 and (EU) 2019/651 will be published in the EEA Supplement to the Official Journal of the European Union and are considered authentic.
The Decision entered into force on 28 September 2019, following the completion of notifications under Article 103(1) of the EEA Agreement. The Decision was published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.

amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement
[2023/24]
THE EEA JOINT COMMITTEE,
Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98
thereof,
Whereas:
(1) Commission Regulation (EU) 2019/650 of 24 April 2019amending Annex III to Regulation (EC) No 1925/2006 of
the European Parliament and of the Council as regards Yohimbe (Pausinystalia yohimbe (K. Schum) Pierre ex Beille)(1)
is to be incorporated into the EEA Agreement.
(2) Commission Regulation (EU) 2019/651 of 24 April 2019refusing to authorise a health claim made on foods and
referring to children's development and health(2)is to be incorporated into the EEA Agreement.
(3) This Decision concerns legislation regarding foodstuffs. Legislation regarding foodstuffs shall not apply to
Liechtenstein as long as the application of the Agreement between the European Community and the Swiss
Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the introduction to
Chapter XII of Annex II to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.
(4) Annex II to the EEA Agreement should therefore be amended accordingly,
HAS ADOPTED THIS DECISION:
Article 1
Chapter XII of Annex II to the EEA Agreement shall be amended as follows:
1. The following indent is added in point 54zzzu (Regulation (EC) No 1925/2006 of the European Parliament and of the
Council):
‘— 32019 R 0650: Commission Regulation (EU) 2019/650 of 24 April 2019(OJ L 110, 25.4.2019, p. 21).’
2. The following point is inserted after point 164 (Regulation (EU) 2017/625 of the European Parliament and of the
Council):
‘165. 32019 R 0651: Commission Regulation (EU) 2019/651 of 24 April 2019refusing to authorise a health claim
made on foods and referring to children's development and health (OJ L 110, 25.4.2019, p. 23).’
Article 2
The texts of Regulations (EU) 2019/650 and (EU) 2019/651 in the Icelandic and Norwegian languages, to be published in
the EEA Supplement to the Official Journal of the European Union, shall be authentic.
Article 3
This Decision shall enter into force on 28 September 2019, provided that all the notifications under Article 103(1) of the
EEA Agreement have been made(*).
