## Summary of EEA Joint Committee Decision No. 293/2022
This decision, adopted by the EEA Joint Committee on December 9, 2022, amends Annex I (Veterinary and phytosanitary matters) and Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement. The amendment incorporates Commission Regulation (EU) 2022/566 into the EEA Agreement, specifically addressing maximum residue levels (MRLs) for flutianil in or on certain products.
Article 1 adds an indent to point 40 of Regulation (EC) No 396/2005 within Chapter II of Annex I, referencing Commission Regulation (EU) 2022/566 (OJ L 109, 8.4.2022, p. 35). Article 2 similarly adds an indent to point 54zzy of Regulation (EC) No 396/2005 within Chapter XII of Annex II, also referencing Commission Regulation (EU) 2022/566 (OJ L 109, 8.4.2022, p. 35).
Article 3 stipulates that the Icelandic and Norwegian language texts of Regulation (EU) 2022/566, to be published in the EEA Supplement to the Official Journal of the European Union, will be authentic.
Notably, this Decision does not apply to Liechtenstein, contingent upon the extension of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products to Liechtenstein, as detailed in the sectoral adaptations to Annex I and the introduction to Chapter XII of Annex II to the EEA Agreement.
The Decision entered into force on December 10, 2022, conditional upon the completion of all notifications required under Article 103(1) of the EEA Agreement. The Decision will be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.

amending Annex I (Veterinary and phytosanitary matters) and Annex II (Technical regulations,
standards, testing and certification) to the EEA Agreement [2023/1235]
THE EEA JOINT COMMITTEE,
Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98
thereof,
Whereas:
(1) Commission Regulation (EU) 2022/566 of 7 April 2022amending Annex II to Regulation (EC) No 396/2005 of the
European Parliament and of the Council as regards maximum residue levels for flutianil in or on certain products(1)
is to be incorporated into the EEA Agreement.
(2) This Decision concerns legislation regarding feedingstuffs and foodstuffs. Legislation regarding feedingstuffs and
foodstuffs shall not apply to Liechtenstein as long as the application of the Agreement between the European
Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified
in the sectoral adaptations to Annex I and the introduction to Chapter XII of Annex II to the EEA Agreement. This
Decision is therefore not to apply to Liechtenstein.
(3) Annexes I and II to the EEA Agreement should therefore be amended accordingly,
HAS ADOPTED THIS DECISION:
Article 1
The following indent is added in point 40 (Regulation (EC) No 396/2005 of the European Parliament and of the Council) of
Chapter II of Annex I to the EEA Agreement:

Article 3
The text of Regulation (EU) 2022/566 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to
the Official Journal of the European Union, shall be authentic.
Article 4
This Decision shall enter into force on 10 December 2022, provided that all the notifications under Article 103(1) of the
EEA Agreement have been made*.
