2. कममचारी राज्य बीमा (कद्ीय) जनयमावली 1950 के जनयम 55 के ईप-जनयम (1) म द जनम्नजलजखत परंतुक जोडा
जाएगा:-
"बिते दक ददनांक 01.04.2020 से पहले जनयतियु व्यजतिय जहतलाभ ऄवजध, जनवरी 2021-जून 2021 के जलए
बीमारी जहतलाभ का दावा करने के जलए ऄहतम ा प्रा् त होगा, यदद ईसके संबंध मद ऄंिदान, ऄंिदान ऄवजध ऄप्रल
2020- जसतंबर 2020 मद 39 ददन से कम नहीं ऄथवा ऄंिदान ऄवजध ऄक् ूबर 2019-माचम 2020 से ऄंिदान ऄवजध म द
ऄठहत् तर ददन स े कम नहीं के जलए देय थे और ईनके जलए बीमारी जहतलाभ की द जनक दर ईप-जनयम (2) मद प्रदान की

NOTIFICATION
New Delhi, the 24th February, 2022
G.S.R. 152(E).—The following draft of certain rules further to amend the Employees’ State Insurance
(Central) Rules, 1950 which the Central Government, after consultation with the Employees’ State Insurance
Corporation, proposes to make in exercise of powers conferred by section 95 of the Employees’ State Insurance
Act, 1948 (34 of 1948), is hereby published as required by the sub-section (1) of the said section for information of all
persons likely to be affected thereby and notice is hereby given that the said draft rules will be taken into consideration
after expiry of a period of thirty days from the date of publication in Official Gazette;
Any objections or suggestions, which may be received from any person in respect of the said draft rules
within the period specified above, will be considered by the Central Government.
The objections and suggestions may be addressed to Shri Madan Chaurasia, Under Secretary, Ministry of
Labour and Employment, Shram Shakti Bhawan, Rafi Marg, New Delhi-110001 (Email ID- madan.c@nic.in).
DRAFT RULES
1. (i) These rules may be called the Employees' State Insurance (Central) Amendment Rules, 2022.
(ii) These shall be effective for the benefit period 01.01.2021 to 30.06.2021.
2. In the Employees’ State Insurance (Central) Rules, 1950, in sub-rule (1) of Rule 55, the following proviso
shall be added: -[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 3
“Provided that person appointed before 01.04.2020 shall be qualified to claim sickness benefit for benefit
period, January 2021-June 2021, if the contributions in respect of him/her were payable for not less than 39 days in
the contribution period from April, 2020- September, 2020 or for not less than seventy-eight days in the
contribution period from October, 2019 to March, 2020 and the daily rate of Sickness benefit for them shall be as
provided in sub-rule (2) calculated on basis of standard benefit rate during the contribution period from April,
2020 to September, 2020 or October, 2019 to March, 2020 respectively”;
3. In the Employees’ State Insurance (Central) Rules 1950, in sub-rule (1) of Rule 56, the following proviso
shall be added: -
“Provided that an Insured Women shall be eligible to claim maternity benefit for a confinement occurring or
expected to occur in the benefit period January 2021-June 2021 if contributions in respect of her were payable for
not less than 35 days in the immediately preceding two consecutive contribution periods from October, 2019 to
March, 2020 and April, 2020- to September, 2020.”
