No. DGCA-27037/4/2019-AED-DGCA Subject: Type Acceptance/Recognition of Type Certificate (TC), Restricted Type Certificate (RTC) and Supplemental Type Certificate (STC) issued by Civil Aviation Authority (CAA) of ICAO Contracting State in respect of Small Airplanes, their Engines and Propellers. 1. Introduction: As a pre-requisite for issuance of Certificate of Airworthiness in accordance with Aircraft Rule 50, an aircraft must be Type Certified/Type validated/Type Accepted by DGCA. Also, every aircraft either manufactured in India or imported into India for which a Certificate of Airworthiness (C of A) required is to be issued or validated, shall conform to the acceptable design standards and be in a condition for safe operation. In accordance with provisions of Aircraft Rule 49E and 49G of ‘the Aircraft Rules- 1937’ DGCA is empowered to accept/recognize the Type Certificate (TC) or Restricted Type Certificate (RTC) and Supplemental Type Certificate (STC) respectively issued by CAA of ICAO Contracting State in respect of aeronautical products i.e. Aircraft, Engine & Propeller. For the purpose of acceptance/recognition of TC, RTC and STC, the airworthiness requirements/code shall be at par with the requirements specified in CAR 21(Certification Procedures for Aircraft and related products and parts). This CAR is issued under the proviso of Rule 133A of the Aircraft Rules 1937. This CAR lays down the detailed requirements under which TC/RTC or STC in respect of the small airplane, their engine and propeller issued by a Contracting State is recognized/ accepted by DGCA. 2. Definition: 2.1 Aeronautical product means any civil aircraft, aircraft engine and propeller. 2.2 CAA means Civil Aviation Authority of ICAO contracting state.2.3 Contracting State means any State which is for the time being a party to the Convention on International Civil Aviation concluded at Chicago on December 7, 1944, and any amendment which may be made thereto under the provisions of Article 94 thereof 2.4 Operator means a person, organization or enterprise engaged in or offering to engage in aircraft operation in India. 2.5 Small airplane means fixed wing airplanes type certificated to standards other than 14 CFR part 25. Small airplanes can reach up to 19,000 lbs maximum takeoff weight. 3. Applicability: The provisions of this CAR are applicable for recognition/ acceptance of TC/ RTC and STC issued by the Civil Aviation Authority of ICAO Contracting State in respect of Small airplanes and their engines & propellers, which will meet the airworthiness requirements/codes as specified in CAR 21.16A. 4. Requirements: 4.1 For the purpose of acceptance/recognition of TC, RTC and STC in respect of small airplanes its engines & propellers, airworthiness requirements/ codes as mentioned in para 21.16A of CAR 21 (Certification Procedures for Aircraft and Related Products and Parts) effective as on date, shall be acceptable. 4.2 For the purpose of TC, RTC and STC, acceptance/recognition in respect of small airplanes the operational capability of the airplane from high altitude airports and capability to operate at high ambient temperatures at sea level conditions shall be restricted to the operational limitations & performance specified in approved Airplane Flight Manual/Airplane Flight Manual Supplement or POH. It shall be operator’s responsibility to adhere to the limitations/restrictions as mentioned in the Letter of Type Acceptance (LoTA). 4.3 (i) The Indian operator shall not import any small airplane its engine & propeller into India, until and unless, a Letter of Type Acceptance (LoTA) for the same has been obtained from the DGCA. (ii) The Indian operator shall not import any small airplane its engine & propeller into India, without consulting DGCA for any further requirements citing the reason that, the small airplane its engine & propeller had already been type accepted/recognized in the past. (iii) The Indian operator shall be required to obtain revised/updated Letter of Type acceptance/recognition (LoTA), in case of the following circumstances:a. Type Certificate Data Sheet has undergone revisions/updation due to design changes/modifications carried out in small airplane its engines & Propellers. b. Changes/amendments in Type Certification basis including Changes/addition in Special Conditions, Equivalent Safety Findings, Exemptions and Deviations which have a bearing on TCDS. c. Changes in airplane’s airworthiness limitations, operating limitations & performance reflected in TCDS. d. Any, significant changes proposed or effected in the aeronautical products. Note: I. In case of the above as mentioned in 4.3(iii), the applicant/Type Certificate Holder is required to submit an application as per the provisions of this CAR through CAA of State of Design of the aeronautical product for revised LoTA (Letter of Type Acceptance). In this case, the fee for type acceptance shall be applicable as per Aircraft Rule 62 of Aircraft Rules 1937. II. In case the type certificate data sheet has undergone revisions/updation due to removal of typographical errors/administrative reason other than physical change then, the type certificate holder shall be required to submit the revised/updated TCDS through the CAA of State of Design without technical data to DGCA. In this case, the fee for type acceptance shall not be applicable and the applicant shall receive a letter with acknowledgement of revised TCDS from DGCA. However, LoTA in this case is not required to be issued. 4.4 Fixed wing small airplane type acceptance/recognition also requires acceptance/recognition of engine and propeller fitted to the said small airplane individually. 4.5 DGCA at its discretion may ask TC holder to comply any other requirements or seek additional information/documentation/ clarification from the TC/RTC/ STC holder in accordance with the provisions of this CAR in order to ensure safe operation of the aircraft. 4.6 The TC/RTC/ STC holder is required to provide a familiarization training for AED DGCA officials at their facility on the aeronautical product for which acceptance is being sought. The duration of the familiarization training shall be depending on the type of aeronautical product, design complexity, type of design change/modification i.e. significant/non-significant. Based on mutual agreement of both the parties. 4.7 The type certificate holder is required to forward the application through the CAA of the State of Design of the TC holder to the DGCA. The format of application for TC/RTC/STC acceptance shall be as per Annexure I, II, III & IV (as applicable) and to be submitted to the Director Aircraft Engineering Directorate (AED), DGCA, Opposite Safdarjung Airport, New Delhi 110003.4.8 When the applicant desires to have type acceptance to restricted type certificate (RTC) issued by a contracting state, the applicant may do so. However, the restriction on the aircraft on account of type certificate being not issued by the primary certification authority in respect of aircraft, engine and propeller is not acceptable. 4.9 When the applicant has submitted an application for type certification of aircraft to DGCA in accordance with CAR 21, type certification for aircraft engine and propeller unlike aircraft is not required under CAR 21, Subpart B unless the aeronautical product(s) is intended to be indigenously designed and developed. The applicant may install aircraft engine or propeller, or both as applicable onto the aircraft, of which type certificate has already been issued by either FAA or EASA and the same are type accepted by DGCA under Rule 49E of the aircraft Rules 1937. 4.10 When the particular aircraft engine and/or propeller are not type accepted by DGCA, the applicant is required to submit an application in accordance with the applicable Civil Aviation Requirements for its type recognition/type acceptance before the same are embodied onto the aircraft under type certification. 5 Issue of Letter of Type Acceptance/recognition (LoTA): After satisfactory examination of the type certification documents & completion of familiarization training, DGCA may issue LoTA (for TC/RTC/ STC) in respect of small airplane, its engine & propeller in accordance with provisions of Aircraft Rule 49E and 49G respectively with the applicable conditions and limitations. 6. Cancellation, suspension of or endorsement on Type Certificate or Restricted Type Certificate and Supplemental Type Certificate: If at any time the Director-General is satisfied that there is a reasonable doubt to indicate that the safety of the aeronautical product is imperiled because of a defect or not adhering to the conditions specified in LOTA, he may cancel, suspend or endorse the LOTA accordingly.
