और,उि अजधकरण ने उक्त अजधजनयम की धारा 5 की उपधारा (2) के अधीन अपनी िरपोटण और जिजनश्चय तारीख 30 ददसंबर, 2010 को प्रस्ट् तुत दकया था; और, केंद्रीय सरकार और पक्षकार आंध्र प्रदेि, कनाणटक और महाराष्र राययों द्वारा उनसे संबंजधत जनदश उि उक्त अजधजनयम की धारा 5 की उपधारा (3) के अधीन उक्त अजधकरण को तारीख 29 माचण, 2011 को जनर्दष्टण दकया था; और, उक्त अजधजनयम की धारा 5 की उपधारा (3) के अधीन, उक्त अजधकरण द्वारा केंद्रीय सरकार को आगे की िरपोटण तारीख 29 माचण, 2011 को या उससे एक िर् ण से पूि,ण अग्रेजर्त करना अपेजक्षत था; 6360 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, उक्त अजधकरण के अनरु ोध पर, उक्त अजधजनयम की धारा 5 की उपधारा (3) के अधीन आग े की िरपोटण प्रस्ट् तुत करने की अिजध समय-समय पर, अजधसूचना संख यांक का.आ. 653 (अ), तारीख 29 माचण, 2012, का.आ. 2339 (अ),तारीख 28 जसतंबर, 2012, का.आ. 916 (अ),तारीख 2 अप्रलै , 2013, का.आ. 2939 (अ), तारीख 27 जसतंबर, 2013, का. आ. 3515 (अ) तारीख 27 निंबर, 2013 द्वारा 31 िनिरी, 2014 तक आगे बढाा़ई गई थी, जिस े िल संसाधन मंत्रालय के तारीख 5 फरिरी, 2014 के आदिे द्वारा तारीख 31 िलु ाई, 2014 तक और जिस्ट्तािरत की गयी थी, अजधसूचना संख या का.आ. 1290 (अ), तारीख 15 मई, 2014, का.आ. 2462 (अ), तारीख 18 िुलाई, 2016 का.आ. 2459 (अ), तारीख 31 िुलाई, 2017; का.आ. 3950 (अ), तारीख 9 अगस्ट् त,2018 और का.आ. 3146 (अ), तारीख 29, अगस्ट्त 2019, का.आ. 2412 (अ), तारीख 23 िलु ाई, 2020 ,का.आ. 2890 (अ), तारीख 20 िलु ाई, 2021 और का.आ. 2916 (अ), तारीख 27 िून, 2022, द्वारा जिस्ट्तार की ज्ञी थी; और, उक्त अजधकरण ने उक् त अजधजनयम की धारा 5 की उपधारा (3) के अधीन केंद्रीय सरकार को अपनी आग े की िरपोटण की तारीख 29 निंबर,2013 को अग्रेजर्त की थी; और,उक्त अजधजनयम की धारा 12 के अधीन, अजधकरण द्वारा िरपोट ण अग्रेजर्त दकये िान े के प‍ चात् और केंद्रीय सरकार को यह संतुजष्ट होने पर दक अजधकरण की मामले में और जनदश उि की आि‍ यकता नह होगी, केंद्रीय सरकार अजधकरण का यथािीघ्र जिघटन कर दगे ी; और, आंध्र प्रदेि पनु गणठन अजधजनयम, 2014 (2014 का 6) की धारा 89 यह उपबंध करती ह ै दक कृष्ण ा िल जििाद अजधकरण की अिजध उक्त धारा के खंड (क) और खंड (ख) म ें जिजनर्दष्ण ट जनदिश उ - जनबंधनों की ितों के साथ जिस्ट्तािरत होगी; और, केन् द्रीय सरकार न,े अंतरराजययक नदी िल जििाद अजधजनयम, 1956 की धारा 5 की उप-धारा (3) द्वारा प्रदत्त िजियों का प्रयोग करते हुए, उि अजधकरण द्वारा आगे की िरपोटण प्रस्ट्ततु करने की अिजध को, भारत सरकार के िल िजि मंत्रालय के िल संसाधन, नदी जिकास एिं गंगा संरक्षण जिभाग की अजधसूचना संखय ा का. आ. 2994 (अ), तारीख 6 िुलाई, 2023 द्वारा 31 माचण, 2024 तक की अिजध का जिस्ट्तार दकया था तादक आंध्र प्रदेि पुनगणठन अजधजनयम, 2014 की धारा 89 के खंड (क) और (ख) में जिजनर्दष्ण ट जनदिश उ - जनबंधनों का जनदान दकया िा सके; और, उि अजधजनयम की धारा 3 के अधीन तले ंगाना सरकार से यह अनुरोध प्राप्त हुआ ह ै दक केिल आन्ध्र प्रदेि और तले ंगाना राययों के बीच जनदश उि के दायरे को सीजमत करके अंतरराजययक कृष्णा नदी और उसकी नदी घाटी से संबंजधत िल जििादों के न्यायजनणणयन के जलए उि अजधकरण को भेिा िाए; और, केन् द्रीय सरकार को यह समाधान हो गया ह ै दक उि अजधजनयम की धारा 12 के अधीन मामले म ें आजधकरण को आग ेके जिचाराथण जिर्य भेिा िाना आि‍यक है; अब, इस प्रकार, उि अजधजनयम की धारा 3, धारा 5 की उपधारा (1) और धारा 12 म ें अंतर्िणष्ट उपबंधों के अनुसरण म,ें केंद्रीय सरकार न्यायजनणणयन के जलए उि अजधकरण को जनम्नजलजखत आगे के जिचाराथण जिर्य भेिती है: (1) मौिूदा जिचाराथण जिर्यों में खडं (क) और (ख) के प्रयोिन के जलए, “पिरयोिना-िार” का अथ ण तले ंगाना और आंध्र प्रदेि दोनों राययों की मौिूदा, चालू और जिचािरत पिरयोिनाएं ह।ैं (2) पूिणिती आंध्र प्रदेि रायय के अजिभाजित जहस्ट्से से कृष्णा नदी के पानी को तले गं ाना और ितणमान रायय आंध्र प्रदेि के बीच जितिरत/आिंिटत करेगा। इस जितरण/आिंटन के प्रयोिन के जलए पूिणिती आध्रं प्रदेि रायय का कुल अजिभाजित जहस्ट्सा इस प्रकार माना िा सकता ह:ै-[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 (i) कृष्ण िल जििाद अजधकरण-I द्वारा पूिणिती आध्रं प्रदेि रायय को दकया गया कुल आिंटन (एकमु‍त) 811 टीएमसी और इसके अलािा उि अजधकरण द्वारा पूिणिती आध्रं प्रदेि रायय को दकया गया कोई भी अजतिरि आिंटन। (ii) गोदािरी नदी जििाद अजधकरण द्वारा पूिणिती आध्रं प्रदेि रायय को आिंिटत पानी का जहस्ट्सा िो पोलािरम पिरयोिना के माध्यम से गोदािरी से कृष्णा तक पानी के हस्ट्तांतरण और पोलािरम पिरयोिना स े गोदािरी से कृष्णा तक दकसी भी अन्य प्रस्ट्ताजित हस्ट्तांतरण द्वारा उपलब्ध कराया िाता ह।ै [का.सं.एन -57021/2/2021- बीएम अनुभाग, एम िो डब्ल्य ूआर – भाग (2)] आनंद मोहन, संयुि सजचि MINISTRY OF JAL SHAKTI (Department of Water Resources, River Development and Ganga Rejuvenation) NOTIFICATION New Delhi, the 6th October, 2023 S.O. 4375(E).—Whereas, the Krishna Water Disputes Tribunal (hereafter in this notification referred to as the said Tribunal) was constituted on the 2nd April, 2004 vide notification of the Government of India in the erstwhile Ministry of Water Resources, number S.O. 451(E), dated the 2nd April, 2004, under section 4 of the Inter-State River Water Disputes Act, 1956 (33 of 1956) (hereafter in this notification referred to as the said Act), for the adjudication of the water disputes regarding Inter-State river Krishna and river valley thereof; And, whereas, the said Tribunal submitted its report and decision under sub-section (2) of section 5 of the said Act on 30th December, 2010; And, whereas, the Central Government and the Party States of Andhra Pradesh, Karnataka and Maharashtra referred their respective references to the said Tribunal under sub-section (3) of section 5 of the said Act on 29th March, 2011; And, whereas, the said Tribunal was required to forward to the Central Government a further report under sub-section (3) of section 5 of the said Act on or before one year from 29th March, 2011; And, whereas, on the request of the said Tribunal, the period of submission of further report under sub- section (3) of section 5 of the said Act was extended from time to time vide notifications number S.O 653(E), dated the 29th March, 2012, S.O. 2339 (E), dated the 28th September, 2012, S.O. 916 (E), dated the 2nd April, 2013, S.O. 2939 (E), dated the 27th September, 2013, S.O. 3515(E), dated the 27th November, 2013 up to the 31st January, 2014, which was further extended up to 31st July, 2014, vide Ministry of Water Resources order dated 5th February, 2014, S.O.1290 (E), dated the 15th May, 2014, S.O. 2462 (E), dated the 18th July, 2016, S.O. 2459 (E), dated the 31st July, 2017, S.O. 3950 (E), dated the 9th August, 2018, S.O. 3146 (E), dated the 29th August, 2019, S.O. 2412 (E), dated the 23rd July, 2020, S.O. 2890 (E), dated the 20th July, 2021, and S.O 2916 (E), dated the 27th June, 2022; And, whereas, the said Tribunal forwarded to the Central Government its further report under sub-section (3) of section 5 of the said Act on the 29th November, 2013; And, whereas, under section 12 of the said Act, the Central Government shall dissolve the Tribunal after it has forwarded its report and as soon as the Central Government is satisfied that no further reference to the Tribunal in the matter would be necessary; And, whereas, section 89 of the Andhra Pradesh Re-organisation Act, 2014 (6 of 2014) provides that the term of the Krishna Water Disputes Tribunal shall be extended with the terms of reference specified in clauses (a) and (b) of the said section; And, whereas, in exercise of the powers conferred under sub-section (3) of section 5 of the Inter-State River Water Disputes Act, 1956, the Central Government extended the period of submission of further report by the said Tribunal up to 31st March, 2024 so as to address the terms of reference specified in clauses (a) and (b) of section 89 of the Andhra Pradesh Re-organisation Act, 2014 vide notification of the Government of India, Department of Water Resources, River Development and Ganga Rejuvenation, in the Ministry of Jal Shakti, number S.O. 2994 (E), dated the 6th July, 2023; And whereas, a request has been received from the Government of Telangana under section 3 of the said Act, to refer the water disputes regarding the Inter-State river Krishna, and the river valley thereof, by confining the scope of reference between the jurisdictional limits of States of Andhra Pradesh and Telangana only, to the said Tribunal for adjudication;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] And, whereas, the Central Government is satisfied that further reference to the Tribunal in the matter is necessary under section 12; Now, therefore, in pursuance of the provisions contained in section 3, sub-section (1) of section 5 and section 12 of the said Act, the Central Government hereby refers the following further terms of reference to the said Tribunal for adjudication: (1) for the purposes of clauses (a) and (b) in the existing terms of reference, “project-wise” means existing, on-going and contemplated projects of both the States of Telangana and Andhra Pradesh; and (2) shall distribute/allocate the Krishna River waters between the States of Telangana and the present State of Andhra Pradesh from the undivided share of erstwhile State of Andhra Pradesh and the total undivided share of the erstwhile State of Andhra Pradesh that may be considered for the purpose of this distribution/allocation is as below: (i) 811 Thousand Million Cubic Feet (TMC) of overall allocation (en bloc) made by the Krishna Water Disputes Tribunal-I to the erstwhile State of Andhra Pradesh and any additional allocation over and above it made by the said Tribunal to the erstwhile State of Andhra Pradesh; and (ii) share of water allocated to the erstwhile State of Andhra Pradesh by the Godavari Water Disputes Tribunal, which is made available by transfer of water from Godavari to Krishna through Polavaram Project and any further transfer from Godavari to Krishna from Polavaram project, if proposed.
