## Policy Analysis Report: Fertilizer (Inorganic, Organic or Mixed) Control Second Amendment Order, 2025 **1. Executive Summary:** This report analyzes the "Fertilizer (Inorganic, Organic or Mixed) Control Second Amendment Order, 2025" based solely on the provided official government text. This amendment modifies the existing "Fertilizer (Inorganic, Organic or Mixed) Control Order, 1985." The key changes involve biostimulant manufacturing/importing regulations and an extension of a deadline related to Form G3. The amendment provides a temporary allowance for the continued manufacture/import of biostimulants lacking specified standards, contingent on applying for provisional registration. Furthermore, it extends a deadline mentioned in Form G3 from February 22, 2025, to June 16, 2025. This report aims to inform affected parties about the specifics of these amendments and their potential impact. **2. Introduction:** This report provides an analysis of the "Fertilizer (Inorganic, Organic or Mixed) Control Second Amendment Order, 2025," utilizing only the text of the order itself. The purpose is to inform stakeholders about the details of this amendment to the "Fertilizer (Inorganic, Organic or Mixed) Control Order, 1985," focusing on its key provisions, implications, and implementation aspects as revealed within the document. **3. Policy Overview:** * This order amends the "Fertilizer (Inorganic, Organic or Mixed) Control Order, 1985." * The core objective, as inferred from the text, is to regulate the manufacture, import, sale, and distribution of fertilizers (inorganic, organic, or mixed) and biostimulants, while also addressing specific concerns and deadlines related to these processes. **4. Background and Rationale:** The amendment appears to address two distinct issues: * **Biostimulant Regulation:** The amendment suggests a need to regulate biostimulants, specifically addressing situations where standards are not yet specified. The allowance for continued manufacture/import conditional on registration implies a transition period towards standardized biostimulant regulation. * **Form G3 Deadline:** The extension of the deadline in Form G3 suggests that the original February 22, 2025, date was either insufficient or required adjustment due to unforeseen circumstances. **5. Key Provisions / Changes:** This amendment introduces the following key changes: * **Amendment to Clause 20C (Biostimulants):** * **Original Policy (Implied):** Clause 20C likely contained regulations regarding biostimulant manufacturing and importing. * **New Rule/Provision:** Subclause 4 is replaced, allowing manufacturers/importers of biostimulants (without specified standards) to continue their activities for three months from March 18, 2025 (date of publication), provided they apply for provisional registration. * **Difference/Effect:** This provides a grace period for biostimulant manufacturers/importers without established standards, allowing them to continue operations while seeking provisional registration. This suggests a move towards formalizing standards and registration for biostimulants. * **Amendment to Form G3:** * **Original Policy:** Form G3 previously referenced a deadline of "22nd day of February 2025". * **New Rule/Provision:** The deadline in Form G3 is changed to "16th day of June 2025". * **Difference/Effect:** This extends the deadline in Form G3 by approximately four months, likely granting affected parties additional time to comply with related requirements. **6. Target Audience and Stakeholders:** Based on the text, the directly affected stakeholders include: * Manufacturers and importers of inorganic, organic, and mixed fertilizers. * Specifically, manufacturers and importers of biostimulants, particularly those whose products currently lack specified standards. * Individuals or entities required to use Form G3 for processes related to fertilizer regulation. **7. Implementation Aspects (Inferred):** * **Responsible Agency/Bodies:** The "Ministry of Agriculture and Farmers Welfare, Department of Agriculture and Farmers Welfare" is responsible for implementing and enforcing this order. * **Timelines/Procedures:** * Biostimulant manufacturers/importers have three months from the date of publication (March 18, 2025) to apply for provisional registration to continue their activities. * The deadline in Form G3 is now June 16, 2025. * **Amendment-Specific Aspects:** The provisional registration process for biostimulants without standards is a key implementation aspect directly resulting from this amendment. **8. Expected Outcomes / Impact of Changes:** * **Biostimulant Changes:** * Likely intended outcome: To facilitate a smoother transition towards regulated biostimulant manufacturing and importing by allowing companies time to comply with new registration requirements without immediate disruption. * Potential Impact: Increased formalization and standardization of biostimulant products. Could potentially lead to increased compliance costs for manufacturers. * **Form G3 Changes:** * Likely intended outcome: To provide affected parties with more time to meet the requirements associated with Form G3. * Potential Impact: Reduced burden on those required to complete Form G3, potentially preventing disruptions caused by the original deadline. **9. Conclusion:** The "Fertilizer (Inorganic, Organic or Mixed) Control Second Amendment Order, 2025" introduces important changes to the regulation of fertilizers and biostimulants. It aims to facilitate the inclusion of biostimulants under existing regulations while providing a grace period for manufacturers and importers to adapt. The extension of the Form G3 deadline also suggests an intent to ease the compliance burden on relevant stakeholders. These amendments reflect an ongoing effort to refine and update the regulatory framework governing the fertilizer industry. Understanding these changes is crucial for stakeholders to ensure continued compliance and adapt their business practices accordingly.
