1. संि(cid:6979)(cid:7009) त नाम और (cid:7079)ारंभ- (1) इस (cid:7021)क(cid:7409)म का संि(cid:6979)(cid:7385) नाम कम(cid:6981)चारी भिव(cid:7020)य िनिध (पांचवा ंसंशोधन) (cid:7021)क(cid:7409)म, 2017 है।
(2) यह शासक(cid:7409)य राजप(cid:7074) म(cid:7286) इसके (cid:7079)काशन क(cid:7409) तारीख को (cid:7079)वृ(cid:7275) होगी ।
2. कम(cid:6981)चारी भिव(cid:7020)य िनिध (cid:7021)क(cid:7409)म, 1952 (िजसे इसम(cid:7286) इसके प(cid:7019) चात् उ(cid:6989) त (cid:7021) क(cid:7409)म कहा गया ह)ै के पैरा 68ञ म(cid:7286),-
(क) उप-पैरा (2) का लोप होगा;
(ख) उप-पैरा (3) के परंतुक का लोप होगा;
(ग) उप-पैरा (6) के (cid:7021) थान पर िन(cid:7013) निलिखत पैरा रखा जाएगा, अथा(cid:6981)त्:--
''(6) उप-पैरा (1) या उप-पैरा (3) के अधीन सद(cid:7021) य को कोई अि(cid:7061)म अनुद(cid:7004) त नह(cid:7277) (cid:7408)कया जाएगा जब तक (cid:7408)क वह उसके (cid:7079)भाव म(cid:7286) (cid:7021) व-
घोषणा (cid:7079)(cid:7021) तुत न करे।''।
3. उ(cid:6989) त (cid:7021) क(cid:7409)म म(cid:7286) पैरा 68ढ के उप-पैरा (2) के (cid:7021) थान पर िन(cid:7013) निलिखत उप-पैरा रखा जाएगा, अथा(cid:6981)त् :--

NOTIFICATION
New Delhi, the 25th April, 2017
G.S.R.404(E).— In exercise of the powers conferred by section 5 read with sub-section (1) of section 7 of
Employees’ Provident Funds and Miscellaneous Provisions Act, 1952 (19 of 1952), the Central Government hereby
makes the following Scheme, further to amend the Employees’ Provident Funds Scheme, 1952, namely:-
1.(cid:32) Short title and commencement.- (1) The scheme may be called the Employees’ Provident Funds (Fifth
Amendment) Scheme, 2017.
(2) It shall come into force on the date of its publication in the Official Gazette.
2.(cid:32) In the Employees’ Provident Funds Scheme, 1952 (hereinafter referred to as the said Scheme), in paragraph
68J,-
(a)(cid:32) sub-paragraph (2) shall be omitted;
(b)(cid:32) proviso to sub-paragraph (3) shall be omitted;
(c)(cid:32) for sub-paragraph (6), the following sub-paragraph shall be substituted, namely;-
“(6) No advance shall be granted to the member under sub-paragraph (1) or sub-paragraph (3) unless
he produces a self-declaration to that effect.”.
3.(cid:32) In the said Scheme, in para 68N, for sub-paragraph (2), the following sub-paragraph shall be substituted,
namely:-
“(2) No advance shall be paid to the member under sub-paragraph (1) unless he produces a self-
declaration to that effect.”.
