प्रकाजित ककए जाते ह ैं और सचू ना दी जाती ह ै कक ईि प्रारुप जनयमों पर, ईस तारीख से, जजसको भारत के राजपत्र में,
यथाप्रकाजित, आस ऄजधसूचना की प्रजतयां जनता को ईपलब्ध करा दी जाती हैं, पंरह कदन की समाजि के पश्चात ् जिचार
ककया जाएगा ;
ऐसे अक्षेपों और सुझािों पर, जो पंरह कदन की पूिोि ऄिजध के समाि होने से पहल े ईि प्रारुप जनयमों के संबंध
में ककसी व्यजि से प्राि हो सकेंग,े केन्द्रीय सरकार द्वारा जिचार ककया जाएगा ;

1. (1) आन जनयमों का संजक्षि नाम कीटनािी (संिोधन) जनयम, 2021 ह ै।
(2) ये राजपत्र में ईनके ऄंजतम प्रकािन को प्रिृत्त होंग े।

2. कीटनािी जनयम, 1971 (जजसे आसमें आसके पश्चात् ईि जनयम कहा जाएगा) म,ें जनयम 9 के ईपजनयम 3 म,े खंड (iii)
के बाद, जनम्नजलजखत परंतुक ऄतं ःस्ट्थाजपत ककया जाएगा, ऄथाता ् :-
बिते कक लाआसेंससग ऄजधकारी लाआसेंस पर ऄजतररि कीटनािक के पृष्ांकन की तारीख से छह महीने के भीतर जिजनमााण
पररसर का जनरीक्षण करेगा ताकक िह खुद को संतुष्ट कर सके कक अियक संयंत्र और मिीनरी, सुरक्षा ईपकरण और
प्राथजमक जचककत्सा सुजिधाएं अकद ईस पररसर म ेंमौजूद ह ैंजहां कीटनािक का जनमााण प्रस्ट्ताजित ह।ै
3. ईि जनयमों म,ें जनयम (10घ) के बाद जनम्नजलजखत जनयम ऄंतःस्ट्थाजपत ककया जाएगा ऄथाात्:-
(10ड़) ऑनलाआन पोटाल के माध्यम से कीटनािकों की जबक्री
“लाआसेंस धारक, लाआसेंस की ऄिजध के दौरान, ककसानों के दरिाजे तक कीटनािक की अपूर्तत के जलए ऑनलाआन
पोटाल के माध्यम से ककसी भी कीटनािक की जबक्री कर सकता ह।ै लाआसेंस धारक ऄजधजनयम के प्रािधानों और ईसके
तहत बनाए गए जनयमों जो किलहाल लागू ह,ै का पालन करेगा । ”
4. ईि जनयमों म,े जनयम 10 के ईपजनयम 3(क) के खंड (iii) में "कृजि या जिज्ञान में " िब्दों के बाद "या जीि जिज्ञान में"

NOTIFICATION
New Delhi, the 8th September, 2021
G.S.R. 670(E).—The following draft rules further to amend the Insecticides Rules, 1971, which
the Central Government proposes to make in exercise of the powers conferred by section 36 of the
Insecticides Act, 1968 (46 of 1968), is hereby published, as required by the said section, for information
of all persons likely to be affected thereby; and notice is hereby given that the said draft rules shall be taken
into consideration after the expiry of fifteen days from the date on which the copies of this notification as
published in the Gazette of India are made available to the public;
The Objections or suggestions which may be received from any person in respect of the said draft
rules before the expiry of the aforesaid period of fifteen days will be considered by the Central
Government;
Objections and suggestions in respect to the said draft rules may be forwarded to the Joint
Secretary (Plant Protection), Ministry of Agriculture and Farmers Welfare, Department of Agriculture, Co-
operation and Farmers Welfare, Krishi Bhawan, New Delhi-110 001.
DRAFT RULES
1. (1) These rules may be called the Insecticides (Third amendment) Rules, 2021.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Insecticides Rules, 1971, (hereinafter referred as the said rules), in Rule 9, in sub-rule (3),
after clause (iii), following proviso shall be inserted, namely:
Provided that the licensing officer shall inspect the manufacturing premises within six months from the
date of endorsement of additional insecticide on license to satisfy itself that necessary plant and machinery,
safety devices and first aid facilities etc exist in the premises where insecticide is proposed to be
manufacture.
3. In the said rules, after rule 10D, the following rule shall be inserted namely:-
(10E) Sale of insecticides through online portal
“A licensee, during the currency of license, may undertake sale of any insecticide through online
portal for supply of insecticide to the door step of the farmers. The licensee shall comply with the
provisions of the Act and the rules made thereunder for the time being in force.”4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
4. In the said rules, in rule 10, in sub-rule 3A, in clause (iii), after the words “a graduate in Agriculture or
in Science”, the words “or in Life Science” shall be inserted.
