परीक्षा बोड ड द्वारा ईपजनयम जनम्नानुसार जनधाडररत ककए गए ह:ैं- 1.0 प्रयोज्यता: गैस परीक्षण सक्षमता प्रमाण पत्र खनन आंजीजनयररग म ें जडग्री या जडप्लोमा या केंद्र सरकार द्वारा ऄनुमोकदत ऄन्य समकक्ष योग्यता प्रदान करने वाले सरकारी तकनीकी संस्ट्थान द्वारा और व्यावसाजयक प्रजिक्षण जनयम, 1966 या आसके संिोजधत/नए संस्ट्करण के तहत भूजमगत खदानों की जरूरतों को पूरा करन े वाले समहू व्यावसाजयक प्रजिक्षण केंद्रों (जीवीटीसी)/व्यावसाजयक प्रजिक्षण केंद्रों (वीटीसी) द्वारा जारी ककया जाएगा । 2.0 पात्रता मानदडं : 2.1 ऄभ्यथी के पास खनन आंजीजनयररग में जडग्री या जडप्लोमा या केंद्र सरकार द्वारा आस संबंध में ऄनुमोकदत ऄन्य समकक्ष योग्यता ह ेया ऄभ्यथी आस योग्यता के जलय ेऄध्ययन करता ह े। 2.2 ऄभ्यथी के पास खनन आंजीजनयररग में जडग्री/जडप्लोमा नहीं ह ै और केन्द्र सरकार द्वारा ऄनुमोकदत कोइ ऄन्य समकक्ष योग्यता जभ नहीं ह,ै लेककन वह भूजमगत खदान में कायडरत ह/ै कायडरत था और माआननग मेट/ब्लास्ट्टर के सक्षमता प्रमाण पत्र के जलए ईपजस्ट्थत हो रहा ह ै या सुरक्षा लपैं ों के रखरखाव और जांच के जलए सक्षम व्यजि के रूप में जनयुि ककया (पी.डी.पी.टी), पोस्ट्ट ग्रेजुएिन प्रैजटटकल रेननग (पी.जी.पी.टी) अकद । 3.0 जारी करन े वाला प्राजधकारी: 3.1 खनन आंजीजनयररग में जडग्री या जडप्लोमा या केंद्र सरकार द्वारा आस संबंध में ऄनुमोकदत ऄन्य समकक्ष योग्यता प्रदान करन े वाल ें सरकारी तकनीकी संस्ट्थानों के परीक्षा जनयत्रं क और जवभागाध्यक्ष (खनन) केवल ईस संस्ट्थानों की छात्रों को । 3.2 खान के माजलक/एजेंट, प्रबंधक और व्यावसाजयक प्रजिक्षण जनयम, 1966 या आसके सिं ोजधत/नए संस्ट्करण के ऄंतगतड बनाए गए भूजमगत खदान को सेवा देने वाला समूह व्यावसाजयक प्रजिक्षण केंद्रों /व्यावसाजयक प्रजिक्षण केंद्रों के प्रभारी/ व्यावसाजयक प्रजिक्षण ऄजधकारी ऄपन े कमडचारर को जजनके पास खनन आंजीजनयररग म ें जडग्री/जडप्लोमा या केंद्र सरकार द्वारा आस संबधं म ें ऄनुमोकदत ऄन्य समकक्ष योग्यता नहीं ह ै और वह माआननग मेट/ब्लास्ट्टर के सक्षमता प्रमाण पत्र के जलए ईपजस्ट्थत हो रहा ह ै या सुरक्षा लपैं ों के रखरखाव और जांच के जलए सक्षम व्यजि के रूप में जनयुि ककया जाना ह।ै 3.3 खान के माजलक/एजेंट, प्रबंधक और व्यावसाजयक प्रजिक्षण जनयम, 1966 या आसके सिं ोजधत/नए संस्ट्करण के ऄंतगतड बनाए गए भूजमगत खदान को सेवा देने वाला समूह व्यावसाजयक प्रजिक्षण केंद्रों /व्यावसाजयक प्रजिक्षण केंद्रों के प्रभारी/ व्यावसाजयक प्रजिक्षण ऄजधकारी, ईनकी खदानों या जीवीटीसी/वीटीसी में प्रजिक्षण प्राप्त करने वाल े प्राजधकृत व्यजियों को जैसे पोस्ट्ट जडप्लोमा प्रैजटटकल रेननग (पीडीपीटी), पोस्ट्ट ग्रेजएु िन प्रैजटटकल रेननग (पीजीपीटी) अकद। 4.0 ईम्मीदवार की पहचान: ऄभ्यथी को ईसके मलू पहचान-पत्र स े सवयाजपत ककया जाएगा ताकक यह सुजनजित हो सके कक वह संस्ट्थान म ें नामांककत ह ै या जीवीटीसी/वीटीसी में नामांककत ह ै या जीवीटीसी/वीटीसी के ऄजधन खदान म ेंनामांककत है, जैसा भी मामला हो। माआननग मेट/ब्लास्ट्टर के सक्षमता प्रमाण पत्र के जलए ईपजस्ट्थत होने वाल े या सरु क्षा लैंपों के रखरखाव और जांच के जलए सक्षम व्यजि के रूप म ें जनयुि होन े वाल े खान के कमडचारी, प्रबंधन को आस अिय का एक घोषणा- पत्र देना होगा। 5.0 सुजवधाएं और ऄवसंरचना: 5.1 सरकारी तकनीकी संस्ट्थान और समूह व्यावसाजयक प्रजिक्षण केंद्र/व्यावसाजयक प्रजिक्षण केंद्र खान ऄजधजनयम, 1952 या आसके संिोजधत/नए संस्ट्करण के तहत गैस परीक्षण सक्षमता प्रमाण पत्र जारी करने से पहल े मुख्य खान जनरीक्षक (सीअइएम) को “ऄनलु ग्नक-I” के ऄनुसार जवजधवत भरा हुअ प्रोफामाड ररकॉडड के जलए प्रस्ट्तुत करेंगे। 5.2 यकद अवश्यक हो, तो तकनीकी संस्ट्थान/जीवीटीसी/वीटीसी द्वारा प्रस्ट्तुत जानकारी को जनरीक्षक या आस ईद्देश्य के जलए सीअइएम द्वारा जनयुि आस जनदेिालय की ओर से ऄजधकृत व्यजि द्वारा सवयाजपत ककया जा सकता ह।ै 5.3 तकनीकी संस्ट्थान/जीवीटीसी/वीटीसी की ऄसंतोषजनक सवयापन ररपोटड वाल े सभी दस्ट्तावेजों की समीक्षा की जाएगी और यकद अवश्यक हो तो सधु ार के जलए संस्ट्थान/जीवीटीसी और वीटीसी के माजलक को संबोजधत ककया जाएगा। 6.0 गैस परीक्षण योग्यता प्रमाण पत्र प्रदान करना: 6.1 तकनीकी संस्ट्थान/जीवीटीसी/वीटीसी खान व्यावसाजयक प्रजिक्षण जनयम, 1966 या आसके संिोजधत/नए संस्ट्करण की अठवीं ऄनुसूची म ेंजनधाडररत ऄनुसार कम स ेकम 07 (सात) कदनों की सैद्ांजतक और व्यावहाररक कक्षाए ं संचाजलत करेगा और सफल ऄभ्यथी को गैस परीक्षण म ेंव्यावहाररक ऄनुभव प्रमाण पत्र जारी करेंग े। 6.2 तकनीकी संस्ट्थान द्वारा गसै परीक्षण म ें व्यावहाररक ऄनुभव प्रमाण पत्र जारी करन े के बाद, जैसा कक उपर ईल्लेख ककया गया ह,ै संस्ट्थानों के परीक्षा जनयंत्रक और जवभागाध्यक्ष (खनन) ऄपने संस्ट्थान के सफल ऄभ्यथी को संस्ट्थान स े खनन आंजीजनयररग में ऄपनी संबंजधत जडग्री या जडप्लोमा सफलतापूवडक पूरा करने पर खान ऄजधजनयम, 1952 या आसके संिोजधत/नए संस्ट्करण के तहत गैस परीक्षण सक्षमता प्रमाण पत्र ऄनुलग्नक-III के ऄनुसार जारी करेंगे। 6.3 जीवीटीसी/वीटीसी द्वारा खदान के कमडचाररयों को गैस परीक्षण म ें व्यावहाररक ऄनुभव प्रमाण पत्र जारी करन े के बाद, जैसा कक नबद ु संख्या 2.2 म ें ईल्लेख ककया गया ह,ै खदान के माजलक/एजेंट, प्रबंधक और जीवीटीसी/वीटीसी[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 3 के प्रभारी ऄभ्यथी का खान गसै ों की ईपजस्ट्थजत का परीक्षण करने का सक्षमता ईजचत परीक्षण द्वारा सुजनजित करन े के बाद सफल ऄभ्यथी को खान ऄजधजनयम, 1952 या आसके संिोजधत/नए संस्ट्करण के तहत गैस परीक्षण सक्षमता प्रमाण पत्र ऄनलु ग्नक-III के ऄनसु ार जारी करेंगे । 6.4 जीवीटीसी/वीटीसी द्वारा गैस परीक्षण म ें व्यावहाररक ऄनुभव प्रमाण पत्र जारी करन े के बाद, खदान के माजलक/एजेंट, प्रबंधक और जीवीटीसी/वीटीसी के प्रभारी ऄपने खदानों म ें प्रजिक्षण प्राप्त करन े वाल े जैसे कक पोस्ट्ट जडप्लोमा व्यावहाररक प्रजिक्षण (पीडीपीटी), पोस्ट्ट ग्रेजुएिन व्यावहाररक प्रजिक्षण (पीजीपीटी) अकद ऄजधकृत ऄभ्यथी को खान ऄजधजनयम, 1952 या आसके संिोजधत/नए संस्ट्करण के तहत गैस परीक्षण सक्षमता प्रमाण पत्र ऄनलु ग्नक-III के ऄनुसार जारी करेंगे। 7.0 जारी करन े वाले प्राजधकारी के कतडव्य और जजम्मेदाररयााँ: 7.1 जारी करन े वाला प्राजधकारी यह सुजनजित करेगा कक गैस परीक्षण सक्षमता प्रमाण पत्र केवल योग्य ईम्मीदवारों को ही ईजचत प्रजिक्षण और/या परीक्षण के बाद जारी ककया जाए। 7.2 जारी करने वाला प्राजधकारी ईन ऄभ्यर्थथयों का सटीक और जवस्ट्ततृ जववरण जैसे की ऄभ्यथी का नाम, प्रमाण- पत्र संख्या, जारी करने की तारीख अकद का ररकाडड बद् पष्ृ ांककत रजजस्ट्टर या गैर-संपादन योग्य आलेटरॉजनक फॉम ड में रखेगा, जजन्ह ेंगैस परीक्षण सक्षमता प्रमाण पत्र जारी ककया गया ह।ै 7.3 जारी करन े वाला प्राजधकारी आस जनदेिालय को ईन ऄभ्यर्थथयों का जववरण प्रस्ट्ततु करेगा, जजन्ह ें गैस परीक्षण सक्षमता प्रमाण पत्र जारी ककया गया ह,ै साथ ही जारी ककए गए प्रमाण-पत्रों की सवय एवं प्रमाजणत रंगीन प्रजतयां भी प्रस्ट्तुत करेगा। 7.4 जारी ककए गए गैस परीक्षण सक्षमता प्रमाण पत्र की ककसी भी समय ऑनलाआन पुनप्राडजप्त और सवयापन हते ु, जारी करन े वाला प्राजधकारी आस ऄजधसूचना के प्रकािन की तारीख से एक वषड के भीतर आस जनदेिालय को सूजचत करते हुए, एक ऑनलाआन पोटलड जवकजसत करेगा । 8.0 हालााँकक, खान ऄजधजनयम, 1952 और/या आसके ऄधीनस्ट्थ जनयमों, जवजनयमों और ईपजनयमों में ककए गए कोइ भी संिोधन गैस परीक्षण सक्षमता प्रमाण पत्र प्रदान करते समय लागू होंगे। यकद ईपजनयमों के ऄग्रं ेजी और नहदी संस्ट्करणों के बीच कोइ जभन्नता या संदेह है, तो ईपजनयमों का ऄंग्रेजी संस्ट्करण नहदी संस्ट्करण पर लागू होगा। [फा. सं. In case of falsification of the documents regarding infrastructure and facilities as submitted by the Institutions/GVTC/VTC* for issue of the Gas Testing Certificate shall be liable to be punished as per the extant law. परीक्षा जनयंत्रक/जी०भी०टी०सी०/भी०टी०सी०का प्रभारी* खनन जवभागाघ्यक्ष/प्रबंधक* * * Controller of Examination/ Incharge of GVTC/VTC HoD of Mining Dept./Manager[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 9 ऄजभकताड/माजलक* Agent/Owner द्वारा तैयार ककया गया/Prepared by द्वारा जाचाँ ा गया /Checked by MINISTRY OF LABOUR AND EMPLOYMENT (Directorate General of Mines Safety) NOTIFICATION Dhanbad, the 22 July, 2025 G.S.R. 492(E).—In pursuance of the provisions of Regulation 13 (1) and 13 (4) of the Metalliferous Mines Regulations, 1961, the Bye-laws for grant of Gas Testing Certificates of Competency, are stipulated by the Board of Mining Examinations as follows:- 1.0 Applicability: The Gas Testing Certificate of Competency shall be issued by Government Technical Institution imparting Degree or Diploma in Mining Engineering or other equivalent qualification approved in that behalf by the Central Government and by the Group Vocational Training Centers (GVTC)/Vocational Training Centers (VTC) serving to the needs of belowground mines maintained under the Vocational Training Rules, 1966 or its amended/new version. 2.0 Eligibility Criteria: 2.1 Candidate studying or possessing Degree or Diploma in Mining Engineering or other equivalent qualification approved in that behalf by the Central Government. 2.2 Candidate not possessing Degree/Diploma in Mining Engineering or other equivalent qualification approved in that behalf by the Central Government but employed/had been employed in below ground mine and appearing for Mining Mate’s/Blaster’s certificate of Competency or to be appointed as a competent person for maintenance and examination of safety lamps. 2.3 Authorized candidate getting training in mines or GVTC/VTC like Post Diploma Practical Training (PDPT), Post Graduation Practical Training (PGPT) etc. 3.0 Issuing Authority: 3.1 Controller of Examinations and Heads of Departments (Mining) of Government Technical Institutions awarding Degree or Diploma in Mining Engineering or other equivalent qualification approved in this behalf by the Central Government, to the students of that institution. 3.2 Owner/Agent, Manager of the mine & In-charge/Vocational Training Officer of the Group Vocational Training Centre/Vocational Training Centre maintained under Vocational Training Rules, 1966 or its amended /new version & serving underground mine to its employees not possessing Degree/Diploma in Mining Engineering or other equivalent qualification approved in that behalf by the Central Government and appearing for Mining Mate’s/Blaster’s certificate of Competency or to be appointed as a competent person for maintenance and examination of safety lamps 3.3 Owner/Agent, Manager of the mine & In-charge/Vocational Training Officer of the Group Vocational Training Centre/Vocational Training Centre maintained under Vocational Training Rules, 1966 or its amended /new version & serving underground mine to the authorized candidates getting training in their mines or GVTC/VTC like Post Diploma Practical Training (PDPT), Post Graduation Practical Training (PGPT) etc. 4.0 Identity of the candidate: The candidate shall be verified with his original Identity-Card to ensure that he is enrolled with the institute or is enrolled with the GVTC/VTC or the mine served by the GVTC/VTC as the case may be. Employee of the mine appearing for Mining Mate’s/Blaster’s certificate of Competency or to be appointed as a competent person for maintenance and examination of safety lamps shall give a declaration to this effect to the management. 5.0 Facilities and infrastructure: 5.1 Government Technical Institutions and the Group Vocational Training Centres/Vocational Training Centres shall submit duly filled in proforma as per “Annexure-I” to the Chief Inspector of Mines (CIM) before issuing Gas Testing Certificate of Competency under the Mines Act, 1952 or its amended/new version for record.10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 5.2 If required, information submitted by the Technical Institution/GVTC/VTC may be verified by an Inspector or by a person authorized on his behalf of this Directorate appointed by the CIM for the purpose. 5.3 All the documents with Un-satisfactory verification report of the Technical Institution/GVTC/VTC shall be reviewed and addressed to Institute/owner of GVTC and VTC for rectification, if required. 6.0 Grant of Gas Testing Certificate of Competency: 6.1 The Technical Institution/GVTC/VTC shall conduct theoretical and practical classes of not less than 07(Seven) days as prescribed in the Eight Schedule of the Mine Vocational Training Rules, 1966 or its amended/new version and issue practical experience certificate in Gas Testing to the successful candidates. 6.2 Subsequently after issuance of practical experience certificate in Gas Testing by the Technical Institution as mentioned above, the Controller of Examination & Head of the Department (Mining) of the Institutions shall issue Gas Testing Certificate of Competency under the Mines Act, 1952 or it’s amended /new version as per Annexure-III to the successful candidates of their Institute after completion of their respective Degree or Diploma in Mining Engineering from the Institute. 6.3 Subsequently after issuance of practical experience certificate in Gas Testing by the GVTC/VTC to the employees of the mine as mentioned at point no 2.2, the Owner/Agent, Manager of the mine & In- charge/Vocational Training Officer of the GVTC/VTC shall issue Gas Testing Certificate of Competency under the Mines Act, 1952 or it’s amended /new version as per Annexure-III to the successful candidates after proper test to ensure their competency to test the presence of mine gases. 6.4 Subsequently after issuance of practical experience certificate in Gas Testing by the GVTC/VTC, the Owner/Agent, Manager of the mine & In-charge/Vocational Training Officer of the GVTC/VTC shall issue Gas Testing Certificate of Competency under the Mines Act, 1952 or it’s amended/new version as per Annexure-III to the authorized candidates getting training in their mines or GVTC/VTC like Post Diploma Practical Training (PDPT), Post Graduation Practical Training (PGPT) etc. 7.0 Duties and responsibilities of issuing Authority: 7.1 The issuing authority shall ensure that the Gas Testing Certificate of Competency is issued only to the eligible candidates after proper training and/or test. 7.2 The issuing authority shall maintain accurate and detailed records of candidates who have been issued Gas Testing Certificate of Competency in a bound paged register or in an electronic non editable form with the details like candidate's name, certificate number, issue date etc. 7.3 The issuing authority shall submit to this Directorate the details of candidates to whom Gas Testing Certificate of Competency have been issued along with a true and certified coloured copies of the issued certificates. 7.4 The issuing authority shall develop an online portal within a year from the date of publication of this notification with intimation to this Directorate for online retrieval & verification of the issued Gas Testing Certificate of Competency at any time. 8.0 However, any amendments made in the Mines Act, 1952 and/or its sub ordinate rules, regulations and Bye- laws shall be applicable while grant of Gas Testing Certificates of Competency. If there is any variation or doubt between English and Hindi versions of Bye-laws, then English version of Byelaws will prevail over the Hindi version. [F.
