पश्चात ् उि अजधजनयम कहा गया ह)ै की धारा 85 की उपधारा (1) द्वारा प्रदत्त िजियों के अनुसरण में 28 मई, 2014 को
कृष्णा नदी प्रबंधन बोड ग (जजसे इसके पश्चात ् केआरएमबी कहा गया ह)ै का गठन दकया और केन्द्रीय सरकार द्वारा यथा
अजधसूजचत पररयोजनाओं के प्रिासन, जिजनयमन, रखरखाि और प्रचालन के जलए इसम ें उजल्लजखत कायों का जनष्पादन
करने हते ु यह 2 जून, 2014 से प्रभािी हो गया;
और उि अजधजनयम की धारा 87 की उपधारा (i) उपबंध करती ह ैदक बोडग साधारणतया सबं ंजधत राज्यों को जल
या जिद्युत प्रदाय करन े के जलए आिश्यक जल िीर् ग तंत्र (बरै ाज, बांध, जलािय, जिजनयामक संरचना) नहर नेटिकग के भाग
तथा पारेर्ण लाइनों पर कृष्णा नदी पर उन पररयोजनाओं म ें से दकसी के संबंध म ें ऐसी अजधकाररता का प्रयोग करेगा जैसी
केंरीय सरकार द्वारा अंतरराजज्यक जल जििाद अजधजनयम, 1956 (1956 का 33) के अधीन गरठत प्राजधकरणों द्वारा दकए
गए जनणगयों, यदद कोई हों, के अनुसार अजधसूजचत की जाए;
और, 6 अक्टूबर, 2020 को आयोजजत िीर्ग पररर्द ् की दसू री बैठक म ें गोदािरी नदी प्रबधं न बोडग तथा कृष्णा
नदी प्रबंधन बोडग दोनों की अजधकाररता अजधसूजचत करने का जनणगय जलया गया और तदनुसार उि अजधजनयम की धारा
87 की उपधारा (I) द्वारा प्रदत्त िजियों का प्रयोग करत े हुए, केन्द्रीय सरकार ने तारीख 15 जुलाई, 2021 की अजधसूचना
संख्या का. आ 2842 (अ) (जजसे इसमें इसके पश्चात ् केआरएमबी क्षेत्राजधकार अजधसूचना कहा गया ह)ै के माध्यम स े कृष्णा
नदी के क्षेत्राजधकार के प्रयोग करने के जलए केआरएमबी का क्षत्रे ाजधकार अजधसूजचत दकया।

और जबदक, उि केआरएमबी क्षेत्राजधकार अजधसूचना के पैरा 2 का खण्ड (च) यह उपबंध करता ह ै दक
अननुमोददत पररयोजनाओं के चल रह े कायों को, पूण ग और आंजिक रूप में, यदद कोई हो, तब तक रोक ददया जाएगा जब
तक दक उि केआरएमबी क्षेत्राजधकार अजधसूचना के प्रकािन के एक िर्ग बाद की अिजध के भीतर उि अजधजनयम के
प्रािधानों के अनुसार अनुमोदन नहीं प्राप्त होते ह;ैं
और जबदक, उि केआरएमबी क्षेत्राजधकार अजधसूचना के पैरा 2 का खण्ड (छ) यह भी उपबंध करता ह ै दक इसके
प्रकािन की तारीख स े एक एक िर् ग के भीतर, दोनों राज्य सरकारें अननुमोददत पररयोजनाओं को उि अजधजनयम के
प्रािधानों के अनुसार और िीर्ग पररर्द की दसू री बैठक म ें जलए गए जनणगयों के अनुसार मूल्यांदकत और अनुमोददत
पररयोजनाओं को परू ा करेंगी; और यदद उि एक िर्ग की जनधागररत समय-सीमा के भीतर उि अनुमोदन प्राप्त नहीं होते ह ैं
तो ऐसी पूण ग हो चुकी अननुमोददत पररयोजनाओं को रोक ददया जाएगा;
और जबदक आंध्र प्रदेि पुनगगठन अजधजनयम 2014 (2014 का 6) की ग्यारहिीं अनुसूची के पैरा 10 के अनुपालन
में, जो इस प्रकार परठत ह ै "जनम्न ससचाई पररयोजनाएं, जो जनमागणाधीन ह,ैं को मौजूदा आध्रं प्रदिे राज्य द्वारा अजधसूजचत
की गई योजना के अनुसार पूरा दकया जाएगा और पानी के बंटिारे की व्यिस्ट्था जनम्न प्रकार होगीीः-
(i) हांदरी जनिा
(ii) तेलगु ु गगं ा
(iii) गलरूे नाजगरी
(iv) िेनेगोंडू
(v) कालिाकुथी
(vi) नेत्तेमपाडु ”
और जबदक, आंध्र प्रदिे सरकार न े सूजचत दकया ह ै दक उि केआरएमबी क्षेत्राजधकार अजधसचू ना के पैरा 2 के खण्ड
(च) और (छ) के उपबंध आंध्र प्रदेि पुनगगठन अजधजनयम 2014 (2014 का 6) की 11िीं अनुसूची के पैरा 10 के उपबंधों के
अनुरूप नहीं ह;ै
अतीः अब, केन्द्रीय सरकार उि अजधजनयम की धारा 87 की उपधारा (1) द्वारा प्रदत्त िजियों का प्रयोग करत े हुए
उि केआरएमबी क्षेत्राजधकार अजधसूचना जनम्न संसोधन करती ह ैअथागतीः-

NOTIFICATION
New Delhi, the 27th July, 2022
S.O. 3511(E).—Whereas, in pursuance of the powers conferred under sub-section (1) of section 85 of the
Andhra Pradesh Reorganisation Act, 2014 (6 of 2014) (hereafter referred to as the said Act), the Central Government
on 28th May, 2014 constituted the Krishna River Management Board (hereafter referred to as the KRMB) and the
same became effective on 2nd June, 2014 to perform the functions mentioned therein for the administration, regulation,
maintenance and operation of projects as may be notified by the Central Government;
And whereas, sub-section (1) of section 87 of the said Act provides that the Board shall ordinarily exercise
jurisdiction on Krishna river in regard to any of the projects over head works (barrages, dams, reservoirs, regulating
structures), part of canal network and transmission lines necessary to deliver water or power to the States concerned,
as may be notified by the Central Government, having regard to the awards, if any, made by the Tribunals constituted
under the Inter-State River Water Disputes Act, 1956 (33 of 1956);
And whereas, in the 2nd meeting of the Apex Council, held on 6th October, 2020, it has been decided to notify
the jurisdiction of both Godavari River Management Board and Krishna River Management Board and accordingly, in
exercise of the powers conferred by sub-section (1) of section 87 of the said Act, the Central Government notified the
jurisdiction of the KRMB to exercise the jurisdiction on Krishna river vide notification number S.O. 2842 (E), dated
the 15th July, 2021 (hereafter referred to as the KRMB jurisdiction notification);
And whereas, clause (f) of paragraph 2 of the said KRMB jurisdiction notification provides that the ongoing
works on unapproved projects, full or partial, if any, shall cease to operate if approvals as per the provisions of the
said Act are not obtained within a period of one year after the publication of the said KRMB jurisdiction notification;
And whereas, clause (g) of paragraph 2 of the said KRMB jurisdiction notification also provides that within
one year from the date of its publication, both State Governments shall complete the unapproved projects appraised
and approved as per the provisions of the said Act and in accordance with the decisions taken in the 2nd meeting of
the Apex Council; and if the said approvals are not obtained within the stipulated time of one year, such completed
unapproved projects shall cease to operate;
And whereas, in pursuance of paragraph 10 of the Eleventh Schedule to the Andhra Pradesh Reorganisation
Act, 2014(6 of 2014), which reads as ―the following irrigation projects which are under construction shall be
completed as per the plan notified by the existing State of Andhra Pradesh and the water sharing arrangement shall
continue as such:––
(i) Handri Niva
(ii) Telugu Ganga
(iii) Galeru Nagiri
(iv) Venegondu
(v) Kalvakurthi

And whereas, the Government of Andhra Pradesh has informed that the provisions of clauses (f) and (g) of
paragraph 2 of the said KRMB jurisdiction notification are not in consonance with the provisions of paragraph 10 of
the Eleventh Schedule to the Andhra Pradesh Reorganisation Act, 2014(6 of 2014);
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 87 of the said Act, the Central
Government hereby makes the following amendments in the said KRMB jurisdiction notification, namely:––
In the said KRMB jurisdiction notification, in paragraph 2, after clause (g), the following proviso shall be
inserted, namely:––
―Provided that the provisions of clauses (f) and (g) shall not apply to the following projects or components
specified in the Table below, namely:––
