(2019 का 30) क) धारा 56 क) उपधारा (2) के खंड (क), खंड (ख), खंड (ग), खंड (घ), खंड (ङ), खंड (च), खंड (छ), खंड (ज) और खंड (थ) 8ारा 9द: शि<य= का 9योग करत े>ए, िन@िलिखत िनयम बनाती ह,ै अथात(cid:26) ् :- 1. संिDE नाम और 9ार(cid:10)भ – (1) इन िनयम= का संिDE नाम रा(cid:21)ीय आय(cid:24)ु व(cid:26)(cid:27)ान आयोग (सदHय= क) िनयुि< और नामिनदशI न क) रीित, उनके वते न, भ: ेऔर सेवा के िनबंधन एवं शतJ तथा आिHतय=, वृि:क और वािणिMयक िविनयोजन क) घोषणा) िनयम, 2019 ह ै। (2) य ेराजपN मO उनके 9काशन क) तारीख से 9व:ृ ह=ग े। 2. पQरभाषाए ं– (1) इन िनयम= म,O जब तक संदभ(cid:26) स ेअ(cid:14)यथा अपेिDत न हो,- (क) “अिधिनयम” से रा(cid:21)ीय आयु(cid:24)व(cid:26)(cid:27)ान आयोग अिधिनयम, 2019 (2019 का 30) अिभ9ेत ह ै; (ख) “आयोग” से अिधिनयम क) धारा 3 के अधीन गQठत रा(cid:21)ीय आय(cid:24)ु व(cid:26)(cid:27)ान आयोग अिभ9ते ह ै; (ग) “धारा” से अिधिनयम क) धारा अिभ9ेत ह ै; (2) इन िनयम= म O 9यु< शTद= और पद=, जो इनम O पQरभािषत नहU ह V (cid:4)क(cid:14)त ु अिधिनयम म O पQरभािषत ह,V के वही अथ (cid:26) ह=गे जो उनके अिधिनयम मO Wमशः ह।V 3. धारा 4 क) उपधारा (4) के खडं (ख) और खंड (ग) के अधीन आयोग के अंशकािलक सदHय= क) िनयुि< क) रीित – (1) के(cid:14)(cid:15)ीय सरकार 8ारा सदHय= क) िनयुि< दो वष(cid:26) क) अविध के िलए क) जाएगी । (2) धारा 4 क) उपधारा (4) के खंड (ख) और खंड (ग) के अधीन िनय<ु (cid:4)कए जान े वाल े आयोग के अंशकािलक सदHय= का आयु(cid:24)व(cid:26)(cid:27)ान सलाहकार पQरषद ्मO राMय= और सघं राMयDNे = के नामिनदिI शितय= से लॉट= के Oसंचािलत (cid:4)कया जाएगा । (4) लॉट= के \ॉ 9‘येक राMय और संघ राMयDेN= के aिbक नाम= का उ(cid:6)लेख करन े वाल े एक समान आकार, रंग और िडजाइन क) पेपर क) प(cid:24)च(cid:26)य= के साथ सचं ािलत (cid:4)कया जाएगा, जो ऐसी रीित मO मुड़ी >ई ह=गी िजससे (cid:4)क उनक) गोपनीयता को पQररिDत रखा जा सके । (5) लॉट= के \ॉ का ि8तीय 9वग(cid:26) धारा 11 क) उपधारा (2) के खडं (ङ) के अधीन नामिनdदb(cid:26) राMय िच(cid:4)क‘सा पQरषद ्के िनवा(cid:26)िचत सदHय= मO स े संबंिधत राMय िच(cid:4)क‘सा पQरषद ् 8ारा राMय= और संघ राMयDेN= के नामिनदिI शितय= स े नौ अंशकािलक सदHय= के िलए सचं ािलत (cid:4)कया जाएगा : (6) लॉट= के \ॉ का 9थम 9वग(cid:26) धारा 11 क) उपधारा (2) के खंड (ग) और खंड (घ) के अधीन नामिनdदb(cid:26) राMय िच(cid:4)क‘सा सलाहकार पQरषद ्के िनवाि(cid:26) चत सदHय= म O स े राMय िच(cid:4)क‘सा पQरषद ्8ारा राMय= और संघ राMयDेN= के नामिनदिI शितय= म O से दस अंशकािलक सदHय= के िलए संचािलत (cid:4)कया जाएगा । परंत ुअिधकतम राMय= और सघं राMयDेN= का 9ितिनिध‘व सिु नि^त करन ेके 9योजन= के िलए, ऐस ेराMय= और संघ राMयDेN=, िजनके नामिनदिI शती 9थम वग(cid:26) के िलए आयोिजत लॉट= के \ॉ से चयिनत (cid:4)कए गए थे, ि8तीय 9वग(cid:26) के िलए आयोिजत (cid:4)कए जान ेवाले लॉट= के \ॉ मO अपव(cid:24)जत(cid:26) (cid:4)कए जाएंग े। (7) पेपर पचf क) कुल संgया राMय= और संघ राMयDेN= क) कुल संgया के इस बात को hयान म O न रखते >ए त‘समान होगी (cid:4)क राMय और सघं राMयDेN Wमशः धारा 11 क) उपधारा (2) के खंड (ग), खंड (घ) और खंड (ङ) के अधीन िविधमा(cid:14)य नामिनदशI न रखत ेह Vया नहU । (8) उपिनयम (5) और उपिनयम (6) म O यथा उि(cid:6)लिखत लॉट= के \ॉ के दौरान, (cid:4)कसी (cid:4)दए >ए 9वग(cid:26) म O सभी सदHय= के बारे म Oिविन^य (cid:4)कए जाने तक एक पेपर पचf एक बार मO उठायी जाएगी । (9) जहां पेपर पचf ऐसे (cid:4)कसी राMय या संघ राMयDेN के िलए उठायी जाती ह ै िजसके पास स(cid:10)बि(cid:14)धत 9वग(cid:26) म O नामिनदिI शती नहU ह,ै वहां पेपर पचf िविशb 9वग(cid:26) के िलए लॉट= के \ॉ के पणू (cid:26) हो जाने तक अलग रख दी जाएगी और जब ि8तीय 9वग(cid:26) के िलए लॉट= का \ॉ आरंभ होता ह ैतब इसे वापस रख (cid:4)दया जाएगा । (10) दो वष_ क) 9थम अविध के प^ात्, लॉट= का 9‘यके \ॉ दो 9Wम= म,O पहला उन राMय= और संघ राMयDेN= म Oस,े जो पूव(cid:26) अविध के दौरान, इस िनयम के अनसु ार आयोग के सदHय= के चयन के िलए और रा(cid:21)ीय आयु(cid:24)व(cid:26)(cid:27)ान, Hवाय: बोड (cid:26) (चौथे सदHय क) िनयिु < क) रीित और वेतन तथा भ:,े सेवा के िनबंधन और शत Jतथा अhयD और सदHय= क) आिHतय=, विृ :क और वािणिMयक िविनयोजन क) घोषणा) िनयम, 2019 के अनसु ार, Hवाय: बोड_ के चौथ ेसदHय के चयन के िलए आयोिजत लॉट= के \ॉ म O चयिनत नहU (cid:4)कए गए थे, िनकाल े जान े वाल े उपिनयम (5) और उपिनयम (6) म Oिनdदb(cid:26) दो 9वग_ के िलए लॉट= के \ॉ 8ारा िनबिj धत (cid:4)कया गया था । (11) ऐसे राMय= और संघ राMयDेN=, िजनके िलए सदHय= का पूव(cid:26) अविध के िलए चयन नहU (cid:4)कया गया था, के संबंध म O उपिनयम (10) मO यथा िनdदb(cid:26) लॉट= के िनबिj धत \ॉ के माhयम से ऐसी सgं या मO नामिनदिI शितय= का चयन कर िलए जाने के प^ात्, उपिनयम (5) और उपिनयम (6) म O िनdद(cid:26)b दो 9वग_ के अधीन आयोग के अशं कािलक सदHय= के िलए शषे नामिनदिI शितय= का Wमशः लॉट= के \ॉ 8ारा शेष राMय= और संघ राMयDेN= म Oस े(cid:4)कया जाएगा । (12) (cid:4)कसी राMय या संघ राMयDेN का 9ितिनिध‘व एक बार मO आयोग मO एक से अिधक नामिनदिI शती 8ारा नहU (cid:4)कया जाएगा । (13) लॉट= का \ॉ, के(cid:14)(cid:15)ीय HवाHkय और पQरवार क(cid:6)याण मंNी क) उपिHथित म Oसंचािलत (cid:4)कया जाएगा । (14) लॉट= के \ॉ क) संपूण (cid:26)9(cid:4)Wया क) वीिडयो Qरकाlडगj क) जाएगी और लॉट= के \ॉ से संबंिधत सभी अिभलेख जनता क) प>चं के िलए HवाHkय और पQरवार क(cid:6)याण मंNालय क) वेबसाइट पर छह मास क) अविध के िलए रख ेजाएगं े । (15) लॉट= के \ॉ क) 9(cid:4)Wया के दौरान, पारद(cid:24)श(cid:26)ता बनाए रखने के 9योजन के िलए, मीिडया का(cid:24)म(cid:26)क= को भी आमिं Nत (cid:4)कया जाएगा । (16) जहां लॉट= के \ॉ के माhयम से चयन (cid:4)कए गए राMय या संघ राMयDेN के नामिनदिI शती क) अविध (cid:4)कसी कारणवश कम करके दो वष(cid:26) कर दी जाती ह,ै वहां के(cid:14)(cid:15)ीय सरकार, यथािHथित, संबंिधत राMय या सघं राMयDेN या राMय िच(cid:4)क‘सा पQरषद ् 8ारा नामिनदशI न के आधार पर शेष अविध के िलए उसी राMय या संघ राMयDNे के अ(cid:14)य नाम नामिनदिI शती क) िनयिु < करेगी ।¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 3 (17) राMय= और सघं राMयDेN= स े नामिनदिI शितय= मO स े आयोग के सदHय= को नामिनdदb(cid:26) करने के िलए लॉट= का \ॉ िनरंतर 9‘यके दो वष(cid:26) म Oसंचािलत (cid:4)कया जाएगा । 4. आयोग के अhयD और सदHय= क) िनयिु < के िलए खोजबीन सिमित हते ु धारा 5 क) उपधारा (1) के खंड (ग) के अधीन िवशेष(cid:27) का नामिनदशI न – (1) के(cid:14)(cid:15)ीय सरकार, दो वष(cid:26) क) अविध के िलए आयोग के अhयD और सदHय= क) िनयिु < के िलए खोजबीन सिमित का भागmप होने के िलए (cid:4)कसी िवशषे (cid:27) क) िनयिु < करेगी । (2) उपिनयम (1) म O िनdदb(cid:26) िवशषे (cid:27) का चयन धारा 4 क) उपधारा (4) के खंड (ग) के अधीन िनयु< आयोग के अंशकािलक सदHय= मO से लॉट= के \ॉ 8ारा (cid:4)कया जाएगा । (3) लॉट= का \ॉ धारा 4 क) उपधारा (4) के खंड (ग) के अधीन िनयु< आयोग के 9‘येक अंशकािलक सदHय के नाम का उ(cid:6)लेख करन े वाला एक समान आकार, रंग और िडजाइन क) पेपर क) प(cid:24)च(cid:26)य= के साथ संचािलत (cid:4)कया जाएगा, जो ऐसी रीित मO मुड़ी >ई ह=गी िजससे (cid:4)क उसक) गोपनीयता को पQररिDत रखा जा सके । (4) इस िनयम के अधीन लॉट= के \ॉ िनयम 3 के उपिनयम (13), उपिनयम (14), उपिनयम (15), उपिनयम (16) और उपिनयम (17) के अधीन यथा िविनdद(cid:26)b 9(cid:4)Wया का, आवoयक पQरवत(cid:26)न= सिहत, अनसु रण करते >ए संचािलत (cid:4)कया जाएगा । 5. आयोग के अhयD को संदये वेतन और भ: े – (1) आयोग के अhयD का वेतन, वेतन मQै pqस (2,25,000 rपए) के Hतर 17 म Oभारत सरकार के सिचव के वेतन के समतु(cid:6)य होगा : परंत ुजहा ंआयोग का अhयD सरकारी, अध-(cid:26) सरकारी अिभकरण=, पिTलक सqे टर उपWम= या मा(cid:14)यता9ाE अनसु ंधान संHथाs से सेवािनव:ृ >आ ह,ै वहां उसके 8ारा 9ाE पशO न या सेवातं फायद= का पOशिनक म(cid:6)ू य या दोन= के साथ संदये वेतन अंितम 9ाE वेतन स ेअिधक नहU होगा । (2) य(cid:4)द आयोग का अhयD, के(cid:14)(cid:15)ीय सरकार या राMय सरकार क) सेवा म Oह ैतो उसके वते न और भ:े, जो भी अिधक हो, उसको लागू िनयम= या उपिनयम (1) के अनसु ार िविनयिमत (cid:4)कए जाएगं े । 6. महगं ाई भ:ा – (1) आयोग का अhयD और 9‘यके अ(cid:14)य सदHय, के(cid:14)(cid:15)ीय सरकार मO समतु(cid:6)य Hतर के अिधकाQरय= को उनके वेतन के मu ेिविनयोिजत अनु(cid:27)ेय दर= पर महगं ाई भ:े के िलए हकदार होगा । (2) आयोग के पदने सदHय= का महगं ाई भ:ा उनके मलू मंNालय या िवभाग या संगठन 8ारा वहन (cid:4)कया जाएगा । 7. याNा भ:ा – (1) आयोग का अhयD और 9‘यके अ(cid:14)य सदHय, के(cid:14)(cid:15)ीय सरकार म O समतु(cid:6)य Hतर के अिधकाQरय= को अनु(cid:27)ेय उनके वेतन के मuे िविनयोिजत दर= पर याNा भ: ेऔर दिै नक भ: े9ाE करने के हकदार ह=ग े। (2) आयोग के पदने सदHय= का याNा भ:ा, मलू मंNालय या िवभाग या संगठन 8ारा वहन (cid:4)कया जाएगा । (3) आयोग का अhयD और 9‘येक सदHय याNा भ:= और दिै नक भ:= स े संबंिधत अपन े िबल= के सबं ंध मO Hवय ं ही िनयंNण अिधकारी होगा । 8. छुvी – आयोग का अhयD और 9‘यके अ(cid:14)य सदHय िन@िलिखत के िलए हकदार होगा – (क) समय-समय पर यथा संशोिधत के(cid:14)(cid:15)ीय िसिवल सेवा (छुvी) िनयम, 1972 के अनसु ार, के(cid:14)(cid:15)ीय सरकार के सेवक= को यथा अन(cid:27)ु ेय अ(cid:24)जत(cid:26) छुvी, अwव(cid:26) ेतन छुvी और पQरव(cid:24)त(cid:26)त छुvी ; और (ख) समय-समय पर यथा संशोिधत के(cid:14)(cid:15)ीय िसिवल सेवा (छुvी) िनयम, 1972 के अधीन Hथायी के(cid:14)(cid:15)ीय सरकार के सेवक= को यथा अन(cid:27)ु ेय असाधारण छुvी । 9. छुvी मंजूर करने वाला 9ािधकारी – (1) के(cid:14)(cid:15)ीय सरकार, अhयD क) छुvी मंजूर करने के िलए सDम 9ािधकारी होगी । (2) अhयD, आयोग के 9‘यके अ(cid:14)य सदHय, िजसके अतं ग(cid:26)त उसका अपना सिचव भी ह,ै को छुvी मंजरू करन े वाला 9ािधकारी होगा ।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 10. अिभदायी भिवxय िनिध – (1) आयोग का अhयD, अिभदायी भिवxय िनिध (भारत) िनयम, 1962 के उपबंध= 8ारा वहा ं शािसत होगा, जहा ं सामा(cid:14)य भिवxय िनिध (के(cid:14)(cid:15)ीय सेवा) िनयम, 1960 के अधीन 9ितyुत करन े का कोई िवक(cid:6)प नहU ह ै। (2) आयोग का अhयD, आयोग म Oउनके 8ारा क) गई सेवा के िलए अितQर< पOशन और उपदान का हकदार नहU होगा । 11. बैठक फ)स – आयोग के पदने सदHय और अंशकािलक सदHय, आयोग क) 9‘यके बैठक के िलए पांच हजार rपए क) बैठक फ)स के हकदार ह=गे । 12. आयोग के अhयD और सदHय= 8ारा आिHतय=, विृ :क और वािणिMयक िविनयोजन या आवेbन क) घोषणा – (1) आयोग का अhयD और 9‘यके अ(cid:14)य सदHय, इन िनयम= से उपाबw अनसु ूची के 9mप ‘क’ म O आिHतय= और दािय‘व= क) िववरणी फाइल करेगा । (2) आयोग का अhयD और 9‘यके अ(cid:14)य सदHय अपनी 9थम िनयुि< पर और पद का ‘याग करने के समय पर उ< अनसु ूची के 9mप ‘ख’ म Oअपने वृि:क और वािणिMयक िविनयोजन या आवेbन क) भी घोषणा करेगा । 13. आयोग का सिचव – (1) आयोग के सिचव को संदये वेतन, वते न मQै pqस (1,82,200-2,24,100 rपए) के Hतर 15 मO भारत सरकार के अपर सिचव के वेतन के समतु(cid:6)य होगा : परंत ु जहा ं आयोग का सिचव सरकारी, अध-(cid:26) सरकारी अिभकरण=, पिTलक सेqटर उपWम= या मा(cid:14)यता9ाE अनसु ंधान संHथाs से सेवािनव:ृ >आ ह,ै वहां उसके 8ारा 9ाE पशO न या सेवातं फायद= का पOशिनक म(cid:6)ू य या दोन= के साथ संदये वेतन अंितम 9ाE वेतन स ेअिधक नहU होगा । (2) आयोग के सिचव के पास िन@िलिखत अहत(cid:26) ाएं और अनुभव होगा, अथा(cid:26)त् :- आव(cid:3)यक : (i) (cid:4)कसी िव{िव|ालय स े(cid:4)कसी िवधा म O}ातको:र उपािध ; (ii) जो के(cid:14)(cid:15)ीय सरकार या राMय सरकार या काननू ी िनकाय या मा(cid:14)यता9ाE संगठन या संHथा मO वेतन मQै pqस (78,800-2,09,200 rपए) के Hतर 12 मO या उसके समतु(cid:6)य अपनी संबंिधत सेवा या वृि: मO कम से कम पं(cid:15)ह वष(cid:26) या उससे अिधक रखता हो, िजसम Oइसके साथ कम से कम दस वष(cid:26) का 9शासिनक अनभु व भी हो ; वांछनीय : (iii) िच(cid:4)क‘सा अहत(cid:26) ा रखने वाल ेaि<य= को वरीयता दी जाएगी । 14. आयोग के सिचव क) पदाविध – आयोग का सिचव चार वष (cid:26) क) अविध के िलए पद धारण करेगा और स:र वष (cid:26) क) आयु 9ाE करन ेके प^ात्, जो भी पहले हो, पद धारण नहU करेगा । 15. सिचव क) आिHतय=, विृ :क और वािणिMयक िविनयोजन या आवेbन क) घोषणा – (1) आयोग का सिचव इन िनयम= स ेउपाबw अनसु ूची के 9mप ‘क’ म OआिHतय= और दािय‘व= क) िववरणी फाइल करेगा । (2) आयोग का सिचव अपनी 9थम िनयुि< पर और कायाल(cid:26) य का ‘याग करने के समय पर उ< अनुसूची के 9mप ‘ख’ म O अपनी आिHतय=, विृ :क और वािणMयक िविनयोजन या आवेbन क) भी घोषणा करेगा । 16. आयोग क) अ(cid:14)य शि<या ं और कृ‘य – (1) आयोग, धारा 10 मO िविनdदb(cid:26) आयोग क) शि<य= तथा कृ‘य= के अितQर<,- (क) दशे मO िच(cid:4)क‘सा िशDा का खच (cid:26)कम करने के िलए अhययन करेगा ;¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 5 (ख) िच(cid:4)क‘सा िशDा के खच (cid:26) म O कमी करने और इस े अिधक सुग(cid:10)य बनान े क) दिृ b स े आधुिनक 9ौ|ोिगक) का अंगीकरण, अवसंरचना का गहन उपयोग, सकं ाय साझाकरण, वैि{क पwितय= यथा िवतQरत अHपताल= का, अ(cid:14)य बात= के साथ-साथ, सझु ाव दने ेपर िवचार करेगा ; और (ग) Hवाय: बोड_ के िविन^य= के िवrw अपील= क) सुनवाई करन ेक) रीित का िविन^य करेगा : परंत ु जहा ं अपील Hवाय: बोड (cid:26) के िविन^य के िवrw क) जाती ह,ै वहा ं ऐस े Hवाय: बोड (cid:26) का अhयD अपील काय(cid:26)वािहय= मO भाग नहU लगे ा ; (घ) धारा 57 क) उपधारा (1) के अधीन पQरकि(cid:6)पत पूव (cid:26)9काशन= के शत (cid:26)पर 9ितकूल 9भाव िबना, सभी राMय सरकार=, संघ राMयDेN 9शासन= और अ(cid:14)य पणधाQरय=, जैस-े िच(cid:4)क‘सा aवसाियय= के संगम, िनवासी िच(cid:4)क‘सक= का संगम, रोगी संबधं ी अिधकार िनकाय= से, िजनके अंतग(cid:26)त साधारण जनता भी ह,ै तीस (cid:4)दन क) अविध के िलए आयोग क) बेवसाइट पर 9ाmप िविनयम= को डालकर और ऐसे आDेप= या सझु ाव=, जो 9ाE (cid:4)कए जाएं, पर िवचार करके, स े परामश (cid:26) करन े के प^ात् िविनयम बनाएगा : (ङ) अपनी अपेDा के अनसु ार, सिं वदा आधार पर कम(cid:26)चाQरय= क) भतf, जो भारतीय िच(cid:4)क‘सा पQरषद ् क) वत(cid:26)मान Hवीकृत संgया स े अिधक न हो, तब तक नहU करेगा, जब तक (cid:4)क आयोग के िलए पद Hवीकृत नहU कर (cid:4)दए जात े ह V और उ< पद= के िलए िनयिमत भतf नहU हो Short title and commencement.––(1) These rules may be called the National Medical Commission (Manner of Appointment and Nomination of Members, their Salary, Allowances and Terms and Conditions of Service, and Declaration of Assets, Professional and Commercial Engagements) Rules, 2019. (2)They shall come into force from the date of their publication in the Official Gazette. 2. Definitions.––(1) In these rules, unless the context otherwise requires,–– (a) “Act” means the National Medical Commission Act, 2019 (30 of 2019); (b) “Commission” means the National Medical Commission constituted under section 3 of the Act; (c) “section” means a section of the Act. (2) Words and expressions used in these rules and not defined herein but defined in the Act, shall have the respective meanings assigned to them in the Act. 3. Manner of appointment of part-time Members of Commission under clauses (b) and (c) of sub-section (4) of section 4.–– (1) The Members shall be appointed by the Central Government for a period of two years. (2) The part-time Members of the Commission to be appointed under clauses (b) and (c) of sub-section (4) of section 4 shall be selected by draw of lots from the nominees of States and Union territories in the Medical Advisory Council. (3) The draw of lots shall be conducted in two categories on such date as may be decided by the Central Government. (4) The draw of lots shall be conducted with paper slips of uniform size, colour and design bearing individual names of each State and Union territories, which shall be folded in such manner so as to preserve the confidentiality. (5) The first category of the draw of lots shall be conducted for ten part-time Members from the nominees of States and Union territories amongst the Members of the Medical Advisory Council, nominated under clauses (c) and (d) of sub-section (2) of section 11. (6) The second category of the draw of lots shall be conducted for nine part-time Members from the nominees of States and Union territories by the respective State Medical Council amongst the elected Members of the State Medical Council, nominated under clause (e) of sub-section (2) of section 11: Provided that for the purposes of ensuring representation of maximum States and Union territories, the States and Union territories whose nominees were selected from the draw of lots held for the first category shall be excluded in the draw of lots to be held for the second category. (7) The total number of paper slips shall correspond to the total number of States and Union territories, irrespective of whether a State or Union territory has valid nomination under clauses (c), (d) and (e) of sub-section (2) of section 11, respectively. (8) During the draw of lots as mentioned in sub-rules (5) and (6), one paper slip shall be picked up at a time till all Members are decided in a given category. (9) Where a paper slip is picked up for a State or Union territory, which does not have a nominee in the respective category, the paper slip shall be kept aside till the draw of lots for the particular category is completed and it shall be put back when the draw of lots for the second category commences. (10) Every draw of lots subsequent to the first term of two years shall be conducted in two stages, first by a restricted draw of lotsfor the two categories referred to in sub-rules (5) and (6) to be drawn from among those States and Union¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 13 territories, which were not selected in the draw of lots held for selection of the Members of the Commissionin accordance with this ruleandfor selection of the fourth Member of Autonomous Boardsin accordance with the National Medical Commission, Autonomous Boards (Manner of Appointment of Fourth Member and the Salary, Allowances and Terms and Conditions of Service, and Declaration of Assets, Professional and Commercial Engagements of President and Members) Rules, 2019, during the previous term. (11) After such number of nominees have been selected through the restricted draw of lots as referred to in sub-rule (10) in respect of the States and Union territories for which Members were not selected for the previous term, the remaining nominees for part-time Members of the Commission under the two categories referred to in sub-rules (5) and (6) shall be selected from amongst the rest of the States and Union territories by draw of lots, respectively. (12) No State or Union territory shall be represented by more than one nominee in the Commission at a time. (13) The draw of lots shall be conducted in the presence of the Union Minister of Health and Family Welfare. (14) The video recording of the entire process of draw of lots shall be made and all records relating to the draw of lots shall be kept for a period of six months on the website of the Ministry of Health and Family Welfare for public access. (15) For the purpose of maintaining transparency during the process of draw of lots, media personnel shall be invited. (16) Where the term of a nominee of a State or Union territory selected through draw of lots is reduced for any reason to less than two years, the Central Government shall appoint other nominee of the same State or Union territory for the remaining period on the basis of nomination by the concerned State or Union territory or the State Medical Council, as the case may be. (17) The draw of lots to nominate Members of the Commission from among the nominees from the States and Union territories shall be conducted every consecutive two years. 4. Nomination of an expert under clause (c) of sub-section (1) of section 5 for Search Committee for appointment of Chairperson and Members of Commission.––(1) The Central Government shall appoint an expert to form part of the Search Committee for appointment of Chairperson and Members of Commission for a period of two years. (2) The expert referred to in sub-rule (1) shall be selected by draw of lots from amongst the part-time Members of the Commission appointed under clause (c) of sub-section (4) of section 4. (3) The draw of lots shall be conducted with the paper slips of uniform size, colour and design bearing individual names of each part-time Member of the Commission appointed under clause (c) of sub-section (4) of section 4, which shall be folded in such manner so as to preserve the confidentiality. (4) The draw of lots under this rule shall be conducted following the procedure, mutatis mutandis, as specified under sub-rules (13), (14), (15), (16) and (17) of rule 3. 5. Salaries and allowances payable to Chairperson of Commission.––(1) The salary payable to the Chairperson of the Commission shall be equivalent to the salary of the Secretary to the Government of India in Level-17 in the pay matrix (Rs. 225000/-): Provided that where the Chairperson of the Commission is a retired person from Government, semi- Government agencies, public sector undertakings or recognised research institutions, the salary payable together with the pension or pensionary value of the terminal benefits, or both, received by him shall not exceed the last pay drawn. (2) If the Chairperson of the Commission is in service of the Central Government or a State Government, his salary and allowances shall be regulated in accordance with the rules applicable to him or sub-rule (1), whichever is higher. 6. Dearness allowance.––(1) The Chairperson and every other Member of the Commission, shall be entitled for dearness allowance appropriate to their pay at the rates admissible to officers of equivalent level in the Central Government.14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (2) The dearness allowance of ex-officio Members of the Commission shall be borne by their parent Ministry or Department or organisation. 7. Travelling allowance.––(1) The Chairperson and every other Member of the Commission shall be entitled to draw travelling allowances and daily allowances at the rates appropriate to their pay admissible to officers of equivalent level in the Central Government. (2) The travelling allowance of ex-officio Members of the Commission shall be borne by their parent Ministry or Department or organisation. (3) The Chairperson and every Member of the Commission shall be his own controlling officer in respect of his bills relating to travelling allowances and daily allowances. 8. Leave.––The Chairperson and every other Member of the Commission shall be entitled to–– (a) earned leave, half pay leave and commuted leave as admissible to Central Government servants in accordance with the Central Civil Services (Leave) Rules,1972, as amended from time to time; and (b) extraordinary leave as admissible to the temporary Central Government servants under the Central Civil Services (Leave) Rules, 1972, as amended from time to time. 9. Leave sanctioning authority.––(1) The Central Government shall be the authority competent to sanction leave to the Chairperson. (2) The Chairperson shall be the authority to sanction leave to every other Member of the Commission including its Secretary. 10. Contributory Provident Fund.––(1) The Chairperson of the Commission shall be governed by the provisions of the Contributory Provident Fund Rules (India), 1962 where no option to subscribe under the General Provident Fund (Central Services) Rules, 1960 is available. (2) The Chairperson of the Commission shall not be entitled to additional pension and gratuity for the service rendered by them in the Commission. 11. Sitting fee.––The ex-officio Members and part-time Members of the Commission shall be entitled to a sitting fee of five thousandrupees for each day ofsitting of the Commission. 12. Declaration of assets, professional and commercial engagement or involvement by Chairperson and Members of Commission.––(1)The Chairperson and every other Member of the Commission shall file return of assets and liabilities in Form A of the Schedule annexed to these rules. (2) The Chairperson and every other Member of the Commission shall also declare their professional and commercial engagement or involvement on their first appointment and at the time of demitting office in Form B of the said Schedule. 13. Secretary to Commission.––(1) The salary payable to the Secretary to the Commission shall be equivalent to the salary of Additional Secretary to the Government of Indiain Level 15 in the pay matrix (Rs. 182200-224100/-). Provided that where the Secretary to the Commission is a retired person from Government, semi-Government agencies, public sector undertakings or recognised research institutions, the salary payable together with the pension or pensionary value of the terminal benefits, or both, received by him shall not exceed the last pay drawn. (2) The Secretary to the Commission shall possess the following qualifications and experience, namely:–– Essential: (i) post-graduate degree in any discipline from any University; (ii) having experience in the Central Government or a State Government or any statutory body or recognized organisation or institution of not less than fifteen years in his related service or profession in Level 12 in the pay matrix (Rs. 78800-209200/-) or equivalent thereto or abovealongwith administrative experience of not less than ten years;¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 15 Desirable: (iii) preference may be given to persons having medical qualification. 14. Term of office of Secretary to Commission.––The Secretary to the Commission shall hold office for a term of four years and shall cease to hold office after attaining the age of seventy years, whichever is earlier. 15. Declaration of assets, professional and commercial engagement or involvement by Secretary.––(1)The Secretary of the Commission shall file return of assets and liabilities in the Form A of the Schedule annexed to these rules. (2) The Secretary of the Commission shall also declare his professional and commercial engagement or involvement on his first appointment and at the time of demitting office in Form B of the said Schedule. 16. Other powers and functions of Commission.––In addition to the powers and functions of the Commission specified in section 10, the Commission shall–– (a) undertake study to reduce the cost of medical education in the country; (b) consider to suggest, among others, adoption of modern technology, intensive use of infrastructure, faculty sharing, global practices as distributed hospitals with a view to reducing the cost of medical education and making it more accessible; and (c) decide the manner of hearing appeals against the decisions of Autonomous Boards: Provided that where an appeal is filed against the decision of an Autonomous Board, the President of such Autonomous Board shall not participate in the appeal proceedings; (d) without prejudice to the condition of previous publication envisaged under sub-section (1) of section 57, make regulations after consulting all State Governments, Union territory Administrations and other stakeholders, such as, association of medical professionals, association of resident doctors and patient rights bodiesincluding general public by placing the draft regulations on the website of the Commission for a period of thirty days and considering the objections or suggestions as may be received; (e) recruit employees on contract basis as per its requirement, not exceeding the present sanctioned strength of the Medical Council of India, until the posts are sanctioned for the Commission and regular recruitment for the said posts takes place. 17. Compensation for the premature termination of employment of employees of Medical Council of India.–– (1) The Commission shall decide on the premature termination compensation of the employees of the erstwhile Medical Council of India within a period of three months from the date of constitution of the Commission. (2) The employees of erstwhile Medical Council of India who are not taken for employment on contract basis by the Commission, shall be paid an advance amount of equivalent to three months’ salary at the time of termination, which shall be deductedfrom the total compensation package.
