DECISION OF THE EEA JOINT COMMITTEE No 236/2024
of 25 October 2024
amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement
[2025/248]
THE EEA JOINT COMMITTEE,
Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98
thereof,
Whereas:
(1) Commission Regulation (EU) 2024/2041 of 29 July 2024amending Regulation (EU) No 432/2012 as regards the
health claim on monacolin K from red yeast rice(1)is to be incorporated into the EEA Agreement.
(2) Commission Implementing Regulation (EU) 2024/2036 of 29 July 2024authorising the placing on the market of 2’-
Fucosyllactose produced by a derivative strain of Escherichia coli W (ATCC 9637) as a novel food and amending
Implementing Regulation (EU) 2017/2470(2)is to be incorporated into the EEA Agreement.
(3) Commission Implementing Regulation (EU) 2024/2044 of 29 July 2024 amending Implementing Regulation
(EU) 2017/2470 as regards the specifications and the conditions of use of the novel food Yarrowia lipolytica yeast
biomass(3)is to be incorporated into the EEA Agreement.
(4) Commission Implementing Regulation (EU) 2024/2046 of 29 July 2024 amending Implementing Regulation
(EU) 2017/2470 as regards the specific labelling requirements for the novel food partially hydrolysed protein from
spent barley (Hordeum vulgare) and rice (Oryza sativa)(4)is to be incorporated into the EEA Agreement.
(5) Commission Implementing Regulation (EU) 2024/2048 of 29 July 2024 amending Implementing Regulation
(EU) 2017/2470 as regards the specifications and the conditions of use of the novel food protein extract from pig
kidneys(5)is to be incorporated into the EEA Agreement.
(6) Commission Implementing Regulation (EU) 2024/2090 of 29 July 2024authorising the placing on the market of
Lacto-N-fucopentaose I and 2'-Fucosyllactose mixture produced using a derivative strain of Escherichia coli K-12
DH1 as a novel food and amending Implementing Regulation (EU) 2017/2470(6)is to be incorporated into the EEA
Agreement.
(7) This Decision concerns legislation regarding foodstuffs. Legislation regarding foodstuffs shall not apply to
Liechtenstein as long as the application of the Agreement between the European Community and the Swiss
Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the introduction to
Chapter XII of Annex II to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.
(8) Annex II to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:
Article 1
Chapter XII of Annex II to the EEA Agreement shall be amended as follows:
1. The following indent is added in point 54zzzzzp (Commission Regulation (EU) No 432/2012):
‘— 32024 R 2041: Commission Regulation (EU) 2024/2041 of 29 July 2024(OJ L, 2024/2041, 30.7.2024).’
2. The following indents are added in point 124b (Commission Implementing Regulation (EU) 2017/2470):
‘— 32024 R 2036: Commission Implementing Regulation (EU) 2024/2036 of 29 July 2024 (OJ L, 2024/2036,
30.7.2024),
— 32024 R 2044: Commission Implementing Regulation (EU) 2024/2044 of 29 July 2024 (OJ L, 2024/2044,
30.7.2024),
— 32024 R 2046: Commission Implementing Regulation (EU) 2024/2046 of 29 July 2024 (OJ L, 2024/2046,
30.7.2024),
— 32024 R 2048: Commission Implementing Regulation (EU) 2024/2048 of 29 July 2024 (OJ L, 2024/2048,
30.7.2024),
— 32024 R 2090: Commission Implementing Regulation (EU) 2024/2090 of 29 July 2024 (OJ L, 2024/2090,

3. The following points are inserted after point 250 (Commission Implementing Regulation (EU) 2024/1052):
‘251. 32024 R 2036: Commission Implementing Regulation (EU) 2024/2036 of 29 July 2024 authorising the
placing on the market of 2’-Fucosyllactose produced by a derivative strain of Escherichia coli W (ATCC 9637)
as a novel food and amending Implementing Regulation (EU) 2017/2470 (OJ L, 2024/2036, 30.7.2024).
252. 32024 R 2090: Commission Implementing Regulation (EU) 2024/2090 of 29 July 2024 authorising the
placing on the market of Lacto-N-fucopentaose I and 2'-Fucosyllactose mixture produced using a derivative
strain of Escherichia coli K-12 DH1 as a novel food and amending Implementing Regulation (EU) 2017/2470
(OJ L, 2024/2090, 30.7.2024).’
Article 2
The texts of Regulation (EU) 2024/2041 and Implementing Regulations (EU) 2024/2036, (EU) 2024/2044,
(EU) 2024/2046, (EU) 2024/2048 and (EU) 2024/2090 in the Icelandic and Norwegian languages, to be published in the
EEA Supplement to the Official Journal of the European Union, shall be authentic.
Article 3
This Decision shall enter into force on 26 October 2024, provided that all the notifications under Article 103(1) of the EEA
Agreement have been made(*).
(*) No constitutional requirements indicated.

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European
Union.
