L.-33004/99 सी.जी.-एच.आर.-अ.-06022024-251830 CG-HxRx-xEG-I0D6H0x2x2x0 24-251830 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (i) PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 90] नई किल्ली, सोमवार, फरवरी 5, 2024/माघ 16, 1945 No. 90] NEW DELHI, MONDAY, FEBRUARY 5, 2024/MAGHA 16, 1945 कृजि एव ंककसान कल्याण मत्रं ालय (कृजि एव ं ककसान कल्याण जवभाग) अजधसचू ना नई किल्ली, 5 फरवरी, 2024 सा.का.जन. 99(अ).—फल एवं सजजियां श्रेणीकरण और जचहनांकन (संिोधन) जनयम, 2024 का जनम्नजलजखत प्रारूप, जिसे केन्द्रीय सरकार द्वारा कृजि उपि (श्रणे ीकरण और जचहनांकन) अजधजनयम, 1937 (1937 का 1) की धारा 3 के तहत प्रित्त िजियों का प्रयोग करते हुए फल एवं सजजियां श्रेणीकरण और जचहनांकन जनयम, 2004 में संिोधन करके बनाने का जवचार ह,ै को उि धारा की अपेक्षानुसार ऐसे सभी व्यजियों की िानकारी के जलए जिनके इस अजधसूचना स े प्रभाजवत होने की संभावना ह,ै एतद्दवारा सूजचत ककया िाता ह ै कक उि प्रारूप जनयमों पर उस तारीख स े जिस तारीख को भारत के रािपत्र की प्रजतया ाँ जिसमें यह अजधसूचना अंतर्विष्ट है, िनता को उपलजध करा िी िाती ह,ैं पतैं ालीस किन की अवजध की समाजि के पश्चात जवचार ककया िाएगा । आपजत्तयों अथवा सुझावों पर िो उक्त प्रारूप जनयमों की बाबत ककसी व् यजि से इस प्रकार जनर्ििष्ट अवजध की समाजि से पूवि प्राि होत े ह,ैं केन्द् रीय सरकार द्वारा जवचार ककया िाएगा । उपयुिि प्रारूप जनयमों के संबंध म ें कोई भी आपजत्त या सुझाव कृजि जवपणन सलाहकार, भारत सरकार, जवपणन एव ं जनरीक्षण जनिेिालय, प्रधान कायािलय, सी.िी.ओ. काम् पलेक्स , एन.एच.-IV, फरीिाबाि (हररयाणा)-121001 को अग्रेजित ककया िा सकता ह।ै 797 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] प्रारूप जनयम 1. सजं क्षप्त नाम, लाग ू होना और प्रारंभ- (1) इन जनयमों का संजक्षि नाम फल एवं सजजियााँ श्रेणीकरण और जचहनांकन (संिोधन) जनयम, 2024 ह ै। (2) य ेभारत के आजधकाररक रािपत्र में उनके अंजतम प्रकािन की तारीख को प्रवृत्त होंग े। 2. फल एव ं सजजिया ं श्रेणीकरण और जचहनांकन जनयम, 2004 (जिन्द्ह ें इसके बाि उि जनयमों के रूप म ें संिर्भित ककया िाएगा) म,ें जनयम 8 के स्ट्थान पर, जनम्नजलजखत को प्रजतस्ट्थाजपत ककया िाएगा, अथाित्:- “8 (1) फल एवं सजजियों के घरेलू व्यापार के मामले म ें यह धातु संििू क, कीटनािक अवििे , सूक्ष्मिीव अपेक्षाओं, फसल संििू कों, प्राकृजतक रूप स े पाए िान े वाल े जविैल े पिाथों के अवजिष्ट स्ट्तर से संबंजधत प्रजतबंधों तथा खाद्य सुरक्षा और मानक (संििू क, आजवि और अवजिष्ट) जवजनयम, 2011 और खाद्य सुरक्षा और मानक (खाद्य उत्पाि मानक और खाद्य सहयोज्य) जवजनयम, 2011 म ें यथा जवजनर्ििष्ट अन्द्य खाद्य सरु क्षा अपेक्षाओं तथा घरेल ू व्यापार के जलए खाद्य सुरक्षा और मानक अजधजनयम, 2006 (2006 का 34) के अधीन ककसी भी अन्द्य जवजनयम का अनुपालन करेगा। (2) फल एवं सजजियों के जनयाित के मामले में यह कोडेक्स एजलमेंटेररयस आयोग द्वारा जनधािररत भारी धातुओं और कीटनािकों की अवजिष्ट सीमाओं तथा अन्द्य खाद्य सुरक्षा मापिंडों अथवा आयातकताि ििे की अपेक्षाओं का अनुपालन करेगा।” 3. उि जनयमों म,ें अनुसूची II के स्ट्थान पर, जनम्नजलजखत अनसु ूची प्रजतस्ट्थाजपत की िाएगी, अथाित:् - “अनसु चू ी –II टेबल अगं रू का श्रणे ी अजभधान और उसकी गणु वत्ता 1. टेबल अगं रू वाइरटस जवनीफेरा एल. की ककस्ट्म (ककस्ट्मों) से प्राि फल होंगे। 2. न्द् यनू तम अपेक्षाए ं: (i) टेबल अगं रू के गच्ु छे एवं फल में जनम्न अपेक्षाएं होंगी: (क) साफ, ठोस, ककसी भी िश्ृ य जविातीय पिाथि स ेमुि होगा; (ख) उपि के सामान्द्य स्ट्वरूप को प्रभाजवत करन े वाले कीटों से मुि होगा; (ग) कीटों या बीमाररयों से होन े वाले नुकसान से मुि होगा; (घ) असामान्द्य बाहरी नमी से मुि होगा; (ङ) ककसी भी जविातीय गधं और/या स्ट्वाि स ेमुि होगा; (च) िश्ृ यमान फफूंि से मिु होगा; (छ) उच्च या जनम्न तापमान से होने वाले नुकसान से मिु होगा। (ii) फल साबुत, सगु रठत और सामान्द्यत: पररपक्व होंगे। (iii) टेबल अंगरू म ेंन्द्यनू तम घुलनिील ठोस पिाथ ि16 जडग्री जिक्स होने चाजहए। (iv) टेबल अंगरू म ेंन्द्यूनतम िकिरा/अम्ल अनुपात 18:1 होना चाजहए। फुट नोट: धूप के कारण होने वाला जपगमेंटेिन कोई िोि नहीं ह।ै 3. श्रणे ी अजभधान और गणु वत्ता के जलए मापिंड: श्रेणी अजभधान श्रेणी अपेक्षाए ं आकार संबंधी प्रावधान श्रेणी सहनीयता 1 2 3 4 उत्कृष्ट श्रेणी अंगरू उत्तम गणु वत्ता के होन े ताजलका 'ए' के अनुसार गुच्छों के विन के अनुसार चाजहए। गुच्छों का आकार, 5% तक ग्रडे की अपक्षे ाओं जवकास और रंग ककस्ट्म की के अनुरूप नहीं हो सकते ह,ैं[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 जविेिता के अनुरूप होना लेककन श्रेणी-I ग्रेड की चाजहए और उनम ें कोई िोि अपेक्षा को पूरा करता हो नहीं होना चाजहए। फल ठोस, या असाधारण रूप से उस डंठल से मिबूती से िडु े हुए, ग्रेड की सहनीयता के भीतर डंठल पर समान िरू ी पर और आता ह।ै स्ट्पष्टत: ताज़ े होन े चाजहए। श्रेणी-I अंगरू अच्छी गुणवत्ता का होना -वही- गुच्छों के विन के अनुसार चाजहए। गुच्छों का आकार, 10% तक ग्रेड की अपक्षे ाओं जवकास और रंग ककस्ट्म की के अनुरूप नहीं हो सकते ह,ैं जविेिता के अनुरूप होना लेककन श्रेणी II ग्रडे की चाजहए। फल ठोस, डंठल स े अपेक्षा को पूरा करता हो मिबूती से िडु े हुए और िहा ं या असाधारण रूप से उस तक संभव हो ताज़ े होन े ग्रेड की सहनीयता के भीतर चाजहए। हालााँकक, वे उत्कृष्ट आता ह।ै श्रेणी की तलु ना में डंठल पर कम समान िरू ी पर हो सकत े ह।ैं जनम्नजलजखत मामूली खाजमयााँ हो सकती ह,ैं बिते य े उत्पाि के सामान्द्य आकार और पैकेि की गुणवत्ता को प्रभाजवत न करें। -आकार में थोडी खराबी, -रंग म ें थोडी खराबी श्रेणी -II गुच्छों में आकार, जवकास और -वही- गुच्छों के विन के जहसाब रंग म ें िोि किखाई िे सकते ह,ैं से 10% और ग्रेड की बिते ये ककस्ट्म की अजनवाय ि अपेक्षाओं के अनुरूप हो जविेिताओं को प्रभाजवत नहीं तथा न्द्यूनतम अपेक्षाओं को करें। फल पयािि रूप से ठोस पूरा करता ह ै। और डंठल से िुड े होन े चाजहए। वे श्रेणी-I ग्रेड की तलु ना म ें डंठल पर कम समान िरू ी पर हो सकते ह।ैं जनम्नजलजखत िोि हो सकते ह,ैं बित े य े उत्पाि के सामान्द्य आकार और पैकेि की गुणवत्ता को प्रभाजवत न करें। - आकार म ेंिोि, - रंग में िोि, -सूरि की गमी स े हल्की झुलसन जिससे केवल जछलका प्रभाजवत हो, - हल्की चोट, - जछलके म ेंमामूली िोि4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 4. अन्द्य आवश्यकताए:ाँ (i) अंगरू ों को सावधानी से चुना िाना चाजहए और वे ककस्ट्म और/या वाजणजज्यक प्रकार और जिस क्षेत्र में वे उगाए गए ह,ैं उसके मानिंडों के अनुसार जवकास और पररपक्वता की उजचत जस्ट्थजत प्राि कर चुके हों। अंगरू ों का जवकास और जस्ट्थजत ऐसी होनी चाजहए कक वह – • यातायात और हडैं ललगं का सामना कर सके, • जिसे अपन ेगतं व्य स्ट्थान पर संतोििनक ढगं से पहुचं ाया िा सके। (ii) एक ककलोग्राम से अजधक के िद्धु विन वाले उपभोिा पैकेि में जवजभन्न ककस्ट्मों के टेबल अंगरू ों का जमश्रण हो सकता ह,ै बित े वे जनर्िष्टि ग्रेड की अन्द्य सभी अपेक्षाओं को परू ा करें। ताजलका 'ए' आकार से संबंजधत प्रावधान आकार का जनधािरण गुच्छों के विन (ग्राम में) स े होता ह।ै बड े और छोटे अगं ूरों के जलए प्रजत गुच्छा जनम्नजलजखत न्द्यूनतम (ग्राम म)ें अपेक्षाए ंजनधािररत की गई ह।ैं श्रेणी बडे फल छोटे फल उत्कृष्ट श्रेणी 200 150 श्रेणी -I 150 100 श्रेणी –II 100 75 आकार सहनीयता: (i) उत्कृष्ट श्रेणी, श्रणे ी I, श्रणे ी II: गुच्छों के विन के जहसाब से 10% तक ग्रडे की आकार अपेक्षाओं को परू ा नहीं कर सकता ह,ै लेककन तत्काल नीचे वाले ग्रडे के जलए आकार की अपेक्षाओं को पूरा करता हो। (ii) एक ककलोग्राम से अनजधक िद्धु विन वाले पैकेिों के जलए, 150 ग्राम से कम विन वाल े एक गुच्छे को विन समायोजित करने की अनुमजत ह,ै बिते कक गच्ु छा जनर्ििष्ट ग्रडे की अन्द्य सभी अपक्षे ाओं को परू ा करता हो।“ [फा. स.ं क्य-ू 11047/05/एफ&वी/2023-मानक) फैज़ अहमि ककिवई,अपर सजचव (जवपणन) नोट : मूल जनयम भारत के रािपत्र भाग-II, खंड-3, उप-खंड (i) म ें किनांक 26 िून, 2004 की अजधसूचना संख्या िी.एस.आर. 220 द्वारा प्रकाजित ककए गए थ े और अंजतम बार किनांक 10 नवंबर, 2016 को अजधसूचना संख्या िी.एस.आर. 1059(अ) द्वारा संिोजधत ककए गए थे। MINISTRY OF AGRICULTURE AND FARMERS WELFARE (Department of Agriculture and Farmers Welfare) NOTIFICATION New Delhi, the, 5th February, 2024 G.S.R. 99 (E).—The following draft of the Fruits and Vegetables Grading and Marking (Amendment) Rules, 2024, which the Central Government proposes to make in exercise of the powers conferred by section 3 of the Agricultural Produce (Grading and Marking) Act, 1937 (1 of 1937), to amend the Fruits and Vegetables Grading and Marking Rules, 2004 are hereby published as required by the said section for information of all persons likely to be affected thereby, and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of a period of forty-five days from the date on which the copies of the Gazette of India containing this notification are made available to the public.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 Objections or suggestions which may be received from any person with respect to the said draft rules before the expiry of the period so specified will be taken into consideration by the Central Government. Objections or suggestions, if any, in respect of the said draft rules may be forwarded to the Agricultural Marketing Adviser to the Government of India, Directorate of Marketing and Inspection, Head Office, CGO Complex, NH - IV, Faridabad (Haryana) 121001. Draft Rules 1. Short title, application and commencement. - (1) These rules shall be called the Fruits and Vegetables Grading and Marking (Amendment) Rules, 2024. (2) They shall come into force on the date of their final publication in the Official Gazette. 2. In the Fruits and Vegetables Grading and Marking Rules, 2004 (hereinafter referred to as the said rules), for Rule 8, the following shall be substituted, namely:- “8 (1) Fruits and Vegetables for domestic trade, shall comply with the restrictions in regard to residual levels of metal contaminants, pesticide residues, microbial requirements, crop contaminants, naturally occurring toxic substances and other food safety requirements as specified under the Food Safety and Standards (Contaminants, Toxins and Residues) Regulations, 2011, Food Safety and Standards (Food Product Standards and Food Additives) Regulations, 2011, and other regulations made for domestic trade under the provisions of Food Safety and Standards Act, 2006 (34 of 2006). (2) Fruits and Vegetables for export trade, shall comply with the residual limits of heavy metals, pesticides and other food safety requirements as laid down by the Codex Alimentarius Commission or importing countries requirement for export.” 3. In the said rules, for Schedule II, the following schedule shall be substituted, namely:– “SCHEDULE – II Grade designation and quality of Table Grapes 1. Table Grapes shall be fruits obtained from varieties (cultivars) of Vitis vinifera L. 2. Minimum requirements: (i) Bunches and berries of Table grapes shall be: (a) clean, sound, free of any visible foreign matter; (b) free of pests, affecting the general appearance of the produce; (c) free of damage caused by pests or diseases; (d) free of abnormal external moisture; (e) free of any foreign smell and/or taste; (f) free of all visible traces of moulds; (g) free of damage caused by high or low temperature. (ii) Berries shall be intact, well formed and normally developed. (iii) Table grapes shall have minimum soluble solids of 16 degrees brix. (iv) Table grapes shall have minimum sugar/ acid ratio of 18:1. Foot Note: Pigmentation due to sun is not a defect. 3. Berries must be but meeting those of Class II firm, firmly attached to the stalk grade or exceptionally and, as far as possible, have their coming within the tolerances bloom intact. They may, of that grade. however, be less evenly spaced along the stalk than in the extra class. Following slight defects may be there, provided these do not affect the general appearance of the produce and keeping quality of the package. - a slight defect in shape, - a slight defect in coloring Class II The bunches may show defects - do - 10% by weight of bunches in shape, development and and satisfying the coloring provided these do not requirements of the grade, impair the essential but meeting the minimum characteristics of the variety. requirements. The berries must be sufficiently firm and sufficiently attached to the stalk. They may be less evenly spaced along the stalk than Class I grade. Following defects may be there, provided these do not affect the general appearance of the produce and keeping quality of the package. - defects in shape, - defects in coloring, - slight sun scorch affecting the skin only, - slight bruising, - slight skin defects 4. Other requirements: (i) Grapes must have been carefully picked and have reached an appropriate degree of development and ripeness in accordance with criteria proper to the variety and/or commercial type and to the area in which they are grown. The development and condition of the grapes must be such as to enable them; • to withstand transport and handling, and • to arrive in satisfactory condition at the place of destination. (ii) Consumer packages of net weight not exceeding one kg may contain mixture of table grapes of different varieties, provided they shall meet all other requirements of the specified grade.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 7 TABLE `A' PROVISIONS CONCERNING SIZING Size is determined by the weight of bunches (in g). The following minimum (in g) requirements per bunch are laid down for large and small berries grapes. Grade Large berries Small berries Extra class 200 150 Class I 150 100 Class II 100 75 Size tolerance: (i) Extra class, Class I, Class II: 10 % by weight of bunches not satisfying the size requirements for the grade, but meeting the size requirements for the grade immediately below. (ii) For packages not exceeding one kg net weight, one bunch weighing less than 150 g is allowed to adjust the weight, provided, the bunch meets all other requirements of the specified grade.” [F.
