## Report on the Aircraft Investigation of Accidents and Incidents Amendment Rules, 2022 **1. Executive Summary:** This report analyzes the Aircraft Investigation of Accidents and Incidents Amendment Rules, 2022, which amends the Aircraft Investigation of Accidents and Incidents Rules, 2017. The core purpose of these amendments, based on the provided text, is to modify procedures related to witness examination and to remove certain existing rules. Key findings include changes to the rules surrounding summoning and examining witnesses, and the removal of rules 18 and 19 from the original 2017 policy. These amendments likely aim to streamline the accident and incident investigation process. **2. Introduction:** This report aims to provide a comprehensive overview of the Aircraft Investigation of Accidents and Incidents Amendment Rules, 2022, based solely on the text provided. It will outline the amendments' purpose, key changes, and potential impacts. **3. Policy Overview:** * This policy *amends* the Aircraft Investigation of Accidents and Incidents Rules, 2017. * The core objective, inferred from the text, is to revise specific aspects of the accident and incident investigation process, specifically concerning witness testimony and the removal of certain rules. **4. Background and Rationale:** This document represents an amendment to existing rules. The rationale for this *specific amendment* appears to be refining the processes related to witness examinations during aircraft accident and incident investigations. The text suggests a focus on clarifying the powers related to summoning witnesses and gathering evidence, as well as removing some existing rules, implying these may no longer be needed or are deemed redundant. **5. Key Provisions / Changes:** This section details the changes introduced by the amendment text. * **Amendment 1: Rule 10, subrule 1:** * **Original Policy Part Being Changed:** Procedures for the investigator to call and examine witnesses. * **New Rule/Provision:** * Clause (a) of Rule 10(1) is substituted. The amendment now explicitly states the investigator has the power "to call and examine any witness relevant to the investigation, by issuing summons under his hand, and to require such witness to furnish or produce information or evidence, or to answer or returns to any inquiries he thinks fit to make." * Clause (b) of Rule 10(1) changes the word "person" to "witness". * **Difference/Effect:** The amendment clarifies the authority of the investigator to summon witnesses, emphasizing their power to compel testimony and the provision of evidence. Changing "person" to "witness" in clause (b) likely narrows the scope to only those involved directly in a witness capacity. * **Amendment 2: Rule 18:** * **Original Policy Part Being Changed:** Entire rule 18. * **New Rule/Provision:** Rule 18 is omitted. * **Difference/Effect:** This means that Rule 18 is being removed from the Aircraft Investigation of Accidents and Incidents Rules, 2017. * **Amendment 3: Rule 19:** * **Original Policy Part Being Changed:** Entire rule 19. * **New Rule/Provision:** Rule 19 is omitted. * **Difference/Effect:** This means that Rule 19 is being removed from the Aircraft Investigation of Accidents and Incidents Rules, 2017. **6. Target Audience and Stakeholders:** Based on the text, the directly affected parties are: * The Ministry of Civil Aviation. * Aircraft accident and incident investigators. * Individuals who may be called as witnesses in aircraft accident or incident investigations. * The aviation industry at large, as these rules govern the investigation process. **7. Implementation Aspects (Inferred):** * **Responsible Agency/Bodies:** The Ministry of Civil Aviation is responsible for implementing and overseeing these amendments. The Director within the Ministry (Shri Pranjol Chandra, as noted for objections) appears to play a key role. * **Timelines/Procedures:** The amendment comes into force on the date of its final publication in the Official Gazette. A thirty-day period is provided for public comment before the draft rules are finalized. Investigators must issue summons under their hand when calling and examining witnesses. **8. Expected Outcomes / Impact of Changes:** The likely intended outcomes of these specific changes are: * **Clarified Authority:** Strengthened and clarified authority for investigators to compel witness testimony. * **Streamlined Process:** The removal of Rules 18 and 19 suggest an intention to streamline or simplify the investigation process by eliminating procedures deemed unnecessary or redundant. * **Enhanced Efficiency:** By clarifying the powers of investigators and streamlining processes, the amendments likely aim to improve the efficiency and effectiveness of aircraft accident and incident investigations. **9. Conclusion:** The Aircraft Investigation of Accidents and Incidents Amendment Rules, 2022, represent targeted modifications to the existing framework for investigating aviation accidents and incidents. By clarifying the authority of investigators regarding witness testimony and removing Rules 18 and 19, these amendments aim to improve the efficiency and effectiveness of the investigation process.
