## Report on the Coconut Development Board Amendment Regulations, 2021
**1. Executive Summary:**
This report analyzes the Coconut Development Board Amendment Regulations, 2021, as published in the Gazette of India on January 19, 2022. This amendment modifies the Coconut Development Board Regulations, 1982. Key changes include alterations to the composition of committees within the Coconut Development Board, specifically concerning the role of the Chief Executive Officer (CEO) and the representation of certain states. The amendment also modifies regulations regarding the quorum for committee meetings and removes regulation 18. The core purpose appears to be streamlining committee operations and potentially broadening representation within the Board.
**2. Introduction:**
This report provides an overview of the Coconut Development Board Amendment Regulations, 2021, based solely on the published notification. The objective is to inform stakeholders, particularly those in the coconut industry, about the changes introduced and their potential implications.
**3. Policy Overview:**
* This document amends the Coconut Development Board Regulations, 1982.
* **Core Objective(s):** The core objective, as inferred from the provided text, appears to be to refine the structure and operational procedures of the Coconut Development Board’s committees. This includes adjusting the composition of the committees and other operational aspects.
**4. Background and Rationale:**
The provided text focuses on specific amendments. The likely rationale for these amendments includes:
* **Clarifying the Role of the CEO:** The consistent substitution of subclauses to explicitly name the Chief Executive Officer as the "Chief Executive and ex-officio Member of the Committee" across multiple committee types suggests a desire to formally define and emphasize the CEO's integral role within these committees.
* **Adjusting Representation:** Changes to the number of representatives and the addition of Andhra Pradesh alongside Kerala may aim to achieve a more balanced regional representation reflecting the current state of the coconut industry in India.
* **Operational Efficiency:** Modifying the quorum requirements for committee meetings and removing regulation 18 likely seeks to enhance the efficiency and relevance of the Board's operations.
**5. Key Provisions / Changes:**
The amendments introduce the following changes to the Coconut Development Board Regulations:
* **Changes to Committee Composition (Regulation 3):**
* **Change:** In multiple clauses (a, b, c, and d) pertaining to committee composition, subclause (i) is replaced to state: "The Chief Executive Officer who shall be the Chief Executive and exofficio Member of the Committee."
* **Original Policy:** The original composition of the committees is not detailed in this text, but the amendment clearly seeks to specify the CEO's role and membership.
* **Effect:** This change codifies the CEO's position as a key, mandatory member of the committees, ensuring their direct involvement in decision-making.
* **Change:** In clauses a(ii), b(ii), and d(iii), the number of representatives is adjusted (e.g., "three" changed to "four," "four" changed to "six"). Andhra Pradesh is added after Kerala in clauses a(ii) and d(iii).
* **Original Policy:** The original number of representatives from specified categories/regions is being changed.
* **Effect:** These changes likely aim to broaden representation within the committees, potentially giving a stronger voice to specific stakeholder groups or regions.
* **Change:** In clauses c(vi) and d(v), the word "Cooperation" is omitted.
* **Original Policy:** The original composition of these committees originally included a representative from "Cooperation".
* **Effect:** This change could streamline the number of stakeholders present in these committes
* **Changes to Quorum Requirements (Regulation 8):**
* **Change:** The wording "at least six members" is replaced with "at least one fourth of the numbers constituting the respective Committee".
* **Original Policy:** The original quorum was a fixed number (six).
* **Effect:** This change makes the quorum dynamic, scaling with the size of each committee. It could make it easier or harder to achieve a quorum, depending on the committee size.
* **Omission of Regulation 18:**
* **Change:** Regulation 18 is removed entirely.
* **Original Policy:** The content of Regulation 18 is not specified in the provided text.
* **Effect:** The effect is unknown based on the provided context, but it eliminates whatever provisions Regulation 18 contained.
**6. Target Audience and Stakeholders:**
Based on the text, the directly affected stakeholders include:
* The Chief Executive Officer of the Coconut Development Board.
* Members of the various committees of the Coconut Development Board.
* Coconut farmers and related industries in Kerala and Andhra Pradesh.
* The Coconut Development Board itself.
**7. Implementation Aspects (Inferred):**
* **Responsible agency:** The Coconut Development Board is the responsible body for implementing these amendments.
* **Timelines:** The regulations came into force on the date of their publication in the Official Gazette, which was January 19, 2022.
* **Specific to Changes:** The changes to committee composition require immediate implementation by updating the committee memberships and procedures. The removal of Regulation 18 requires the Board to cease enforcing or adhering to its provisions from the effective date. The change to quorum requirements must be factored into future meeting protocols.
**8. Expected Outcomes / Impact of Changes:**
* **Of CEO Designation:** Clarifying the CEO's role aims to improve committee leadership and ensure alignment with the Board's overall strategic direction.
* **Of Representation Changes:** The alterations to representation may lead to a more inclusive and balanced decision-making process, reflecting the diverse interests within the coconut industry.
* **Of Quorum Changes:** The new quorum requirements could affect the frequency and efficiency of committee meetings, potentially speeding up or slowing down decision-making processes.
* **Of Regulation 18 Removal:** The impact of this change is difficult to determine without knowing the content of Regulation 18, but it indicates a strategic adjustment to the Board's regulatory framework. It could be a streamlining effort, a response to changing industry conditions, or the removal of an outdated or ineffective regulation.
**9. Conclusion:**
The Coconut Development Board Amendment Regulations, 2021 represent a series of targeted adjustments to the operational framework of the Coconut Development Board. The changes focus on clarifying the CEO's role, adjusting committee representation, modifying quorum requirements, and removing regulation 18. The overall effect is likely intended to streamline operations, improve committee effectiveness, and ensure better representation of key stakeholders within the coconut industry. Stakeholders should carefully review these changes to understand their implications for their involvement with the Coconut Development Board.
