अत:, अब, िायुयान अजधजनयम, 1934 (1934 का 22) की धारा 5 द्वारा प्रदि िजियों का प्रयोग करते हुए,
केंद्रीय सरकार आग ेिायुयान जनयम, 1937 के रूप मे संिोजधत करने के जलए जनम्नजलजखत जनयम बनाती ह,ै अथाात्-
1. संजिति नाम और प्रारंभ-
(1) इन जनयमों का संजि प् त नाम िायुयान (दसू रा संिोधन) जनयम, 2022 ह।ै
(2) ये राजपत्र म ेंइनके प्रकािन की तारीख को प्रिृत् त होंगे।

2. िायुयान जनयम, 1937 में, जजन्ह े इसमें इसके पश् चात उक्त जनयम कहा जाएगा, के जनयम 3 में, खंड (34क) के
पश् चात, जनम्न जलजखत खंड को अत: स्ट्थ ाजपत दकया जाएगा, अथाात्:-
“(34कक) “जिजनमााण” से कायों का जनष्पादन जजसमें जिमान, इंजन, प्रोपैलर अथिा संबंजधत पुजों तथा प्रोटोटाइप
सजहत इसके लागू जडजाइन के साथ अनरूु पता में उपकरणों का संयोजन/अथिा उत्पादन िाजमल होता है, अजभप्रेत ह।ै
स्ट्पष्टीकरण.- इस खडं के प्रयोजन के जलए “जडजाइन” से डाटा और सूचना का समूह जो िैमाजनक उत् पाद टाइप के जिचार को
पररभाजि त करत े ह,ैं उड्डयन योग्यता जनधाारण के प्रयोजन के जलए उससे संबंजधत पुजे और उपकरण, अजभप्रेत ह।ैं
3. उक्त जनयमों के जनयम 133क में, उप-जनयम (1) म,ें “प्रचालन” िब्द के स्ट्थान पर “प्रचालन, जिजनमााण” िब्दों को रखा
जाएगा;
4. उक्त जनयमों की अनुसूची 2 म,ें धारा ट एिं ढ म,ें ग्राफ 5क में, खंड (ख) के जलए जनम्न जलजखत खंडों को रखा जाएगा,
अथाात:-
(ख) पैरा (क) के अनुसार संपाददत प्रिीणता जांच इस प्रकार होगीीः-
(i) पायलट द्वारा संचाजलत जिजुअल फ्लाइट रूल्स प्रचालनों के मामले म ें जांच की तारीख स े बारह महीनों की
समयािजध के जलए िैध होगी तथा एक बार म ें आग े केिल बारह महीने की समयािजध के जलए निीकृत की
जाएगी।
(ii) पायलट द्वारा संचाजलत इंस्ट्ूमेंट फ्लाइट रूल्स प्रचालनों के मामले में जांच की तारीख से छह महीनों की
समयािजध के जलए िैध होगी तथा एक बार में आगे केिल छह महीने की समयािजध के जलए ही निीकृत की
जाएगी।
(खक) खंड (ख) के उप-खंड (ii) में जनजहत दकसी बात के होते हुए भी, पायलट-इन-कमांड अथिा सह-पायलट जजसन े
सफलतापूिाक इंस्ट्ूमेंट रेटटग फ्लाइंग टैस्ट्ट अथिा निीकृत जांच, जैसा भी मामला हो, खंड “त” में जिजनर्ददष्टानुसार
पूरी कर ली हो, के जििय म ें माना जाएगा दक उसने प्रिीणता जांच पूरी कर ली है, जो दक छह महीनों की समयािजध
के जलए िैध होगी।

NOTIFICATION
New Delhi, the 1st April, 2022
G.S.R. 253(E).—Whereas, the draft of certain rules further to amend the Aircraft Rules, 1937, was
published as required under Section 14 of the Aircraft Act, 1934 (22 of 1934), vide notification of the
Government of India in the Ministry of Civil Aviation, number G.S.R. 891(E), dated the 28th December,
2021 in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), inviting objections and
suggestions from all persons likely to be affected thereby, before the expiry of the period of thirty days
from the date on which copies of the Gazette containing the said notification were made available to public;
And whereas, copies of the Gazette containing the said notification were made available to the
public on the 29th December, 2021;
And whereas, the objections and suggestions received from the public in respect of the draft rules

Now, therefore, in exercise of the powers conferred by Section 5 of the Aircraft Act, 1934 (22 of
1934), the Central Government hereby makes the following rules further to amend the Aircraft Rules,
1937, namely: —
1. Short title and commencement. —
(1) These rules may be called the Aircraft (Second Amendment) Rules, 2022.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Aircraft Rules, 1937, hereinafter referred to as said rules, in rule 3, after clause (34A), the
following clause shall be inserted namely:—
“(34AA) “Manufacture” means the performance of tasks that involve assembly or production of
aircraft, engine, propeller or associated parts and appliances in conformity with its applicable design
including prototype.”;
Explanation,- For the purpose of this clause, “design” means the set of data and information that
defines the configuration of an aeronautical product type, its associated parts and appliances for the
purpose of airworthiness determination”.
3. In rule 133A of the said rules, in sub-rule (1), for the word “operation”, the words, “operation,
manufacture” shall be substituted.
4. In Schedule II of the said rules, in section K and N, in paragraph 5A, for clause (b), the following
clauses shall be substituted, namely:—
“(b) The proficiency check carried out as per para (a) shall be—
(i) valid for a period of twelve months from the date of the check in case of pilot conducting
Visual Flight Rules operations and shall be renewed for a further period of twelve months
at a time.
(ii) valid for a period of six months from the date of the check in case of pilot conducting
Instrument Flight Rules operations and shall be renewed for a further period of six
months at a time.
(ba) Notwithstanding anything contained in sub-clause (ii) of clause (b) , the Pilot- in-Command or
Co-pilot who has successfully carried out instrument rating flying test or renewal check, as the
case may be, specified under Section “P” shall be considered to have undergone proficiency check
which shall be valid for a period of six months.”
