प्रारूप जनयम
1. संजक्षि नाम और प्रारंभ:- (1) इन जनयमों का संजक्षि नाम कीटनािी संिोधन जनयम, 2022 ह।ै
(2) यह राजपत्र म ेंइनके अंजतम प्रकािन की तारीख को प्रवत्तृ होंगे।

परन्द्त ु यह कक कोई भी व्यजि इन जनयमों के प्रवृत्त होने की तारीख स े छह माह की समाजि के पश्चात ् ककसी ऐस े लेबल या
पत्रक का उपयोग नहीं करेगा जो इन जनयमों के अनुसार संिोजधत नहीं ककय े गय ेह:ैं
परंत ु यह भी कक ऐस े लेबल या पत्रक लगे ककसी कीटनािक या इसका पैकेज जो इन जनयमों के अनुसार संिोजधत नहीं ककए
गए ह,ैं इन जनयमों के प्रवृत्त होने की तारीख स े एक वि ष की समाजि के पश्चात जबक्री अथवा भंडारण हते ु जवतररत, बेचे,
प्रदर्तित नहीं ककया जाएगा ।
2. कीटनािी जनयम, 1971 (जजसे इसम ें इसके पश्चात ्उि जनयम कहा गया ह)ै के जनयम 19 के उपजनयम (1) म,ें-
(क) खडं (i) म,ें -
(1) उपखंड (क) म,ें कोष्ठक के बाद, िब्द "ब्ांड नाम सामान्द्य नाम के 1.5 गुना आकार स े बडा नहीं होना चाजहए" िब्दों के
साथ प्रजतस्ट्थाजपत ककया जाएगा "ब्ांड नाम और सामान्द्य नाम को समान महत्व कदया जाएगा" ।
(2) उपखंड (ब) म,ें पहले परंतकु के बाद, जनम्नजलजखत परंतुक अंत:स्ट्थाजपत ककया जाएगा:
"परन्द्तु यह कक क्यूआर कोड को खुदरा पैक (प्राथजमक या जद्वतीयक जैसा भी मामला हो) पर उपयुि स्ट्थान पर लगाया जा
सकता ह ै जहा ं मोबाइल फोन जैसे उपकरणों स े क्यूआर कोड को स्ट्कैन करन े पर मैन्द्युफैक्चररग कंपनी का एक वेब ललक या
यूआरएल खोलन े के जलए ललक कदखाई देगा, जजसे दबाने/जक्लक करने पर उपयोगकता ष को लबे ल और पत्रक की पूरी अनूठी
जानकारी जमल जाएगी। क्यूआर कोड म ें कम स े कम जनम्नजलजखत जानकारी होनी चाजहए:
(क) जवजिष्ट पहचानकता ष या जीटीआईएन
(ख) बैच संख्या
(ग) जनमाषण की तारीख
(घ) समाजि की तारीख
(ड) वेब ललक/यूआरएल
(3) रटप्पण II म:ें तीसरे अनुच्छेद की दसू री पंजि म ें "जचत्र जलजप होगी" िब्दों के बाद, जनम्नजलजखत िब्द डाले जाएंगे "
परन्द्तु यह कक केवल अजत लघु पैक के लेबल के संबंध म ें जचत्र जलजप का आकार आधा वगष सेंटीमीटर (0.5 सेमी x 0.5 सेमी)
हो”।
(ख) खडं (i) और (ii) म,ें "जब तक अन्द्यथा न कहा गया हो" िब्द हटा कदया जाएगा ।
(ग) खडं (iii) म,ें उपखंड (अ) म,ें जनम्नजलजखत परंतुक डाला जाएगा:
“परन्द्तु यह कक अजत लघु पैकेज के जलए, एक जद्वतीयक पैक म ें कई प्राथजमक पैकककग पैक ककए जा सकते ह ैं और जनमाषता यह
सुजनजश्चत करेगा कक प्रत्येक प्राथजमक पैक को एक जद्वतीयक पैक म ें पैक करन े स े पहले पत्रक और क्यूआर कोड को प्रत्येक
प्राथजमक पैक पर सरु जक्षत रूप से संलग्न ककया जाएगा।”
3. जनयम 19 के, उपजनयम (3) म,ें जनम्नजलजखत परंतुक अतं :स्ट्थाजपत ककया जाएगा:

NOTIFICATION
New Delhi, the 27th October, 2022
G.S.R. 806(E).—The following draft rules further to amend the Insecticides Rules, 1971, which the Central
Government proposes to make in exercise of the powers conferred by section 36 of the Insecticides Act, 1968 (46 of
1968), is hereby published, as required by the said section, for information of all persons likely to be affected
thereby; and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of thirty
days from the date on which the copies of this notification as published in the Gazette of India are made available to
the public;
The objections or suggestions which may be received from any person in respect of the said draft rules before
the expiry of the aforesaid period of thirty days will be considered by the Central Government;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
Objections and suggestions in respect to the said draft rules may be forwarded to the Joint Secretary (Plant
Protection), Ministry of Agriculture and Farmers Welfare, Department of Agriculture and Farmers Welfare, Krishi
Bhawan, New Delhi-110001 or through email at jspp-dac@gov.in.
DRAFT RULES
1. Short Title and Commencement. - (1) These rule may be called the Insecticides (Amendment) Rules, 2022.
(2) They shall come into force on the date of their final publication in the Official Gazette.
Provided that no person shall use a label or leaflet that has not been amended in accordance with these rules after
the expiry of six months from the date of coming into force of these rules:
Provided also that no insecticide or its package bearing a label or leaflet that has not been amended in accordance
with these rules shall be distributed, sold, exhibited for sale or stocked, after the expiry of one year from the date
of coming into force of these rules.
2. In the Insecticides Rules, 1971 (hereinafter referred as the said rules) in sub-rule (1) of rule 19,-
(a) in clause (i),-
(1) in sub-clause (a) , after the bracket , the words “The Brand name shall not be of bigger size than 1.5 times size
of common name” shall be substituted with the words “ Equal prominence shall be given to the Brand name and
Common name”.
(2) in sub-clause (w) , after the first proviso, following proviso shall be inserted:
“Provided that QR Code can be placed on retail pack (Primary or Secondary as the case may be) at suitable place
where on scanning the QR code by scanning equipments like mobile phones, a web link or link for opening the URL
of the Manufacturing company will appear, on pressing /clicking of which, will take the user to the entire unique
information of label and leaflet. The QR code shall contain at least the following information:
(a) Unique Identifier or GTIN
(b) Batch Number
(c) Date of Manufacturing
(d) Date of Expiry
(e) Web link/URL
(3) in Note II : in the second line of third para after the words “minimum size”, following words shall
be inserted “provided that the size of pictograms shall be half- square centimeter (0.5 cm x 0.5 cm) in respect
of labels of ultra-small packs only”.
(b) in Clause (i) and (ii), the word “unless stated otherwise” shall be deleted.
(c ) in clause (iii), in sub-clause (a), following proviso shall be inserted:
Provided that for ultra-small packs, multiple primary packs may be packed in one secondary pack and the
manufacturer shall ensure leaflet and QR code shall be securely attached with each primary pack before packing them
in one secondary pack.
3. In sub-rule (3) of rule 19, following proviso shall be inserted:
Provided that for ultra-small packs, the dimensions of the said square shall be of dimensions not less than 2.25 square
centimeters (1.5cm x1.5 cm).
