L 164/22 EN Official Journal of the European Union 29.6.2023 DECISION OF THE EEA JOINT COMMITTEE No 300/2022 of 9 December 2022 amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2023/1242] THE EEA JOINT COMMITTEE, Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof, Whereas: (1) Commission Implementing Regulation (EU) 2022/741 of 13 May 2022 concerning a coordinated multiannual control programme of the Union for 2023, 2024 and 2025 to ensure compliance with maximum residue levels of pesticides and to assess the consumer exposure to pesticide residues in and on food of plant and animal origin and repealing Implementing Regulation (EU) 2021/601(1)is to be incorporated into the EEA Agreement. (2) Implementing Regulation (EU) 2022/741 repeals, with effect from 1 September 2023, Commission Implementing Regulation (EU) 2021/601(2), which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement with effect from 1 September 2023. (3) This Decision concerns legislation regarding foodstuffs. Legislation regarding foodstuffs shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the introduction to Chapter XII of Annex II to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein. (4) Annex II to the EEA Agreement should therefore be amended accordingly, HAS ADOPTED THIS DECISION: Article 1 Chapter XII of Annex II to the EEA Agreement shall be amended as follows: 1. The following is inserted after point 213 (Commission Implementing Regulation (EU) 2022/196): ‘214. 32022 R 0741: Commission Implementing Regulation (EU) 2022/741 of 13 May 2022 concerning a coordinated multiannual control programme of the Union for 2023, 2024 and 2025 to ensure compliance with maximum residue levels of pesticides and to assess the consumer exposure to pesticide residues in and on food of plant and animal origin and repealing Implementing Regulation (EU) 2021/601 (OJ L 137, 16.5.2022, p. 12). The provisions of the Regulation shall, for the purposes of this Agreement, be read with the following adaptation: The following shall be added to the table in point (5) of Annex II: “IS 12 NO 12”’ (1) OJ L 137, 16.5.2022, p. 12. (2) OJ L 127, 14.4.2021, p. 29.29.6.2023 EN Official Journal of the European Union L 164/23 2. The text of point 196 (Commission Implementing Regulation (EU) 2021/601) shall be deleted with effect from 1 September 2023. Article 2 The text of Implementing Regulation (EU) 2022/741 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic. Article 3 This Decision shall enter into force on 10 December 2022, provided that all the notifications under Article 103(1) of the EEA Agreement have been made*.
