## Report on the National Commission for Allied and Healthcare Professions 2nd Removal of Difficulties Order, 2021 **1. Executive Summary:** This report analyzes the National Commission for Allied and Healthcare Professions 2nd Removal of Difficulties Order, 2021, as published in the Gazette of India. This order addresses difficulties arising from the inability of State Governments/Union Territories to constitute State Allied and Healthcare Councils within the originally stipulated timeframe due to the COVID-19 pandemic. The core purpose of the order is to extend the deadline for the constitution of these councils. The key finding is that the order provides a one-year extension from the commencement of the National Commission for Allied and Healthcare Professions Act, 2021, for State Governments/Union Territories to establish the necessary councils. **2. Introduction:** The purpose of this report is to provide an informative analysis of the National Commission for Allied and Healthcare Professions 2nd Removal of Difficulties Order, 2021, based solely on the content of the provided official gazette notification. This report aims to outline the amendment's objectives, provisions, and potential impact on relevant stakeholders. **3. Policy Overview:** * This order is an amendment related to the National Commission for Allied and Healthcare Professions Act, 2021 (14 of 2021). * **Core Objective:** As inferred from the provided text, the core objective of this order is to remove difficulties encountered in the timely constitution of State Allied and Healthcare Councils as mandated by Section 22 of the National Commission for Allied and Healthcare Professions Act, 2021. **4. Background and Rationale:** The provided text indicates that the reason for this specific amendment is the disruption caused by the second wave of the COVID-19 pandemic in India. This disruption prevented State Governments/Union Territories from establishing State Allied and Healthcare Councils within the six-month timeframe initially prescribed by Section 22 of the Act. This order aims to address the non-compliance with the provisions due to the unforeseen pandemic-related challenges. **5. Key Provisions / Changes:** This order specifically amends the implementation timeline for the constitution of State Allied and Healthcare Councils. * **Original Policy Part Affected (Inferred):** Section 22 (1) of the National Commission for Allied and Healthcare Professions Act, 2021, which originally stipulated a six-month deadline for the constitution of State Councils. * **New Rule/Provision:** The order clarifies that all State Governments/Union Territories shall constitute State Allied and Healthcare Councils within one year from the date of commencement of the National Commission for Allied and Healthcare Professions Act, 2021. * **Difference/Effect of Change:** The order extends the deadline by an additional six months, providing State Governments/Union Territories with a total of one year from the commencement of the Act to establish the councils. This provides additional time for the establishment of the councils considering the circumstances. **6. Target Audience and Stakeholders:** Based on the provided text, the primary target audience and stakeholders directly affected by this order are: * State Governments/Union Territories: As they are responsible for constituting the State Allied and Healthcare Councils. * The Allied and Healthcare Professions: As the establishment of the State Councils is critical for the implementation and regulation of the profession at the state level. **7. Implementation Aspects (Inferred):** * **Responsible Agency/Bodies:** The State Governments/Union Territories are responsible for implementing this order by constituting the State Allied and Healthcare Councils. The Ministry of Health and Family Welfare appears to be the central governing body overseeing the Act's implementation. * **Timelines:** The text specifies that the councils must be constituted within one year from the date of commencement of the National Commission for Allied and Healthcare Professions Act, 2021 (i.e., May 25, 2021). * **Specific to the changes:** The order effectively delays the original implementation timeline, and stakeholders should adjust their strategies and planning to accommodate the extended deadline. **8. Expected Outcomes / Impact of Changes:** The likely intended outcome of this amendment is to ensure that all State Allied and Healthcare Councils are constituted, albeit with a delayed timeline. This ensures that the objectives of the National Commission for Allied and Healthcare Professions Act, 2021, can be effectively realized at the state level. The delay seeks to accommodate the difficulties created by the pandemic and allow State Governments/Union Territories sufficient time to fulfill their obligations. **9. Conclusion:** The National Commission for Allied and Healthcare Professions 2nd Removal of Difficulties Order, 2021, is a crucial amendment that addresses the challenges faced by State Governments/Union Territories in constituting State Allied and Healthcare Councils due to the COVID-19 pandemic. By extending the deadline for council establishment, the order aims to facilitate the effective implementation of the National Commission for Allied and Healthcare Professions Act, 2021, and ensure the regulation and development of the allied and healthcare professions across the country.
