30.6.2022 EN Official Journal of the European Union L 175/37 DECISION OF THE EEA JOINT COMMITTEE No 22/2022 of 4 February 2022 amending Annex XX (Environment) to the EEA Agreement [2022/1070] THE EEA JOINT COMMITTEE, Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof, Whereas: (1) Commission Delegated Regulation (EU) 2021/1416 of 17 June 2021 amending Directive 2003/87/EC of the European Parliament and of the Council as regards the exclusion of incoming flights from the United Kingdom from the Union emissions trading system(1)is to be incorporated into the EEA Agreement. (2) Annex XX to the EEA Agreement should therefore be amended accordingly, HAS ADOPTED THIS DECISION: Article 1 Point 21al (Directive 2003/87/EC of the European Parliament and of the Council) of Annex XX to the EEA Agreement shall be amended as follows: 1. The following indent is added: ‘- 32021 R 1416: Commission Delegated Regulation (EU) 2021/1416 of 17 June 2021(OJ L 305, 31.8.2021, p. 1).’ 2. The text of adaptation (u) is replaced by the following: ‘In the second paragraph of the entry ‘Aviation’ of column ‘Activities’ of the table in Annex I: (i) the second paragraph of point (j) and point (k) as amended by Commission Delegated Decision (EU) 2020/1071 of 18 May 2020, and point (l) shall apply from 1 January 2020, (ii) the second paragraph of point (j) and point (k) as amended by Commission Delegated Regulation (EU) 2021/1416 of 17 June 2021, and point (m) shall apply from 1 January 2021.’ Article 2 The text of Delegated Regulation (EU) 2021/1416 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic. Article 3 This Decision shall enter into force on 5 February 2022, provided that all the notifications under Article 103(1) of the EEA Agreement have been made*.
