(1) इन जनयमों का संजिप्त नाम कममचारी राज्य ीीमा (कद्ीय) संिोधन जनयम, 2023 ह ै । (2) इन्ह द तारीख 1 िनवरी, 2021 को लागू माना िाएगा और तारीख 30 िून, 2021 तक छह महीने की अवजध के जलए प्रवत्त रहगद े। 2. कममचारी राज्य ीीमा (कद्ीय) जनयम 1950 मद ,- (क) जनयम 55 के, उप-जनयम (1) के, तीसरे परन्तुक के पश्चात, जनम्नजलजखत परन्तुक अन्तःस्ट्थाजपत दकया िाएगा, अथामत:् - "परन्त ु यह भी दक तारीख 01.04.2020 से पहल े जनयुि कोई व्यजि, तारीख 1 िनवरी 2021 से तारीख 30 िून 2021 की अवजध के जलए ीीमारी जहतलाभ का िावा करने के जलए अर्हतम होगा, यदि ऐसे व्यजि के संींध मद अंििान, तारीख 1 अप्रैल 2020 स े तारीख 30 जसतंीर 2020 की अंििान अवजध म दउन्तालीस दिनों से कम या 1 अक्टूीर 2019 से 31 माच म 2020 की अंििान अवजध म द अठहत् तर दिनों से कम के जलए संिेय नह था और उस व्यजि के जलए ीीमारी जहतलाभ की िैजनक िर उप-जनयम (2) मद प्रिान की िाएगी, जिसकी संगणना यथास्ट्थाजपत तारीख 1 अप्रैल 2020 से तारीख 30 जसतंीर 2020 की अंििान अवजध या तारीख 1 अक्टूीर 2019 से तारीख 31 माचम 2020 तक की अंििान अवजध के िौरान लाग ू मानक जहतलाभ िर के आधार पर होगी”; (ख) जनयम 56 के, उप-जनयम (1) म,द जनम्नजलजखत परंतुक अन्तःस्ट्थाजपत दकया, अथामत:् - " परन्तु दक कोई ीीमाकृत मजहला तारीख 1 िनवरी 2021 स े तारीख 30 िून 2021 की जहतलाभ अवजध म द होने वाल े या होन े के जलए आिजयत प्रसव के जलए मातृत्व जहतलाभ का िावा करन े हते ु पात्र होगी, यदि ऐसी मजहला संींध मद अंििान, तु रंत पूवमवती िो लगातार अिं िान अवजधयों, अथामत, तारीख 1 अक्टूीर 2019 से तारीख 31 माच म 2020 और तारीख 1 अप्रैल 2020 से तारीख 30 जसतंीर 2020 के ठीक पूवमती अवजध म दपंतीस दिनों से कम के जलए संिेय नह था ।" [फा.सं. एस-65012/02/2021-एसएस-।] अलोक चं्, ज्येष्ट श्रम और रोज़गार सलाहकार टट‍प णी : मलू जनयम भारत के रािपत्र, भाग II, खंड 3, उप-खंड (i) मद अजधसूचना संखया का.जन.आ. 212, तारीख 22 िून, 1950, द्वारा प्रकाजित दकए गए थे। MINISTRY OF LABOUR AND EMPLOYMENT NOTIFICATION New Delhi, the 25th July, 2023 G.S.R. 536(E).—Whereas a draft containing certain rules further to amend the Employees’ State Insurance (Central) Rules, 1950 were published in the Gazette of India, Extraordinary, Part II, section 3, sub-section (i) vide notification number G.S.R. 152(E), dated the 24th February, 2022, as required under sub-section (1) of section 95 of the Employees’ State Insurance Act, 1948 (XXXIV of 1948), inviting objections and suggestions from all persons likely to be affected thereby before the expiry of a period of thirty day from the date on which the copies of the Official Gazette containing the said notification were made available to public; And whereas, the copies of the said Official Gazette were made available to the public on the 24th February, 2022; And whereas, no objection or suggestion has been received from any person in respect of the said draft rules within the period specified above for consideration by the Central Government;[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 Now, therefore, in exercise of the powers conferred by section 95 of the Employees’ State Insurance Act, 1948 (XXXIV of 1948), the Central Government, after consultation with the Employees’ State Insurance Corporation, hereby makes the following rules further to amend the Employees’ State Insurance (Central) Rules, 1950, namely:- 1. (1) These rules may be called the Employees’ State Insurance (Central) Amendment Rules, 2023. (2) They shall be deemed to have come into force on the 1st day of January, 2021, and shall remain in force for a period of six months till the 30th day of June, 2021. 2. In the Employees’ State Insurance (Central) Rules, 1950,- (a) in rule 55, in sub-rule (1), after the third proviso, the following proviso shall be inserted, namely:- “Provided also that a person, appointed before the 1st April, 2020, shall be qualified to claim sickness benefit for the period 1st January, 2021 to the 30th June 2021, if the contributions in respect of such person were payable for not less than thirty-nine days during the contribution period 1st April, 2020 to the 30th September, 2020, or for not less than seventy-eight days during the contribution period 1st October, 2019 to the 31st March, 2020, and the daily rate of sickness benefit for that person shall be as provided in sub-rule (2) calculated on basis of standard benefit rate applicable during the contribution period 1st April, 2020 to the 30th September, 2020 or during the contribution period 1st October, 2019 to the 31st March, 2020, as the case may be.”; (b) in rule 56, in sub-rule (1), the following proviso shall be inserted, namely:- “Provided that an insured woman shall be eligible to claim maternity benefit for a confinement occurring or expected to occur during the benefit period 1st January, 2021 to the 30th June, 2021, if the contributions to such woman were payable for not less than thirty-five days in the immediately preceding two consecutive contribution periods, namely, the 1st October, 2019 to the 31st March, 2020 and the 1st April, 2020 to the 30th September, 2020.”.
