Official Journal EN of the European Union L series 2024/1521 27.6.2024 DECISION OF THE EEA JOINT COMMITTEE No 40/2024 of 2 February 2024 amending Annex XX (Environment) to the EEA Agreement [2024/1521] THE EEA JOINT COMMITTEE, Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof, Whereas: (1) Commission Implementing Decision (EU) 2023/1533 of 24 July 2023on the recognition of the requirements of the Ecoprofit environmental management system as complying with the corresponding requirements of the eco- management and audit scheme (EMAS) in accordance with Article 45 of Regulation (EC) No 1221/2009 of the European Parliament and of the Council(1)is to be incorporated into the EEA Agreement. (2) Commission Decision (EU) 2023/1809 of 14 September 2023 establishing the EU Ecolabel criteria for absorbent hygiene products and for reusable menstrual cups(2)is to be incorporated into the EEA Agreement. (3) Decision (EU) 2023/1809 repeals Commission Decision 2014/763/EU(3), which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement. (4) Annex XX to the EEA Agreement should therefore be amended accordingly, HAS ADOPTED THIS DECISION: Article 1 Annex XX to the EEA Agreement shall be amended as follows: 1. The following point is inserted after point 1eat (Commission Decision (EU) 2021/2054): ‘1eau. 32023 D 1533: Commission Implementing Decision (EU) 2023/1533 of 24 July 2023on the recognition of the requirements of the Ecoprofit environmental management system as complying with the corresponding requirements of the eco-management and audit scheme (EMAS) in accordance with Article 45 of Regulation (EC) No 1221/2009 of the European Parliament and of the Council (OJ L 186, 25.7.2023, p. 28).’ 2. The text of point 2zo (Commission Decision 2014/763/EU) is replaced by the following: ‘32023 D 1809: Commission Decision (EU) 2023/1809 of 14 September 2023establishing the EU Ecolabel criteria for absorbent hygiene products and for reusable menstrual cups (OJ L 234, 22.9.2023, p. 142).’ Article 2 The texts of Decision (EU) 2023/1809 and Implementing Decision (EU) 2023/1533 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic. Article 3 This Decision shall enter into force on 3 February 2024, provided that all the notifications under Article 103(1) of the EEA Agreement have been made(*). (1) OJ L 186, 25.7.2023, p. 28.
