**Report on the Plant Quarantine Regulation of Import into India Second Amendment Order, 2022**
**1. Executive Summary:**
This report analyzes the Plant Quarantine Regulation of Import into India Second Amendment Order, 2022 (hereinafter referred to as "the Amendment Order"), based solely on the text provided. The Amendment Order modifies Schedule VI of the Plant Quarantine Regulation of Import into India Order, 2003, introducing specific phytosanitary requirements for the import of stone fruits (Prunus domestica plums and Prunus avium sweet cherries) and grapes (Vitis vinifera) from Uzbekistan. The key findings indicate a focus on preventing the introduction of specific pests and diseases through import regulations, necessitating compliance with systems approach for production, methyl bromide fumigation or pre-shipment cold treatment protocols for affected commodities.
**2. Introduction:**
The purpose of this report is to provide an informative overview of the Plant Quarantine Regulation of Import into India Second Amendment Order, 2022. The analysis is based exclusively on the provided policy text, focusing on the key provisions, target audience, and potential impact of the amendment.
**3. Policy Overview:**
* This is an amendment to the Plant Quarantine Regulation of Import into India Order, 2003.
* **Core Objective(s):** Based on the provided text, the core objective of this amendment is to update and strengthen the existing plant quarantine regulations to prevent the introduction and spread of destructive insects, pests, and diseases into India, specifically related to imported stone fruits (plums and sweet cherries) and grapes from Uzbekistan.
**4. Background and Rationale:**
This amendment appears to be driven by the need to address specific phytosanitary risks associated with the import of plums, sweet cherries, and grapes from Uzbekistan. The identified pests and diseases (e.g., Amphitetranychus viennensis, Eupoecilia ambiguella, Grapholitafunebrana, Grapholitamolesta, Leucopteramalifoliella, Lobesiabotrana, Sphaerolecaniumprunastri, Caliroacerasi, Rhagoletiscerasi, Alternaria vitis syn. Macrosporiumvitis) suggest that existing regulations were deemed insufficient to mitigate these risks, thus necessitating the introduction of more stringent import requirements.
**5. Key Provisions / Changes:**
The Amendment Order introduces the following changes to Schedule VI of the Plant Quarantine Regulation of Import into India Order, 2003:
* **Specific Part of Original Policy Changed:** Schedule VI, relating to import regulations for various plants and plant products. Specifically, entries related to Stone Fruits (Prunus domestica plums and Prunus avium sweet cherries) and Grapes (Vitis vinifera) under serial numbers 293 and 319, respectively.
* **New Rules/Provisions:**
* For *Prunus domestica plums* from Uzbekistan, the amendment mandates that export consignments must be free from specific insects and mites (listed in the document), and must comply with one of the following options:
* Systems Approach for production and export
* Methyl bromide fumigation (32 gm3 for 2 hrs at 21oC or above)
* Pre-shipment cold treatment (0oC or below for 10 days; 0.55oC or below for 11 days; 1.1oC or below for 12 days) plus in transit refrigeration.
* For *Prunus avium sweet cherries* from Uzbekistan, the amendment mandates that export consignments must be free from specific insects and mites (listed in the document), and must comply with one of the following options:
* Systems Approach for production and export
* Methyl bromide fumigation (32 gm3 for 2 hrs at 21oC or above)
* Pre-shipment cold treatment (0oC or below for 10 days; 0.55oC or below for 11 days; 1.1oC or below for 12 days) plus in transit refrigeration.
* For *Vitis vinifera grapes* from Uzbekistan, the amendment mandates that export consignments must be free from specific insects and fungi (listed in the document), and must comply with one of the following options:
* Systems Approach for production and export
* Methyl bromide fumigation (32 gm3 for 2 hour at 11oC or for 2 hours at 13oC)
* Pre-shipment cold treatment (0oC or below for 10 days; 0.55oC or below for 11 days; 1.1oC or below for 12 days) plus in transit refrigeration.
* Details on treatment and Production under Systems Approach should be endorsed on Phytosanitary Certificate issued at the country of Origin Reexport.
* **Difference/Effect of the Change:** The amendment introduces specific and mandatory phytosanitary measures for the import of stone fruits (plums and sweet cherries) and grapes from Uzbekistan, providing options for compliance (systems approach, fumigation, or cold treatment) and increasing the level of scrutiny required for these imports. The effect is to potentially restrict imports that do not meet these requirements, and to impose compliance costs on exporters in Uzbekistan.
**6. Target Audience and Stakeholders:**
Based on the text, the directly affected parties include:
* Importers of plums, sweet cherries, and grapes into India.
* Exporters of plums, sweet cherries, and grapes from Uzbekistan.
* The National Plant Protection Organization (NPPO) of Uzbekistan.
* Phytosanitary certification agencies in Uzbekistan.
* Consumers of stone fruits and grapes in India (indirectly, through price and availability).
**7. Implementation Aspects (Inferred):**
* **Responsible Agency/Bodies:** The Department of Agriculture and Farmers Welfare, Central Government of India. Phytosanitary authorities in both India and Uzbekistan are implicitly involved.
* **Timelines/Procedures:** The Amendment Order comes into force on the date of its publication in the Official Gazette (July 27, 2022, as stated in the provided text). No specific procedures are outlined within the amendment itself, but it can be inferred that importers will need to provide evidence of compliance with the specified phytosanitary measures (e.g., phytosanitary certificates, treatment records) to Indian plant quarantine authorities.
* **Implementation aspects related specifically to the changes**: The most relevant aspect of the implementation of these changes is the need to clearly communicate the new requirements to Uzbek exporters and Indian importers, so they can adopt the correct practices. There will also need to be a way to verify the claims that treatment and production under Systems Approach are endorsed on Phytosanitary Certificates.
**8. Expected Outcomes / Impact of Changes:**
The likely intended outcome of these amendments is to:
* Reduce the risk of introducing harmful pests and diseases into India through imported plums, sweet cherries, and grapes from Uzbekistan.
* Enhance the protection of Indian agriculture and biodiversity.
* Potentially increase the cost of importing these commodities due to the required phytosanitary measures.
* Potentially impact trade volumes if exporters are unable to meet the new requirements or choose to redirect their exports to other markets.
* Encourage adoption of systems approach, cold treatment, or Methyl Bromide fumigation in Uzbekistan agricultural practices.
**9. Conclusion:**
The Plant Quarantine Regulation of Import into India Second Amendment Order, 2022, represents a targeted effort to strengthen phytosanitary controls on the import of plums, sweet cherries, and grapes from Uzbekistan. By mandating specific measures such as a systems approach for production, methyl bromide fumigation, or pre-shipment cold treatment, the amendment aims to mitigate the risk of introducing harmful pests and diseases, thereby safeguarding Indian agriculture. Compliance with these new regulations will be crucial for both importers and exporters involved in the trade of these commodities.
