## Report on the Fertiliser Inorganic, Organic or Mixed Control Fifth Amendment Order, 2022 **1. Executive Summary:** This report analyzes the Fertiliser Inorganic, Organic or Mixed Control Fifth Amendment Order, 2022, based on the official government notification. This amendment modifies the Fertiliser Inorganic, Organic or Mixed Control Order, 1985. Key changes include extending specific timeframes related to clause 20C and Form G3 of the principal order. These amendments likely affect the validity and reporting requirements for specific authorizations or approvals related to fertilizers. **2. Introduction:** This report provides an overview of the Fertiliser Inorganic, Organic or Mixed Control Fifth Amendment Order, 2022, as published in the Gazette of India. The analysis is based solely on the provided text of the notification and aims to inform the affected industry about the specific changes introduced. **3. Policy Overview:** This document is an *amendment* to the Fertiliser Inorganic, Organic or Mixed Control Order, 1985. The core objective of the *original* order, as inferred from the amendment's context, is to regulate the control of inorganic, organic, or mixed fertilizers. **4. Background and Rationale:** The provided text focuses on specific amendments to the 1985 Order. The extension of timelines within clause 20C and Form G3 suggests that the original durations were found to be insufficient or that the government is aiming for a more aligned and longer-term approach. The specific reasons for these extensions cannot be definitively determined from the text alone, but it is plausible that the industry requested or required more time for compliance or reporting, or that the government seeks to streamline these processes over a longer period. **5. Key Provisions / Changes:** This amendment introduces the following specific changes: * **Amendment to Clause 20C:** * **Original Policy Part Being Changed:** Clause 20C of the Fertiliser Inorganic, Organic or Mixed Control Order, 1985. * **New Rule/Provision:** * Subclause 4: The phrase "two years" is replaced with "three years." * Subclause 5: The date "30th September, 2022" is replaced with "31st March, 2023." * **Difference/Effect:** * The change in subclause 4 extends a duration from two years to three years. This implies an extension of the validity period or timeframe associated with the specific provision governed by subclause 4 within clause 20C. * The change in subclause 5 extends a deadline from September 30, 2022, to March 31, 2023. This pushes back the deadline for whatever action or process is governed by subclause 5 within clause 20C. * **Amendment to Form G3:** * **Original Policy Part Being Changed:** Form G3 of the Principal Order. * **New Rule/Provision:** The date "upto 22nd day of February, 2023" is replaced with "upto 22nd day of February, 2024". * **Difference/Effect:** This change extends the period applicable to the area marked after item 5 in Form G3 by one year, from February 22, 2023, to February 22, 2024. This likely pertains to a period of validity or a reporting deadline related to the information requested in Form G3. **6. Target Audience and Stakeholders:** Based on the text and the nature of the Fertiliser Control Order, the direct target audience includes: * Fertilizer manufacturers * Fertilizer dealers * Any entity involved in the production, sale, and distribution of inorganic, organic, or mixed fertilizers. * Entities required to use Form G3. **7. Implementation Aspects (Inferred):** * **Responsible Agency/Bodies:** The Department of Agriculture and Farmers Welfare, under the Ministry of Agriculture and Farmers Welfare, is responsible for implementing and overseeing the amended order. * **Timelines:** The amendment came into force on the date of its publication in the Official Gazette (September 30, 2022). It introduces new deadlines and validity periods as specified in Section 5. * **Specific to Changes:** Affected entities must adjust their practices and documentation to reflect the extended timelines detailed in the amended Clause 20C and Form G3. **8. Expected Outcomes / Impact of Changes:** The likely intended outcomes of these specific changes include: * **Extended Validity/Deadlines:** Allowing affected parties more time to comply with requirements related to clause 20C and Form G3. * **Potentially Reduced Administrative Burden (Short-Term):** Postponing deadlines might temporarily reduce the immediate administrative workload for both the industry and the regulatory bodies. * **Possible Harmonization:** Extending the duration to 3 years in clause 20C may be indicative of standardization across different areas within the control order. **9. Conclusion:** The Fertiliser Inorganic, Organic or Mixed Control Fifth Amendment Order, 2022, introduces targeted changes to the 1985 order, specifically extending timelines associated with clause 20C and Form G3. These amendments offer stakeholders additional time for compliance and reporting, potentially streamlining processes and aligning them for the future. The changes are significant for the fertilizer industry and warrant careful attention to ensure adherence to the updated regulations.
