(IV) पररकद की बै कों म भाग लने े वाले गरै सरकारी सदस्ट् यों के यात्रा भत् ते और दैजनक भत् ते,अनपछ ूरक जनयम 190 के
उपबंधों तथा भारत सरकार द्वारा उनके अधीन समय-समय पर जारी दकए आदेिों के अनछसार जनयजमत दकए
जाय गे।
(V) होने वाले व् यय की पूर्थत इस प्रयोजन के जलए स्ट् वीकृत बजअ अनदछ ान म स ेकी जाएगी।
(VI) क रीय सरकार और रामंय सरकारों के जविेक्ञ तथा तकनीकी सलाहकार इस पररकद के सदस्ट् य नह होंगे और
पररकद द्वारा जनणगय जलए जात े समय उन्द ह मत देन े का अजधकार नह होगा, ककतछ यदद पररकद द्वारा अपेजक्षत हो
तो वे पररकद की बै क म हाजजर होंगे।
(VII) पररकद का सजचवीय स्ट्अॉफ होगा, जजसम एक सजचव होगा तथा उतन े अजधकारी और पदधारी होंग े जजतन े क रीय
सरकार के अनछमोदन से अध् यक्ष, जनयछक्त करना उजचत समझे।[भाग II—खण् ड 3(ii)] भारत का राजपत्र : असाधारण 3
2. इस पररकद द्वारा दकए जान ेवाल ेकायो की प्रकृजत:
पररकद एक सलाहकार जनकाय होगा और उस हजै सयत से यह जनम्न जलजखत कायग करेगा,अथागत-
(क) स्ट् वास्ट् ् य एवं पररवार कल् याण के मामल े म संबंजधत सभी पहलछ प पर नीजत की मोअी-मोअी ूपपरेखा पर जवचार-
जवमिग तथा जसफाररि करना जसै े-उपचारी,स्ट् वास्ट् ् यवधगक और जनवारक उपचार का प्रावधान, पयागवरजणक सफाई,
पोकण,स्ट् वास्ट् ् य जिक्षा एवं प्रजिक्षण और अनछसंधान के जलए सछजवधा प को बढ़ावा देना;
(ख) जचदकत् सा तथा लोक स्ट् वास्ट् ् य तथा पररवार कल् याण के मामलों से संबंजधत दियाकलाप के क्षेत्रों म जवधान के जलए
प्रस्ट् ताव तैयार करना और समस्ट्त देि के जवकास के जलए प्रजतमान जनधागररत करना;
(ग) त् योहारों के अवसर पर महामाररयों के फैलने और जवपजत्त की जस्ट्थजत जैसे भूकंप तथा सूखे की जस्ट्थजत म अतं र-
रामंय ीय संगरोधन के संबंध म व् यापक आधार पर यथासंभव सहयोग की संपूणग संभावना का पता लगाना और
सामान्द य कायगिम तैयार करना;
(घ) स्ट् वास्ट् ् य और पररवार कल् याण प्रयोजनों के जलए उपल ध सहायता अनछदानों को रामंय ों म जवतररत करन े के संबंध
म क रीय सरकार को जसफाररि करना और इन सहायता अनछदानों के उपयोग द्वारा जवजभन्द न क्षेत्रों म हुए कायग की
आवजधक समीक्षा करना; और
(ङ) क र और रामंय ों के स्ट् वास्ट् ् य और पररवार कल् याण प्रिासनों के बीच सहयोग बनाए रखन े और उसको बढ़ावा देन े के
जलए ऐसे दकन्दही सगं न अथवा संग नों की स्ट् थापना करना जजन्दह उपयछक् त काय गसपपे जाएं।
3. पररकद की काय गप्रदिया:
पररकद अपने कामकाज के संचालन के जलए जनम्न जलजखत प्रदिया अपनाएगी,नामत:-
(क) पररकद हर वकग एक या अजधक बार अपनी बै क करेगी;
(ख) इस पररकद की बै क उस समय और उस स्ट् थान पर होगी जो अध् यक्ष द्वारा इस जनजमत् त जनयत दकया जाएगा;
(ग) इस पररकद की बै क के जलए पांच सदस्ट् यों (अध् यक्ष सजहत)का कोरम होगा;
(घ) अध् यक्ष और उनकी अनछपजस्ट्थजत म उपाध् यक्ष या कोई ऐसा सदस्ट् य, जजसे पैरा-1 के उप परै ा (I) के खंड (घ)म
जवजनर्ददष्ट अ सदस्ट् यों म अध् यक्ष द्वारा इस जनजमत् त नामोदद्द्ट दकया जाएगा, बै क की अध् यक्षता करेगा;
(ङ) इस पररकद की बै क म उ ाए जान े वाल े सभी प्रश् नों का जवजनश् चय बै क म उपजस्ट्थत सदस्ट्य ों (अध् यक्ष सजहत) के
बहुमत से दकया जाएगा।
(च) मतों के बराबर होने की दिा म, अध् यक्षता करन ेवाल ेव् यजि का दसू रा अथवा जनणागयक मत होगा।
(छ) पररकद अपन े कामकाज के जलए ऐसी अन्द य प्रदिया का पालन करेगी जो वह क रीय सरकार के अनछमोदन से समय-
समय पर जनधागररत करे।

Constitution of Central Council of Health and Family Welfare
S.O. 1916(E).—In exercise of the powers conferred by the Article 263 of the Constitution, the
President hereby reconstitutes the Central Council of Health and Family Welfare and defines the nature of
duties to be performed by it and its organization and procedure as follows, namely: -
1. Organization of the Council:
(I) The Council shall consist of: -
(a) The Union Minister for Health and Family Welfare : Chairman
(b) The Union Minister of State in the Ministry of : Vice Chairman

(II) The Members of Lok Sabha shall be Members of the Council so long as they are members of
Lok Sabha or for two years, whichever is earlier.
(III) The Members of Rajya Sabha shall be Members of the Council so long as they are members of

(IV) The travelling and daily allowances of the non-official members for attending the meetings of
the Council shall be regulated in accordance with the provision of Supplementary Rule 190 and
orders of the Government of India there-under as issued from time to time.
(V) The expenditure involved will be met from within the sanctioned budget grant for the purpose.
(VI) Experts and technical advisers to the Central Government and State Governments shall not be
members of the Council and shall not have any right to vote when any decision is taken by it but
shall, if so required by the Council, be in attendance at its meetings.
(VII) The Council shall have a Secretarial staff consisting of a Secretary and such officers and
officials as the Chairman may, with the approval of the Central Government, think fit to appoint.
2. Nature of the duties to be performed by the Council:
The Council shall be an advisory body and in that capacity shall perform the following duties,
namely: -
(a) To consider and recommend broad lines of policy in regard to matters concerning Health
and Family Welfare in all its aspects, such as the provision of remedial, promotive and
preventive care, environmental hygiene, nutrition, health education and the promotion of
facilities for training and research;
(b) To make proposal for legislation in fields of activity relating to medical and public health
and Family Welfare matters, laying down the pattern of development for the country as a
whole;
(c) To examine the whole field of possible co-operation on a wide basis in regard to inter-
State quarantine during time of festivals, out-break of epidemics and serious calamities
such as earth-quakes and famines and to draw up a common programme of action;
(d) To make recommendations to the Central Government regarding distribution of available
grants-in-aid for Health and Family Welfare purposes to the States and to review
periodically the work accomplished in different areas through the utilization of these
grants-in-aid; and
(e) To establish any organization or organizations invested with appropriate functions for
promoting and maintaining co-operation between the Central and State Health and Family
Welfare administration.
3. Procedure of the Council:
The Council shall in its conduct of business observe following procedures, namely: -
(a) The Council shall meet once or more each year;
(b) It shall meet at such time and place as the Chairman may appoint in this behalf;
(c) Five members (including the Chairman) shall form the quorum for a meeting of the
Council;
(d) The Chairman and, in his absence Vice-Chairman or such member as may be designated
by the Chairman in this behalf from among the members referred to in clause (d) of sub-
paragraph (I) of paragraph 1 shall preside at the meeting;
(e) All questions which may come up before the Council at the meeting shall be decided by a
majority of vote of the members (including the Chairman) present at the meeting;
(f) In case of equality of votes, the person presiding shall have a second or casting vote;
(g) The Council shall observe in the conduct of its business such other procedure as it may,
with the approval of the Central Government, lay down from time to time.
