(1) इन जर्जनयमों को सर्व हररयाणा ग्रामीण बैंक (कमवचारी) पेंिन (संिोधन) जर्जनयम, 2024 कहा िाएगा. (2) य ेजनयम रािपत्र म ेंउनके प्रकािन की तारीख से लाग ूहोंगे. 2. सर्व हररयाणा ग्रामीण बकैं (कमवचारी) पेंिन जर्जनयम, 2018 (इसके बाद इसे उक्त जर्जनयम कहा िाएगा) के, जर्जनयम 2 के, उप-जर्जनयम (1) के, खडं (के) में, आंकड,े अकं और िब् द "अप्रलै , 2018 का पहला ददन" के स्ट्थान पर "नर्ंबर 1993 का पहला ददन" आंकड,े अंक और िब्द प्रजतस्ट्थ ाजपत दकए िाएगं े. 3. उक्त जर्जनयमों म,ें जर्जनयम 3 को जनम्न जलजखत जर्जनयम स ेप्रजतस्ट्थाजपत दकया िाएगा, नामत:, - "3. अनप्रु योग - (1) कोई भी कमवचारी िो - (क) 1 जसतंबर, 1987 और 31 माचव 2010 के मध् य बैंक की सेर्ा में था और सर्व हररयाणा ग्रामीण बैंक (कमवचारी) पेंिन (संिोधन) जर्जनयम, 2024 की अजधसूचना की तारीख से पहले सेर्ाजनर्ृत्त या बखावस्ट्त या हटा ददया गया या 6656 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] सेर्ा की समाजि कर दी गई और आजधकाररक रािपत्र में सर् व हररयाणा ग्रामीण बैंक (कमवचारी) पेंिन (संिोधन) जर्जनयम, 2024 की अजधसूचना की तारीख से पंद्रह ददनों के भीतर ररफंड करता ह ै या जनजध का सदस्ट् य बनता ह ै और उसके द्वारा प्राि संपणू व अंजतम राजि (कमवचारी पिें न योिना, 1995 के तहत भजर्ष्य जनजध में बैंक का योगदान और राजि की प्राजि की तारीख तक उस पर अर्िवत ब्याि) को ररफंड कर देता ह ै और कमवचारी पेंिन योिना, 1995 के तहत उसके द्वारा प्राि आर्जधक पेंिन, यदद कोई हो, तो आजधकाररक रािपत्र में सर् व हररयाणा ग्रामीण बैंक (कमवचारी) पिें न (संिोधन) जर्जनयम, 2024 की अजधसूचना की तारीख स े पहल े दकसी भी अर्जध के जलए आरोप्य, या अनारोप् य, दकसी भी जस्ट्थजत म,ें ऐसी राजियों की प्राजि की तारीख स े ररफंड की तारीख तक ऐसी राजियों पर ब्याि का भगु तान करना अपेजक्षत नहीं होगा. बिते दक कोई कमवचारी जिससे इस खंड के अनुसार राजि र्ापस करना अपेजक्षत है, बैंक द्वारा उसको देय राजि में स ेइन राजियों को समायोजित करने के जलए बैंक को प्राजधकृत कर सकता ह.ै और, बित े दक कोई कमवचारी िो उक्त जर्जनयमों के तहत पिें न का जर्कल्प चुनने का पात्र था, लेदकन जनधावररत समय के भीतर उसन े पेंिन का जर्कल्प नहीं चनु ा या चुना ककंतु जनधावररत समय के भीतर धन र्ापस नहीं दकया, तो उस कमवचारी को, कमवचारी पेंिन योिना, 1995 के तहत उसके द्वारा प्राि आर्जधक पेंिन, यदद कोई हो, को र्ापस करने की आर्‍यकता नहीं होगी. (ख) 1 जसतंबर, 1987 और 31 माचव 2010 के मध् य बैंक की सर्े ा में था और आजधकाररक रािपत्र में सर् व हररयाणा ग्रामीण बैंक (कमवचारी) पेंिन (संिोधन) जर्जनयम, 2024 की अजधसूचना की तारीख को या उसके बाद बैंक की सेर्ा में िारी रहता ह,ै और जनजध का एक सदस्ट्य होता ह ै या सदस्ट्य बनता ह ै और आजधकाररक रािपत्र म ें सर् व हररयाणा ग्रामीण बैंक (कमवचारी) पिें न (संिोधन) जर्जनयम, 2024 की अजधसूचना की तारीख से पंद्रह ददनों के भीतर, जर्जनयम 4 में गरित जनजध में बैंक के पूरे योगदान को र् उस पर अर्िवत ब्याि के साथ अंतररत कर िमा कर दते ा ह ै या करर्ाता ह ै तथा कमवचारी पेंिन योिना 1995 के तहत उसके द्वारा प्राि और आजधकाररक रािपत्र म ें सर् व हररयाणा ग्रामीण बैंक (कमवचारी) पिें न (संिोधन) जर्जनयम, 2024 की अजधसूचना की तारीख से पहले दकसी भी अर्जध के जलए आरोजपत पेंिन का भाग, यदद कोई हो, को र्ापस कर दते ा ह.ै (ग) 1 जसतंबर, 1987 और 31 माचव 2010 के मध् य बैंक की सेर्ा में था और अजधजनयम की धारा 23 ए की उप- धारा (3) के खडं (बी) के तहत जिसने एक जर्कल्प का प्रयोग दकया था या उक्त जर्जनयमों की अजधसूचना स े पहल े इस्ट्तीफा दे ददया था, दोनों ही मामलों म,ें 20 साल की अहकव सेर्ा पूरी करने के बाद और उजचत नोरटस देकर, जनजध का सदस्ट्य बनता ह ै और आजधकाररक रािपत्र में सर्व हररयाणा ग्रामीण बैंक (कमवचारी) पिें न (संिोधन) जर्जनयम, 2024 की अजधसूचना की तारीख से पंद्रह ददनों के भीतर, उसके द्वारा प्राि संपूण व अंजतम राजि (कमवचारी पेंिन योिना, 1995 के तहत र् भजर्ष्य जनजध में बैंक का योगदान और राजि की प्राजि की तारीख तक उस पर अर्िवत ब्याि) को ररफंड कर देता ह ै और कमवचारी पेंिन योिना, 1995 के तहत उसके द्वारा प्राि आर्जधक पिें न, यदद कोई हो, तो आजधकाररक रािपत्र म ें सर् व हररयाणा ग्रामीण बैंक (कमवचारी) पिें न (संिोधन) जर्जनयम, 2024 की अजधसूचना की तारीख से पहल े दकसी भी अर्जध के जलए आरोप्य, या अनारोप् य, दकसी भी जस्ट्थजत में, ऐसी राजियों की प्राजि की तारीख से ररफंड की तारीख तक ऐसी राजियों पर ब्याि का भुगतान करना अपजे क्षत नहीं होगा. बिते दक एक कमवचारी, जिससे इस खंड के तहत राजि र्ापस करना अपेजक्षत ह,ै बैंक द्वारा उसको देय राजि में स ेइन राजियों को समायोजित करने के जलए बैंक को प्राजधकृत कर सकता ह.ै (2) उप-जर्जनयम (1) के खडं (क) और (ग) के तहत िाजमल दकया गया कमवचारी का पररर्ार इन जर्जनयमों के तहत पाररर्ाररक पेंिन का हकदार होगा, िब ऐसे ददर्ंगत कमवचारी का पररर्ार आजधकाररक रािपत्र में सर् व हररयाणा ग्रामीण बैंक (कमवचारी) पेंिन (संिोधन) जर्जनयम, 2024 की अजधसूचना की तारीख से तीस ददनों के भीतर, ददर्ंगत कमवचारी द्वारा या यथाजस्ट्थजत पररर्ार द्वारा प्राि पूरी अंजतम राजि, कमवचारी पिें न योिना, 1995 के तहत भजर्ष्य जनजध म ें बैंक का योगदान और ददर्गं त कमवचारी या यथाजस्ट्थजत ददर्ंगत कमवचारी के पररर्ार द्वारा राजि की प्राजि की तारीख तक उस पर अर्िवत ब्याि और कमवचारी पिें न योिना के तहत कमवचारी या ददर्ंगत कमवचारी के पररर्ार द्वारा प्राि पिें न या पाररर्ाररक पेंिन, यदद कोई हो, को ररफंड कर ददया हो या ररफंड करता हो, ककंत ु दोनों मामलों म ेंप्राजि की तारीख से र्ापसी की तारीख तक ब्याि का भुगतान करना अपेजक्षत नहीं होगा. बिते दक ददर्ंगत कमवचारी का पररर्ार जिससे इस खंड के तहत राजि र्ापस करना अपेजक्षत है, बैंक द्वारा उसको देय राजि में से इन राजियों को समायोजित करन ेके जलए बैंक को प्राजधकृत कर सकता ह.ै[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 (3) इस जर्जनयम म ें दकसी बात के होते हुए भी, िो कमवचारी 1 अप्रलै , 2010 को या उसके बाद बैंक की सेर्ा म ें िाजमल हुआ ह,ै उसे राष्ट्रीय पिें न प्रणाली म ेंिाजमल दकया िाएगा. 4. उक्त जर्जनयमों के जर्जनयम 20 म,ें उप-जर्जनयम (1) के पश्चात्, जनम्नजलजखत परंतुक अतं ःस्ट्थाजपत दकया िाएगा, नामत: - "बित े दक जर्जनयम 3 के उप-जर्जनयम (1) के खंड (सी) के अतं गवत आन े र्ाल े कमवचाररयों का सेर्ाकाल समपहृत नहीं होगा.” 5. उक्त जर्जनयमों के जर्जनयम 32 में जनम् नजलजखत जर्जनयम को प्रजतस्ट्थाजपत दकया िाएगा, नामत: - "कजतपय कमवचाररयों के संबंध में पेंिन या पाररर्ाररक पिें न का भुगतान, - (1) र्े कमवचारी िो 1 जसतंबर 1987 और 31 अक्त ूबर 1993 के मध् य बैंक की सेर्ा से सेर्ाजनर्ृत्त हुए हैं, र् े प्रभार्ी तारीख से पेंिन के जलए पात्र होंग.े (2) ददर्ंगत कमवचारी, िो 1 जसतंबर 1987 और 31 अक्त ूबर 1993 के मध् य सेर्ा म ें था और 31 अक्त ूबर 1993 से पहल े उसकी मृत् यु हो गई थी, उसका पररर्ार प्रभार्ी तारीख से पररर्ाररक पिें न के भुगतान के जलए पात्र होगा. 6. उक्त जर्जनयमों के जर्जनयम 50 में जनम् नजलजखत जर्जनयम को प्रजतस्ट्थाजपत दकया िाएगा, नामत:- "जिस तारीख से पेंिन देय होती ह ै – (1) जिस कमवचारी पर जर्जनयम 32 के उप-जर्जनयम (1), जर्जनयम 41 या 44 के उपबंध लागू होत े ह,ैं को छोडकर, सर् व हररयाणा ग्रामीण बैंक (कमवचारी) पिें न (संिोधन) जर्जनयम, 2024 के तहत जनधावररत समय के भीतर जर्जनयम 3 के उप-जर्जनयम (1) के तहत जनर्दवष् ट पूरी राजि को ररफंड कर देने या ररफंड दकए िाने या समायोिन हते ु प्राजधकृत करन े पर, पाररर्ाररक पेंिन को छोडकर, उस तारीख की अगली तारीख से पिे न देय हो िाएगी जिस तारीख को कोई कमवचारी सेर्ाजनर्ृत्त होता ह ै या, यथाजस्ट्थजत, पदत् याग करता ह ै या अजधजनयम की धारा 23 क की उपधारा (3) के खंड (ख) के तहत अंतररती बैंक में िाजमल होन े का जर्कल्प नहीं चुनता ह.ै (2) जिस कमवचारी पर जर्जनयम 32 के उप-जर्जनयम (1), जर्जनयम 41 या 44 के उपबंध लाग ू होते ह,ैं को छोडकर, सर् व हररयाणा ग्रामीण बैंक (कमवचारी) पिें न (संिोधन) जर्जनयम, 2024 के तहत जनधावररत समय के भीतर जर्जनयम 3 के उप-जर्जनयम (2) के तहत जनर्दवष् ट पूरी राजि को ररफंड कर देने या ररफंड दकए िाने या समायोिन हते ु प्राजधकृत करन े पर, उस तारीख की अगली तारीख से पाररर्ाररक पेंिन देय हो िाएगी जिस तारीख को कमवचारी की मृत् यु होती ह.ै (3) इन जर्जनयमों में दकसी बात के होते हुए भी, दकसी कमवचारी या ददर्ंगत कमवचारी के पररर्ार के मामले में, िो उक्त जर्जनयमों के तहत यथाजस्ट्थजत पेंिन या पाररर्ाररक पेंिन का जर्कल् प चुनन े के जलए पात्र था, उसने जर्कल् प नहीं चुना या जर्कल् प तो चुना ककंतु पैसा ररफंड नहीं दकया ककंतु अब र्ह जर्जनयमन (3) के उप-जर्जनयम (1) के खंड (क) के तहत यथाजस्ट्थजत, ररफंड करता ह ै या समायोिन हते ु प्राजधकृत करता ह ै तो र्ह जर्जनयम 3 के उप- जर्जनयम (2) के तहत सर् व हररयाणा ग्रामीण बैंक (कमवचारी) पेंिन (संिोधन) जर्जनयम, 2024 की अजधसूचना पर या उसके बाद, उप-जर्जनयम (1) या जर्जनयम 3 के खडं (ग) के तहत या जर्जनयम 3 के उप-जर्जनयम (2) के तहत सेर्ाजनर्ृजत्त या इस्ट्तीफे की तारीख या मृत्यु, िो भी बाद म ें हो, से यथाजस्ट्थजत ररफंड या समायोिन की तारीख स े यथाजस्ट्थजत पेंिन या पाररर्ाररक पेंिन के जलए पात्र होगा. संिीर् कुमार धपू ड, अध्यक्ष [जर्ज्ञापन-III/4/असा./570/2024-25] नोट : मूल अजधसूचना सं. 425 ददनाकं 19 नर्म्बर, 2018 के भारत के रािपत्र, असाधारण, भाग III, खंड 4, उप-खडं (i) के माध् यम से प्रकाजित की गई थी, ददनांक 19 नर्म्बर, 2018.4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] SARVA HARYANA GRAMIN BANK NOTIFICATION Rohtak, the 9th October, 2024 F. No. HO/HRDD/2024/2016.—In exercise of the powers conferred by Section 30 read with sub-section (1) of section 17 of the Regional Rural Banks Act, 1976 (21 of 1976) the Board of Directors of Sarva Haryana Gramin Bank, after consultation with Punjab National Bank being the Sponsor Bank, and the National Bank for Agriculture and Rural Development and with the previous sanction of the Central Government, hereby makes the following regulations to amend the Sarva Haryana Gramin Bank (Employees’) Pension Regulations, 2018, namely: 1. (1) THESE REGULATIONS MAY BE CALLED SARVA HARYANA GRAMIN BANK (EMPLOYEES’) PENSION (AMENDMENT) REGULATIONS, 2024. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Sarva Haryana Gramin Bank (Employees’) Pension Regulations, 2018 (hereinafter referred to as the said regulations), in regulation 2, in sub-regulation (1), in clause (k), for the figures, letters and words “1st day of April, 2018”, the figures, letters and words “1st day of November, 1993” shall be substituted. 3. In regulation 3 of the said regulations, the following regulation shall be substituted, namely:- “3. Application.–(1) Any employee who – (a) was in the service of the Bank between the 1st September, 1987 and the 31st March, 2010 and retired or dismissed or removed or terminated from service before the date of notification of Sarva Haryana Gramin Bank (Employees’) Pension (Amendment) Regulations, 2024 and refunded or becomes a member of the Fund and refund within fifteen days from the date of notification of Sarva Haryana Gramin Bank (Employees’) Pension (Amendment) Regulations, 2024 in the Official Gazette, the entire final amounts received by him (the corpus comprising of Bank’s contribution to provident fund under the Employees’ Pension Scheme, 1995 and interest accrued thereon till the date of receipt by him of the amount) and the periodic pension, if any, received by him under the Employees’ Pension Scheme, 1995 attributable to any period before date of notification of Sarva Haryana Gramin Bank (Employees’) Pension (Amendment) Regulations, 2024 in the Official Gazette but without, in either case, requiring to pay interest on such amounts from the date of receipt of such amounts to the date of refund: Provided that an employee who is required to refund the amounts as per this clause may authorise the Bank to adjust these amounts from the amounts payable by the Bank to the employee: Provided further that an employee who was eligible to opt for pension under the said regulations but did not opt within the stipulated time or having opted not refunded the money within the stipulated time, the periodic pension, if any, received by him under the Employees’ Pension Scheme, 1995, need not be refunded. (b) was in the service of the Bank between the 1st September, 1987 and the 31st March, 2010 and continue to be in the service of the Bank on or after the date of notification of Sarva Haryana Gramin Bank (Employees’) Pension (Amendment) Regulations, 2024 in the Official Gazette, and a member or becomes member of the Fund and caused or cause to transfer the entire contribution of the Bank along with the interest accrued thereon, within fifteen days from the date of notification of Sarva Haryana Gramin Bank (Employees’) Pension (Amendment) Regulations, 2024 in the Official Gazette, to the credit of the Fund constituted in regulation 4 and refund the portion of pension, if any, received by him under Employees’ Pension Scheme 1995, and attributable to any period before date of notification of Sarva Haryana Gramin Bank (Employees’) Pension (Amendment) Regulations, 2024 in the Official Gazette. (c) was in the service of the Bank between the 1st September, 1987 and the 31st March, 2010 and exercised an option under clause (b) of sub-section (3) of section 23A of the Act or resigned before the notification of the said Regulations, in either case, after having completed twenty years of qualifying service and by giving proper notice, shall become member of the Fund and refund within fifteen days from the date of notification of Sarva Haryana Gramin Bank (Employees’) Pension (Amendment) Regulations, 2024 in the Official Gazette, the entire final amounts received by him (the corpus comprising of Bank’s contribution to provident fund under the Employees’ Pension Scheme, 1995 and interest accrued thereon till the date of receipt by him of the amount) and periodic pension, if any, received by him under the Employees’ Pension Scheme, 1995 attributable to any period before date of notification of Sarva Haryana Gramin Bank (Employees’) Pension (Amendment) Regulations, 2024 in the Official Gazette but without, in either case, requiring to pay interest on such amounts from the date of receipt of such amounts to the date of refund:[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 5 Provided that an employee, who is required to refund the amounts, under this clause may authorise the Bank to adjust these amounts from the amounts payable by the Bank to the employee. (2) The family of the employee covered under clauses (a) and (c) of sub-regulation (1), shall be entitled to family pension under these regulations when the family of such deceased employee refunded or refunds within thirty days from the date of notification of Sarva Haryana Gramin Bank (Employees’) Pension (Amendment) Regulations, 2024 in the Official Gazette, the entire final amounts received by the deceased employee or as the case may be the family, the corpus comprising of Bank’s contribution to provident fund under the Employees’ Pension Scheme, 1995, and interest accrued thereon till the date of receipt of the amount by the deceased employee or, as the case may be, the family of a deceased employee and pension or family pension, if any, received by the employee or the family of the deceased employee under the Employees’ Pension Scheme, 1995, but in either case without requiring to pay interest from the date of receipt to the date of refund. Provided that a family of the deceased employee, who is required to refund the amounts under this clause may authorise the Bank to adjust these amounts from the amounts payable by the Bank to the employee. (3) Notwithstanding anything contained in this regulation, any employee who joined the service of the Bank on or after the 1st April, 2010 shall be covered by the National Pension System”. 4. In regulation 20 of the said regulations, after sub-regulation (1), the following proviso shall be inserted, namely:- “Provided that there would no forfeiture of service for employees covered under clause (c) of sub-regulation (1) of regulation 3”. 5. In regulation 32 of the said regulations, the following regulation shall be substituted namely:- “Payment of pension or family pension in respect of certain employees.- (1) Employees who have retired from the service of the Bank between the 1st September, 1987 and the 31st October, 1993 shall be eligible for pension from the effective date. (2) The family of a deceased employee, who was in service between the 1st September, 1987 and the 31st October, 1993 and died before the 31st October, 1993 shall be eligible for payment of family pension from the effective date”. 6. In regulation 50 of the said regulations, the following regulation shall be substituted, namely:- “Date from which pension becomes payable.- (1) Except in the case of an employee to whom the provisions of sub-regulation (1) of regulations 32, or 41, or 44 apply a pension other than the family pension shall become payable from the date following the date on which an employee retires or, as the case may be, resigns or opts not to join the transferee bank under clause (b) of sub-section (3) of section 23A of the Act on refund or refunding or authorising adjustment of the entire amounts specified under sub-regulation (1) of regulation 3 within the time stipulated under Sarva Haryana Gramin Bank (Employees’) Pension (Amendment) Regulations, 2024. (2) Except in the case of an employee to whom the provisions of sub-regulation (1) of regulations 32, or 41, or 44 apply, family pension shall become payable from the date following the date of death of the employee, on refunding or authorising adjustment of the entire amounts specified under sub-regulation (2) of regulation 3 within the time stipulated under Sarva Haryana Gramin Bank (Employees’) Pension (Amendment) Regulations, 2024. (3) Notwithstanding anything contained in these regulations, in case of an employee, or as the case may be, family of the deceased employee who was eligible to opt for pension, or as the case may be, family pension under the said regulations but did not opt or opted but did not refund the money, but refunds or authorise adjustment of money under clause (a) of sub-regulation (1) of regulation (3), or as the case may be, under sub-regulation (2) of regulation 3 on or after notification of Sarva Haryana Gramin Bank (Employees’) Pension (Amendment) Regulations, 2024 shall be entitled for pension, family pension, or as the case may be, from date of refund or adjustment under clause (c) of sub-regulation (1) of regulation 3, or as the case may be, sub-regulation (2) of regulation 3, or the date of retirement or resignation, or death, as the case may be, whichever is later.” SANJEEV KUMAR DHUPAR, Chairman [ADVT.-III/4/Exty./570/2024-25] Note: The principal notification was published vide number 425 dated the 19th November, 2018 in the Gazette of India, Extraordinary, Part III, section 4, sub-section (i), date the 19th November, 2018.
