और, उि अजधसूचना की प्रजतयां 5 फरवरी 2024 को आम िनता को उपलजध करा िी गई थीं; और, उि प्रारूप जनयमों पर आम िनता स े प्राप्त आक्षेपों और सुझावों पर सरकार द्वारा सम्यक रूप से जवचार कर जलया गया ह;ै 4884 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] अतः अब, केन्द्र सरकार कृजि उपि (श्रेणीकरण और जचह्रनाकं न) अजधजनयम, 1937 (1937 का 1) की धारा 3 द्वारा प्रित्त िजियों का प्रयोग करते हुए, फल एवं सजजियााँ श्रणे ीकरण और जचहनांकन जनयम, 2004 म ें संिोधन करने के जलए जनम्नजलजखत जनयम बनाती ह,ै अथागत:- 1. सजं क्षप्त नाम और प्रारंभ-(1) इन जनयमों का संजक्षप्त नाम फल एवं सजजियााँ श्रेणीकरण और जचहनांकन (संिोधन) जनयम, 2024 ह ै। (2) य ेभारत के रािपत्र में उनके अंजतम प्रकािन की तारीख से प्रवृत्त होंगे । 2. फल एव ं सजजिया ाँ श्रेणीकरण और जचहनांकन जनयम, 2004 (जिन्द्ह ें इसके बाि उि जनयमों के रूप म ें संिर्भगत ककया िाएगा) म,ें जनयम 8 के स्ट्थान पर, जनम्नजलजखत जनयम को प्रजतस्ट्थाजपत ककया िाएगा, अथागत्:- “8 (1) फल एवं सजजियों के घरेल ू व्यापार के मामल े में यह खाद्य सुरक्षा और मानक अजधजनयम, 2006 (2006 का 34) म ें जवजनर्िगष्ट धात ु संििू क, कीटनािक अविेि, सूक्ष्मिीव अपेक्षाओं, फसल संििू कों, प्राकृजतक रूप से पाए िान े वाल े जविैल े पिाथों के अवजिष्ट स्ट्तर से संबजं धत प्रजतबंधों तथा अन्द्य खाद्य सुरक्षा अपक्षे ाओं का अनपु ालन करेगा। (2) फल एवं सजजियों के जनयागत के मामले में यह कोडेक्स एजलमेंटेररयस आयोग द्वारा जनधागररत भारी धातओंु और कीटनािकों की अवजिष्ट सीमाओं तथा अन्द्य खाद्य सुरक्षा मापिंडों अथवा आयातकताग ििे की अपेक्षाओं का अनुपालन करेगा।” 3. उि जनयमों म,ें अनुसूची II के स्ट्थान पर, जनम्नजलजखत अनसु ूची प्रजतस्ट्थाजपत की िाएगी, अथागत:् - “अनसु चू ी –II (मलू जनयम का जनयम 4 िेख)ें टेबल अगं रू का श्रणे ी अजभधान और उसकी गणु वत्ता 1. टेबल अगं रू सीधे मानव उपभोग के प्रयोिनाथग, वाइरटस जवनीफेरा एल. की ककस्ट्म (ककस्ट्मों) से प्राप्त फल होंग े। 2. न्द्य नू तम अपक्षे ाए ं:- (i) टेबल अगं रू के गच्ु छे एवं फल में जनम्न अपेक्षाएं होंगी: (क) साफ, ठोस, ककसी भी िश्ृ यमान जविातीय पिाथग स ेमुि होगा; (ख) उपि के सामान्द्य स्ट्वरूप को प्रभाजवत करन े वाले कीटों से मुि होगा; (ग) कीटों या बीमाररयों से होन े वाले नुकसान से मुि होगा; (घ) असामान्द्य बाहरी नमी से मुि होगा; (ङ) ककसी भी जविातीय गधं या स्ट्वाि से मिु होगा; (च) िश्ृ यमान फफूंि से मिु होगा; (छ) उच् च या जनम्न तापमान से होने वाले नुकसान से मुक्त होगा। (ii) फल साबुत, सगु रठत और सामान्द्यत: पररपक्क होंगे। (iii) टेबल अंगरू म ेंन्द्यनू तम घुलनिील ठोस पिाथ गसोलह जडग्री जिक्स होने चाजहए। (iv) टेबल अंगरू म ेंन्द्यूनतम िकगरा-अम्ल अनुपात 18:1 होना चाजहए। 3. टेबल अगं रू के श्रेणी अजभधान के जलए मापिडं : श्रेणी अजभधान के मापिडं नीच ेताजलका ए में किए गए ह ैंऔर आकार से संबंजधत प्रावधान ताजलका बी में किए गए ह:ैं[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 ताजलका ए श्रेणी अजभधान श्रेणी अपेक्षाएं आकार संबंधी प्रावधान श्रेणी सहनीयता (1) (2) (3) (4) उत्कृष्ट श्रेणी (i) अंगरू उत्तम गुणवत्ता के होन े ताजलका बी के अनुसार गुच्छों के विन के चाजहए। गुच्छों का अनुसार 5% तक ग्रेड आकार, जवकास और रंग की अपेक्षाओं के अनुरूप ककस्ट्म की जविेिता के नहीं हो सकते हैं, अनुरूप होना चाजहए और लेककन श्रेणी-I ग्रेड की उनमें कोई िोि नहीं होना अपेक्षा को पूरा करता चाजहए। हो या असाधारण रूप (ii) फल ठोस, डंठल स े मिबूती से उस ग्रेड की से िुडे हुए, डंठल पर सहनीयता के अंतगगत समान िरू ी पर और हो। स्ट्पष्टत: ताज़ े होन े चाजहए। श्रेणी-I (i) अंगरू अच्छी गुणवत्ता का -वही- गुच्छों के विन के होना चाजहए। गुच्छों का अनुसार 10% तक ग्रेड आकार, जवकास और रंग की अपेक्षाओं के अनुरूप ककस्ट्म की जविेिता के नहीं हो सकते ह,ैं लेककन अनुरूप होना चाजहए। श्रेणी II ग्रेड की अपेक्षा (ii) फल ठोस, डंठल स े मिबूती को पूरा करता हो या से िुडे हुए और िहां तक असाधारण रूप से उस संभव हो ताज़े होने ग्रेड की सहनीयता के चाजहए। अंतगगत हो। (iii) हालााँकक, वे उत्कृष्ट श्रेणी की तुलना में डंठल पर कम समान िरू ी पर हो सकत े ह।ैं (iv) जनम्नजलजखत मामूली खाजमयााँ हो सकती ह,ैं बित े ये उत्पाि के सामान्द्य आकार और पैकेि की गणु वत्ता को प्रभाजवत न करें: (क) आकार म ें मामूली खराबी, (ख) रंग म ेंमामूली खराबी श्रेणी -II (i) गुच्छों में आकार, जवकास -वही- गुच्छों के विन के और रंग में िोि किखाई ि े जहसाब स े 10% और ग्रेड की अपेक्षाओं के सकते ह,ैं बित े य े ककस्ट्म अनुरूप हो तथा की अजनवायग जविेिताओं न्द्यूनतम अपेक्षाओं को को प्रभाजवत नहीं करें। पूरा करता हो । (ii) फल पयागप्त रूप स े ठोस और डंठल से िडु े होन े चाजहए।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (iii) वे श्रेणी-I ग्रेड की तलु ना म ें डंठल पर कम समान िरू ी पर हो सकत े ह।ैं (iv) जनम्नजलजखत िोि हो सकत े ह,ैं बित े ये उत्पाि के सामान्द्य आकार और पैकेि की गणु वत्ता को प्रभाजवत न करें: (क) आकार म ेंिोि, (ख) रंग में िोि (ग) सूरि की गमी स े हल्की झुलसन जिससे केवल जछलका प्रभाजवत हो, (घ) हल्की चोट, (ङ) जछलके म ें मामूली िोि ताजलका बी आकार से संबंजधत प्रावधान आकार का जनधारग ण गुच्छों के विन (ग्राम में) स े होता ह ैऔर प्रजत गुच्छा जनम्नजलजखत न्द्यूनतम (ग्राम में) अपेक्षाए ं जनधागररत की गई ह:ैं- श्रेणी बडे फल छोटे फल उत्कृष्ट श्रेणी 200 150 श्रेणी -I 150 100 श्रेणी –II 100 75 आकार सहनीयता: (i) उत्कृष्ट श्रेणी, श्रणे ी I,श्रेणी II: गुच्छों के विन के जहसाब से 10% तक ग्रेड की आकार अपेक्षाओं के अनुरूप नहीं हो सकते ह,ैं लेककन तत्काल नीचे वाल ेग्रेड के जलए आकार की अपेक्षाओं को पूरा करता हो। (ii) एक ककलोग्राम स े अनजधक िुद्ध विन वाले पैकेिों के जलए, 150 ग्राम से कम विन वाल े एक गच्ु छे को विन समायोजित करने की अनुमजत ह,ै बिते कक गुच्छा जनर्िष्टग ग्रडे की अन्द्य सभी अपेक्षाओं को परू ा करता हो। िोनों ताजलकाओं के प्रयोिन के जलए स्ट्पष्टीकरण: धूप के कारण हुए जपगमेंटेिन को िोि नहीं माना िाएगा। 4.अन्द्य अपेक्षाएं:- (i) अंगरू ों को सावधानी स े चुना िाना चाजहए और व े ककस्ट्म या वाजणजययक प्रकार और जिस क्षेत्र म ें व े उगाए गए हैं, उसके मानिंडों के अनुसार जवकास और पररपक्वता की उजचत जस्ट्थजत प्राप्त कर चुके हों। अंगरू ों का जवकास और जस्ट्थजत ऐसी होनी चाजहए कक वह : (क) यातायात और हडैं ललगं का सामना कर सके; और[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 (ख) जिसे अपन ेगतं व्य स्ट्थान पर संतोििनक ढगं से पहुचं ाया िा सके। (ii) एक ककलोग्राम स े अनजधक के िुद्ध विन वाल े उपभोिा पैकेि म ें जवजभन्न ककस्ट्मों के टेबल अंगरू ों का जमश्रण हो सकता ह,ै बिते व ेजनर्िगष्ट ग्रडे की अन्द्य सभी अपेक्षाओं को परू ा करें।” [फा. स.ं -क्य-ू 11047/05/एफ &वी/2023-मानक] फैज़ अहमि ककिवई, अपर सजचव (जवपणन) नोट –मूल जनयम भारत के रािपत्र भाग-II, खंड-3, उप-खंड (i) म ें किनांक 26 िून, 2004 को अजधसूचना संख्या िी.एस.आर. 220 द्वारा प्रकाजित ककए गए थे और अंजतम बार किनांक 10 नवंबर, 2016 को अजधसूचना सख्ं या िी.एस.आर. 1059(अ) द्वारा संिोजधत ककए गए थे। MINISTRY OF AGRICULTURE AND FARMERS WELFARE (Department of Agriculture and Farmers Welfare) NOTIFICATION New Delhi the 5th August, 2024 G.S.R. 480(E).—Whereas, the draft rules further to amend the Fruits and Vegetables Grading and Marking Rules, 2004, were published, as required under section 3 of the Agricultural Produce (Grading and Marking) Act, 1937 (1 of 1937), vide notification of the Government of India in the Ministry of Agriculture and Farmers Welfare notification number G.S.R. 99(E), dated the 5th February, 2024, in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), inviting objections and suggestions from all persons likely to be affected thereby within forty-five days from the date on which copies of the said notification published in the Gazette of India, were made available to the public; And whereas, copies of the said notification were made available to the public on 5th February, 2024; And whereas, the objections and suggestions received from the public in respect of the said draft rules have been duly considered by the Government; Now, therefore, in exercise of the powers conferred by sub-section (1) of section 3 of the Agricultural Produce (Grading and Marking) Act, 1937 (1 of 1937), the Central Government hereby makes the following rules, further to amend the Fruits and Vegetables Grading and Marking Rules, 2004, namely:- 1. Short title and commencement.-(1) These rules may be called the Fruits and Vegetables Grading and Marking (Amendment) Rules, 2024. (2) They shall come into force on the date of their final publication in the Gazette of India. 2. In the Fruits and Vegetables Grading and Marking Rules, 2004 (hereinafter referred to as the said rules) for rule 8, the following rule shall be substituted, namely:- “8 (1) The fruits and vegetables for domestic trade, shall comply with the restrictions in regard to residual levels of metal contaminants, pesticide residues, microbial requirements, crop contaminants, naturally occurring toxic substances and other food safety requirements as specified under the regulations made under the Food Safety and Standards Act, 2006 (34 of 2006). (2) The fruits and vegetables for export trade, shall comply with the residual limits of heavy metals, pesticides and other food safety requirements as laid down by the Codex Alimentarius Commission or importing countries requirement for export.”6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 3. In the said rules, for Schedule-II, the following Schedule shall be substituted, namely:– “SCHEDULE–II (see rule 4 of principal rules) Grade designation and quality of Table Grapes 1. Table grapes shall be fruits obtained from varieties (cultivars) of Vitis vinifera L. which are intended for direct human consumption. 2. Minimum requirements:- (i) Bunches and berries of Table grapes shall be: (a) clean, sound, free from any visible foreign matter; (b) free from pests, affecting the general appearance of the produce; (c) free from damage caused by pests or diseases; (d) free from abnormal external moisture; (e) free from any foreign smell or taste; (f) free from all visible traces of moulds; (g) free from damage caused by high or low temperature. (ii) Berries shall be intact, well formed and normally developed. (iii) Table grapes shall have minimum soluble solids of sixteen degrees brix. (iv) Table grapes shall have minimum sugar-acid ratio of 18:1. 3. (ii) For packages not exceeding one kilogram net weight, one bunch weighing less than 150 gram is allowed to adjust the weight, provided, the bunch meets all other requirements of the specified grade. Explanation for the purpose of both the tables: Pigmentation caused by the sun shall not be treated as a defect. 4. Other requirements:- (i) The grapes must have been carefully picked and have reached an appropriate degree of development and ripeness in accordance with criteria proper to the variety or commercial type and to the area in which they are grown and the development and condition of the grapes must be such as to enable them; (a) to withstand transport and handling; and (b) to arrive in satisfactory condition at the place of destination.8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ii) The consumer packages of net weight not exceeding one kilogram may contain mixture of table grapes of different varieties, provided they shall meet all other requirements of the specified grade.” [F.
