और उक्त अजधसूचना की प्रजतयां, 07 नवंबर, 2022 को जनसाधारण को उपलब्ध करा दी गई थीं ; और उक्त प्रारूप जनयमों के संबंध म ें जनसाधारण स े प्राप्त आक्षपे या सुझावों पर केंद्रीय सरकार द्वारा जवचार कर जलया गया ह ै ; अत:, अब, केंद्रीय सरकार, कीटनािी अजधजनयम, 1968 (1968 का 46) की धारा 36 द्वारा प्रदत्त िजक्तयों का प्रयोग करते हुए, कीटनािी जनयम, 1971 का और संिोधन करने के जलए जनम्नजलजखत जनयम बनाती ह,ै अथाचत् :-- 1. संजक्षप्त नाम और प्रारंभ- (1) इन जनयमों का संजक्षप्त नाम कीटनािी (दसू रा संिोधन) जनयम, 2023 ह ै। (2) ये राजपत्र में उनके प्रकािन की तारीख को प्रवृत्त होंगे । 1945 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 2. कीटनािी जनयम, 1971 (जजसे इसमें इसके पश् चात् मलू जनयम कहा गया ह)ै म,ें जनयम 19 के उपजनयम (1) म,ें -- (क) खडं (i) म,ें -- (i) ‘‘अन् यथा कजथत के जसवाय’’ िब् दों का लोप ककया जाएगा ; (ii) उपखडं (क) म,ें ‘‘ब्ांड नाम साधारण नाम स े 1.5 गुणा आकार से बडे आकार का नहीं होगा’’ िब् दों के स्ट् थान पर, ‘‘समान प्रमुख ब्ांड नाम और साधारण नाम में कदए जाएंग’े’ िब् द रख ेजाएंग े; (iii) उपखंड (ब) म,ें पहले परंतकु के पश् चात ् जन‍न जलजखत परंतुक अतं :स्ट्थ ाजपत ककया जाएगा, अथाचत् :-- ‘‘परंतु क्य आू र कोड समुजचत स्ट्थ ान पर खुदरा पैक (प्राथजमक या जद्वतीय पैक, जैसी भी जस्ट् थजत हो) के ऐसे स्ट्थ ान पर रखा जाएगा जहा ं क्य ूआर कोड स्ट् कैनिंगनग उपकरण जैसे मोबाइल नोन से स्ट्कैन करन े पर, वेबनिंगलक या निंगलक जवजनमाचता कंपनी के यूआरएल खोलन े के जलए प्रदर्शित होगा, जजस पर जक्लक करन े से उपयोगकताच लबे ल और पची की संपणू च जवजिष्ट सूचना प्राप् त करेगा और क्य आू र कोड म ेंकम से कम जन‍न जलजखत सूचना अंतर्शवष्ट होगी: (क) जवजिष्ट पहचानकताच या जीटीआईएन ; (ख) बैच संख या ; (ग) जवजनमाचण की तारीख ; (घ) अवसान की तारीख ; (ङ) वेब निंगलक या यूआरएल । (iv) टटप् पण – 2 में जन‍न जलजखत उपबंध अंत:स्ट्थ ाजपत ककए जाएगं ,े अथाचत ्:-- ‘‘जपक्ट ोग्रामाम का आकार केवल अल् रा स्ट् माल पैक के लेबल के संबंध में आधा वग च सेंटीमीटर (0.5 सेमी X 0.5 सेमी) होगा ’’। (ख) खडं (ii) म,ें ‘‘अन् यथा कजथत के जसवाय’’ िब् दों का लोप ककया जाएगा । (ग) खडं (iii) के उपखडं (क) म,ें जन‍न जलजखत परंतुक अतं :स्ट् थाजपत ककया जाएगा, अथाचत् :-- ‘‘परंतु अल् रा स्ट् माल पैक के जलए बहुसंख यक प्राथजमक पैक एक जद्वतीय पैक म ें पैक ककये जा सकेंग े और जवजनमाचता सुजनजश् चत करेगा कक एक जद्वतीय पैक म ें पैक करन े से पहल े प्र‍ येक प्राथजमक पैक के साथ पची और क्य ूआर कोड सुरजक्षत रूप से सलं ग् न कर कदया गया ह ै।’’ 3. उक्त जनयम म,ें उपजनयम (3) के पश् चात ् जन‍न जलजखत परंतुक अतं :स्ट्थ ाजपत ककया जाएगा, अथाचत् :-- ‘‘परंतु अल् रा स्ट् माल पैक के जलए उक्त वगच का आयाम 2.25 वग चसेंटीमीटर (1.5 सेमी x 1.5 समे ी) से कम नहीं होगा’’ । 4. उपजनयम (3) के पश् चात ् जन‍ नजलजखत स्ट्प ष्ट ीकरण अंत:स्ट्थ ाजपत ककया जाएगा, अथातच ् :-- ‘‘स्ट्प ष्ट ीकरण: उपजनयम (1) और उपजनयम (3) के प्रयोजन के जलए यह स्ट् पष्ट ककया जाता ह ैकक,- (i) कोई भी पंजीकरण प्रमाणपत्र धारक ककसी ऐस े लेबल या पची , जो कीटनािी (दसू रा ससं ोधन) जनयम, 2023 के उपबंधों के अनुसार न हो, का उपयोग, कीटनािी (दसू रा संसोधन) जनयम के प्रवत्त होने की तारीख से छह माह के पश्चात नहीं करेगा । (ii) ऐसे लेबल या पची लग े ककसी कीटनािक या इसका पैकेज जोकक कीटनािी (दसू रा संसोधन) जनयम, 2023 के अनुसार न हो, जनयम के प्रवत्त होने की तारीख से दो विच या उसके अवसान की तारीख जो भी पहले हो, की समाजप्त के पश्चात, जवतटरत, बेचें जबक्री अथवा भण्डारण हते ू प्रदर्शित नहीं ककया जायेगा, और जब तक अन्यथा जनदेि न कदया जाए, उक्त अवजध की समाजप्त के बाद यह स्ट्पष्टीकरण अजस्ट्त‍व म ेंनहीं रहगे ा। [ना. सं. 13035/33/2019-पीपी-I] आिीि कुमार श्रीवास्ट्तव, संयुक्त सजचव (पीपी) टटप्पण : मलू जनयम, भारत के राजपत्र, असाधारण, भाग II, खंड 3, उपखंड (i) में संखयांक सा.का.जन. 1650(अ), तारीख 19 अक्तूबर, 1971 द्वारा प्रकाजित ककए गए थ े और सा.का.जन. संखयांक 140 (अ), तारीख 28 नरवरी, 2023 द्वारा संिोजधत ककए गए थ े।[भाग II—खण् ड 3(i)] भारत का राजपत्र : असाधारण 3 MINISTRY OF AGRICULTURE AND FARMERS WELFARE (Department of Agriculture and Farmers Welfare) NOTIFICATION New Delhi, the 17th March, 2023 G.S.R. 211(E).—Whereas the draft rules further to amend the Insecticides Rules, 1971, was published, as required by section 36 of the Insecticides Act, 1968 (46 of 1968) vide notification of the Government of India in the Ministry of Agriculture and Farmers Welfare (Department of Agriculture and Farmers Welfare) number G.S.R. 806 (E), dated the 27th October, 2022, in the Gazette of India, Extraordinary, Part-II, section-3, sub-section (i), inviting objections or suggestions from all persons likely to be affected thereby, before the expiry of a period of thirty days from the date on which the copies of the Gazette of India in which the said notification was published were made available to the public; And whereas, copies of the said notification were made available to the public on 07th November, 2022; And whereas, objections or suggestions received from the public in respect of the said draft rules have been considered by the Central Government; Now, therefore, in exercise of the powers conferred by section 36 of the Insecticides Act, 1968 (46 of 1968), the Central Government hereby makes the following rules further to amend the Insecticides Rules, 1971, namely :- 1. Short title and commencement: (1) These Rules may be called the Insecticides (Second Amendment) Rules, 2023. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Insecticides rules, 1971 (hereinafter referred as the said rules), in sub-rule (1) of rule 19,- (a) in clause (i),- (i) the words “unless stated otherwise” shall be omitted. (ii) in sub-clause (a) , for the bracket and words “(The Brand name shall not be of bigger size than 1.5 times size of common name)” the words “Equal prominence shall be given to the Brand name and Common name” shall be substituted. (iii) in sub-clause (w) , after the first proviso, following proviso shall be inserted: “Provided that QR Code shall be placed on retail pack (Primary or Secondary pack as the case may be) at suitable place where on scanning the QR code by scanning equipment like mobile phone, a web link or link for opening the URL of the Manufacturing company will appear, which on pressing or clicking, will take the user to the entire unique information of label and leaflet and the QR code shall contain at least the following information: (a) Unique Identifier or GTIN; (b) Batch Number; (c) Date of Manufacturing; (d) Date of Expiry; (e) Web link or URL. (iv) in Note II, the following provisio shall be inserted, namely:- “provided that the size of pictograms shall be half- square centimeter (0.5 cm x 0.5 cm) in respect of labels of ultra-small packs only”. (b) in clause (ii), the word “unless stated otherwise” shall be omitted. (c ) in clause (iii), in sub-clause (a), the following proviso shall be inserted, namely:- “Provided that for ultra-small packs, multiple primary packs may be packed in one secondary pack and the manufacturer shall ensure leaflet and QR code be securely attached with each primary pack before packing them in one secondary pack.” 3. In the said rules, after sub-rule (3), following proviso shall be inserted: “Provided that for ultra-small packs, the dimensions of the said square shall be not less than 2.25 square centimeters (1.5cm x1.5 cm).”4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 4. After sub-rule (3), the following Explanation shall be inserted, namely:- Explanation: For the purposes sub-rule (1) and sub-rule (3), it is hereby clarified that,- (i) no registration certificate holder shall use a label or leaflet, which is not in accordance with the provisions of the Insecticides (Second Amendment) Rules, 2023, after a period of six months from the date of commencement of the Insecticides (Second Amendment) Rules, 2023. (ii) no insecticides or its package bearing a label or leaflet, which is not in accordance with the provisions of the Insecticides (Second Amendment) Rules, 2023, shall be distributed, sold, exhibited for sale or stocked, after expiry of two years from the date of commencement of the Insecticides (Second Amendment) Rules, 2023 or its expiry date, whichever is earlier and this explanation shall cease to exist after expiry of the said period, unless otherwise directed.
