(vii) संजविा कमडकार, उपिान संिाय अजधजनयम, 1972 (1972 का 39) के उपबंधों के अधीन आएगं ;े और (viii) संजविा कमडकारों को खान अजधजनयम, 1952 (1952 का 35) के उपबंधों के अनुसार मििरू ी सजहत बोनस और छुट्टी िी िाएगी । [फा. सं. एस.-16012/05/2021-एल.डब्लल्य.ू(बी)] आलोक चरं ा, वररष्ठ श्रम और रोिगार सलाहकार MINISTRY OF LABOUR AND EMPLOYMENT NOTIFICATION New Delhi, the 2nd November, 2022 S.O. 5101(E).—In exercise of the powers conferred by section 31 of the Contract Labour (Regulation and Abolition) Act, 1970(37 of 1970), the Central Government, after consultation with the Central Advisory Contract Labour Board, hereby exempts the raising of coal, coal loading and unloading and overburden removal and earth cutting in the National Aluminium Company Limited (NALCO), Angul, Bhubaneswar from the applicability of notification of the Government of India in the erstwhile Ministry of Labour number S.O. 2063, dated the 21st June, 1988, published in the Gazette of India, Part II, section 3, sub-section (ii), in respect of employment of contract labour in the works specified in the Schedule to the said notification against serial numbers 1 to 3, for a period of five years with effect from the date of publication of this notification in the Official Gazette subject to the following conditions, namely:- (i) the interest of the workmen engaged in the above mentioned works be protected; (ii) such workmen be paid wages and other benefits as per the recommendations of the High Powered Committee appointed by the Coal India Limited, Ministry of Coal, Government of India and the rates notified by the Coal India Limited from time to time; (iii) the Central Advisory Contract Labour Board shall have the right to inspect the establishment to ensure and check whether such wages and benefits are given to such workers in the National Aluminium Company Limited (NALCO), Angul, Bhubaneswar; (iv) the Management of the National Aluminium Company Limited (NALCO), Angul, Bhubaneswar shall ensure that whenever there is a change of contract, the existing contract workmen who are working may be given preference in employment by the incoming contractor, subject to satisfactory performance of duties; (v) the workmen working in jobs ancillary or incidental to coal mining works specified against serial numbers 1 to 3 except raising-cum-selling of coal of the Schedule to the said notification number S.O. 2063, dated the 21st June, 1988shall get wages as determined by the High Powered Committee appointed by the Coal India Limited, Ministry of Coal, Government of India and the rates notified by the Coal India Limited from time to time;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 (vi) the contractor, as well as the Principal Employer, shall ensure payment of the said High Powered Committee wages, which increases every six months, and also other benefits as per the provisions of the Mines Act, 1952 (35 of 1952);
