Official Journal EN of the European Union L series 2024/103 18.1.2024 DECISION OF THE EEA JOINT COMMITTEE No 93/2021 of 19 March 2021 amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement [2024/103] THE EEA JOINT COMMITTEE, Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof, Whereas: (1) Commission Implementing Regulation (EU) 2020/2235 of 16 December 2020laying down rules for the application of Regulations (EU) 2016/429 and (EU) 2017/625 of the European Parliament and of the Council as regards model animal health certificates, model official certificates and model animal health/official certificates, for the entry into the Union and movements within the Union of consignments of certain categories of animals and goods, official certification regarding such certificates and repealing Regulation (EC) No 599/2004, Implementing Regulations (EU) No 636/2014 and (EU) 2019/628, Directive 98/68/EC and Decisions 2000/572/EC, 2003/779/EC and 2007/240/EC(1)is to be incorporated into the EEA Agreement. (2) Commission Implementing Regulation (EU) 2020/2236 of 16 December 2020laying down rules for the application of Regulations (EU) 2016/429 and (EU) 2017/625 of the European Parliament and of the Council as regards model animal health certificates for the entry into the Union and movements within the Union of consignments of aquatic animals and of certain products of animal origin from aquatic animals, official certification regarding such certificates and repealing Regulation (EC) No 1251/2008(2)is to be incorporated into the EEA Agreement. (3) Implementing Regulation (EU) 2020/2235 repeals, with effect from 21 April 2021, Commission Regulation (EC) No 599/2004(3), Commission Implementing Regulations (EU) No 636/2014(4) and (EU) 2019/628(5) and Commission Directive 98/68/EC(6), which are incorporated into the EEA Agreement and which are consequently to be repealed under the EEA Agreement with effect from 21 April 2021. (4) Implementing Regulation (EU) 2020/2236 repeals, with effect from 21 April 2021, Commission Regulation (EC) No 1251/2008(7), which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement with effect from 21 April 2021. (5) This Decision concerns legislation regarding veterinary matters. Legislation regarding veterinary matters shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I to the EEA Agreement. The provisions of this Regulation shall, for the purposes of the EEA Agreement, be read with the following adaptations: In Annex III the words “Iceland, Norway” shall be inserted after the word “Finland” in paragraphs (4) of Part II of the Notes of Part II of Chapter 1, (3) of Part II of the Notes of Part II of Chapter 3 and (3) of Part II of the Notes of Part II of Chapter 19, and after the word “Sweden” in paragraph (2) of Part II of the Notes of Part II of Chapter 13. This act applies to Iceland for the areas referred to in paragraph 2 of the Introductory Part. 13m. 32020 R 2236: Commission Implementing Regulation (EU) 2020/2236 of 16 December 2020 laying down rules for the application of Regulations (EU) 2016/429 and (EU) 2017/625 of the European Parliament and of the Council as regards model animal health certificates for the entry into the Union and movements within the Union of consignments of aquatic animals and of certain products of animal origin from aquatic animals, official certification regarding such certificates and repealing Regulation (EC) No 1251/2008 (OJ L 442, 30.12.2020, p. 410).’ 2. The texts of points 11bl (Commission Implementing Regulation (EU) 2019/628) in Part 1.1, 119 (Commission Regulation (EC) No 599/2004), 151 (Commission Implementing Regulation (EU) No 636/2014) in Part 1.2, 86 (Commission Regulation (EC) No 1251/2008) in Part 4.2 of Chapter I shall be deleted with effect from 21 April 2021. 3. The texts of points 31aa (Commission Directive 98/68/EC) and 31ql (Commission Implementing Regulation (EU) 2019/628) in Chapter II of Annex I to the EEA Agreement shall be deleted with effect from 21 April 2021. Article 2 The texts of Implementing Regulations (EU) 2020/2235 and (EU) 2020/2236 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic. Article 3 This Decision shall enter into force on 20 March 2021, provided that all the notifications under Article 103(1) of the EEA Agreement have been made*, or on the day of the entry into force of Decision of the EEA Joint Committee No 179/2020 of 11 December 2020(8), whichever is the later. * No constitutional requirements indicated.
