(1) इन जवजनर्मों को पजिम बगं ग्रामीण बैंक (कमाचारी) पेंिन (संिोधन) जवजनर्म, 2024 कहा िाएगा. (2) र् ेजनर्म रािपत्र म ेंउनके प्रकािन की तारीख से लाग ूहोंगे. 2. पजिम बंग ग्रामीण बैंक (कमाचारी) पेंिन जवजनर्म, 2018 (इसके बाद इसे उक्त जवजनर्म कहा िाएगा) के, जवजनर्म 2 के, उप-जवजनर्म (1) के, खडं (के) में, आंकड़,े अंक और िब्द "अप्रैल, 2018 का पहला ददन" के स्ट्थान पर "नवंबर 1993 का पहला ददन" आंकड़,े अंक और िब्द प्रजतस्ट् थाजपत दकए िाएंग.े 6779 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] 3. उक्त जवजनर्मों म,ें जवजनर्म 3 को जनम्न जलजखत जवजनर्म स ेप्रजतस्ट्थाजपत दकर्ा िाएगा, नामत:, - "3. अनप्रु र्ोग - (1) कोई भी कमाचारी िो - (क) 1 जसतंबर, 1987 और 31 माचा 2010 के मध् र् बैंक की सेवा में था और पजिम बंग ग्रामीण बैंक (कमाचारी) पेंिन (संिोधन) जवजनर्म, 2024 की अजधसूचना की तारीख से पहले सेवाजनवृत्त र्ा बखाास्ट्त र्ा हटा ददर्ा गर्ा र्ा सेवा की समाजि कर दी गई और आजधकाठरक रािपत्र म ें पजिम बंग ग्रामीण बैंक (कमाचारी) पेंिन (संिोधन) जवजनर्म, 2024 की अजधसूचना की तारीख से पंद्रह ददनों के भीतर ठरफंड करता ह ै र्ा जनजध का सदस्ट् र् बनता ह ै और उसके द्वारा प्राि संपूण ा अंजतम राजि (कमाचारी पेंिन र्ोिना, 1995 के तहत भजवष्र्जनजध म ें बैंक का र्ोगदान और राजि की प्राजि की तारीख तक उसपर अर्िात ब्र्ाि) को ठरफंड कर देता ह ैऔर कमाचारी पेंिन र्ोिना, 1995 के तहत उसके द्वारा प्राि आवजधक पेंिन, र्दद कोई हो, तो आजधकाठरक रािपत्र में पजिम बंग ग्रामीण बैंक (कमाचारी) पेंिन (संिोधन) जवजनर्म, 2024 की अजधसूचना की तारीख से पहल े दकसी भी अवजध के जलए आरोप्र्, र्ा अनारोप् र्, दकसी भी जस्ट्थजत म,ें ऐसी राजिर्ों की प्राजि की तारीख से ठरफंड की तारीख तक ऐसी राजिर्ों पर ब्र्ाि का भुगतान करना अपेजक्षत नहीं होगा. बिते दक कोई कमाचारी जिससे इस खंड के अनुसार राजि वापस करना अपेजक्षत है, बैंक द्वारा उसको देर् राजि में स ेइन राजिर्ों को समार्ोजित करने के जलए बैंक को प्राजधकृत कर सकता ह.ै और, बित े दक कोई कमाचारी िो उक्त जवजनर्मों के तहत पिें न का जवकल्प चुनने का पात्र था, लेदकन जनधााठरत समर् के भीतर उसन े पेंिन का जवकल्प नहीं चनु ा र्ा चुना ककंतु जनधााठरत समर् के भीतर धन वापस नहीं दकर्ा, तो उस कमाचारी को, कमाचारी पेंिन र्ोिना, 1995 के तहत उसके द्वारा प्राि आवजधक पेंिन, र्दद कोई हो, को वापस करने की आव‍र्कता नहीं होगी. (ख) 1 जसतंबर, 1987 और 31 माच ा 2010 के मध् र् बैंक की सेवा में था और आजधकाठरक रािपत्र में पजिम बंग ग्रामीण बैंक (कमाचारी) पेंिन (संिोधन) जवजनर्म, 2024 की अजधसूचना की तारीख को र्ा उसके बाद बैंक की सेवा में िारी रहता ह,ै और जनजध का एक सदस्ट्र् होता ह ै र्ा सदस्ट्र् बनता ह ै और आजधकाठरक रािपत्र में पजिम बंग ग्रामीण बैंक (कमाचारी) पिें न (संिोधन) जवजनर्म, 2024 की अजधसूचना की तारीख से पंद्रह ददनों के भीतर, जवजनर्म 4 में गठित जनजध में बैंक के पूरे र्ोगदान को व उसपर अर्िात ब्र्ाि के साथ अंतठरत कर िमा कर दते ा ह ै र्ा करवाता ह ै तथा कमाचारी पेंिन र्ोिना 1995 के तहत उसके द्वारा प्राि और आजधकाठरक रािपत्र म ें पजिम बंग ग्रामीण बैंक (कमाचारी) पिें न (सिं ोधन) जवजनर्म, 2024 की अजधसूचना की तारीख से पहल े दकसी भी अवजध के जलए आरोजपत पेंिन का भाग, र्दद कोई हो, को वापस कर देता ह.ै (ग) 1 जसतंबर, 1987 और 31 माचा 2010 के मध् र् बैंक की सेवा में था और अजधजनर्म की धारा 23 ए की उप- धारा (3) के खडं (बी) के तहत जिसने एक जवकल्प का प्रर्ोग दकर्ा था र्ा उक्त जवजनर्मों की अजधसूचना स े पहल े इस्ट्तीफा दे ददर्ा था, दोनों ही मामलों म,ें 20 साल की अहका सेवा पूरी करने के बाद और उजचत नोठटस देकर, जनजध का सदस्ट्र् बनता ह ै और आजधकाठरक रािपत्र में पजिम बंग ग्रामीण बैंक (कमाचारी) पेंिन (संिोधन) जवजनर्म, 2024 की अजधसूचना की तारीख से पंद्रह ददनों के भीतर, उसके द्वारा प्राि संपूण ा अंजतम राजि (कमाचारी पेंिन र्ोिना, 1995 के तहत व भजवष्र् जनजध म ें बैंक का र्ोगदान और राजि की प्राजि की तारीख तक उसपर अर्िात ब्र्ाि) को ठरफंड कर देता ह ै और कमाचारी पेंिन र्ोिना, 1995 के तहत उसके द्वारा प्राि आवजधक पिें न, र्दद कोई हो, तो आजधकाठरक रािपत्र में पजिम बगं ग्रामीण बकैं (कमाचारी) पेंिन (संिोधन) जवजनर्म, 2024 की अजधसूचना की तारीख से पहल े दकसी भी अवजध के जलए आरोप्र्, र्ा अनारोप् र्, दकसी भी जस्ट्थजत में, ऐसी राजिर्ों की प्राजि की तारीख से ठरफंड की तारीख तक ऐसी राजिर्ों पर ब्र्ाि का भुगतान करना अपजे क्षत नहीं होगा.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 बिते दक एक कमाचारी, जिससे इस खंड के तहत राजि वापस करना अपेजक्षत ह,ै बैंक द्वारा उसको देर् राजि में स ेइन राजिर्ों को समार्ोजित करने के जलए बैंक को प्राजधकृत कर सकता ह.ै (2) उप-जवजनर्म (1) के खडं (क) और (ग) के तहत िाजमल दकर्ा गर्ा कमाचारी का पठरवार इन जवजनर्मों के तहत पाठरवाठरक पेंिन का हकदार होगा, िब ऐसे ददवगं त कमाचारी का पठरवार आजधकाठरक रािपत्र में पजिम बगं ग्रामीण बैंक (कमाचारी) पेंिन (संिोधन) जवजनर्म, 2024 की अजधसूचना की तारीख से तीस ददनों के भीतर, ददवंगत कमाचारी द्वारा र्ा र्थाजस्ट्थजत पठरवार द्वारा प्राि पूरी अंजतम राजि, कमाचारी पिें न र्ोिना, 1995 के तहत भजवष्र् जनजध म ें बैंक का र्ोगदान और ददवगं त कमाचारी र्ा र्थाजस्ट्थजत ददवंगत कमाचारी के पठरवार द्वारा राजि की प्राजि की तारीख तक उसपर अर्िात ब्र्ाि और कमाचारी पिें न र्ोिना के तहत कमाचारी र्ा ददवंगत कमाचारी के पठरवार द्वारा प्राि पिें न र्ा पाठरवाठरक पेंिन, र्दद कोई हो, को ठरफंड कर ददर्ा हो र्ा ठरफंड करता हो, ककंत ु दोनों मामलों म ेंप्राजि की तारीख से वापसी की तारीख तक ब्र्ाि का भुगतान करना अपेजक्षत नहीं होगा. बिते दक ददवंगत कमाचारी का पठरवार जिससे इस खंड के तहत राजि वापस करना अपेजक्षत है, बैंक द्वारा उसको देर् राजि में से इन राजिर्ों को समार्ोजित करन ेके जलए बैंक को प्राजधकृत कर सकता ह.ै (3) इस जवजनर्म म ें दकसी बात के होते हुए भी, िो कमाचारी 1 अप्रलै , 2010 को र्ा उसके बाद बैंक की सेवा म ें िाजमल हुआ ह,ै उसे राष्ट्रीर् पिें न प्रणाली म ेंिाजमल दकर्ा िाएगा. 4. उक्त जवजनर्मों के जवजनर्म 20 म,ें उप-जवजनर्म (1) के पिात,् जनम्नजलजखत परंतुक अतं ःस्ट्थाजपत दकर्ा िाएगा, नामत: - "बित े दक जवजनर्म 3 के उप-जवजनर्म (1) के खंड (सी) के अतं गात आन े वाल े कमाचाठरर्ों का सेवाकाल समपहृत नहीं होगा.” 5. उक्त जवजनर्मों के जवजनर्म 32 में जनम् नजलजखत जवजनर्म को प्रजतस्ट्थाजपत दकर्ा िाएगा, नामत: - "कजतपर् कमाचाठरर्ों के संबंध में पेंिन र्ा पाठरवाठरक पिें न का भुगतान, - (1) वे कमाचारी िो 1 जसतंबर 1987 और 31 अक्त ूबर 1993 के मध् र् बैंक की सेवा से सेवाजनवृत्त हुए हैं, व े प्रभावी तारीख से पेंिन के जलए पात्र होंग.े (2) ददवंगत कमाचारी, िो 1 जसतंबर 1987 और 31 अक्त ूबर 1993 के मध् र् सेवा म ें था और 31 अक्त ूबर 1993 स े पहल े उसकी मृत् र्ु हो गई थी, उसका पठरवार प्रभावी तारीख से पठरवाठरक पिें न के भुगतान के जलए पात्र होगा. 6. उक्त जवजनर्मों के जवजनर्म 50 में जनम् नजलजखत जवजनर्म को प्रजतस्ट्थाजपत दकर्ा िाएगा, नामत:- "जिस तारीख से पेंिन देर् होती ह ै – (1) जिस कमाचारी पर जवजनर्म 32 के उप-जवजनर्म (1), जवजनर्म 41 र्ा 44 के उपबंध लागू होत े ह,ैं को छोड़कर, पजिम बंग ग्रामीण बैंक (कमाचारी) पिें न (संिोधन) जवजनर्म, 2024 के तहत जनधाठा रत समर् के भीतर जवजनर्म 3 के उप-जवजनर्म (1) के तहत जनर्दाष् ट परू ी राजि को ठरफंड कर देन े र्ा ठरफंड दकए िाने र्ा समार्ोिन हते ु प्राजधकृत करन े पर, पाठरवाठरक पेंिन को छोड़कर, उस तारीख की अगली तारीख स े पेिन देर् हो िाएगी जिस तारीख को कोई कमाचारी सेवाजनवृत्त होता ह ैर्ा, र्थाजस्ट्थजत, पदत् र्ाग करता ह ैर्ा अजधजनर्म की धारा 23 क की उपधारा (3) के खडं (ख) के तहत अंतठरती बैंक म ेंिाजमल होन े का जवकल्प नहीं चुनता ह.ै4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (2) जिस कमाचारी पर जवजनर्म 32 के उप-जवजनर्म (1), जवजनर्म 41 र्ा 44 के उपबंध लाग ू होते ह,ैं को छोड़कर, पजिम बंग ग्रामीण बैंक (कमाचारी) पिें न (संिोधन) जवजनर्म, 2024 के तहत जनधाठा रत समर् के भीतर जवजनर्म 3 के उप-जवजनर्म (2) के तहत जनर्दाष् ट परू ी राजि को ठरफंड कर देन े र्ा ठरफंड दकए िाने र्ा समार्ोिन हते ु प्राजधकृत करने पर, उस तारीख की अगली तारीख स े पाठरवाठरक पेंिन देर् हो िाएगी जिस तारीख को कमाचारी की मृत् र्ु होती ह.ै (3) इन जवजनर्मों में दकसी बात के होते हुए भी, दकसी कमाचारी र्ा ददवंगत कमाचारी के पठरवार के मामले में, िो उक्त जवजनर्मों के तहत र्थाजस्ट्थजत पेंिन र्ा पाठरवाठरक पेंिन का जवकल् प चुनन े के जलए पात्र था, उसने जवकल् प नहीं चुना र्ा जवकल् प तो चुना ककंतु पैसा ठरफंड नहीं दकर्ा ककंतु अब वह जवजनर्मन (3) के उप-जवजनर्म (1) के खंड (क) के तहत र्थाजस्ट्थजत, ठरफंड करता ह ै र्ा समार्ोिन हते ु प्राजधकृत करता ह ै तो वह जवजनर्म 3 के उप- जवजनर्म (2) के तहत पजिम बंग ग्रामीण बैंक (कमाचारी) पिें न (संिोधन) जवजनर्म, 2024 की अजधसूचना पर र्ा उसके बाद, उप-जवजनर्म (1) र्ा जवजनर्म 3 के खडं (ग) के तहत र्ा जवजनर्म 3 के उप-जवजनर्म (2) के तहत सेवा जनवृजत्त र्ा इस्ट्तीफे की तारीख र्ा मृत्र्ु, िो भी बाद में हो, से र्थाजस्ट्थजत ठरफंड र्ा समार्ोिन की तारीख से र्थाजस्ट्थजत पेंिन र्ा पाठरवाठरक पेंिनके जलए पात्र होगा. प्रणब कुमार जबश्वास, अध्र्क्ष [जवज्ञापन-III/4/असा./597/2024-25] नोट: मूल अजधसूचना स.ं 464 ददनांक 5 ददसंबर, 2018 के भारत के रािपत्र, असाधारण, भाग III, खंड 4, के माध् र्म से प्रकाजित की गई थी, ददनांक 15 नवंबर, 2018. No. PBGB/HO/CHM/PAD/301/2024-25.— In exercise of the powers conferred by Section 30 read with sub-section (1) of section 17 of the Regional Rural Banks Act, 1976 (21 of 1976) the Board of Directors of Paschim Banga Gramin Bank, after consultation with UCO Bank being the Sponsor Bank, and the National Bank for Agriculture and Rural Development and with the previous sanction of the Central Government, hereby makes the following regulations to amend the Paschim Banga Gramin Bank (Employees’) Pension Regulations, 2018, namely: 1. (1) These Regulations may me called Paschim Banga Gramin Bank (Employees’) Pension (Amendment) Regulations, 2024. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Paschim Banga Gramin Bank (Employees’) Pension Regulations, 2018 (hereinafter referred to as the said regulations), in regulation 2, in sub-regulation (1), in clause (k), for the figures, letters and words “1st day of April, 2018”, the figures, letters and words “1st day of November, 1993” shall be substituted. 3. In regulation 3 of the said regulations, the following regulation shall be substituted, namely:- “3. Application.–(1) Any employee who – (a) was in the service of the Bank between the 1st September, 1987 and the31stMarch, 2010 and retired or dismissed or removed or terminated from service before the date of notification of Paschim[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 5 Banga Gramin Bank (Employees’) Pension (Amendment) Regulations, 2024 and refunded or becomes a member of the Fund and refund within fifteen days from the date of notification of Paschim Banga Gramin Bank (Employees’) Pension (Amendment) Regulations, 2024 in the Official Gazette, the entire final amounts received by him (the corpus comprising of Bank’s contribution to provident fund under the Employees’ Pension Scheme, 1995 and interest accrued thereon till the date of receipt by him of the amount) and the periodic pension, if any, received by him under the Employees’ Pension Scheme, 1995 attributable to any period before date of notification of Paschim Banga Gramin Bank (Employees’) Pension (Amendment) Regulations, 2024 in the Official Gazette but without, in either case, requiring to pay interest on such amounts from the date of receipt of such amounts to the date of refund: Provided that an employee who is required to refund the amounts as per this clause may authorise the Bank to adjust these amounts from the amounts payable by the Bank to the employee: Provided further that an employee who was eligible to opt for pension under the said regulations but did not opt within the stipulated time or having opted not refunded the money within the stipulated time, the periodic pension, if any, received by him under the Employees’ Pension Scheme, 1995, need not be refunded. (b) was in the service of the Bank between the 1st September, 1987 and the 31stMarch, 2010 and continue to be in the service of the Bank on or after the date of notification of Paschim Banga Gramin Bank (Employees’) Pension (Amendment) Regulations, 2024in the Official Gazette, and a member or becomes member of the Fund and caused or cause to transfer the entire contribution of the Bank along with the interest accrued thereon, within fifteen days from the date of notification of Paschim Banga Gramin Bank (Employees’) Pension (Amendment) Regulations, 2024 in the Official Gazette, to the credit of the Fund constituted in regulation 4 and refund the portion of pension, if any, received by him under Employees’ Pension Scheme 1995, and attributable to any period before date of notification of Paschim Banga Gramin Bank (Employees’) Pension (Amendment) Regulations, 2024 in the Official Gazette. (c) was in the service of the Bank between the 1stSeptember, 1987 and the 31st March,2010 and exercised an option under clause (b) of sub-section (3) of section 23A of the Act or resigned before the notification of the said Regulations, in either case, after having completed twenty years of qualifying service and by giving proper notice, shall become member of the Fund and refund within fifteen days from the date of notification of Paschim Banga Gramin Bank (Employees’) Pension (Amendment) Regulations, 2024 in the Official Gazette, the entire final amounts received by him (the corpus comprising of Bank’s contribution to provident fund under the Employees’ Pension Scheme, 1995 and interest accrued thereon till the date of receipt by him of the amount) and periodic pension, if any, received by him under the Employees’ Pension Scheme, 1995 attributable to any period before date of notification of Paschim Banga Gramin Bank (Employees’) Pension (Amendment) Regulations, 2024 in the Official Gazette but without, in either case, requiring to pay interest on such amounts from the date of receipt of such amounts to the date of refund: Provided that an employee, who is required to refund the amounts, under this clause may authorise the Bank to adjust these amounts from the amounts payable by the Bank to the employee. (2) The family of the employee covered under clauses (a) and (c) of sub-regulation (1), shall be entitled to family pension under these regulations when the family of such deceased employee refunded or refunds within thirty days from the date of notification of Paschim Banga Gramin Bank (Employees’) Pension(Amendment) Regulations, 2024 in the Official Gazette, the entire final amounts received by the deceased employee or as the case may be the family, the corpus comprising of Bank’s contribution to provident fund under the Employees’ Pension Scheme, 1995, and interest accrued thereon till the date of receipt of the amount by the deceased employee or, as the case may be, the family of a deceased employee and pension or family pension, if any, received by the employee or the family of the deceased employee under the Employees’ Pension Scheme, 1995, but in either case without requiring to pay interest from the date of receipt to the date of refund.6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] Provided that a family of the deceased employee, who is required to refund the amounts under this clause may authorise the Bank to adjust these amounts from the amounts payable by the Bank to the employee. (3) Notwithstanding anything contained in this regulation, any employee who joined the service of the Bank on or after the 1st April, 2010 shall be covered by the National Pension System”. 4. In regulation 20 of the said regulations, after sub-regulation (1), the following proviso shall be inserted, namely:- “Provided that there would no forfeiture of service for employees covered under clause (c) of sub- regulation (1) of regulation 3”. 5. In regulation 32 of the said regulations, the following regulation shall be substituted namely:- “Payment of pension or family pension in respect of certain employees.-(1) Employees who have retired from the service of the Bank between the 1stSeptember, 1987 and the 31stOctober, 1993 shall be eligible for pension from the effective date. (2) The family of a deceased employee, who was in service between the 1stSeptember, 1987 and the 31stOctober, 1993 and died before the 31stOctober, 1993 shall be eligible for payment of family pension from the effective date”. 6. In regulation 50 of the said regulations, the following regulation shall be substituted, namely:- “Date from which pension becomes payable.- (1) Except in the case of an employee to whom the provisions of sub-regulation (1) of regulations 32, or 41, or 44 apply a pension other than the family pension shall become payable from the date following the date on which an employee retires or, as the case may be, resigns or opts not to join the transferee bank under clause (b) of sub- section (3) of section 23A of the Act on refund or refunding or authorising adjustment of the entire amounts specified under sub-regulation (1) of regulation 3 within the time stipulated under Paschim Banga Gramin Bank (Employees’) Pension(Amendment) Regulations, 2024. (2) Except in the case of an employee to whom the provisions of sub-regulation (1) of regulations 32, or 41, or 44 apply, family pension shall become payable from the date following the date of death of the employee, on refunding or authorising adjustment of the entire amounts specified under sub-regulation (2) of regulation 3 within the time stipulated under Paschim Banga Gramin Bank (Employees’) Pension (Amendment) Regulations, 2024. (3) Notwithstanding anything contained in these regulations, in case of an employee, or as the case may be, family of the deceased employee who was eligible to opt for pension, or as the case may be, family pension under the said regulations but did not opt or opted but did not refund the money, but refunds or authorise adjustment of money under clause (a) of sub-regulation (1) of regulation (3), or as the case may be, under sub-regulation (2) of regulation 3 on or after notification of Paschim Banga Gramin Bank (Employees’) Pension (Amendment) Regulations, 2024 shall be entitled for pension, family pension, or as the case may be, from date of refund or adjustment under clause (c) of sub-regulation (1) of regulation 3, or as the case may be, sub-regulation (2) of regulation 3, or the date of retirement or resignation, or death, as the case may be, whichever is later.” PRANAB KUMAR BISWAS, Chairman [ADVT.-III/4/Exty./597/2024-25] Note: The principal notification was published vide number 464 dated the 05.12.2018 in the Gazette of India, Extraordinary, Part III, section 4, date the 15.11.2018.
