No. 05-05/2014-AED Subject: Requirements for recognition/ acceptance of Type Certificate, Restricted Type Certificate and Supplemental Type Certificate issued by a Contracting State for aeronautical product, viz. aircraft, aircraft engine and propeller. 1. Introduction: Rule 49E of ‘the Aircraft Rules 1937’ provides for recognition/ acceptance of Type Certificate (TC) or Restricted Type Certificate (RTC) issued by a Contracting State. It empowers the Director General of Civil Aviation (DGCA) to accept the TC/ RTC or any other similar document in respect of an aeronautical product, i.e. aircraft, engine, and propeller issued by a contracting state whose airworthiness requirements are at least equal to the requirements established in accordance with the national regulation contained in CAR 21. Similarly, Rule 49G of the Aircraft Rules, 1937 provides for recognition/ acceptance of Supplemental Type Certificate (STC) in respect of an aeronautical product issued by a Contracting State. The rule states that the Director General may accept STC issued by a Contracting State in respect of the aeronautical product. This CAR is issued under the provisions of Rule 3(4C), Rule 49E, 49G read in conjunction with Rule 133A of the Aircraft Rules, 1937. 2. Definition: 2.1 Aeronautical product means any civil aircraft, aircraft engine or propeller. 2.2 Airworthiness requirements means the comprehensive and detailed airworthiness codes established, adopted or accepted by DGCA for the class of aircraft, engine or propeller under consideration. 2.3 CAA means Civil Aviation Authority of a contracting state. 2.4 Contracting State means any State which is for the time being a party to the Convention on International Civil Aviation concluded at Chicago on December 7, 1944, and any amendment which may be made thereto under the provisions of Article 94 thereof. Rev. 4, XX XXX XXXX 1CIVIL AVIATION REQUIREMENTS SECTION 6 SERIES A PART II XX XXX XXXX 2.5 Operator means a person, organization or enterprise engaged in or offering to engage in aircraft operation. 2.6 Satisfactory evidence means a set of documents or activities that DGCA accepts as sufficient to show compliance with an airworthiness requirement. 2.7 Type Certificate means a document issued by a Contracting State to define the design of an aircraft, engine or propeller type and to certify that this design meets the appropriate airworthiness requirements of that State. 3. Applicability: 3.1 ICAO Annex 8 allows each Contracting State to adopt/ accept a comprehensive and detailed code established by another Contracting State. Accordingly, DGCA as an ICAO Contracting State has adopted/ accepted the airworthiness codes of FAA/EASA. DGCA shall accept the TC/RTC/STC of an aeronautical product, when the airworthiness codes of the CAA of a Contracting State issued TC/RTC/STC are harmonized with the airworthiness codes issued by FAA/ EASA viz. CS- LSA, CS 22, CS VLA, CS VLR, CS/ FAR 23, CS/ FAR 25, CS/FAR 27, CS/ FAR 29, CS31HB/FAR-31, CS-E / FAR 33, CS-34/FAR 34, CS-P/ FAR 35 and CS/ FAR 36. 3.2 However, DGCA shall validate the TC/RTC of an aeronautical product in accordance with CAR Section 6 Series ‘A’ Part I in the following cases: a) when the airworthiness codes of the CAA of a Contracting State are not harmonized with that of FAA/ EASA; or b) an Indian organization intends to manufacture an aeronautical product in India under license agreement with the licensor that is type certificated by the CAA of other Contracting State; or (c) a design organization intends to integrate an aeronautical product viz. aircraft engine and/or propeller, certified by the CAA of any Contracting State, on an aircraft for which application of TC/ RTC has been submitted to DGCA. 4. Requirements: 4.1 The application shall be submitted by the TC/RTC/STC holder as per Annexure I, II, III & IV (as applicable), to the Director, Aircraft Engineering Directorate (AED), DGCA 4.2 The application shall be forwarded through the CAA of the State of Design to the DGCA. Note: In the case of acceptance of STC, the application shall be submitted to DGCA along with an evidence that the STC applicant has intimated the CAA of the State of Design. 4.3 The operator shall not import an aeronautical product in the country, without having the Letter of Type Acceptance (LoTA) issued from DGCA. 2 Rev. 4, XX XXX XXXXCIVIL AVIATION REQUIREMENTS SECTION 6 SERIES A PART II XX XXX XXXX 4.4 The operator shall not import an aeronautical product based on earlier model accepted by DGCA if: a) there are any changes in the certification basis in the TCDS vis-à-vis earlier accepted TCDS (Revision No.) with respect to the model; or b) the TCDS has undergone revisions/ updation due to major changes in the type design including changes to approved airworthiness and operating limitations. Note: The applicant is required to submit application as per this CAR through their CAA for re-issue of LoTA with updated TCDS Revision No. to meet requirement specified in 4.4 above. 4.5 Aircraft type acceptance, shall be considered complete, only when engine and/or propeller as product, embedded in the aircraft, is also type accepted by DGCA in accordance with this CAR. 4.6 DGCA at its discretion may ask any additional information/documentation/ clarification from the TC/RTC/STC holder. 4.7 The applicant (TC/RTC/STC holder, as the case may be) shall arrange familiarization programme of adequate duration for DGCA (AED) officials, depending on the complexity, type of aeronautical product, type of design change (significant), at their facility. 4.8 The applicable fees for acceptance of TC/RTC/STC are specified in Rule 62 of The Aircraft Rules, 1937 (available in DGCA website www.dgca.gov.in) and are required to be paid online through the web portal https://bharatkosh.gov.in. 5. Issue/ Cancellation of Letter of Type Acceptance (LoTA): 5.1 Upon being satisfied, DGCA may grant LoTA (for TC/RTC/STC) w.r.to the model, which shall be communicated to the TC/RTC/STC holder, CAA of the State of Design and the operator with additional conditions, if any. 5.2 If at any point of time, the DGCA finds that there is a reasonable doubt to indicate that the safety of the aeronautical product is imperiled because of an unsafe condition developed in the aeronautical product, or that the said acceptance has been obtained based on false documents, DGCA may cancel the ‘Letter of Type Acceptance’.
