और उि अजधकरण से उि अजधजनयम की धारा 5 की उप-धारा (2) के अधीन तीन िर्ण की अिजध के भीतर, अथाणत तारीख 15 निम् बर, 2013 को या उससे पहले अपनी ररपोटण और जिजनश्चय प्रस्ट्त ुत करने की अपेक्षा की गई थी; और उि अजधकरण न े केन्रीय सरकार स े यह अनरु ोध दकया था दक उि अजधजनयम की धारा 5 की उप-धारा (2) के प्रयोिन के जलए उनके कायण प्रारम्भ करन े की प्रभािी तारीख अथाणत 21 अगस्ट्त, 2013 को इसके गठन की तारीख माना िाए; और, केन्रीय सरकार न े अजधसूचना संख्या का.आ. 2908 (अ), तारीख 13 निम्बर, 2014 द्वारा यह जिजनश्चय दकया था दक उि अजधकरण के गठन की प्रभािी तारीख 21 अगस्ट्त , 2013 होगी और तिनसु ार, उि अजधजनयम की धारा 5 की उप-धारा (2) के उपबंधों के अधीन महािायी िल जििाि अजधकरण द्वारा ररपोटण और जिजनश्चय िेने के जलए तीन िर्ण की अिजध तारीख 21 अगस्ट् त, 2013 से प्रारम्भ होगी; और, उि अजधकरण से तारीख 20 अगस्ट् त, 2016 को या उसके पूिण उसकी ररपोटण और जिजनश्चय प्रस्ट्ततु करने की अपेक्षा की गई थी; 4756 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, उि अजधकरण न े केन्रीय सरकार से ररपोटण और जिजनश्चय प्रस्ट्तुत करन े की अिजध तारीख 21 अगस्ट् त, 2016 से एक िर्ण के जलए और बढाने का अनुरोध दकया था; और, केन्रीय सरकार न े अजधसूचना संख्या का.आ. 2686 (अ), तारीख 11 अगस्ट्त, 2016 द्वारा ररपोटण और जिजनश्चय की प्रस्ट्तुजत की अिजध को तारीख 21 अगस्ट्त , 2016 से एक िर्ण की और अिजध के जलए जिस्ट्ताररत कर दिया था; और, उि अजधकरण न े केन्रीय सरकार से ररपोटण और जिजनश्चय प्रस्ट्तुत करन े की अिजध तारीख 21 अगस्ट् त, 2017 से एक िर्ण के जलए और बढाने का अनुरोध दकया था; और, केन्रीय सरकार ने अजधसूचना संख्या का.आ. 2332 (अ.) तारीख 24 िलु ाई, 2017 द्वारा ररपोटण और जिजनश्चय प्रस्ट्तुत करने की अिजध को तारीख 21 अगस्ट् त, 2017 से एक िर्ण की और अिजध के जलए जिस्ट्ताररत कर दिया था; और, उि अजधकरण न े उि अजधजनयम की धारा 5 की उपधारा (2) के अधीन अपनी ररपोटण और जिजनश्चय तारीख 14 अगस्ट्त, 2018 को प्रस्ट्तुत कर दिया था; और, गोिा रायय न े तारीख 20 अगस्ट्त, 2018 को उि अजधजनयम की धारा 5 की उपधारा (3) के साथ परठत जसजिल प्रदिया संजहता, 1908 (1908 का 5) के आिेि 39 जनयम 2क के अधीन उि अजधकरण म ें एक आिेिन िाजखल दकया था तथा तारीख 20 जसतम्बर, 2018 को उि अजधजनयम की धारा 5 की उपधारा (3) के परंतुक के अधीन उि अजधकरण में अजतररि जनििे दकया; और, कनाणटक रायय न े तारीख 13 निम्बर, 2018 को उि अजधजनयम की धारा 5 की उपधारा (3) के परंतुक के अधीन उि अजधकरण म ें अजतररि जनिेि दकया, महाराष्ट्र रायय ने तारीख 5 निम्बर, 2018 को उि अजधकरण म ें अजतररि जनिेि दकया तथा केन्रीय सरकार न े तारीख 14 िनिरी, 2019 को उि अजधकरण म ें अजतररि जनििे दकया तथा उि अजधकरण को 20 अगस्ट्त, 2018 स े प्रभािी एक िर्ण की अिजध के भीतर अपनी अजतररि ररपोटण प्रस्ट्तुत करनी थी; और, उि अजधकरण न े केन्रीय सरकार स े उि अजधजनयम की धारा 5 की उपधारा (3) के अधीन अपनी अजतररि ररपोटण प्रस्ट्ततु करने की अिजध तारीख 20 अगस्ट् त, 2019 से एक िर्ण के जलए और बढाने का अनुरोध दकया था; और, केन्रीय सरकार ने अजधसूचना संख्या का.आ. 768 (अ), तारीख 17 फरिरी, 2020 द्वारा उि अजधकरण द्वारा अजतररि ररपोटण प्रस्ट्तुत करने की अिजध को तारीख 19 अगस्ट्त , 2020 तक जलए जिस्ट्ताररत कर दिया था; और, माननीय उच्चतम न्यायालय द्वारा आई.ए. सख्ं या 109720/2019 के साथ एसएलपी सख्ं या 33018/2018 के संिभण म ें दिए गए 20 फरिरी, 2020 के आिेिानुसार केंरीय सरकार न े अजधसूचना संख्या का.आ. 888 (अ), तारीख 27 फरिरी, 2020 द्वारा उि अजधजनयम की धारा 5 की उपधारा (2) के अधीन दिए गए उि अजधकरण की ररपोटण और जिजनश्चय को 14 अगस्ट्त, 2018 को प्रकाजित दकया था; और, उि अजधकरण न े केन्रीय सरकार स े उि अजधजनयम की धारा 5 की उपधारा (3) के अधीन अपनी अजतररि ररपोटण प्रस्ट्ततु करने की अिजध तारीख 20 अगस्ट् त, 2020 से एक िर्ण के जलए और बढाने का अनुरोध दकया था; और, केन्रीय सरकार ने अजधसचू ना संख्या का.आ. 2830(अ), तारीख 17 अगस्ट्त, 2020 द्वारा उि अजधकरण द्वारा अजतररि ररपोटण प्रस्ट्तुत करने की अिजध को तारीख 20 अगस्ट्त , 2020 से एक िर् ण की और अिजध के जलए जिस्ट्ताररत कर दिया था; और, उि अजधकरण न े केन्रीय सरकार स े उि अजधजनयम की धारा 5 की उपधारा (3) के अधीन अपनी अजतररि ररपोटण प्रस्ट्ततु करने की अिजध तारीख 20 अगस्ट् त, 2021 से एक िर्ण के जलए और बढाने का अनुरोध दकया था; और, केन्रीय सरकार ने अजधसूचना संख्या का.आ. 2889(अ), तारीख 20िुलाई, 2021 द्वारा उि अजधकरण द्वारा अजतररि ररपोटण प्रस्ट्तुत करने की अिजध को तारीख 20 अगस्ट्त , 2021 से एक िर् ण की और अिजध के जलए जिस्ट्ताररत कर दिया था; और, उि अजधकरण ने अब केन्रीय सरकार से उि अजधजनयम की धारा 5 की उपधारा (3) के अधीन अपनी अजतररि ररपोटण प्रस्ट्ततु करने की अिजध तारीख 20 अगस्ट् त, 2022 से एक िर् ण के जलए और बढाने का अनुरोध दकया था;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 और, केन्रीय सरकार ने अजधसूचना संख्या का.आ. 3348(अ), तारीख 21 िलु ाई, 2022 द्वारा उि अजधकरण द्वारा अजतररि ररपोटण प्रस्ट्तुत करने की अिजध को तारीख 20 अगस्ट्त , 2022 से एक िर् ण की और अिजध के जलए जिस्ट्ताररत कर दिया था; और, उि अजधकरण ने अब केन्रीय सरकार से उि अजधजनयम की धारा 5 की उपधारा (3) के अधीन अपनी अजतररि ररपोटण प्रस्ट्ततु करने की अिजध तारीख 20 अगस्ट् त, 2023 से एक िर् ण के जलए और बढाने का अनुरोध दकया ह;ै अतः, अब, केन्रीय सरकार, उि अजधजनयम की धारा 5 की उप-धारा (3) के परंतुक द्वारा प्रित्त िजियों के अनुसरण में, उि अजधकरण द्वारा अजतररि ररपोटण प्रस्ट्तुत करने की अिजध को तारीख 20 अगस्ट् त, 2023 से एक िर्ण अिजध के जलए बढाती ह।ै [फा. स.ं एन-58012/1/2020-बी एम सेक्िन–एमओडब्लआू र] आनन्ि मोहन, संयुि सजचि MINISTRY OF JAL SHAKTI NOTIFICATION New Delhi, the 21st July, 2023 S.O. 3305(E).—Whereas, the Mahadayi Water Disputes Tribunal (hereinafter referred to as the said Tribunal) was constituted on the 16th November, 2010 vide notification of the Government of India in the erstwhile Ministry of Water Resources, number S.O.2786 (E), dated the 16th November, 2010 under section 4 of the Inter-State River Water Disputes Act, 1956 (33 of 1956) (hereinafter referred to as the said Act), for the adjudication of the water disputes regarding Inter-State river Mahadayi and river valley thereof; And whereas, the said Tribunal was required to submit its report and decision under sub-section (2) of section 5 of the said Act within a period of three years, i.e., on or before the 15th November, 2013; And whereas, the said Tribunal had requested the Central Government to reckon the effective date of its functioning, i.e., 21st August, 2013 to be the date of its constitution for the propose of sub-section (2) of section 5 of the said Act; And whereas, the Central Government vide notification number S.O.2908 (E), dated the 13th November, 2014, had decided that the effective date of constitution of the said Tribunal shall be the 21st August, 2013, and accordingly, under the provisions of sub-section (2) of section 5 of the said Act, the period of three years for submission of report and decision by the Mahadayi Water Disputes Tribunal shall commence from the 21st August, 2013; And whereas, the said Tribunal was required to submit its report and decision on or before the 20th August, 2016; And whereas, the said Tribunal had requested the Central Government to extend the period of submission of report and decision for a period of one year with effect from the 21st August, 2016; And whereas, the Central Government vide notification number S.O. 2686(E), dated the 11th August, 2016, had extended the period of submission of report and decision for a period of one year with effect from the 21st August, 2016; And whereas, the said Tribunal had further requested the Central Government to extend the period of submission of report and decision for a period of one year with effect from the 21st August, 2017; And whereas, the Central Government vide notification number S.O. 2332(E), dated the 24th July, 2017, had extended the period of submission of report and decision for a further period of one year with effect from the 21st August, 2017; And whereas, the said Tribunal submitted its report and decision under sub-section (2) of section 5 of the said Act on the 14th August, 2018; And whereas, the State of Goa had filed an application under Order 39 Rule 2A of the Code of Civil Procedure, 1908 (5 of 1908) read with sub-section (3) of section 5 of the said Act on 20th August, 2018 and had made further reference to the said Tribunal under the proviso to sub-section (3) of section 5 of the said Act on 20th September, 2018; And whereas, the State of Karnataka had made further reference to the said Tribunal under the proviso to sub-section (3) of section 5 of the said Act on 13th November, 2018, the State of Maharashtra had made further4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] reference to the said Tribunal on 5th November, 2018 and the Central Government made further reference to the said Tribunal on 14th January, 2019 and the said Tribunal had to submit its further report within a period of one year with effect from the 20th August, 2018; And whereas, the said Tribunal had requested the Central Government to extend the period of submission of further report under sub-section (3) of section 5 of the said Act for a period of one year with effect from the 20th August, 2019; And whereas, the Central Government vide notification number S.O. 768(E), dated the 17th February, 2020, had extended the period of submission of further report by the said Tribunal up to the 19th August, 2020; And whereas, as per Hon’ble Supreme Court’s Order dated the 20th February, 2020 in I.A. No.109720/2019 with SLP No.33018/2018, the Central Government vide notification number S.O. 888(E), dated the 27th February, 2020, had published the report and decision of the said Tribunal given under sub-section (2) of section 5 of the said Act on the 14th August, 2018; And whereas, the said Tribunal had requested the Central Government to extend the period of submission of further report under sub-section (3) of section 5 of the said Act for a period of one year with effect from the 20th August, 2020; And whereas, the Central Government vide notification number S.O. 2830(E), dated the 17th August, 2020, had extended the period of submission of further report by the said Tribunal for a period of one year with effect from the 20th August, 2020; And whereas, the said Tribunal had requested the Central Government to extend the period of submission of its further report under sub-section (3) of section 5 of the said Act for a further period of one year with effect from the 20th August, 2021; And whereas, the Central Government vide notification number S.O. 2889(E), dated the 20th July, 2021, had extended the period of submission of further report by the said Tribunal for a further period of one year with effect from the 20th August, 2021; And whereas, the said Tribunal had requested the Central Government to extend the period of submission of its further report under sub-section (3) of section 5 of the said Act for a further period of one year with effect from the 20th August, 2022; And whereas, the Central Government vide notification number S.O. 3348(E), dated the 21st July, 2022, had extended the period of submission of further report by the said Tribunal for a further period of one year with effect from the 20th August, 2022; And whereas, the said Tribunal has now requested the Central Government to extend the period of submission of its further report under sub-section (3) of section 5 of the said Act for a period of one year with effect from the 20th August, 2023; Now, therefore, in pursuance of the powers conferred by the proviso to sub-section (3) of section 5 of the said Act, the Central Government hereby extends the period of submission of further report by the said Tribunal for a further period of one year with effect from the 20th August, 2023.
