Executive Summary & Key Takeaways

**Policy Summary:** EEA Joint Committee Decision No. 295/2022, dated 9 December 2022, amends Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement. The decision incorporates Commission Delegated Regulation (EU) 2022/2238 of 22 August 2022, which itself amends Delegated Regulation (EU) 2021/2306. The amendment pertains to transitional provisions for certificates of inspection and extracts thereof, specifically addressing certificates of inspection issued in Ukraine, related to foodstuffs. This decision does not apply to Liechtenstein due to the existing agreement between the European Community and the Swiss Confederation on trade in agricultural products. The amendment is reflected by adding "32022 R 2238: Commission Delegated Regulation (EU) 2022/2238 of 22 August 2022 (OJ L 294, 15.11.2022, p. 3)" to point 54bb of Commission Delegated Regulation (EU) 2021/2306 of Chapter XII of Annex II to the EEA Agreement. The Icelandic and Norwegian language versions of Delegated Regulation (EU) 2022/2238 will be published in the EEA Supplement to the Official Journal of the European Union and are considered authentic. The decision entered into force on 10 December 2022, following the completion of notifications under Article 103(1) of the EEA Agreement. The decision will be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
