No. AV 22025/32/DMS/Med SUBJECT: MEDICAL REQUIREMENTS AND EXAMINATION FOR FLIGHT CREW/ AIR TRAFFIC CONTROLLER LICENCES AND RATINGS. 1. INTRODUCTION: 1.1 Rule 39B of the Aircraft Rules, 1937 regarding Medical Standards of flight crew stipulates that no licence or rating required for any of the personnel of the aircraft shall be issued or renewed unless the applicant undergoes a medical examination with an approved medical authority and satisfies the medical standards as notified by the Director General. The validity of the medical for pilots is laid down in Rule 39 C. 1.2 Further, Rule 103 of the Aircraft Rules, 1937 stipulates that no licence or rating shall be issued or renewed unless the applicant holds a Medical Assessment issued by the Director General after undergoing a medical examination with an approved medical authority and satisfying the medical standards as specified by the Director-General for the purpose. Rule 104 of Aircraft Rules 1937 lays down the Period of validity of Licences and Medical Fitness Assessment. 1.3 This Civil Aviation Requirement specifies: a) The medical requirements in accordance with the provisions of ICAO Annex 1 and amendments, if any from time to time, for grant and renewal of various licenses and ratings. b) The procedure to be followed for the medical examinations; and c) Approved medical authorities /designated medical examiners who can conduct the medical examinations. 1.4 This CAR is issued under the provisions of Rule 133A of the Aircraft Rules, 1937. Rev. 4, 6th May 2019 1CIVIL AVIATION REQUIREMENTS SECTION 7 SERIES C PART I 12 TH OCTOBER, 2017 2. REQUIREMENTS FOR MEDICAL ASSESSMENT 2.1 An applicant for grant/renewal of a Flight Crew License/ Student Air Traffic Controller / Air Traffic Controller license shall hold a valid Medical Assessment issued by DGCA in accordance with the International Standards and Recommended Practices contained in ICAO Annex 1, Chapter 6 and the medical requirements laid down by DGCA in consultation with Director General Medical Services (Air) who is the advisor to DGCA on the matters concerning Civil Aviation. Medical Information Circular (MIC) issued by DGMS (Air) shall be issued as Aeronautical Information Circular (AIC) by DGCA. When the issue of AIC is awaited, the medical examiner shall carry out the assessment of an applicant as specified in the MIC. 2.2 The applicant for a Medical Assessment shall undergo a medical examination based on the following requirements: a) Physical and Mental; b) Visual and colour perception; and c) Hearing. The Physical, Visual, Colour Perception and Hearing requirements as laid down in paras 6.2.2, 6.2.3, 6.2.4 and 6.2.5 of Chapter 6 of ICAO, Annex 1, shall be followed for all Classes of Medical Assessment 2.3 The applicant for any class of Medical Assessment shall be free from: a) Any abnormality, congenital or acquired; or b) Any active, latent, acute or chronic disability; or c) Any wound, injury or sequelae from operation; or d) Any effect or side-effect of any prescribed or non-prescribed therapeutic, diagnostic or preventive medication taken; such as shall entail a degree of functional incapacity which is likely to interfere with the safe operation of an aircraft or with the safe performance of duties. Rev. 4, 6th May 2019 2CIVIL AVIATION REQUIREMENTS SECTION 7 SERIES C PART I 12 TH OCTOBER, 2017 2.4 An applicant is required to hold a particular class of applicable Medical Assessment as given below: 2.4.1 Class 1 Medical Assessment (a) Class 1 Medical Assessment is required for applicants and holders of: i) Commercial Pilot’s License (Aeroplane & Helicopter); ii) Airline Transport Pilot’s License (Aeroplane & Helicopter); iii) Private Pilot’s License (Aeroplane and Helicopter) where Instrument Rating (Aeroplane and Helicopter) privileges are required. (b) The Standards and Recommended Practices relating to: i) Physical and Mental requirements; ii) Visual requirements; and iii) Hearing requirements As contained in paras 6.3.2, 6.3.3 and 6.3.4 of ICAO Annex 1 respectively, shall be followed for issuance of Class 1 Medical Assessment. In addition, the requirements contained in AICs (Medical) displayed on DGCA Website shall also be complied with. 2.4.2 Class 2 Medical Assessment a) Class 2 Medical Assessment is required for applicants and holders of: i) Private Pilot’s License (Aeroplane & Helicopter); ii) Pilot’s Licence (Microlight); iii) Student Pilot’s License (Aeroplane); iv) Student Pilot’s License (Helicopter); v) Student Pilot’s Licence (Glider); vi) Student Pilot’s Licence (Balloons); Rev. 4, 6th May 2019 3CIVIL AVIATION REQUIREMENTS SECTION 7 SERIES C PART I 12 TH OCTOBER, 2017 vii) Student Pilot’s Licence (Microlight); viii) Flight Radio Telephone Operator’s Licence; ix) Flight Radio Telephone Operator’s Licence (Restricted). b) The Standards and Recommended Practices relating to: i) Physical and Mental requirements; ii) Visual requirements; and iii) Hearing requirements As contained in paras 6.4.2, 6.4.3 and 6.4.4 of ICAO Annex 1 respectively, shall be followed for issuance of Class 2 Medical Assessment. In addition, the requirements contained in AICs (Medical) displayed on DGCA website shall also be complied with. 2.4.3 Class 3 Medical Assessment a) Class 3 Medical Assessment is required for applicant and holders of: i) Student ATCO License ii) ATCO License b) The Standards and Recommended Practices relating to: i) Physical and Mental requirements; ii) Visual requirements; and iii) Hearing requirements As contained in paras 6.5.2, 6.5.3 and 6.5.4 of ICAO Annex 1 respectively, shall be followed for issuance of Class 3 Medical Assessment. In addition, the requirements contained in AICs (Medical) displayed on DGCA Website shall also be complied with. 2.5 No flight crew shall exercise privileges of a licence/rating, unless he/she holds a valid Medical Certificate/Assessment of appropriate class. While exercising the Rev. 4, 6th May 2019 4CIVIL AVIATION REQUIREMENTS SECTION 7 TH SERIES C PART I 12 OCTOBER, 2017 privilege of a licence, it is mandatory for the flight crew to carry along with the licence their Medical Assessment issued by DGCA in the format as per Appendix ‘A’. When the Medical Assessment from DGCA is awaited, the flight crew shall carry along with the license the medical certificate (CA35) issued by the medical examination centres listed under para 3.1. However, in case of Post Temporary Unfit Review cases, the aircrew will only fly after issuance of a Fit Medical Assessment by the DGCA (Appendix ‘A’). 2.6 No ATCO shall exercise privileges of a licence/ rating, unless he/she holds a valid Class 3 Medical Assessment. When the Medical Assessment from DGCA is awaited, the ATCO shall be in possession of medical certificate issued by the designated medical examiner (CA 35) exercising privileges of his/her licence/ratings. However, in case of Post Temporary Unfit Review cases, the ATCO will exercise the privileges of a license / rating only after issuance of a Fit Medical Assessment by the DGCA. 3. In-flight incapacitation shall be fully evaluated at Special Medical Examination Centres specified in Para 3.1.1 (e). During medical evaluation, areas of increased medical risk shall be identified and addressed as case to case basis. 3.2 Class 2 Medical Examination 3.2.1 The following can carry out Class 2 medical examinations (both initial and renewal): a) All DGCA empanelled Class 1 medical examiners. b) All DGCA empanelled Class 2 Medical Examiners having a minimum of MBBS qualification and registered with the Medical Council of India and who have received the approved training in Aviation Medicine at IAM, Bangalore 3.3 Class 3 Medical Examination 3.3.1 Initial Class 3 medical examination will be carried out by DGCA empanelled Class 1 medical examiners. 3.3.2 Renewal Class 3 medical examination will be carried out by DGCA empanelled Class 3 Medical examiners. It includes Class 1 & Class 2 (more than 3 years of experience) Medical examiners. 3.3.3 For a period of unfitness more than 20 days the following procedure will be followed: a) The ATCO/Student ATCO will forward all relevant investigations by email to the Authorized Medical Attendant (AMA) of AAI who is a qualified Aviation Medicine Specialist. Rev. 4, 6th May 2019 7CIVIL AVIATION REQUIREMENTS SECTION 7 TH SERIES C PART I 12 OCTOBER, 2017 b) A decision on to where to conduct the medical (IAF Boarding Centre/ one of Class 3 Medical Examiners) will be jointly taken by DMS (CA) DGCA Medical Directorate and the Aviation Medicine Specialist of AAI. c) The ATCO will report to the concerned centre/Class 3 Medical Examiner for medical examination as conveyed to him/ her. 3.3.4 In case of pregnancy, a holder of Student Air Traffic Controller’s Licence/ Air Traffic Controller’s Licence who knows or has reason to believe that she is pregnant, shall not exercise the privileges of the licence and inform ATS In- charge of concerned ATC Centre/Airport. She shall consult the AMA, AAI whether she is fit to exercise privileges her licence . 3.3.5 The holder of the licence shall submit the medical report from her gynaecologist to the Authorised Medical Attendant, AAI at the earliest to enable him/ her to make the assessment on medical fitness. 3.3.6 In case of student air traffic controllers/air traffic controllers with a low- risk uncomplicated pregnancy, the fitness assessment should be limited to the period until the end of the 34th week of gestation. 3.3.7 Post delivery in following conditions, the concerned Student Air Traffic Controller/ Air Traffic Controller may obtain fitness report from gynaecologist and request for an appointment with DGCA empanelled Class 3 Medical Examiner for special medical examination and subsequently, to obtain fitness from DMS (CA) before exercising the privileges of her licence :. (i) Following termination of pregnancy: The Student Air Traffic Controller/ Air Traffic Controller is not permitted to exercise the privileges of her ratings until declared medically fit by DMS (CA), DGCA. (ii) Spontaneous/induced abortion without any sequelae: Such Student Air Traffic Controller/Air Traffic Controller remain medically unfit for 4 weeks and then follow the procedures as given above. (iii) In case of Caesarean delivery or any other complication, she will remain unfit until she recovers completely, then follow the procedures as given above. Role of AMA, AAI: The AMA, who is a Qualified Aviation Medical Specialist of AAI will be taking decision on fitness in cases of sickness or hospitalisation upto 20 days as well as in pregnancy cases, at the time of initial declaration of her pregnancy and later fitness after normal delivery. 4. REQUIREMENTS FOR MEDICAL EXAMINATION (For Medical Examiners) 4.1 The medical examiners, who have received training in Aviation Medicine, including the President of the Board of the aforesaid medical centres are authorized to conduct the medical examinations for fitness of applicants for issue or renewal of licences or ratings specified in Rule 38 of the Aircraft Rules, 1937. The President of the Board shall coordinate the results of all examiners and shall submit a final report, under his/her signature to the DGCA for issue of medical assessment. However, he/she shall give a medical certificate of fitness or otherwise to the applicant on form CA 35 on completion of the medical examination. For more details please refer CAR Section 7 Series C Part IIII on Empanelment of Class 1 Medical Examiner for conduct of Class 1 Medical Examination and CAR Section 7 Series C Part IV on Empanelment of Medical Examiner for Conduct of Class 2 Medical Examination. For Applicant 4.2 As a first step, the applicant for medical examination should make a request for appointment for medical examination directly to the DGCA Empanelled medical examiners and civil medical centres. Appointment for Air Force Medical Centres shall be through Centralized Appointment procedure. 4.3 Prior to the examination at IAF centres, the applicants are required to pay the following fee on Portal/ link https://bharatkosh.gov.in. Category Licence type Amount Class 1 Initial issue of License 3000/- Renewal of License 2000/- Class 2 / Initial issue of License 1000/- Class 3 Renewal of License 500/- Rev. 4, 6th May 2019 9CIVIL AVIATION REQUIREMENTS SECTION 7 TH SERIES C PART I 12 OCTOBER, 2017 4.4 Applicants for issue of Student Pilot Licence may need to obtain a Cockpit Test Report from the Chief Flying Instructor/ Flight Instructor/ Assistant Flight Instructor of the Flying Club/ Institute and Instructor of the Gliding Club he/she proposes to join only if it is felt necessary by the designated medical examiner and the requirement is endorsed on the CA 34/ 34A. 4.5 Applicants shall sign and furnish to the medical examiner a declaration: a) whether they have previously undergone such an examination and, if so, with what result; b) any period of sickness, injury, surgical procedure since the last medical examination; c) Whether they are taking any drug or are on medication. 4.6 Any false declaration to a medical examiner made by an applicant shall amount to ‘False Declaration’ and will be considered a serious lapse. This shall be reported by the Examiner to DGCA for appropriate penal action within one week by email. 5 Procedure for Conduct of Medical Examination 5.1 The validity of the medical shall be: (a) Class 1 One year up to 60 years, six monthly thereafter. For single crew operations, validity is six months above 40 years of age. (b) Class 2 2 years up to the age of 50 years, yearly thereafter (c) Class 3 Upto 40 years - 4 years Above 40 years up to 50 years - 2 years Above 50 years - One year 5.2 Prior to conduct of a renewal medical examination, the examiner must first review the previous Medical Assessment to determine the instructions issued by the DGCA Medical Assessor for the next medical examination. 5.3 All applicants for a Class 1, 2 & 3 medical examination shall undergo medical investigations for the Initial/ Renewal/ Review Medical Examination as specified by DGCA from time to time. For Class 1 & 2 these are listed in FCL Circular No. 01 of 2017 Rev. 4, 6th May 2019 10CIVIL AVIATION REQUIREMENTS SECTION 7 TH SERIES C PART I 12 OCTOBER, 2017 5.4 The medical examination shall be carried out as per relevant DGCA policies and ICAO guidelines 5.5 Forms used for Flight Crew and ATCO a) Form CA 34 shall be used in case of medical examination for initial issue of medical assessment and Form 34A for renewal of medical assessment. Examiners shall use only DGCA approved Medical Examination forms (CA- 34/34A/35) available on DGCA website for conduct of Medical Examination. The Medical Examination forms are to be downloaded and printed by the Medical Examiners and filled by hand. b) The Medical Board/Examiners shall also fill up Form CA 35, a copy of which shall be given to the flight crew/ATCO/candidate. c) The Medical Examiner/ Centre undertaking a Class 1, 2 and 3 medical examination shall submit a written report of medical examination in Form CA 34/ 34A as applicable under his/her signature with a seal indicating his/her qualifications and registration number with name of State Medical Council in bracket. d) The medical records along with copies of CA 34/34A and CA 35 shall be forwarded to DGCA Headquarters by Speed/ Registered post for issue of medical assessment at the following address. Kind Attn: DMS (CA) Medical Directorate Directorate General of Civil Aviation, Opposite Safdarjung Airport, New Delhi – 110 003. 6. Issuance of Medical Assessment by DGCA 6.1 The medical assessor at DGCA shall evaluate and approve the medical reports for issue of medical assessment. The medical assessor is post graduate in Aviation Medicine from Indian Air Force, who is qualified and experienced in practice of Aviation Medicine, competent in evaluating and assessing medical conditions. 6.2 The final medical assessment shall not be issued in medical conditions ‘Likely’ to occur, which in context of the medical provisions of ICAO Annexure 1 Chapter 6 means “with a probability of occurring that is unacceptable to the medical assessor”. The date of medical assessment issued by the Office of DGCA shall be reckoned from the date of medical Rev. 4, 6th May 2019 11CIVIL AVIATION REQUIREMENTS SECTION 7 TH SERIES C PART I 12 OCTOBER, 2017 examination (CA-35). Permission for Review of medical assessment of flight crew before due date but no more than 30 days before it expires shall be given by the office of DGCA only (Refer Rule 39C). Permission for review of medical assessment of controllers before due date but no more than 45 days before it expires shall be given by the office of DGCA only. 6.3 The aeromedical disposition of the applicant shall be indicated as follows: a) Fit b) Fit with Limitations c) Temporary unfit d) Permanent unfit 6.4 If the medical Standards prescribed in Chapter 6 of ICAO Annex 1 and those laid down by DGCA, for a particular licence/rating are not met, the medical assessment shall not be issued or renewed unless the following conditions are fulfilled: a) Accredited medical conclusion indicates that under special circumstances the applicant’s failure to meet any requirement, whether numerical or otherwise, is such that exercise of the privileges of the licence applied for is not likely to jeopardize flight safety; b) Relevant ability, skill and experience of the applicant and operational conditions have been given due consideration; and c) The licence is endorsed with any special limitation or limitations when the safe performance of the licence holder’s duties is dependent on compliance with such limitation or limitations. 6.5 In the medical assessment for aircrew the following limitations shall be imposed on the aircrew depending upon their medical conditions, if deemed necessary:- a) ‘Fit to fly as Co-Pilot only’ b) ‘Fit to fly as Pilot-in-Command along with a Qualified Experienced Pilot’. 6.6 Where the medical certificate of fitness issued by a Medical Boarding Centre or the medical assessment issued by DGCA carries the restriction as mentioned in para 6.5 above, the term “Experienced Pilot” shall mean a pilot who: Rev. 4, 6th May 2019 12CIVIL AVIATION REQUIREMENTS SECTION 7 TH SERIES C PART I 12 OCTOBER, 2017 a) has no restrictions due to medical conditions; b) has a current Pilot-in-Command rating on type of aircraft; or a Co-pilot meeting the following criteria: i) has a minimum of 250 hours of experience on type and currently flying the type of the aircraft; ii) has not been held blameworthy for any incident on type during the preceding two years for his/her proficiency in operating that type; iii) has not been held blameworthy for any accident on any aircraft for his/her proficiency in operating an aircraft in the preceding five years; iv) has not shown ‘Below Standard’ performance during proficiency check and/or instrument rating check during preceding two years; and v) has a suitability certificate issued after suitability check on aircraft/simulator, by an examiner on type indicating that the co-pilot is fit for handling the aircraft, especially during take-off/ and landing. 6.7 In addition to limitations, the aircrew is advised recommendations in the medical assessment. The list of common recommendations is enclosed in the Appendix ‘C’. The recommendations contains only pertinent medical Information for follow up by the aircrew and for oversight by the licensing authority. 6.8 No pilot/ATCO shall carry out any flying/ATCO duties if he/she has been declared unfit on the basis of medical examination (CA-35) till he/she receives the satisfactory final assessment issued by the Office of DGCA. 6.9 Medical confidentiality shall be respected at all times by DGCA empanelled medical examiners. All medical reports and records shall be securely held with accessibility restricted to authorized personnel. Rev. 4, 6th May 2019 13CIVIL AVIATION REQUIREMENTS SECTION 7 TH SERIES C PART I 12 OCTOBER, 2017 7 PROCEDURE FOR APPEAL MEDICAL EXAMINATION 7.1 All Aircrew declared Temporary Unfit are to be reviewed at AFCME, IAM, MEC (East), CHAF ‘B’, 11 AFH after the period of unfitness is over. ATCO declared Temporary Unfit are to be reviewed by either a Class 1 medical examiner or at IAF Boarding Centre on a case to case basis, depending upon merits of each case, as decided by DMS (CA)/ JDMS (CA) at Medical Directorate, DGCA. 7.2 Permanent unfitness of a licence holder shall be recommended by the Medical Board at AFCME, IAM, MEC (E), CHAF‘B’, 11 AFH only after thorough evaluation by specialists and after relevant specialized investigations. The approval for declaring an aircrew permanently unfit is by DGMS (Air). For ATCO’s, same procedure shall be followed as laid down in para 7.1 above. 7.3 In the event of an aircrew/ ATCO being declared temporarily medically unfit for more than three months at a stretch or in aggregate or permanently unfit for issue or renewal of the licence, the applicant may appeal to the DGCA for a review of the medical assessment within a period of 90 days from the date of applicant having been declared permanently unfit. The appeal shall be addressed to the Kind Attn. DMS (CA), Medical Directorate, Directorate General of Civil Aviation, Opposite Safdarjung Airport, New Delhi – 110 003. 7.4 The appeal in the above cases shall be forwarded by either registered post/ Speed Post or courier services or may be delivered in person to the Receipt & Dispatch Section in the office of DGCA and receipt for the same can be obtained. The appeal must be accompanied by the following documents: a) All documents in original obtained by the applicant from reputed medical institutions/specialists clearly certifying the fitness status and cause of unfitness as stated in the medical assessment issued by the office of DGCA. The medical practitioner/specialist certifying the fitness in such a case should give sound reasons justifying his/ her opinion. b) Reports of the medical examination and results of investigations, in original, conducted by the medical practitioner/specialist giving the aforesaid certificate. Rev. 4, 6th May 2019 14CIVIL AVIATION REQUIREMENTS SECTION 7 TH SERIES C PART I 12 OCTOBER, 2017 7.5 The appeal shall be considered by DGCA, and if found justified, it shall be referred to the DGMS (Air). If adequate medical evidence is provided for medical review, DGMS (Air) may grant an appeal/review medical examination at Air Force Appellate Centres and may also ask for any such investigation/report or opinion of any specialist to determine the fitness of the applicant. In case the appeal for medical review is not found justified, DGMS (Air) has the right to reject it. 7.6 If the medical review is accepted, it shall be carried out at the centre specified for the purpose. However for Permanently Unfit cases, it shall not be done at the centre where the first examination was conducted and where the applicant was declared unfit.
