(1) इन जवजनयमों को पजिम बंग ग्रामीण बैंक (अजधकारी और कमशिारी) सेवा (संिोधन) जवजनयम, 2024 कहा िाएगा. (2) य ेसंिोधन, इनके सरकारी रािपत्र म ेंप्रकाजित होन े की जतजथ से लाग ूहो िाएगं े. 2. पजिम बगं ग्रामीण बैंक (अजधकारी और कमशिारी) सेवा जवजनयम, 2010 (जिन् ह ेंइसके बाद उि जवजनयम कहा िाएगा) म,ें जवजनयम 61 के उप-जवजनयम (4) के जलए, जनम्नजलजखत उप-जवजनयम प्रजतस्ट्थाजपत ककया िाएगा, यथा:- 6778 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] “(4) जविेिाजधकार अवकाि 270 कदनों स े अजधक तक का नहीं िमा ककया िा सकता है, जसवाय इसके कक िहा ं छुट्टी के जलए आवेदन ककया गया हो और उसे अस्ट्वीकार कर कदया गया हो: बिते कक जविेिाजधकार अवकाि का नकदीकरण अजधकतम 240 कदन के जलए ही ककया िा सकेगा.” 3. उि जवजनयमों के जवजनयम 67 के,- क) दसू रे प्रावधान म,ें “बैंक की सेवा से सेवाजनवृत्त” िब्दों के बाद, “जवजनयम 11 के प्रावधानों के अंतगशत” िब्द सजममजलत ककए िाएंग;े ख) तीसरे प्रावधान के स्ट्थान पर जनम्नजलजखत प्रावधान िाजमल ककया िाएगा, यथा:- “यह भी प्रावधान ककया िाता ह ै कक उस कमशिारी के संबंध म ें जिसकी सेवाएं छंटनी के कारण समाप्त कर दी िाती ह,ैं वह जविेिाजधकार अवकाि की अवजध के जलए पठरलजब्धयों के बराबर की राजि का भुगतान प्राप् त करने के जलए पात्र होगा, िो उसने जवजनयम 61 के उप-जवजनयम (4) के अधीन िमा कर रखा था.” ग) तीसरे प्रावधान के बाद, जनम्नजलजखत प्रावधान सजममजलत ककए िाएंगे, यथा,- “यह भी प्रावधान ककया िाता ह ै कक िहांकोई अजधकारी अथवा कमशिारी, पजिम बंग ग्रामीण बैंक (कमशिारी) पेंिन जवजनयम, 2018 के जवजनयम 27 के उप-जवजनयम (1) और (2) के तहत जवजधवत् नोठटस देने के बाद अपनी स्ट्वेच्छा से कदनांक 01 अप्रलै 2018 को या उसके बाद सेवा से सेवा जनवृत्त होता है, तो वह अपने द्वारा जवजनयम 61 के उप-जवजनयम (4) के अधीन संजित जविेिाजधकार अवकाि की अवजध के जलए पठरलजब्धयों के बराबर की राजि का भुगतान प्राप् त करन ेके जलए पात्र होगा. यह भी प्रावधान ककया िाता है कक िहां ककसी अजधकारी या कमशिारी को, अजनवायश रूप से सेवाजनवृत्त कर कदया गया हो, जिसमें दंड भी िाजमल ह,ै वह जवजनयम 61 के उप-जवनयम (4) के अधीन, ककसी भी अवजध की पठरलजब्धयों के बराबर की राजि का भुगतान प्राप् त करन ेके जलए पात्र होगा. यह भी प्रावधान ककया िाता ह ैकक िहां कोई अजधकारी या कमशिारी सेवा छोड़ देता ह ैया काम पर आना बंद कर दते ा ह ैया जवजनयम 10 के उप-जवजनयम (1) के प्रावधानों के तहत पद त्याग कर देता है, तो वह सेवा की समाजप्त की जतजथ को उसके खाते में िमा जविेिाजधकार छुट्टी की आधी अवजध की पठरलजब्धयों के बराबर की राजि का भुगतान प्राप् त करने के जलए पात्र होगा, यह अवजध अजधकतम 120 कदन तक की ही हो सकती ह ै I” प्रणब कुमार जब‍ वास, अध्यक्ष [जवज्ञापन-III/4/असा./596/2024-25] नोट: पजिम बगं ग्रामीण बकैं (अजधकारी और कमशिारी) सेवा जवजनयमन, 2010 को कदनांक 10 अगस्ट्त, 2011 के भारत के रािपत्र, भाग III, खडं 4 में कदनांक 11 अक्टूबर, 2010 की अजधसूिना संख्या 255 के माध्यम से प्रकाजित ककया गया था और बाद में कदनांक 05 कदसबं र, 2018 की अजधसूिना संख्या 464 द्वारा संिोजधत ककया गया था I[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 PASCHIM BANGA GRAMIN BANK NOTIFICATION Howrah, the 15th October, 2024 No. PBGB/HO/CHM/PAD/300/2024-25.—In exercise of the powers conferred by Section 30 read with sub- section (1) of Section 17 of the Regional Rural Banks Act, 1976 (21 of 1976), the Board of Directors of Paschim Banga Gramin Bank after consultation with UCO Bank, being the Sponsor Bank and the National Bank for Agriculture and Rural Development and with the previous sanction of the Central Government, hereby makes the following regulations to further amend the Paschim Banga Gramin Bank (Officers & Employees) Service Regulations, 2010, namely:- 1. (1) These Regulations may be called Paschim Banga Gramin Bank (Officers & Employees) Service (Amendment) Regulations, 2024. (2) In the Paschim Banga Gramin Bank (Officers & Employees) Service Regulations, 2010, (hereinafter referred to as said regulations), in the regulations 61 for sub-regulation (4), the following sub-regulation shall be substituted, namely;- “(4) Privilege Leave may be accumulated up to not more than 270 days, except where leave has been applied for and it has been refused: Provided that encashment of Privilege Leave shall be restricted up to a maximum of 240 days.” 3. In the said regulations, in regulation 67,- (a) In the second proviso, after the words “retires from the service of the Bank”, the words “under the provisions of regulation 11” shall be inserted; (b) For third Proviso, the following proviso shall be substituted, namely:- “Provided also that in respect of the employee where his services are terminated owing to retrenchment, he shall be eligible to be paid a sum equivalent to the emoluments for the period of privilege leave he had accumulated subject to sub-regulation (4) of regulation 61.” (c) After third proviso, the following provisos shall be inserted, namely,- “Provided also that where an officer or employee voluntarily retires from service on or after the 1st of April 2018, after giving due notice under sub-regulations (1) and (2) of regulation 27 of the Paschim Banga Gramin Bank (Employees) Pension Regulations 2018, he shall be eligible to be paid a sum equivalent to the emoluments for the period of privilege leave he had accumulated, subject to sub-regulation (4) of regulation 61. Provided also that where an officer or employee has been compulsorily retired including as a measure of punishment, he shall be eligible to be paid a sum equivalent to the emoluments of any period, subject to sub-regulation (4) of regulation 61.
