Executive Summary & Key Takeaways

**Summary:** EEA Joint Committee Decision No. 32/2022, dated 4 February 2022, amends Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement. The decision incorporates Commission Delegated Regulation (EU) 2021/642 of 30 October 2020, which amends Annex III to Regulation (EU) 2018/848 of the European Parliament and of the Council regarding information on the labeling of organic products, into the EEA Agreement. Article 1 of the Decision adds "32021 R 0642: Commission Delegated Regulation (EU) 2021/642 of 30 October 2020 (OJ L 133, 20.4.2021, p. 1)" to point 54b (Regulation (EU) 2018/848 of the European Parliament and of the Council) of Chapter XII of Annex II to the EEA Agreement. Article 2 stipulates that the Icelandic and Norwegian language texts of Delegated Regulation (EU) 2021/642 will be published in the EEA Supplement to the Official Journal of the European Union and shall be authentic. Article 3 states that the Decision entered into force on 5 February 2022, contingent upon completion of notifications under Article 103(1) of the EEA Agreement, or on the entry into force of Decision of the EEA Joint Committee No 31/2022 of 4 February 2022, whichever was later. Article 4 mandates publication of the Decision in the EEA Section of, and the EEA Supplement to, the Official Journal of the European Union. Notably, the legislation regarding foodstuffs, as outlined in this Decision, does not apply to Liechtenstein, contingent upon the extension of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products to Liechtenstein, as detailed in the introduction to Chapter XII of Annex II to the EEA Agreement.
