Decision of the EEA Joint Committee No 320/2022 of 9 December 2022 amending Annex II (Technical regulations, standards, testing and certification) and Annex XX (Environment) to the EEA Agreement [2023/1262]
This EEA Joint Committee Decision No. 3/202022, dated 9 December 2022, amends Annex II (Technical regulations, standards, testing and certification) and Annex XX (Environment) to the EEA Agreement. The amendment incorporates Commission Implementing Regulation (EU) 2019/290 into the EEA Agreement. This regulation establishes the format for registration and reporting of producers of electrical and electronic equipment (EEE) to the register. Specifically, the decision inserts new points (9eb and 32fab) referencing Regulation (EU) 2019/290 into Annexes II and XX, respectively. The authentic Icelandic and Norwegian language versions of Regulation (EU) 2019/290 will be published in the EEA Supplement to the Official Journal. The decision entered into force on 10 December 2022, contingent upon completion of notifications under Article 103(1) of the EEA Agreement, and will be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.

THE EEA JOINT COMMITTEE,
Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98
thereof,
Whereas:
(1) Commission Implementing Regulation (EU) 2019/290 of 19 February 2019establishing the format for registration
and reporting of producers of electrical and electronic equipment to the register(1) is to be incorporated into the
EEA Agreement.
(2) Annexes II and XX to the EEA Agreement should therefore be amended accordingly,
HAS ADOPTED THIS DECISION:
Article 1
The following point is inserted after point 9ea (Commission Implementing Regulation (EU) 2017/699) of Chapter XVII of
Annex II to the EEA Agreement:
‘9eb. 32019 R 0290: Commission Implementing Regulation (EU) 2019/290 of 19 February 2019establishing the format
for registration and reporting of producers of electrical and electronic equipment to the register (OJ L 48, 20.2.2019,
p. 6).’
Article 2
The following point is inserted after point 32faa (Commission Implementing Regulation (EU) 2017/699) of Annex XX to
the EEA Agreement:
‘32fab. 32019 R 0290: Commission Implementing Regulation (EU) 2019/290 of 19 February 2019 establishing the
format for registration and reporting of producers of electrical and electronic equipment to the register (OJ L 48,
20.2.2019, p. 6).’
Article 3
The text of Implementing Regulation (EU) 2019/290 in the Icelandic and Norwegian languages, to be published in the EEA
Supplement to the Official Journal of the European Union, shall be authentic.
Article 4
This Decision shall enter into force on 10 December 2022, provided that all the notifications under Article 103(1) of the
EEA Agreement have been made*.
Article 5
This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European
Union.
