जनयम, 2022 ह। .
(2) ये सरकारी रािपत्र में प्रकाजिन की तारीख को लाग ूहोंगे।

2. िायुयान (जनमााण और िृक्षों आदि द्वारा काररत बाधाओं का उन्म ूलन) जनयम, 1994 म,ें —
(क) जनयम 3 के स्ट् ्ान पर, जनम्न जलजखत जनयम से प्रजतस्ट् ्ाजपत दकया िाएगा, नामत: —
“3.माजलक को अजधसचू ना की तामील और उल्ल घन ं न सबं धं ी ररपोिा प्रस्ट्त ुत करना।—(1) िहां अजधजनयम की
धारा 9क की उपधारा (1) के तहत केंीीय सरकार द्वारा कोई अजधसूचना िारी की गई ह और संबंजधत
एयरोड्रोम के प्रभारी अजधकारी के पास यह जिश् िास करने का कारण ह दक दकसी भी भिन या िृक्ष की
मदििू गी से उपयुात त अजधसूचना के प्रािधानों का उल् लंघन न हो रहा ह, तो िह अजधजनयम की धारा 9 क की
उप-धारा (3) म ें जनधााररत प्रदक्रया के अनुसार, अजधसूचना की एक प्रजत भिन या िृक्ष के माजलक को तामील
कराएगा।
(2) संबंजधत हिाई अड्डा का प्रभारी अजधकारी इस तरह के उल्लघन ं न की ररपोिा तरु ंत नागर जिमानन
महाजनिेिालय या उसके द्वारा इस संबंध में अजधकृत दकसी अजधकारी को भेिेगा।”;
(ख) जनयम के स्ट् ्ान पर, जनम्न जलजखत जनयम प्रजतस्ट् ्ाजपत दकया िाएगा, नामत: —
“4. जििरण िमा करान े के जलए आििे —(1) िहां, नागर जिमानन महाजनिेिक, या उनके द्वारा इस संबंध
में अजधकृत दकसी अजधकारी कोजनयम 3 के उप-जनयम (2) के तहत कोई ररपोिा प्राप् त होती ह, तो िह, एक
जलजखत आिेि द्वारा, ऐसे भिन या िृक्ष के माजलक को, एक जिजनर्िष्ा ि अिजध के भीतर, उस एयरोड्रोम के
प्रभारी अजधकारी के पास, िस्ट् तुजस्ट् ् जत, जिसमें भिन, या िृक्ष की अिजस्ट््जतििााई गई हो, और उसकी
लंबाई-चदडाई और आििे म ें जिजनर्िष्ा ि अन् य ब् यदरे का खलु ासा भी दकया गया हो, प्रस्ट्त ुत करने का जनिेि
िेगा।
(2) िहां, इस जनयम के उप-जनयम (1) के तहत एक आिेि िारी दकया िाता ह , माजलक आिेि में य्ा
जिजनर्िष्ा ि सूचना, और ऐसा ब् यदरा प्रस्ट् ततु करने के जलए बा य होगा।
(3) माजलक को उप-जनयम (1) के तहत आिेि की तामील, अजधजनयम की धारा 9क की उप-धारा (3) म ें
य्ा जनधााररत तरीके से की िाएगी।”;
(ग) जनयम 7 म,ें उप-जनयम (2) के बाि, जनम्न जलजखत उप-जनयम अंत: स्ट्् ाजपत िाएगा, नामत: —
“(3) कोई भी माजलक िो, अजधजनयम की धारा 9क के तहत अजधसूचना के लागू होन े की तारीख के बाि,
अजधसूचना के प्रािधानों का अनुपालन न करके दकसी भी संरचना का जनमाणा करता ह , िह उप-जनयम (2) के
तहत प्रजतपूर्ता का िािा करने का पात्र नहीं होगा।”.

New Delhi, the 25th July, 2022
G.S.R. 600(E).—The following draft of certain rules further to amend the Aircraft (Demolition of
Obstructions caused by Buildings and Trees etc.) Rules, 1994, which the Central Government proposes to
make in exercise of the powers conferred by sub-section (2) of section 11B of the Aircraft Act, 1934 (22 of
1934), is hereby published as required by section 14 of the said Act, for information of all persons likely to
be affected thereby; and notice is hereby given that the said draft rules will be taken into consideration after
a period of thirty days from the date on which copies of the Gazette of India, in which this notification is

Objections or suggestions, if any, may be addressed to the Director-General of Civil Aviation,
Opposite Safdarjung Airport, New Delhi-110003 or mailed to dgoffice.dgca@nic.in;
Any objection or suggestion which may be received from any person with respect to the said
draft rules before the expiry of the period specified above will be considered by the Central Government.
Draft Rules
1. (1) These rules may be called the Aircraft (Demolition of Obstructions caused by Buildings and
Trees etc.) (Amendment) Rules, 2022.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Aircraft (Demolition of Obstructions caused by Buildings and Trees etc.) Rules, 1994,—
(A) for rule 3, the following rule shall be substituted, namely: —
“3. Service of Notification on the owner and submission of report regarding violation.—
(1) Where any notification has been issued by the Central Government under subsection (1) of
Section 9A of the Act and the officer-in charge of the concerned aerodrome has reason to
believe that any building or tree exists in violation of the provisions of the aforesaid notification,
he shall serve a copy of the notification on the owner of the building or tree, as the case may be,
in accordance with the procedure laid down in sub-section (3) of Section 9A of the Act.
(2) The officer-in charge of the concerned aerodrome shall forthwith send a report of such
violation to the Director General of Civil Aviation, or any officer authorised by him in this
behalf.”;
(B) for rule 4, the following rule shall be substituted, namely: —
“4. Order to furnish details.— (1) Where, a report under sub-rule(2) of Rule 3 is received by
the Director General of Civil Aviation, or any officer authorised by him in this behalf, he shall,
by a written order, direct the owner of such building, or tree, to furnish to the officer-in charge
of the aerodrome, within a specified period, a plan showing the location of building, or tree, and
also disclosing the dimensions or any other details specified in the order.
(2) Where, an order is issued under sub-rule (1) of this rule, the owner shall be bound to furnish
the information, and such details, as specified in the order.
(3) An order under sub-rule (1) shall be served upon the owner in the manner as laid down in
sub-section (3) of Section 9A of the Act.”;
(C) in rule 7, after sub-rule (2), the following sub-rule shall be inserted, namely: —
“(3) Any owner who, after the date of coming into force of the notification under Section 9A of
the Act, constructs, or erects any structure in non-compliance of the provisions of the
notification shall not be eligible to claim compensation under sub-rule (2).”.
