## Policy Analysis Report: Plant Quarantine Regulation of Import into India Seventh Amendment Order, 2022 **1. Executive Summary:** This report analyzes the "Plant Quarantine Regulation of Import into India Seventh Amendment Order, 2022" based on the provided official notification. This amendment modifies the Plant Quarantine Regulation of Import into India Order, 2003, specifically concerning the import of Pome fruits, particularly *Malus domestica* (Apple). The key change involves adding specific pest and disease requirements and associated treatments for apples originating from Japan to be considered free of certain pests before import into India. The report details these new provisions, their potential impact on apple imports, and relevant stakeholders. **2. Introduction:** This report aims to provide information and analysis of the "Plant Quarantine Regulation of Import into India Seventh Amendment Order, 2022" based solely on the text of the official government notification. It focuses on the changes introduced to the Plant Quarantine Regulation of Import into India Order, 2003, and their potential implications. **3. Policy Overview:** * **Original Policy Being Amended:** The Plant Quarantine Regulation of Import into India Order, 2003. * **Core Objective(s):** Based on the provided text, the core objective of the original policy, and by extension this amendment, is to prevent the introduction and spread of destructive insects, pests, and diseases into India through the regulation of plant and plant product imports. This is achieved by specifying conditions and treatments required for imported goods. **4. Background and Rationale:** This is an amendment to an existing order. The likely reason for *this specific amendment* is to update the import regulations for apples (*Malus domestica*) from Japan, adding specific pest and disease concerns and establishing treatment requirements. This suggests that new pest risks or revised risk assessments related to Japanese apples have been identified, necessitating these changes to safeguard Indian agriculture. The amendment appears to address a perceived gap or inadequacy in the existing quarantine regulations concerning these specific pests and diseases found in or near Japanese apple orchards. **5. Key Provisions / Changes:** This amendment focuses on changes to Schedule VI of the Plant Quarantine Regulation of Import into India Order, 2003. Specifically, it modifies the entry for Pome fruits regarding *Malus domestica* (Apple), fresh fruits for consumption. The amendment *adds* the following requirements for apples from Japan: * **Specific Part of Original Policy Changed:** Schedule VI, relating to Pome fruits, specifically concerning *Malus domestica* (Apple) and fresh fruits for consumption, serial number 262. * **New Rule/Provision:** Apples must be free from a list of specified insects, mites, fungi, and bacteria (listed below), along with specified treatments: * **Insects/Mites:** * Adoxophyes orana (Summer fruit tortrix) - Methyl Bromide fumigation 32 gm3 for 2 hrs at 21oC or above at NAP or equivalent. * Amphitetranychus viennensis (Hawthorn Spider mite) - Preshipment cold treatment at 0oC or below for 13 days; 0.55oC or below for 14 days; 1.1oC or below for 18 days plus intransit refrigeration. * Byturus tomentosus (Raspberry beetle) * Carposina sasakii (Peach fruit moth) * Chaetocnema confinis (Flea beetle) * Grapholita inopinata (Manchurian fruit moth) * Grapholita molesta (Oriental fruit moth) * Harmonia axyridis (Harlequin ladybird) * Hoplocampa (Apple saw fly) * Pandemis heparana (Apple brown totrix) * Peridroma saucia (Pearly underwing moth) * Pseudococcus comstocki (Comstock mealybug) * **Fungi:** * Botryosphaeria berengriana f.sp.pyricola (Physalospora Canker) * Gymnosporangium yamadae (Japanese apple rust) * Monilia polystroma (Asiatic brown rot) * Phytophthora cryptogea (tomato foot rot) * Phytophthora megasperma (Root rot) * **Bacteria:** * Pseudomonas viridiflava (Bacterial leaf blight of tomato) * **Difference/Effect of the Change:** This amendment adds a new layer of scrutiny for apple imports from Japan. Previously, the import requirements may not have specifically addressed these particular pests and diseases. The new requirements necessitate specific treatments (like fumigation or cold treatment) and certification, potentially adding costs and logistical complexity for importers. **6. Target Audience and Stakeholders:** Based on the provided text, the primary target audience and stakeholders affected by this amendment are: * **Apple importers in India:** They will need to comply with the new requirements for apples sourced from Japan. * **Apple exporters in Japan:** They will need to ensure their apples meet the new Indian import standards, including treatment and certification requirements. * **Indian plant quarantine authorities:** Responsible for enforcing the amended regulations and inspecting apple imports. * **Indian farmers and agricultural sector:** Ultimately, they are the beneficiaries of this policy, which aims to protect domestic crops from foreign pests and diseases. **7. Implementation Aspects (Inferred):** * **Responsible Agency/Bodies:** The Department of Agriculture, Cooperation and Farmers Welfare and plant quarantine authorities (implied) are responsible for implementing this order. * **Timelines or Procedures:** The order comes into force on the date of its publication in the Official Gazette (November 21, 2022). The amendment also mandates that the treatment should be endorsed on the Phytosanitary certificate issued at the country of origin/re-export, indicating a pre-shipment verification and certification process. * **Amendment-Specific Implementation:** The implementation of these changes will require Indian quarantine officials to specifically check for the listed pests and diseases and verify the corresponding treatments as documented on the phytosanitary certificate. **8. Expected Outcomes / Impact of Changes:** The likely intended outcome *of these specific changes* is to reduce the risk of introducing the specified pests and diseases into India through apple imports from Japan. This amendment aims to protect the Indian agricultural sector, particularly apple production, from potential economic losses and environmental damage caused by these invasive species. The impact of the changes could include: * Increased costs and logistical challenges for apple importers from Japan due to treatment and certification requirements. * Potential shifts in sourcing apples from other countries with less stringent requirements (if applicable). * Reduced risk of introduction and establishment of the listed pests and diseases in India. * Enhanced biosecurity and protection of the Indian agricultural sector. **9. Conclusion:** The "Plant Quarantine Regulation of Import into India Seventh Amendment Order, 2022" represents a targeted effort to update and strengthen plant quarantine measures, specifically concerning apple imports from Japan. By incorporating specific pest and disease requirements and associated treatments, this amendment aims to minimize the risk of introducing harmful organisms into India. This will likely impact apple importers and exporters and provide a higher degree of biosecurity for the Indian agricultural sector.
