And whereas, copies of the said notification were made available to the public on 29th September, 2021; And whereas, objections or suggestions received from the public in respect of the said draft rules have been considered by the Central Government; Now, therefore, in exercise of the powers conferred by section 36 of the Insecticides Act, 1968 (46 of 1968), the Central Government hereby makes the following rules further to amend the Insecticides Rules, 1971, namely :-4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 1. Short title and Commencement: (1) These Rules may be called the Insecticides (Second Amendment) Rules, 2022. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Insecticides Rules, 1971 (hereinafter referred to as the said rules), in rule 9, in sub-rule (3), after clause (iii), the following proviso shall be inserted, namely:- “Provided that the licensing officer shall inspect the manufacturing premises within six months from the date of endorsement of additional insecticide on license to satisfy itself that necessary plant and machinery, safety devices and first aid facilities and the like, exist in the premises where insecticide is proposed to be manufactured.”; 3. In the said rules, after rule 10D, the following rule shall be inserted, namely:- “10(E) Sale of Insecticides through e-commerce entity A licensee, during the currency of license, may undertake sale of any insecticide through e-commerce entity for supply of insecticides to the door step of the farmers and the licensee shall comply with the provisions of the Act and the rules made there under for the time being in force: Provided that the operators of e-commerce entity before engaging the licensee for sale of insecticide through online portal, shall verify the validity of the licence issued by the concerned Licensing Officer of the State: Provided further that the operators of e-commerce entity and licensee shall comply with the provisions of the Consumer Protection (E-commerce) Rules, 2020 notified in the Gazette of India vide G.S.R No. 462(E) dated 23rd July, 2020 and further subsequent amendments (if any).” 4. In the said rules, in rule 10, in sub-rule 3A, in clause (iii), after words a “graduate in Agriculture or Science”, the words “or in Life Science” shall be inserted. [F. No. 13035/10/2021-PP-I] DR.
