िजसक(cid:30) =थायी मुहर होगी और इस पर और इसके Dारा मकु दमा इसके िनगिमत नाम पर चलाया जा सकता ह।ै (2) इसके पास िनIिलिखत शिKया ँव काय(cid:22) ह0गे :- (i) िचBकला, मू)तक(cid:22) ला और Nा(cid:4)फक आ(cid:4)द जैसी सज(cid:22)ना>मक कलाA के 3ेB0 म( अPययन तथा शोध को (cid:10)ो>सािहत व (cid:10)ोEत करना। (ii) 3ेBीय कला संगठन0 और राQय लिलत कला अकादिमय0 के कायक(cid:22) लाप0 को (cid:10)ो>सािहत व समि(cid:14)वत करना। (iii) कलाकार0 व कला सघं 0 के बीच सहयोग को (cid:10)ोEत करना तथा ऐसे संघ0 का िवकास करना। (iv) जहाँ आव@यकता हो, 3ेBीय कला के(cid:14)(cid:15)0 क(cid:30) =थापना को (cid:10)ो>सािहत करना। (v) अिखल भारतीय आधार पर सJमेलन0, सेिमनार0, (cid:10)दश(cid:22)िनय0 आ(cid:4)द का आयोजन करके िविभE कला िवSालय0 के िवचार0 के आदान-(cid:10)दान को (cid:10)ो>सािहत करना, िजनम( अPयेताA व िश3ािवद0 एव ं राQय अकादिमय0, अंचल सां=कृितक के(cid:14)(cid:15)0, िवTिवSालय0 के कला-सकं ाय0, कला कॉलजे 0 व =कूल0, कला संNहालय0, कला दीघाA(cid:22) , एव ंकला संघ0 जसै ेकला संगठन0 क(cid:30) सहभािगता हो। (vi) िविनबंध0, पिBकाA आ(cid:4)द सिहत कला सािह>य के (cid:10)काशन को (cid:10)कािशत तथा संवध(cid:22)न करना। (vii) ऐसा पु=तकालय =थािपत तथा अनुरि3त करना जो (cid:4)क िविभE संगठन0 क(cid:30) जVरत परू ी करे और िवT-कला को भी समिवW करे। (viii) कला संघ0 और संगठन0 के समिु चत िवकास व कायक(cid:22) ारण का संवध(cid:22)न करने के उFे@य स ेराQय अकादिमया ँव सरकार0 के परामश(cid:22) से कला संघ0 तथा अ(cid:14)य कला संगठन0 को मा(cid:14)यता (cid:10)दान करना ता(cid:4)क उनके माPयम से कलाकार0 क(cid:30) सहायता क(cid:30) जा सके। (ix) कला (cid:10)दश(cid:22)िनय0, का)मक(cid:22) व कला-व=तुA के आदान-(cid:10)दान आ(cid:4)द के माPयम से दशे के भीतर तथा अ(cid:14)य दशे 0 के साथ भी सां=कृितक सJपकY को (cid:10)ो>सािहत करना। (x) यो7य कलाकार0 को छाBवृि[यां और परु =कार (cid:10)दान करना। (xi) उ>कृW उपलि\धय0 के िलए कलाकार0 को मा(cid:14)यता (cid:10)दान करना। (xii) लोक, जनजातीय व पारJप#रक कलाA और िश(cid:6)प-तकनीक0 के अPययन, शोध तथा सव3] ण0 का संवध(cid:22)न करना, उनके कला Vप0 को प#ररि3त और (cid:10)द)श(cid:22)त करना तथा 3Bे ीय सव]3ण0 का आयोजन करना तथा जीिवत दशे ज िश(cid:6)पकार0, िचBकार0 व मू)तक(cid:22) ार0 को (cid:10)ो>सािहत करना। (xiii) अपने उFे@य0 और कायY को पूरा करने के दिृ W से भिू म खरीदना, सभी (cid:10)कार क(cid:30) सJपि[ को =वािम>व म ( लने ा और उसका अनुर3ण, िव^य या अ(cid:14)यथा िन=तारण करना, और (xiv) अकादमी क(cid:30) (cid:4)कसी भी सJपि[ या अिधकार के अवमू(cid:6)यन या पुन_‘ार, = तरो(cid:14)न यन, (cid:10)सार या अनुर3ण के िलए और खराब प#रसंपि[य0 के पनु N(cid:22)हण के िलए तथा (cid:4)कसी अ(cid:14)य उस (cid:10)योजन के िलए िजस हते ु अकादमी (cid:4)कसी ऐसी िनिध या िनिधय0 को सिृ जत करने या बनाये रखने क(cid:30) बावत य(cid:4)द आव@यक समझा जाए, तो आरि3त िनिध, िन3ेप या (cid:4)कसी अ(cid:14)य िवशेष िनिध का सृजन करना पर(cid:14) त ु भारत सरकार स े (cid:10)ाa अनुदान का कोई भी या भारत सरकार Dारा वहन (cid:4)कए गए bय म( स े उ>पE आय के (cid:4)कसी भी भाग को कला कलाकार क(cid:6)याण (cid:14)यास को सिृ जत व =थािपत करना और इन शीषY के अ(cid:14)तग(cid:22)त सभी भावी िनिधय0 को (cid:14)यास शीषक(cid:22) 0 म (जमा (cid:4)कया जाएगा। (xvi) ऐसे ही अ(cid:14)य काय (cid:22)या तो =वयं या अ(cid:14)य संगठन0 या bिKय0 के सहयोग से करना, िज(cid:14)ह (अकादमी उपयKु(cid:22) उFे@य0 क(cid:30) पू)त (cid:22)हते ुआव@यक, (cid:10)ासंिगक या सहायक समझ।े (3) अकादमी क(cid:30) आय और सपं ि[ (cid:4)कतनी और कैसी भी हो, का एकमाB उपयोग तथा (cid:10)योग संगम (cid:27)ापन म( यथािनधा(cid:22)#रत लeय 0 और उFे@य 0 के िलए (cid:4)कया जाएगा तथा इसका कोई भी िह=स ा, लाभांश, उपहार, अंश, बोनस या सोसाइटी या सोसाइटी क(cid:30) (cid:4)कसी सिमित के वत(cid:22)मान या पूव (cid:22) सद= य0 को (cid:10)> य3त: या अ(cid:10)> य3त: (cid:4)कसी भी तरह के लाभाथ(cid:22) भुगतान या अंत#रत नहc (cid:4)कया जाएगा। अकादमी का fय य सरकारी संगठन0 पर यथा (cid:10)योQ य िव> तीय िववेक के िनयम0 के अनुपालन म ( (cid:4)कया जाएगा। पर(cid:14)त ,ु इसक(cid:30) कोई भी बात, सोसाइटी के (cid:4)कसी अिधकारी या सेवक या सोसाइटी को (cid:10)द>त (cid:4)कसी सेवा के बदले सोसाइटी म( (cid:4)कसी सद=य को तक(cid:22)संगत और उिचत पा#र<िमक, उिचत दर0 पर \ याज का भुगतान या सोसाइटी के (cid:4)कसी सद= य Dारा सोसाइटी को (cid:4)कराए पर (cid:4)दए (cid:10)ािधकारी िनI ह0गे - (क) महा-प#रषद; (ख) काय(cid:22)कारी बोड;(cid:22) (ग) िव[ सिमित; (घ) कोई अ(cid:14)य =थायी सिमित या सिमितया ँ जो (cid:4)क महा-प#रषद या काय(cid:22)कारी बोड,(cid:22) अपने (cid:4)कसी एक या अिधक काय (cid:22) करने के िलए ग#ठत कर( । 5555.... ममममहहहहाााा----पपपप(cid:20)(cid:20)(cid:20)(cid:20)ररररषषषषदददद महा-प#रषद एक सतत् (cid:10)ािधकरण होगा िजसके पदने सद=य0 के अित#रK सद=य0 को तीन वषY के कायक(cid:22) ाल के िलए िनयKु (cid:4)कया जाएगा तथा इसम (िनJन िलिखत शािमल ह0गे, अथात(cid:22) :- (i) अPय3; (ii) उपाPय3; (iii) सं=क ृित मंBालय का िव>त सलाहकार; (iv) भारत सरकार के पाँच नामिनदि] शती अथा(cid:22)त्, िनदशे क, राCीय आधिु नक कला संNहालय; महािनदशे क, राCीय संNहालय; अकादमी स े संबिं धत सभी मामल0 के (cid:10)भारी संयKु सिचव, भारत सरकार और सं=कृित िवभाग के एक अिधकारी, िजनक(cid:30) समय-समय पर िवभाग Dारा पहचान क(cid:30) जाएगी तथा िव[ सलाहकार, भारत सरकार, सं=कृित िवभाग ह।9 य(cid:4)द अि(cid:14)तम उि(cid:6)लिखत नामिनदि] शती को भारत सरकार Dारा अकादमी के अशं कािलक िव[ सलाहकार के Vप म( िनयKु (cid:4)कया जाता ह,ै तो नामिनदि] शितय0 क(cid:30) स(cid:31)ं या चार होगी। नामिनदि] शत bिK महा-प#रषद के पदने सद=य ह0ग;े (v) भारत सरकार के कायाल(cid:22) य0 म( पद धारण (cid:4)कए Hए आठ नामिनदि] शती अथा(cid:22)त ् अPय3 या सभापित, यथाि=थित संगीत नाटक अकादमी और सािह>य अकादमी, महािनदशे क, भारतीय सां=कृितक सJब(cid:14)ध प#रषद,् सद=य-सिचव, इि(cid:14)दरा गाधँ ी राCीय कला के(cid:14)(cid:15), महािनदशे क, आकाशवाणी और दरू दश(cid:22)न, अPय3, अिखल भारतीय तकनीक(cid:30) िश3ा प#रषद ्तथा अPय3, िवTिवSालय अनुदान आयोग महा-प#रषद के पदेन सद=य ह0ग;े4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC. 1] (vi) अकादमी के अPय ते ा उनके िनवा(cid:22)चन ^म म ( सूचीब‘ (cid:4)कए जाएंगे तथा उनम( से तीन अP यते ा बारी-बारी से अPय3 Dारा उनक(cid:30) सद=यता के बारे म ( सूिचत (cid:4)कए जान े स े लके र तीन वषY तक अकादमी के सद=य ह0गे। अPय3 Dारा च(cid:4)^य रो=टर तैयार (cid:4)कया जाएगा। अPय3 तीन वषY के िलए सद=य0 के Vप म( अध य् ेताA को नामिनदि] शती करेगा तथा (cid:4)कसी भी कारणवश उदभूत #रिK के त>काल पiात ् उनको सद=यता के बारे म ( सूिचत करेगा। च(cid:4)^य रो=टर नाम0 के ^म पर अPय3 का िनण(cid:22)य अि(cid:14)तम होगा। तीन अP येताA को महा-प#रषद के पदने सद=य0 के Vप म ( समझा जायेगा। कोई भी fय िK दो पदाविध स े अिधक समय के िलए महा-प#रषद का सद= य बनने के िलए पाB नहc होगा और उ&त दोन0 कायक(cid:22) ाल एक-दसू रे के आन^ु िमक नहc ह0ग।े (vii) वणा(cid:22)न^ु म म ( राQय सरकार/संघ राQय 3Bे (cid:10)शासन Dारा अनुशिं सत तीन नाम0 के पैनल म( स,े भारत के सिं वधान म ( उि(cid:6)लिखत (cid:10)>य ेक राQय और संघ राQ य3Bे 0 से एक-एक f यिK होने चािहए िज(cid:14) ह0ने द@ृ य और सुनJ य कलाA म ( मह>व पूण(cid:22) योगदान (cid:4)दया हो और िजसक(cid:30) #रकाडY म( पिु W क(cid:30) गई हो। वे पूव(cid:22) म( महा-प#रषद या अकादमी क(cid:30) (cid:4)कसी सिमित के सद=य नहc होने चािहए। राQ य0 या संघ राQ य 3ेB0 Dारा (cid:10)=त ािवत तीन नाम0 म( से एक मिहला होनी चािहए। इन तीन0 म ( से एक का चयन, राQ य/संघ राQ य3Bे स े नामाकं न (cid:10)ाj त होने के एक माह क(cid:30) अविध के भीतर ऊपर ^म स.ं (ii), (iii) एवं (iv) म( व)णत(cid:22) सद= य साथ परामश (cid:22) करके, अP य3 Dारा (cid:4)कया जाएगा। चयन म( यह सुिनिiत (cid:4)कया जाए (cid:4)क कम से कम 33 (cid:10)ितशत सद= य मिहलाए ं ह0। इन सद= य0 क(cid:30) पदाविध तीन वष(cid:22) होगी। कोई भी fय िK दो से अिधक पदाविध के िलए महा-प#रषद का सद= य होने का पाB नहc होगा तथा उ& त दो पदाविध एक दसू रे के आन^ु िमक नहc होगी। (viii) उk स>यिनlा तथा कलाA के (cid:10)ोEयन म ( (cid:10)बंधक व सेवा #रकाड (cid:22) वाले दस bिKय0 को महा-प#रषद Dारा सरकार को अनशु ंिसत कम स ेकम तीन नाम0 स ेकला संगठन0 व संघ0 का (cid:10)ितिनिध>व करन ेके िलए सं=कृित मंBालय, भारत सरकार Dारा नामिनदि] शत (cid:4)कया जाएगा। अनुशिं सत bिK िवTिवSालय0 के लिलत कला संकाय0, कला महािवSालय0 व िवSालय0, कला वीिथय0, कला (cid:10)काशक0 और छपाई वाले और कला माPयम0 जसै े मा(cid:14)यता (cid:10)ाa कला सघं 0 या कला संगठन0 के काय(cid:22) म ( लग े ह0 या उसका (cid:10)ितिनिध>व करते ह0। इसम( लोक और जनजातीय कला; समसामियक कला; पारंप#रक कलाए ं और िश(cid:6) प; नवीन मीिडया; वा= तुकला; Nा(cid:4)फक िडजाइन के 3ेB से भी नाम शािमल (cid:4)कए जाएंगे। य(cid:4)द सरकार (cid:4)कसी कला-काय (cid:22) 3ेB का (cid:10)ितिनिध>व करन े के िलए (cid:4)कसी भी नाम को उपयु& त नहc पाती ह ै तो वह =वेmछा से (cid:4)कसी bिK का नामिनदि] शत कर सकेगी। नामिनदि] शत f यिKय0 क(cid:30) पदाविध तीन वषY क(cid:30) होगी। कोई भी bिK महा-प#रषद का सद=य दो अविधय0 स े अिधक नहc बना रहगे ा तथा उ& त दो काया(cid:22)विध एक दसू रे के अन^ु िमक नहc होगी, िजसम (उपशमन अविध अिनवाय(cid:22) होगी। (cid:20)(cid:20)(cid:20)(cid:20)टटटट(cid:24)(cid:24)(cid:24)(cid:24)पप पप णणणण 1111:::: जब उपयKु(cid:22) महा-प#रषद के एक या अिधक सद=य दसू रे सद=य0 को नामिनदि] शत करने क(cid:30) शिK रखत े ह0, ल(cid:4)े कन उनको =वयं को न तो िनयुK (cid:4)कया गया हो और न तो (cid:4)कसी कारणवश व ेइस ि=थित म( ह0, तो महा-प#रषद के अ(cid:14)य अिधकार (cid:10)ाa सद=य 0 Dारा (cid:4)कए गए नामाकं न0 पर (cid:10)n िच(cid:14)ह नहc लगाया जाएगा। (cid:20)(cid:20)(cid:20)(cid:20)टटटट(cid:24)(cid:24)(cid:24)(cid:24)पप पप णणणण 2222:::: पदने सद=य क(cid:30) पदाविध तीन वषY स े अिधक हो सकेगी। महा-प#रषद के अ(cid:14)य सद=य0 के सJब(cid:14)ध म( तीन वषY क(cid:30) अविध के िलए नामाकं न सिचव Dारा वत(cid:22)मान पदधारी क(cid:30) पदाविध समाप त् होने स े पवू (cid:22) संबिं धत नामाकं न करन े वाले (cid:10)ािधकारी स े (cid:10)ाjत (cid:4)कया जाएगा। य(cid:4)द (cid:4)कसी कारणवश महा-प#रषद के सद=य के Vप म ( नामिनदि] शत bिK ऐसा सद=य नहc बना रहता तो सिचव Dारा नामिनदि] शती (cid:10)ािधकारी स े (cid:4)कसी अ(cid:14)य bिK को तीन वषY क(cid:30) अिधशेष पदाविध के िलए नामिनदि] शत करन े का अनरु ोध (cid:4)कया जाएगा। खo ड 7 (vii) म( मामले के िसवाय जहाँ संब‘ राQय सरकार0/सघं -राQय (cid:10)शासन0 के (cid:10)ितिनिधय0 को अिधशेष तीन वषY के िलए नामिनदि] शत (cid:4)कया जाएगा। (cid:20)(cid:20)(cid:20)(cid:20)टटटट(cid:24)(cid:24)(cid:24)(cid:24)पप पप णणणण 3333:::: (cid:4)कसी पद पर िनयKु bिK का प#रवत(cid:22)न करने से उपयKु(cid:22) खoड (i), (iii), (iv) और (v), क(cid:30) िनबंधन0 के अधीन पदने सद=य के Vप म (नािमत (cid:4)कया जाता ह,ै तो इससे महा-प#रषद ्क(cid:30) सद=यता #रK हो जाएगी और उसके पूव(cid:22)वतp के =थान पर नए bिK क(cid:30) िनयिु K करना। (vi) (क) अकादमी के उपि=थत और मतदान करन ेवाले कम स ेकम तीन चौथाई सद= य0 के बHमत स ेऔर िसफा#रश (cid:4)कए गए fय िKय0 के जीवन व>ृ त और कै#रयर के आधार पर अकादमी के िवSमान अP येताA Dारा िसफा#रश या कला इितहासकार का एक से अनिधक नाम क(cid:30) िसफा#रश जो िव(cid:31) यात ह ैया ऐसे f यिK के नाम क(cid:30) िजसन ेकला के मामले म (उ>क ृ+ट सेवा क(cid:30) हो; पर(cid:14)त ु अPय ते ाA क(cid:30) स(cid:31)ं य अकादमी का = टूिडयो (cid:10)योग कर रहा हो या िवगत म( िजसने = टूिडयो का (cid:10)योग (cid:4)कया हो या अकादमी के कायक(cid:22) लाप0 से संबिं धत (cid:4)कसी कला समालोचक या कला इितहासकार के िव_‘ आचरण संिहता का उ(cid:6)ल ंघन करन े या अ(cid:14)य था अनिु चत आचरण का आरोप लगाया जाता ह ै तथा पचास या अिधक (cid:10)(cid:31) यात या¹Hkkx Iµ[k.M 1º Hkkjr dk jkti=k % vlk/kj.k 13 मा(cid:14)य ता(cid:10)ाjत कलाकार0 Dारा अ(cid:14) यथा अनिु चत आचरण के िलए दोषी होने का आरोप हो, तो ऐसे कृ> य के होने या लोप क(cid:30) जांच करने हते ु अनशु ासना>म क सिमित का गठन (cid:4)कया जाएगा। जहा ं उ&त यािचका म ( पूव(cid:22)वतp या वत(cid:22)मान अP य3 के िव_‘ आरोप अतं )व(cid:22)+ ट हो और जो सरकार के माPय म स े(cid:10)ाjत Hई हो, वहां रा+r पित Dारा अनुशासना>म क सिमित का गठन (cid:4)कया जाएगा। ((((3333)))) यथाि=थित अPय 3 या भारत के No. 3-14/2016.—In accordance with the provisions contained in the Resolution of the Government of India, number 16-8/53 H2, dated the 7th October, 1953 read with item (ii) of sub-clause 12 of clause 17 of the Memorandum of Association of the Lalit Kala Akademi, the Central Government in consultation with the Administrator, hereby makes the amendments to the Memorandum of Association and Rules and Regulations of the Lalit Kala Akademi and the revised Memorandum of Association and Rules and Regulations of the Lalit Kala Akademi is annexed herewith. M.L. SRIVASTAVA, Jt. Secy. MEMORANDUM OF ASSOCIATION OF LALIT KALA AKADEMI 1. CONSTITUTION Whereas it is considered expedient to establish a national organisation to foster and coordinate activities in the sphere of creative visual arts and promote thereby the cultural unity of the country, it is hereby resolved as follow: A National Academy of Art, to be called ‘Lalit Kala Akademi’ shall be established. 2. HEADQUARTERS The headquarters of the Akademi shall be at New Delhi. 3. ORGANIZATION AND FUNCTION (1) The Akademi shall be a corporate body, shall have perpetual seal and may sue and be sued in its corporate name.14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC. 1] (2) It shall have the following powers and functions, namely:- (i) to encourage and promote study and research in the fields of creative arts such as painting, sculpture and graphics etc.; (ii) to encourage and coordinate the activities of the regional art organisations and State Lalit Kala Akademis; (iii) to promote cooperation among artists and art associations and development of such associations; (iv) to encourage, where necessary, the establishment of Regional Art Centres; (v) to encourage the exchange of ideas between various schools of art by organising conferences, seminars, exhibitions, etc., on all India basis involving scholars and educationists and State Academies, Zonal Cultural Centres and Art Organisations like faculties of art in universities, art colleges and schools, art museums, art galleries and art associations; (vi) to publish and to promote publication of literature on art including monographs, journals etc.; (vii) to establish and maintain a Library, catering to the needs of various organisations and covering world art; (viii) to give recognition to art associations and other art organizations for assisting artists through them, in consultation with State Akademis and Government in order to promote the proper growth and functioning of art Associations and Organizations; (ix) to foster cultural contacts within the country and also with other countries, through art exhibitions, exchange of personnel and art objects, etc. (x) to award scholarships and prizes to deserving artists; (xi) to accord recognition to artists for outstanding achievements; (xii) to promote study, research and survey of folk, tribal and traditional arts and crafts techniques, preserve and project their art forms and to organize regional surveys of and to encourage surviving indigenous craftsmen, painters and sculptors; (xiii) in furtherance of its objects and works, to purchase land, own property of all kinds and to maintain, sell mortgage or otherwise dispose of and deal with the same; (xiv) to create a Reserve Fund, Sinking Fund, or any other special fund, whether for depreciation or for repairs, improving, extending or maintaining any of the properties or rights of the Akademi and or recoupment of wasting assets and for any other purposes for which the Akademi deems it expedient or proper to create or maintain any such fund or funds, provided that no part of grants received from the Government of India or any part of income derived out of expenditure met from the Government of India grants shall be transferred to any such funds without the prior approval of the Government of India. (xv) to create and establish the Lalit Kala Artists’s Welfare Trust with the money available in Artists Aid Fund and Social Security and to credit all future funds under these heads to the Trust; and (xvi) to do all such other acts either on its own or in conjunction with other organizations or persons as the Akademi may consider necessary, incidental or conducive to the fulfillment of above said objectives. 3. The income and property of the Akademi howsoever derived shall be solely utilised and applied towards the promotion of the aims and objects as set forth in the Memorandum of the Association and no portion thereof shall be paid or transferred directly or indirectly by way of dividend, gift, division, bonus or in any manner whatsoever to the profit of the present or past members of the Society or any committees of the Society. The expenditure of the Akademi shall be incurred in accordance with norms of financial prudence as applicable to Government organisations: Provided that nothing herein shall prevent the payment in good faith of reasonable and proper remuneration to any officer or servant of the Society or to any member of the Society in return for any services rendered to the Society nor prevent payment of interest at appropriate rates or payment of a reasonable and proper rent for premises let out to the Society by any member thereof. 4. AUTHORITIES OF THE AKADEMI The following shall be the authorities of the Akademi:¹Hkkx Iµ[k.M 1º Hkkjr dk jkti=k % vlk/kj.k 15 (a) The General Council; (b) The Executive Board; (c) The Finance Committee; (d) Any other Standing Committee or Committees which the General Council or the Executive Board may set up for discharging any one or more of their functions. 5. GENERAL COUNCIL The General Council shall be a continuing authority with its members other than ex-officio members appointed for a term of three years and shall consist of the following, namely:- (i) Chairman; (ii) Vice Chairman; (iii) Financial Adviser of the Ministry of Culture; (iv) Five nominees of the Government of India, namely, Director, National Gallery of Modern Art; Director General, National Museum; Joint Secretary to the Government of India in charge of matters relating to the Akademi and holder of one more office in the Department of Culture identified from time to time by the Department and the Financial Adviser to the Government of India in the Department of Culture. If the last mentioned nominee is appointed by the Government of India as the part time Financial Adviser of the Akademi then the number of nominees shall be four. The nominees shall be ex-officio members of the General Council; (v) Eight nominees of the Government of India holding offices, namely, the Chairperson or President, as the case may be, the Sangeet Natak Akademi and Sahitya Akademi; the Director General of the Indian Council for Cultural Relations; the Member Secretary of the Indira Gandhi National Centre for Arts; the Directors General of Akashwani and Doordarshan; Chairman of the All India Council for Technical Education and Chairman, University Grants Commission shall be ex-officio members of the General Council; (vi) Fellows of the Akademi will be listed in order of their selection as Fellows and three of them will be members of the Akademi by rotation for three years from the date they are informed of their membership by the Chairman. The rotation roster shall be maintained by the Chairman who shall nominate the Fellows as members for three years and inform them of their membership soon after a vacancy arises for any reason whatsoever. The decision of the Chairman on the order of names in the rotation roster shall be final. The three Fellows shall be deemed to be ex-officio members of the General Council. No person shall be eligible to be a member of the General Council for more than two terms and the two terms shall not be successive to each other; (vii) One person from each of the States and Union Territories enumerated in the Constitution of India, from a panel of three names recommended by the State Government or Union territory administration in alphabetical order. These should be persons of eminence who have made significant contribution in visual and plastic arts endorsed by records. They should not have been member of the General Council, or any of the Committee of the Akademi earlier. At least one out of three names proposed by the States or Union territory should be a woman. Out of these three, one would be selected by the Chairman in consultation with members mentioned in serial (ii), (iii) and (iv) above within a period of one month of receipt of nomination from the State or Union territory. The selection should ensure that at least 33% of the members are women. The term of these members shall be three years. No person shall be eligible to be a member of the General Council for more than two terms and the two terms shall not be successive to each other; (viii) Ten persons of high integrity and record of management and service in promotion of arts, to be nominated by the Ministry of Culture, Government of India, from at least thirty names recommended to the Government by the General Council. The persons whose names are recommended must be representative of and involved with work of recognised art associations or art organisation like faculties of fine arts in universities, art colleges and schools, art museums, art galleries, art publishers and printers and art media. These should also include names from the sphere of Folk and Tribal Art; Contemporary Art; Traditional Arts and Crafts; New Media; Arts in Architecture; Graphic Design. If the Government does not find any suitable name from those recommended by the General Council to represent any area of work relating to art it may nominate a person suo motu. The term of the nominated members shall be three years. The persons nominated shall be deemed to be ex-officio members of the General Council. No person shall be eligible to be a16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC. 1] member of the General Council for more than two terms and two terms shall not be successive to each other, with a mandatory cooling off period. Note 1.- When one or more of the members of the General Council aforesaid with power to nominate other members or the General Council have themselves not been appointed or are not in position, for any reason whatsoever, nominations made by other empowered members of the General Council present shall not be called in question. Note 2.- The term of an ex-officio member may exceed three years. In respect of other members of General Council, nominations for a term of three years shall be obtained from the concerned nominating authorities by the Secretary well before the term of the existing incumbent expires. If for any reason whatsoever a person nominated as member of the General Council ceases to be such a member, the nominating authority shall be requested by the Secretary to nominate another person for a term of three years, save in the case of clause 7(vii), where the representative of the concerned State/Union Territory shall be nominated for the balance of the term of three years. Note 3.- A change of appointee in an office by virtue of which a person is nominated as an ex-officio member in terms of sub clauses (i), (iii), (iv) and (v) above will automatically result in a vacancy in the membership of General Council with the new appointee in office taking the place of his predecessor, The new appointee in office shall become member of the General Council as soon as he is appointed as officer of the Akademi or nominated into the General Council, as the case may be. Note 4.- Where any member of the General Council is of the view that any person nominated does not fulfill the qualification required in him the member may take action as provided for in Clause 17. 6. EXECUTIVE BOARD The Executive Board shall consist of the following, namely: (i) Chairman of General Council who shall also be Chairman of the Executive Board; (ii) Vice Chairman of General Council who shall also be Vice-Chairman of the Executive Board; (iii) Financial Adviser of Ministry of Culture; (iv) Three members nominated by the Government of India from among their nominees on the General Council falling under sub-clause (iv) of clause 5; (v) Six persons to be elected from amongst the members of the General Council in the following manner, namely: - (a) Three persons with organisational and management experience to be elected by the General Council from among those nominated to the General Council by State Government and Union territory Administrations falling under sub-clause (iv) of clause 5; (b) Three persons with management experience to be elected by the General Council from among the members of the General Council falling under sub-clause (viii) of clause 5;. (vi) Three persons with management experience to be nominated by the Chairman from among the members of the General Council falling under sub-clauses (v), (vi) or (vii) of clause 5. Note.- The term of the members of the Executive Board as are elected by the General Council or nominated by the Government of India or the Chairman for membership of the Executive Board shall be three years. 7. FINANCE COMMITTEE The Finance Committee shall consist of the following , namely:- (1) The Financial Adviser of the Ministry of Culture who will be the Chairman of the Committee. (2) One nominee of the Government of India from among its nominees on the General Council. (3) Two representatives of the General Council nominated by it from among its members. (4) One representative of the Executive Board nominated by it from among its members. Note.- The term of the members of the Finance Committee as are nominated by the Government of India, the General Council or the Executive Board shall be three years. However, the term of the Financial Advisor, who is Chairperson of the Finance Committee, may exceed three years.¹Hkkx Iµ[k.M 1º Hkkjr dk jkti=k % vlk/kj.k 17 GENERAL RULES AND REGULATIONS OF LALIT KALA AKADEMI 1. NAME OF THE SOCIETY The name of the Society as registered under the Registration of Societies Act XXI of 1860 shall be Lalit Kala Akademi. The Office of the Society shall be situated in Rabindra Bhavan at New Delhi. 2. OFFICERS OF THE AKADEMI The following shall be the officers of the Akademi namely: (i) Chairman; (ii) Vice Chairman; (iii) Financial Advisor of the Ministry of Culture; and (iv) Secretary. 3. CHAIRMAN (1) Selection (i) The selection of the Chairman shall be through a transparent selection process, for which a Search Committee shall be constituted. The Search Committee shall consist of three members, one member shall be nominated by the General Council of the Akademi, the other two members shall be nominated by the President of India and one out of three members may be a woman. The Search Committee shall draw a panel of three names in alphabetical order and submitted to the President of India who shall appoint one of the three names in the panel as the Chairman of the Akademi. The names empanelled shall be eminent persons from different specialisations in the field of visual arts, having high integrity and moral character and widely respected with proven capability to run an organisation smoothly. The conditions of service of the Chairman shall be decided by the Government of India appropriate to the status accorded to him. Note.- Where it becomes necessary, the President of India may appoint a protem Chairman for a maximum period of six months on the recommendation of the Government of India. A regular Chairman must be in position on the expiry of six months. (ii) The Chairman shall hold office for a term not exceeding three years from the date on which he or she assumes office. However, he or she shall not continue in office beyond the date he or she completes 70 years of age. At the time of selection, due care may be taken to ensure that the person recommended is able to serve full time of three years before attaining the age of 70 years. The term of a Chairman should ordinarily be limited to one term. However, a Chairman of exceptional merit, may be given a second term, if felt appropriate. Second term should not be in continuation of the first term. The maximum number of years a person can be Chairman shall be restricted to six years, comprising two terms of three years each. The Chairman may demit his office by resignation sent to the President of India and on its acceptance by the President of India. Casual vacancy can be filled up by any other member of the General Council. (2) Duties (i) In order to ensure efficient administration of the Akademi, the Chairman shall inter-alia, have the following powers and functions, namely:- (a) to supervise and coordinate on behalf of the General Council the execution of the directions of the General Council and the decisions of the Executive Board and the various committees of the Akademi by the Secretary; (b) to maintain the rotation roster of Fellows for membership of General Council; (c) to appoint the Secretary and Group ‘A’ and Group ‘B’ employees of the Akademi, in accordance with the Service Bye-Laws and Recruitment Rules, as prescribed by the General Council, subject to the approval of Government of India; (d) to nominate three members of the General Council to the Executive Board; and (e) to coordinate activities of the Akademi with Governments, including State Governments, Zonal Cultural Councils, other Akademies, and Art organisations and associations. (ii) The Chairman shall have the power to take a decision on behalf of the General Council or the Executive Board when circumstances so warrant subject to ratification by the respective authority at its next meeting.18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC. 1] 4. VICE CHAIRMAN Selection (i) The Vice Chairman shall be elected in a meeting of the General Council from amongst the members of the General Council present and for a term of three years or up to the end of his term as member if it falls earlier. However, he or she shall not continue in office beyond the date he or she completes 70 years of age. The person elected as Vice Chairman must have managerial experience. No person shall be eligible to hold office of Vice Chairman for more than two terms and the second term should not be in continuation of first term. (ii) The Vice Chairman shall assist the Chairman in such matters as are entrusted to him by the Chairman. No Statutory power of the Chairman shall be so entrusted. The Vice Chairman shall temporarily hold the office of the Chairman during the period in which the Chairman is unavailable, till the Chairman resumes office. (iii) The Vice Chairman may demit his office by resigning and on his resignation being accepted by the Chairman. 5. FINANCIAL ADVISER (1) SELECTION An officer of appropriate level in the Akademi to be designated as Financial Adviser to render financial advice whose concurrence should be obtained for sanction and incurring of expenditure. The financial limits up to which such concurrence is mandatory may be drawn up by the Akademi as per rule 229 (viii) of GFR, 2017. (2) DUTIES (i) The Financial Adviser shall advise the Akademi in all matters relating to the management of the properties and investment of the Akademi, preparation of the annual estimates and statements of accounts and the expenditure of funds on assets, goods and services for which moneys have been granted to Akademi by the Government by reference to the objectives to be achieved. (ii) In order to ensure efficient management of the Akademi, the Financial Adviser shall, have the following powers and functions, namely:- (a) to examine and scrutinise the budget of the Akademi prepared by the Secretary; (b) to examine all expenditure proposals of the Akademi; ( c) to consider the Audit Report; (d) to review the finances of the Akademi from time to time; (e) to give advice on any financial question affecting the Akademi either on his own initiative or at the instance of the Secretary. 6. SECRETARY (1) SELECTION (i) The Secretary shall be the full time principal Executive Officer of the Akademi and he shall be appointed by the Chairman as per the prescribed Service Bye-Laws and Recruitment Rules for the post. No Person who is or has been a member of the General Council in the preceding five years shall be eligible for being appointed as Secretary. (ii) The post of the Secretary shall not be kept vacant. In the event of the contingent situation arising due to unforeseen circumstances, the Chairman shall nominate the next senior most officer of the Akademi to temporarily discharge the duties of the Secretary of the Akademi, till a new Secretary is appointed. (iii) The Secretary shall be the ex-officio Secretary of the General Council, the Executive Board, Finance Committee and all other Committees, which may be set up from time to time but shall not be deemed to be a member of any of these bodies. (2) DUTIES It shall be the duty of the Secretary.- (i) to be the custodian of the records and such other property or assets of the Akademi;¹Hkkx Iµ[k.M 1º Hkkjr dk jkti=k % vlk/kj.k 19 (ii) to conduct the official correspondence on behalf of the authorities of the Akademi; (iii) to issue all notice convening meeting of the authorities of the Akademi and of all committees appointed by any of these authorities; (iv) to keep the minutes of all meeting of the authorities of the Akademi and of all committees appointed by any of these authorities; (v) to maintain the accounts of the Akademi and ensure the timely preparation of Annual Report and the Audit of the Accounts; (vi) subject to the control of the Executive Board, manage the property and investments of the Akademi and be responsible for the preparation of the annual estimate and statements of accounts and for their presentation to the Executive Board and General Council. (vii) to be responsible for seeing that all moneys are expended on the purpose for which they are granted or allotted; (viii) to sign all contracts and assurances of property made on behalf of the Akademi after the same have been approved by the Executive Board. 7. QUORUM The quorum for meeting of the General Council shall be 25% of the total members and for the meeting of the Executive Board, Finance Committee and Standing Committee the quorum shall be 40% of their total strength. 8. VACANCY Any vacancy in the General Council, Executive Board, Finance Committee or any Standing Committee arising as a result of death, resignation, or any other reason, shall be filled at the earliest. 9. FUNCTIONS OF THE GENERAL COUNCIL The General Council shall have the following functions and powers, namely:- (i) To elect a Vice Chairman from among its members. (ii) To elect six members of the Executive Board from amongst its members and to prescribe the rules of procedure of the Executive Board. (iii) To elect two members of the Finance Committee from amongst its members and to prescribe the rules of procedure of the Finance Committee. (iv) To approve the annual budget of the Akademi drawn up by the Executive Board. (v) To appoint auditors for auditing the annual accounts of the Akademi. (vi) (a) To elect, by a majority of at least three fourth of the members present and voting, not more than one new fellow every year from out of names recommended by the existing Fellows of the Akademi, and based on bio-data and career achievements of the persons recommended. Each Fellow may recommend not more than one name of artist, art critic or art historian who is eminent or name of a person who has rendered outstanding service to the cause of art: Provided that the number of Fellows shall at no time exceed 25, of whom not more than three shall be non-Indians. (b) Removal of a Fellow from the list of Fellows of the Akademi for sufficient reasons to be placed on record and after communication sent to said Fellow by the Chairman on the advice of the Executive Board, as a show cause notice containing the reasons. The notice shall be returnable within a reasonable time and after considering reply thereto of the said Fellow, the General Council may decide on his removal from the list of Fellows. The removal of a Fellow will be by majority of the total number of members of the General Council and majority of two thirds of the number of members present and voting. (vii) To grant recognition on the recommendations of the Executive Board to art organisations rendering useful service to art. (viii) To consider and approve programmes proposed by the Executive Board. (ix) Subject to the provisions in this Memorandum of Association and Rules and Regulations, the functions also include framing of rules, regulations, bye-laws and rules of procedure including rules or codes for the following:-20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC. 1] (a) setting up Standing Committee, by whatever names they are called eg. Advisory Committee, their functions and their rules of procedure; (b) grant of recognition to artists, art historians and art critics through selection by Juries and preparation and maintenance of a Special Roll of Juries from which Juries for the National and International Exhibitions of the Akademi and for making other selections shall be chosen; (c) grant of scholarships, prizes and grants for research to artists, art historians and art critics; (d) admission to studio facilities of the Akademi; (e) artists Welfare Trust and Artists-Aid-Fund; (f) documentation, Publication, Library and Archives of the Akademi; (g) grant of recognition and assistance to art organisations and art associations, in consultation with Zonal Cultural Centers and Akademies and Governments or Administrations in States and Union territory Administrations; (h) conduct of persons who are members of the authorities of the Akademi and those engaged in activities of the Akademi; (i) payment of Honorarium, Travel and Daily allowances and other amounts to members of General Council, Executive Board, Finance Committee, Standing Committees, Members of Juries and others entrusted with work of the Akademi; (j) sale of Publication of the Akademi; (k) framing of Recruitment Rules, Service Bye-Laws and service conditions of employees of the Akademi: Provided that any such Bye-Laws, Rules and Regulations, service conditions and any addition, alteration and amendment to these, shall require the approval of the Government of India; and (l) administration, accounts financial control and review of action taken on pending audit observations; (x) To do any other such acts as may be necessary for the maintenance of the organisation and performance of the functions of the Akademi. Note.- In the discharge of its functions the General Council shall be guided by such directions on questions of policy as may be issued to it by the Central Government. The decision of the Central Government as to whether a question is or is not one of policy shall be final. Explanation.- for the purposes of Akademi, the recognized art critic or art historian means, an art critic or art historian, who has won a recognition award or honorable mention given by the Akademi at the National or International level as a result of selection by a jury, constituted by the Akademi. 10. MEETINGS OF THE GENERAL COUNCIL The General Council shall meet twice a year at the Headquarter of the Akademi in August and February of the Financial Year. Special or Extraordinary meetings of the General Council may be called at the Headquarters of the Akademi, at any other time, to discuss any special agenda. 11. FUNCTIONS OF THE EXECUTIVE BOARD The Executive Board shall have the following functions and powers, namely:- (i) to exercise the executive authority of the Akademi, subject to the supervision of the General Council; (ii) to be responsible for the supervision and control of the work of the Akademi and of its office; (iii) to prepare the programmes of the Akademi and to appoint committees in respect of such programmes as approved by the General Council; (iv) to draw up the annual budget of the Akademi subject to the financial limits prescribed by the Finance Committee to be submitted for the approval of the General Council; (v) to prepare the annual report and accounts of the Akademi for the consideration of the General Council; (vi) subject to the provisions of sub-clause (v) of clause 9, to initiate action for removal of a Fellow from the list of Fellows of the Akademi where warranted;¹Hkkx Iµ[k.M 1º Hkkjr dk jkti=k % vlk/kj.k 21 (vii) to consider and propose to the General Council names of important art organisations deserving recognition from the Akademi; (viii) subject to the budgetary limits and the policy directive, if any, of the General Council, to grant financial assistance to organisations recognised by the Akademi; (ix) to nominate a member of the Finance Committee in accordance with item 4 of Clause 7 of the Memorandum of Association; (x) to nominate a person or persons to represent the Akademi in National and International conferences or organisations; (xi) (a) to propose creation of posts in accordance with the policy guidelines of the Government of India, for employment of staff of the Akademi. (b) to review action taken under scheme, if any, for assessment for advancement of artist employees and welfare and training and retraining of all the employees to improve their work efficiency and morale; (xii) to hold meetings atleast once in three months at the Headquarters. 12. FUNCTIONS OF THE FINANCE COMMITTEE The Finance Committee shall consider the budget estimates of the Akademi, make recommendations thereon to the Executive Board and prescribe the total limits of expenditure within a financial year. 13. ASSETS OF THE AKADEMI (1) All movable and immovable properties or assets of the Akademi shall vest in the Akademi. The Akademi shall have no powers to license or lease for more than two years or mortgage, sell or part with in any other way possession of any assets of the Akademi without the approval of the Central Government obtained in writing, except where the transfer of possession is to the Central Government or to any of its attached or subordinate organisations or to such statutory organisation under control of Central Government as it may specify. (2) In case of dissolution of the Akademi, the properties or assets of the Akademi, movable and immoveable shall vest in the Central Government. 14. ANNUAL REPORT AND AUDIT (1) The financial year of the Society shall be from April 1 to March 31. (2) The Governing Body shall be required to submit an Annual Report on the working of the Akademi to the Government of India and ensure timely submission of this Report along with the Audited Accounts within the timeframe prescribed. Such report shall contain particulars regarding the work of the Akademi during the previous year and shall be accompanied by a balance sheet duly audited showing the income and expenditure of the Akademi during the said year. (3) The accounts of the Akademi shall be audited by Comptroller and Auditor General every year. 15. TAKE OVER OF MANAGEMENT BY CENTRAL GOVERNMENT (1) In the event of serious crisis arising with regard to the management of the Akademi, if the Central Government is of the view, that it is necessary for the Government to take over the management of the Akademi in order to secure proper management and that any delay would be highly detrimental to the interests of the Akademi, the Government may, in accordance with the provisions contained in the Lalit Kala Akademi (Taking over of Management) Act, 1997 by order, take over the management of the Akademi for a period not exceeding three years and relinquish the management of the Society after three years or earlier, in the manner stated hereinafter. (2) On the takeover of the management of the Akademi by the Government the Chairman, Vice-Chairman, Financial Adviser, Honorary Secretaries or Honorary appointees, if any, the member of the General Council, the Executive Board, the Finance Committee and all the Standing Committees of the Akademi shall be deemed to have vacated their offices, as such, from the date of the takeover. The powers of the Chairman, the General Council, Executive Board and Standing Committees shall be vested in a person appointed by the Central Government as the Administrator,22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC. 1] from the date of the takeover. The Administrator shall carry on the management of the society for and on behalf of the Central Government, subject to the directions of that Government. Subject to the supervision, control and direction of the Administrator the powers of the Finance Committee shall be vested in an officer of the Central Government appointed by that Government. 16. HANDING BACK OF THE MANAGEMENT OF AKADEMI BY GOVERNMENT (1) In the event of the takeover of the management of the Akademi by the Central Government as referred to in clause 15, on the expiry of the said three years or even earlier if it appears to the Central Government that purpose of taking over of management of the Society has been fulfilled or that for any other reason it is not necessary that the management of the Society should remain vested in the Government, the Government may by order relinquish the management of the Akademi with effect from such date as may be specified in the order. On and from the date so specified, the management of the Society shall vest back in the new General Council as shall be constituted under the Memorandum of Association and the rules and regulations. (2) If the steps in relation to the appointment of a Chairman, where necessary, are not completed by the specified date, the President of India may appoint a protem Chairman till the regular Chairman is appointed in accordance with the memorandum of association and rules and regulation of the Akademi. (3) The term of three calendar year, of the nominated and elected members of the new General Council shall begin with the year in which the specified date falls. 17. APPELLATE AUTHORITY Appeal shall lie from any officer or employee of the Akademi or any person to the Central Government against any final decision of any officer or authority of the Akademi pertaining to service matters which is not more than one year old. However, it shall be open to the Government to entertain; at its discretion appeals pertaining to service matters which are much older, taking into account special circumstances where under the appeals could not be preferred earlier. Where disciplinary action is taken by the President of India, or by Government of India, a review petition shall lie to the President of India from the person proceeded against. 18. REVIEW COMMITTEE The Central Government may set up a review committee at intervals of 10 years to re-evaluate the objectives and assess the achievements of the Akademi vis-à-vis the goals for which it was set up. The Committee shall submit the Report to the Government. 19. RIGHT OF THE CENTRAL GOVERNMENT (1) Notwithstanding anything contained in any of the above clauses of Memorandum of Association, Rules and Regulations, the Central Government may, issue such directives, as it may deem fit, in regard to the financial matters, conduct of business and the functioning of the Akademi and in like manner may issue such directives. The Akademi shall give immediate effect to the directives so issued. In particular the Central Government will have the power, inter-alia.- (i) to give directions to the Akademi as to the exercise and performance of its functions in matters involving national security and public interest; (ii) to call for such returns, accounts and other information, with respect to the property and activities of the Akademi as may be required from time to time;¹Hkkx Iµ[k.M 1º Hkkjr dk jkti=k % vlk/kj.k 23 (iii) to approve agreements involving foreign collaboration proposed to be entered into by the Akademi: Provided, that all decisions of the Central Government on ‘Public Interest’ shall be final. (2) The directives issued by the Central Government shall be in writing addressed to the Chairman of the Akademi and these directives shall be required to be complied with within a period fortnight, failing which, the situation shall be treated as deemed to be a crisis. 20. DISCIPLINARY MATTERS (1) The power to appoint, nominate or elect which is vested in President of India, Government of India, Authorities of the Akademi or Officers of the Akademi as the case may be, in terms of any of the clauses in the Memorandum of Association, Rules and Regulations, Rules of the procedure, Service Bye-Laws and other rules including Recruitment Rules shall include the power to remove any person appointed, nominated or elected after giving him an opportunity to be heard in the interest of Natural Justice. (2) Whenever a violation of the code of conduct or conduct unbecoming otherwise, is alleged against any past or present member of the General Council, Executive Board, Finance Committee or Standing Committees, any person holding an Honorary position or any artist using or who has used a Studio of the Akademi or an art critic or art historian associated with the activities of the Akademi and a petition signed by fifty or more eminent or recognised artists or a petition signed by fifty or more employees of the Akademi is received, the Chairman shall constitute a disciplinary committee to enquire into any act of omission or commission by the person who is alleged to have violated the code of conduct or is alleged to be guilty of conduct unbecoming otherwise. Where the said petition contains allegations against a past or present Chairman and is received by the Government, the President of India shall constitute the said disciplinary committee. (3) The Chairman or the President of India, as the case may be, shall take action on the basis of the recommendations of the disciplinary committee which shall have powers to recommend censure for a limited period or for all times and recovery of loss caused to the Akademi. (4) The President of India or Chairman shall be empowered to remove the censured Chairman, or as the case may be, Vice Chairman, Member, artist or person for the period of the censure from the office, Council, Board Committee or studio as soon as the person concerned is censured by the President of India or Chairman on the recommendations of the disciplinary committee. The President of India or Chairman may also effect or cause to be effected recovery of loss to Akademi as recommended by the disciplinary committee and during the period of the censure, the censured artist or person shall be ineligible for election from the constituencies comprising of artists and for using the studios of the Akademi or for display in exhibitions or for awards of, the Akademi. (5) The aforesaid disciplinary powers of the President of India or Chairman shall also be invoked in relation to conduct unbecoming by reference to accepted moral principles, on the part of Chairman, member, artist or person a aforesaid, prior to the empowerment of President of India or Chairman with the disciplinary powers.
