L.-33004/99 xxxGIDHxxx सी.जी.-डी.एलxx.x-GअID.-E1x8x0x 42023-245228 CG-DL-E-18042023-245228 ऄसाधारण EXTRAORDINARY भाग II—खण् ड 3—ईप-खण्ड (i) PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 235] नइ ददल्ली, सोमिार, ऄप्रैल 17, 2023/चत्रै 27, 1945 No. 235] NEW DELHI, MONDAY, APRIL 17, 2023/CHAITRA 27, 1945 श्रम और रोजगार मत्रं ालय ऄजधसचू ना नइ ददल्ली, 17 ऄप्रैल, 2023 सा.का.जन. 296(ऄ).—राष्ट्रपजत, संजिधान के ऄनच्ु छेद 309 के परन्तुक द्वारा प्रदत्त िजियों का प्रयोग करत े हुए और खान सुरक्षा महाजनदेिालय (समूह ‘ग’ और समूह-‘घ’ पद) भती जनयम, 1989 को जहां तक ईनका संबंध ज्येष्ठ हहदी ऄनुिादक के पद से ह,ै ईन बातों के जसिाय ऄजधक्ांत करते हुए, जजन्ह ें ऐसे ऄजधक्मण से पूिव दकया गया ह ैया करने का लोप दकया गया ह,ै खान सुरक्षा महा-जनदेिालय, श्रम और रोजगार मंत्रालय में ज्येष्ठ हहदी ऄनुिादक के पद पर भती की पद्धजत का जिजनयमन करन े के जलए जनम्नजलजखत जनयम बनात ेह,ैं ऄथावत् :- 1. संजक्षप्त नाम और प्रारंभ- (1) आन जनयमों का संजक्षप्त नाम श्रम और रोजगार मंत्रालय, खान सुरक्षा महाजनदेिालय, ज्यष्ठे हहदी ऄनुिादक (समूह ‘ख’ पद)भती जनयम, 2023 ह।ै (2) ये राजपत्र में आनके प्रकािन की तारीख को प्रिृत्त होंगे। 2. पद सख्ं या, िगीकरण और िते न मट्रै रक्स म ें स्ट्तर– ईि पद की संख्या, ईसका िगीकरण और आससे संलग्न िेतन मैट्ररक्स में स्ट्तर िह होगा जो आन जनयमों से ईपाबद्ध ऄनुसूची के स्ट्तंभ (2) से स्ट्तंभ (4) म ेंजिजनर्ददष्ट ह।ैं 3. भती की पद्धजत, अय ु सीमा, ऄन्य ऄहतव ाएं, अदद– भती की पद्धजत, अयु सीमा, ऄहतव ाएं और ईससे संबंजधत ऄन्य बातें िे होंगी जो ईि ऄनुसूची के स्ट्तंभ (5) से स्ट्तंभ (13) म ेंजिजनर्ददष्ट ह।ैं 4. जनरहतव ा: िह व्यजि- (क) जजसने ऐसे व्यजि से,जजसका पजत या जजसकी पत्नी जीजित ह,ै जििाह दकया ह,ै या जििाह की संजिदा की ह;ै या 2495 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ख) जजसने ऄपन े पजत या ऄपनी पत्नी के जीजित रहत े हुए दकसी व्यजि स े जििाह दकया ह ै या जििाह की संजिदा की ह ै ईि पद पर जनयुजि का पात्र नहीं होगा : परन्त ु यदद केंद्रीय सरकार का यह समाधान हो जाता ह ै दक ऐसा जििाह ऐसे व्यजि और जििाह के ऄन्य पक्षकार को लाग ू स्ट्िीय जिजध के ऄधीन ऄनुज्ञेय ह ै और ऐसा करन े के जलए ऄन्य अधार ह ैं तो िह दकसी व्यजि को आस जनयम के प्रितनव से छूट दे सकेगी। 5. जिजथल करन े की िजि: जहा ं केन्द्रीय सरकार की यह राय ह ै दक ऐसा करना अिश्यक या समीचीन है, िहां िह ईसके जलए जो कारण ह,ैं ईन्ह ें लेखबद्ध करके और संघ लोक सेिा अयोग स े परामिव करके, आन जनयमों के दकसी ईपबंध को दकसी िगव या प्रिग वके व्यजियों की बाबत, अदेि द्वारा जिजथल कर सकेगी। 6. व्यािजृ त्त: आन जनयमों की कोइ बात, ऐसे अरक्षण, अय-ु सीमा में छूट और ऄन्य ट्ररयायतों पर प्रभाि नहीं डालगे ी, जजनका केन्द्रीय सरकार द्वारा आस संबंध म ें समय–समय पर जारी दकए गए अदेिों के ऄनुसार ऄनुसूजचत जाजतयों, ऄनुसूजचत जनजाजतयों, ऄन्य जपछड़े िगों, भूतपूिव सैजनकों और ऄन्य जििेष प्रिगव के व्यजियों के जलए ईपबंध करना ऄपेजक्षत ह।ै ऄनसु चू ी पद का नाम पद सख्ं य ा िगीकरण (1) (2) (3) ज्येष्ठ हहदी ऄनुिादक 1* (2023) साधारण केंद्रीय सेिा * कायवभार के अधार पर पट्ररितवन समूह-ख,ऄराजपजत्रत, ऄननुसजचिीय। दकया जा सकता ह।ै िते न मट्रे रक्स म ें स्ट्तर चयन ऄथिा ऄचयन पद। (4) (5) िेतन मैट्ररक्स में स्ट्तर 7 (रु.-44,900 – 1,42,400) लाग ूनहीं होता सीध ेभती दकए जान ेिाल ेव्य जक्त यों के जलए अय ुसीमा। सीध े भती दकए जान े िाल े व्य जक्त यों के जलए ऄपजे क्षत िजै क्षक और ऄन्य ऄहतव ाएं। (6) (7) लाग ूनहीं होता लाग ूनहीं होता सीध े भती दकए जान े िाल े व्य जक्त यों के पट्ररिीक्षा की ऄिजध, यदद कोइ हो। भती की पद्धजत, भती सीधी होगी जलए जिजहत अय ु और िजै क्षक ऄहतव ाए ं याप्रोन्नजत होगी या प्रोन्न त व्य जक्त यों की दिा म ें लाग ू प्रजतजनयजु ि/अमले न द्वारा तथा होंगी। जिजभन्न पद्धजत द्वारा भरी जान े िाली ट्ररजियोंकी प्रजतिता (8) (9) (10) लाग ूनहीं होता लाग ूनहीं होता संयुि पद्धजत द्वारा (प्रजतजनयुजि और प्रोन्नजत) प्रोन्नजत या प्रजतजनयजु ि/ अमले न द्वारा भती की दिा म,ें ि ेश्रजे णया ंजजनस े प्रोन्नजत या प्रजतजनयजु ि/ अमले न दकया जाएगा। (11) संयुि पद्धजत (प्रजतजनयुजि और प्रोन्नजत) (I) केंद्रीय सरकार या राज्य सरकार या संघ राज्यक्षेत्रों के ऐसऄे जधकारी:[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 3 (क) (i) जो मलू काडर या जिभाग म ेंजनयजमत अधार पर सदिृ पद धारण दकए हुए ह;ैं या (ii) जजन्होंने मूल काडर या जिभाग में िेतन मैट्ररक्स के स्ट्तर 6 (35400 रूपय े -112400 रुपय)े या समतुल्य पदों म ें जनयजमत अधार पर जनयुजि के पश्चात ईस श्रेणी म ेंपांच िष व सेिा की ह;ै और (ख) जजसके पास जनम्नजलजखत िैक्षजणक ऄहतव ाएं और ऄनुभि हो: (i) दकसी मान्यताप्राप्त जिश्वजिद्यालय से हहदी में मास्ट्टर जडग्री जजसमे जडग्री स्ट्तर पर ऄंग्रेजी एक ऄजनिायव या िैकजल्पक जिषय के रूप में रहा हो या परीक्षा का माध्यम रहा हो; या दकसी मान्यताप्राप्त जिश्वजिद्यालय स े ऄग्रं ेजी म ें मास्ट्टर जडग्री जजसमे जडग्री स्ट्तर पर हहदी एक ऄजनिायव या िैकजल्पक जिषय के रूप म ेंरहा हो या परीक्षा का माध्यम रहा हो; या दकसी मान्यताप्राप्त जिश्वजिद्यालय से हहदी या ऄग्रं ेजी से जभन्न दकसी भी जिषय में मास्ट्टर जडग्री जजसमें जडग्री स्ट्तर पर जहन्दी माध्यम रहा हो और ऄंग्रेजी एक ऄजनिायव या िैकजल्पक जिषय के रूप में रहा हो या परीक्षा का माध्यम रहा हो; या दकसी मान्यताप्राप्त जिश्वजिद्यालय से हहदी या ऄग्रं ेजी से जभन्न दकसी भी जिषय में मास्ट्टर जडग्री जजसमें जडग्री स्ट्तर पर ऄंग्रेजी माध्यम रहा हो और जहन्दी एक ऄजनिायव या िैकजल्पक जिषय के रूप म ें रहा हो या परीक्षा का माध्यम रहा हो; या दकसी मान्यताप्राप्त जिश्वजिद्यालय से हहदी या ऄग्रं ेजी से जभन्न दकसी भी जिषय में मास्ट्टर जडग्री जजसमें जडग्री स्ट्तर पर जहन्दी और ऄंग्रेजी ऄजनिायव या िैकजल्पक जिषय के रूप में रहा हो या दोनों में से कोइ एक परीक्षा का माध्यम रहा हो और दसू रा ऄजनिायव या िैकजल्पक जिषय के रूप में रहा हो; और (ii) केन्द्रीय सरकार या राज्य सरकार के कायावलय जजसके ऄंतगवत भारत सरकार के ईपक्म भी ह ै में जहन्दी से ऄग्रं ेजी ऄनुिाद म ें और जिपयवयने म ें मान्यता प्राप्त जडप्लोमा या सर्टटदिकेट कोसव या जहन्दी स े ऄग्रं ेजी ऄनुिाद और जिपयवमेन म ें दो िषव का ऄनुभि। ट्रटप्पण 1: िेतन मैट्ररक्स के स्ट्तर 6 (35400 रूपय े -112400) में ऐसे जिभागीय कजनष्ठ हहदी ऄनुिादक जजन्होंन े पांच िष व जनयजमत सेिा की ह ै और प्रजतजनयुि व्यजियों के साथ ऐस े बाह्य व्यजियों के संबंध म ें भी जिचार दकया जाएगा जजसके पास जिजहल िैक्षजणक ऄहतव ाए ं ह ै यदद ऐस े व्यजि की ईस पद पर जनयुजि के जलए चयन हो जाता ह ै तो िह पद प्रोन्नजत द्वारा भरा गया समझा जाएगा। ट्रटप्पण 2: प्रजतजनयुजि की ऄिजध जजसके ऄंतगवत केन्द्रीय सरकार के ईसी या दकसी ऄन्य संगठन या जिभाग म ें आस जनयुजि से ठीक पहल े धाट्ररत दकसी ऄन्य बाह्य पद पर प्रजतजनयुजि की ऄिजध ह ै साधारणतः तीन िषव स े ऄजधक नहीं होगी। प्रजतजनयुजि के जलए ऄजधकतम अयु सीमा अिेदन प्राप्त करन ेकी ऄंजतम तारीख को 56 िष व स ेऄजधक नहीं होगी। यदद जिभागीय प्रोन्नजत सजमजत ह,ै तो ईसकी सरं चना। भती करन ेम ेंजजन पट्ररजस्ट्थजतयों म ेंसघं लोक सिे ा अयोग स े परामि व करना ह।ै (12) (13) लाग ूनहीं होता संघ लोक सेिा अयोग से परामिव करना अिश्यक नहीं ह।ै [िा. स.ं ए.-12018/03/2016-अइएसएच-II)(पाटव.III)] दीजपका कच्छल, संयुि सजचि4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] MINISTRY OF LABOUR AND EMPLOYMENT NOTIFICATION New Delhi, the 17th April, 2023 G.S.R. 296(E).—In exercise of the power conferred by the proviso to article 309 of the constitution and in supersession of the Directorate - General of Mines Safety (Group ‘C’ and Group ‘D’ posts) Recruitment Rules, 1989, in so far as they relate to the post of Senior Hindi Translator, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment for the post of Senior Hindi Translator, in the Directorate - General of Mines Safety, Ministry of Labour and Employment, namely:- 1. Short title and commencement.- (1) These rules may be called the Ministry of Labour and Employment, Directorate - General of Mines Safety, Senior Hindi Translator (Group ‘B’ post) Recruitment Rules, 2023. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Number of post, classification and level in the pay matrix.- The number of the said post, its classification and the level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules. 3. Method of recruitment, age-limit, other qualifications, etc.- The method of recruitment, age-limit, qualifications and other matters relating thereto, shall be as specified in columns (5) to (13) of the said Schedule. 4. Disqualification.- No person,- (a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to any of the said posts: provided that if the Central Government may, if satisfied, that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule. 5. Power to relax.- Where the Central Government is of the opinion that it is necessary or expedient to do so, it may, by order, and for reasons to be recorded in writing, and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons. 6. Saving.- Nothing in these rules shall affect reservation, relaxation of age-limit and other concession required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard. (11) COMPOSITE METHOD (Deputation plus promotion) (I). Officers under the Central Government or State Government or Union Territories: (a) (i) holding analogous posts on regular basis in parent cadre or department; or (ii) with five years’ service in the grade rendered after appointment thereto on a regular basis in posts in Level 6 in the Pay Matrix (Rs.35400-112400) or equivalent in the parent cadre or department; and (b) Possessing the following educational qualifications and experience : (i) Master’s Degree of a recognized University in Hindi with English as a compulsory or elective subject or as medium of examination at degree level; Or Master’s Degree of a recognized University in English with Hindi as a compulsory or elective subject or as medium of examination at degree level; Or Master’s Degree of a recognized University in any subject other than Hindi or English with Hindi medium and English as a compulsory or elective subject or as medium of examination at degree level; Or Master’s degree of a recognized University in any subject other than Hindi or English with English medium and Hindi as a compulsory or elective subject or as medium of examination at degree level; Or Master’s degree of a recognized University in any subject other than Hindi or English, with Hindi and English as compulsory or elective subjects or either of the two as a medium of examination and the other as compulsory or elective subject at the degree level. And (ii) Recognized Diploma or Certificate Course in translation from Hindi to English and vice-versa or three years’ experience of translation work from Hindi to English and vice-versa in Central Government or State Government offices, including Government of India Undertakings. NOTE: The Departmental Junior Hindi Translator in Level 6 of pay Matrix (Rs. 35,400-1,12,400) with five years regular service and possessing the educational qualification prescribed for deputationists will also be considered alongwith outsiders in case he or she is selected for appointment to the post the same shall be deemed to have been filled by promotion. Note 2 : Period of deputation including the period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organization or department of the Central Government shall ordinarily not exceed three years.
