(1) इन जवजनयिों को तजिलनाडु ग्राि बैंक (किशचारी) पेंिन (संिोधन) जवजनयि, 2024 कहा िाएगा । (2) य ेजनयि रािपत्र ि ेंउनके प्रकािन की तारीख से लाग ूहोंगे । 2. तजिलनाडु ग्राि बैंक (किशचारी) पेंिन जवजनयि, 2019 (इसके बाद इसे उक्त जवजनयि कहा िाएगा) के, जवजनयि 2 के, उप-जवजनयि (1) के, खडं (के) िें, आंकडे, अंक और िब् द "अप्रलै , 2018 का पहला ददन" के स्ट्थान पर "नवंबर 1993 का पहला ददन" आंकड,े अंक और िब्द प्रजतस्ट् थाजपत दकए िाएंग े । 3. उक्त जवजनयिों ि,ें जवजनयि 3 को जनम्न जलजखत जवजनयि स ेप्रजतस्ट्थाजपत दकया िाएगा, नाित:, - "3. अनप्रु योग - (1) कोई भी किशचारी िो - (क) 1 जसतंबर, 1987 और 31 िाचश 2010 के िध् य बैंक की सेवा िें था और तजिलनाडु ग्राि बैंक (किशचारी) पिें न (संिोधन) जवजनयि, 2024 की अजधसूचना की तारीख से पहले सेवाजनवृत्त या बखाशस्ट्त या हटा ददया गया या सेवा की 6872 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] सिाजि कर दी गई और आजधकाठरक रािपत्र ि ें तजिलनाडु ग्राि बैंक (किशचारी) पेंिन (संिोधन) जवजनयि, 2024 की अजधसूचना की तारीख से पंद्रह ददनों के भीतर ठरफंड करता ह ै या जनजध का सदस्ट् य बनता ह ै और उसके द्वारा प्राि संपणू श अंजति राजि (किशचारी पेंिन योिना, 1995 के तहत भजवष्य जनजध िें बैंक का योगदान और राजि की प्राजि की तारीख तक उस पर अर्िशत ब्याि) को ठरफंड कर देता ह ै और किशचारी पेंिन योिना, 1995 के तहत उसके द्वारा प्राि आवजधक पेंिन, यदद कोई हो, तो आजधकाठरक रािपत्र िें तजिलनाडु ग्राि बैंक (किशचारी) पिें न (सिं ोधन) जवजनयि, 2024 की अजधसूचना की तारीख स े पहल े दकसी भी अवजध के जलए आरोप्य, या अनारोप् य, दकसी भी जस्ट्थजत ि,ें ऐसी राजियों की प्राजि की तारीख से ठरफंड की तारीख तक ऐसी राजियों पर ब्याि का भुगतान करना अपेजक्षत नहीं होगा । बिते दक कोई किशचारी जिसस े इस खडं के अनुसार राजि वापस करना अपेजक्षत है, बैंक द्वारा उसको देय राजि ि ें से इन राजियों को सिायोजित करने के जलए बैंक को प्राजधकृत कर सकता ह ै और, बिते दक कोई किशचारी िो उक्त जवजनयिों के तहत पिें न का जवकल्प चुनने का पात्र था, लेदकन जनधाशठरत सिय के भीतर उसने पेंिन का जवकल्प नहीं चनु ा या चुना ककंतु जनधाशठरत सिय के भीतर धन वापस नहीं दकया, तो उस किशचारी को, किशचारी पेंिन योिना, 1995 के तहत उसके द्वारा प्राि आवजधक पेंिन, यदद कोई हो, वापस करने की आव‍यकता नहीं होगी । (ख) 1 जसतंबर, 1987 और 31 िाचश 2010 के िध् य बैंक की सेवा िें था और आजधकाठरक रािपत्र िें तजिलनाडु ग्राि बैंक (किशचारी) पेंिन (संिोधन) जवजनयि, 2024 की अजधसूचना की तारीख को या उसके बाद बैंक की सेवा िें िारी रहता है, और जनजध का एक सदस्ट्य होता ह ै या सदस्ट्य बनता ह ै और आजधकाठरक रािपत्र ि ें तजिलनाडु ग्राि बैंक (किशचारी) पेंिन (संिोधन) जवजनयि, 2024 की अजधसूचना की तारीख स े पंद्रह ददनों के भीतर, जवजनयि 4 िें गठित जनजध िें बैंक के पूरे योगदान को व उस पर अर्िशत ब्याि के साथ अतं ठरत कर ििा कर देता ह ै या करवाता ह ै तथा किशचारी पेंिन योिना 1995 के तहत उसके द्वारा प्राि और आजधकाठरक रािपत्र ि ें तजिलनाडु ग्राि बैंक (किशचारी) पेंिन (संिोधन) जवजनयि, 2024 की अजधसूचना की तारीख से पहले दकसी भी अवजध के जलए आरोजपत पिें न का भाग, यदद कोई हो, को वापस कर देता ह ै। (ग) 1 जसतंबर, 1987 और 31 िाचश 2010 के िध् य बैंक की सेवा िें था और अजधजनयि की धारा 23 ए की उप-धारा (3) के खंड (बी) के तहत जिसन े एक जवकल्प का प्रयोग दकया था या उक्त जवजनयिों की अजधसचू ना से पहले इस्ट्तीफा दे ददया था, दोनों ही िािलों ि,ें 20 साल की अहकश सेवा परू ी करने के बाद और उजचत नोठटस देकर, जनजध का सदस्ट्य बनता ह ैऔर आजधकाठरक रािपत्र ि ें तजिलनाडु ग्राि बैंक (किशचारी) पिें न (संिोधन) जवजनयि, 2024 की अजधसूचना की तारीख से पंद्रह ददनों के भीतर, उसके द्वारा प्राि संपूण श अंजति राजि (किशचारी पेंिन योिना, 1995 के तहत व भजवष्य जनजध ि ें बैंक का योगदान और राजि की प्राजि की तारीख तक उस पर अर्ितश ब्याि) को ठरफंड कर दते ा ह ै और किशचारी पेंिन योिना, 1995 के तहत उसके द्वारा प्राि आवजधक पेंिन, यदद कोई हो, तो आजधकाठरक रािपत्र ि ें तजिलनाडु ग्राि बैंक (किशचारी) पेंिन (संिोधन) जवजनयि, 2024 की अजधसूचना की तारीख से पहले दकसी भी अवजध के जलए आरोप्य, या अनारोप् य, दकसी भी जस्ट्थजत ि,ें ऐसी राजियों की प्राजि की तारीख से ठरफंड की तारीख तक ऐसी राजियों पर ब्याि का भगु तान करना अपेजक्षत नहीं होगा । बिते दक एक किशचारी, जिससे इस खडं के तहत राजि वापस करना अपेजक्षत है, बैंक द्वारा उसको देय राजि िें स े इन राजियों को सिायोजित करने के जलए बैंक को प्राजधकृत कर सकता ह ै। (2) उप-जवजनयि (1) के खंड (क) और (ग) के तहत िाजिल दकया गया किशचारी का पठरवार इन जवजनयिों के तहत पाठरवाठरक पेंिन का हकदार होगा, िब ऐसे ददवंगत किशचारी का पठरवार आजधकाठरक रािपत्र िें तजिलनाडु ग्राि बैंक(किशचारी) पेंिन (संिोधन) जवजनयि, 2024 की अजधसूचना की तारीख से तीस ददनों के भीतर, ददवंगत किशचारी द्वारा या यथाजस्ट्थजत पठरवार द्वारा प्राि पूरी अंजति राजि, किशचारी पेंिन योिना, 1995 के तहत भजवष्य जनजध िें बैंक का योगदान और ददवगं त किशचारी या यथाजस्ट्थजत ददवगं त किशचारी के पठरवार द्वारा राजि की प्राजि की तारीख तक उस पर अर्िशत ब्याि और किशचारी पेंिन योिना के तहत किशचारी या ददवंगत किशचारी[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 के पठरवार द्वारा प्राि पेंिन या पाठरवाठरक पेंिन, यदद कोई हो, को ठरफंड कर ददया हो या ठरफंड करता हो, ककंत ु दोनों िािलों ि ेंप्राजि की तारीख से वापसी की तारीख तक ब्याि का भुगतान करना अपेजक्षत नहीं होगा । बिते दक ददवंगत किशचारी का पठरवार जिससे इस खंड के तहत राजि वापस करना अपेजक्षत है, बैंक द्वारा उसको देय राजि ि ेंसे इन राजियों को सिायोजित करने के जलए बैंक को प्राजधकृत कर सकता ह ै। (3) इस जवजनयि िें दकसी बात के होते हुए भी, िो किशचारी 1 अप्रलै , 2010 को या उसके बाद बैंक की सेवा िें िाजिल हुआ ह,ै उसे राष्ट्रीय पिें न प्रणाली िें िाजिल दकया िाएगा । 4. उक्त जवजनयिों के जवजनयि 20 ि,ें उप-जवजनयि (1) के पश्चात,् जनम्नजलजखत परंतकु अतं ःस्ट्थाजपत दकया िाएगा, नाित: - "बिते दक जवजनयि 3 के उप-जवजनयि (1) के खंड (सी) के अंतगतश आने वाले किशचाठरयों का सेवाकाल सिपहृत नहीं होगा.” 5. उक्त जवजनयिों के जवजनयि 32 िें जनम् नजलजखत जवजनयि को प्रजतस्ट्थाजपत दकया िाएगा, नाित: - "कजतपय किशचाठरयों के संबंध िें पेंिन या पाठरवाठरक पिें न का भुगतान, - (1) वे किशचारी िो 1 जसतंबर 1987 और 31 अक्त ूबर 1993 के िध् य बैंक की सेवा से सेवाजनवृत्त हुए ह,ैं वे प्रभावी तारीख से पेंिन के जलए पात्र होंगे । (2) ददवंगत किशचारी, िो 1 जसतंबर 1987 और 31 अक् तूबर 1993 के िध् य सेवा ि ें था और 31 अक् तूबर 1993 से पहल े उसकी िृत् य ु हो गई थी, उसका पठरवार प्रभावी तारीख स ेपठरवाठरक पेंिन के भुगतान के जलए पात्र होगा । 6. उक्त जवजनयिों के जवजनयि 50 िें जनम् नजलजखत जवजनयि को प्रजतस्ट्थाजपत दकया िाएगा, नाित:- "जिस तारीख से पेंिन देय होती ह ै – (1) जिस किशचारी पर जवजनयि 32 के उप-जवजनयि (1), जवजनयि 41 या 44 के उपबंध लागू होते ह,ैं को छोडकर, तजिलनाडु ग्राि बैंक (किशचारी) पेंिन (संिोधन) जवजनयि, 2024 के तहत जनधाशठरत सिय के भीतर जवजनयि 3 के उप-जवजनयि (1) के तहत जनर्दशष्ट पूरी राजि को ठरफंड कर देने या ठरफंड दकए िाने या सिायोिन हते ु प्राजधकृत करने पर, पाठरवाठरक पेंिन को छोडकर, उस तारीख की अगली तारीख से पेिन देय हो िाएगी जिस तारीख को कोई किशचारी सेवाजनवृत्त होता ह ै या, यथाजस्ट्थजत, पदत् याग करता ह ै या अजधजनयि की धारा 23 क की उपधारा (3) के खंड (ख) के तहत अंतठरती बैंक िें िाजिल होन े का जवकल्प नहीं चुनता ह।ै (2) जिस किशचारी पर जवजनयि 32 के उप-जवजनयि (1), जवजनयि 41 या 44 के उपबंध लाग ू होते ह,ैं उसको छोडकर, तजिलनाडु ग्राि बैंक (किशचारी) पेंिन (संिोधन) जवजनयि, 2024 के तहत जनधाशठरत सिय के भीतर जवजनयि 3 के उप-जवजनयि (2) के तहत जनर्दशष्ट पूरी राजि को ठरफंड कर देन े या ठरफंड दकए िान े या सिायोिन हते ु प्राजधकृत करने पर, उस तारीख की अगली तारीख से पाठरवाठरक पिें न देय हो िाएगी जिस तारीख को किशचारी की िृत् यु होती ह ै । (3) इन जवजनयिों िें दकसी बात के होते हुए भी, दकसी किशचारी या ददवंगत किशचारी के पठरवार के िािल े िें, िो उक्त जवजनयिों के तहत यथाजस्ट्थजत पेंिन या पाठरवाठरक पेंिन का जवकल् प चुनन े के जलए पात्र था, उसन े जवकल् प नहीं चुना या जवकल् प तो चनु ा ककंतु पैसा ठरफंड नहीं दकया ककंतु अब वह जवजनयिन (3) के उप-जवजनयि (1) के खंड (क) के तहत यथाजस्ट्थजत, ठरफंड करता ह ै या सिायोिन हते ु प्राजधकृत करता ह ै तो वह जवजनयि 3 के उप-जवजनयि (2) के तहत तजिलनाडु ग्राि बैंक (किशचारी) पेंिन (संिोधन) जवजनयि, 2024 की अजधसूचना पर या उसके बाद, उप- जवजनयि (1) या जवजनयि 3 के खंड (ग) के तहत या जवजनयि 3 के उप-जवजनयि (2) के तहत सेवाजनवृजत्त या इस्ट्तीफे की तारीख या िृत्यु, िो भी बाद िें हो, से यथाजस्ट्थजत ठरफंड या सिायोिन की तारीख से यथाजस्ट्थजत पिें न या पाठरवाठरक पेंिन के जलए पात्र होगा । िजण सुब्रिण्यन, अध् यक्ष [जवज्ञापन-III/4/असा./619/2024-25] नोट : पूवशवती पल्लवन ग्राि बकैं (किशचारी) पिें न जवजनयिों की िुख्य अजधसूचना भारत के रािपत्र, असाधारण, भाग III, खंड 4, ददनांक 01.01.2019 िें संख्या 194504 ददनांक 21.12.2018 के िाध्यि स े प्रकाजित की गई थी और पूवशवती पांजडयन ग्राि बैंक (किशचारी) पिें न जवजनयिों की िुख्य अजधसूचना संख्या 194193 ददनांक 18.12.2018 के िाध्यि से भारत के रािपत्र, असाधारण, भाग III, खंड 4, ददनांक 27.12.2018 िें प्रकाजित की गई थी। जवत्त िंत्रालय, भारत सरकार की सिािेलन अजधसूचना आईडी 196225 ददनांक 28.01.2019 के अनुसार, तजिलनाडु ग्राि बैंक 01.04.2019 से प्रभावी हुआ।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] TAMIL NADU GRAMA BANK NOTIFICATION Salem, the 4th October, 2024 No. TNGB/Pension (Amendment)/041024/2024.—In exercise of the powers conferred by Section 30 read with sub-section (1) of section 17 of the Regional Rural Banks Act, 1976 (21 of 1976) the Board of Directors of Tamil Nadu Grama Bank, after consultation with Indian Bank, being the Sponsor Bank, and the National Bank for Agriculture and Rural Development and with the previous sanction of the Central Government, hereby makes the following regulations to amend the Tamil Nadu Grama Bank (Employees’) Pension Regulations, 2019, namely: 1. (1) These Regulations May Be Called Tamil Nadu Grama Bank (Employees’) Pension (Amendment) Regulations, 2024. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Tamil Nadu Grama Bank (Employees’) Pension Regulations, 2019 (hereinafter referred to as the said regulations), in regulation 2, in sub-regulation (1), in clause (k), for the figures, letters and words “1st day of April, 2018”, the figures, letters and words “1st day of November, 1993” shall be substituted. 3. In regulation 3 of the said regulations, the following regulation shall be substituted, namely:- “3. Application.–(1) Any employee who – (a) was in the service of the Bank between the 1st September, 1987 and the 31st March, 2010 and retired or dismissed or removed or terminated from service before the date of notification of Tamil Nadu Grama Bank (Employees’) Pension (Amendment) Regulations, 2024 and refunded or becomes a member of the Fund and refund within fifteen days from the date of notification of Tamil Nadu Grama Bank (Employees’) Pension (Amendment) Regulations, 2024 in the Official Gazette, the entire final amounts received by him (the corpus comprising of Bank’s contribution to provident fund under the Employees’ Pension Scheme, 1995 and interest accrued thereon till the date of receipt by him of the amount) and the periodic pension, if any, received by him under the Employees’ Pension Scheme, 1995 attributable to any period before date of notification of Tamil Nadu Grama Bank (Employees’) Pension (Amendment) Regulations, 2024 in the Official Gazette but without, in either case, requiring to pay interest on such amounts from the date of receipt of such amounts to the date of refund: Provided that an employee who is required to refund the amounts as per this clause may authorise the Bank to adjust these amounts from the amounts payable by the Bank to the employee: Provided further that an employee who was eligible to opt for pension under the said regulations but did not opt within the stipulated time or having opted not refunded the money within the stipulated time, the periodic pension, if any, received by him under the Employees’ Pension Scheme, 1995, need not be refunded. (b) was in the service of the Bank between the 1st September, 1987 and the 31st March, 2010 and continue to be in the service of the Bank on or after the date of notification of Tamil Nadu Grama Bank (Employees’) Pension (Amendment) Regulations, 2024 in the Official Gazette, and a member or becomes member of the Fund and caused or cause to transfer the entire contribution of the Bank along with the interest accrued thereon, within fifteen days from the date of notification of Tamil Nadu Grama Bank (Employees’) Pension (Amendment) Regulations, 2024 in the Official Gazette, to the credit of the Fund constituted in regulation 4 and refund the portion of pension, if any, received by him under Employees’ Pension Scheme 1995, and attributable to any period before date of notification of Tamil Nadu Grama Bank (Employees’) Pension (Amendment) Regulations, 2024 in the Official Gazette. (c) was in the service of the Bank between the 1st September, 1987 and the 31st March, 2010 and exercised an option under clause (b) of sub-section (3) of section 23A of the Act or resigned before the notification of the said Regulations, in either case, after having completed twenty years of qualifying service and by giving proper notice, shall become member of the Fund and refund within fifteen days from the date of notification of Tamil Nadu Grama Bank (Employees’) Pension (Amendment) Regulations, 2024 in the Official Gazette, the entire final amounts received by him (the corpus comprising of Bank’s contribution to provident fund under the Employees’ Pension Scheme, 1995 and interest accrued thereon till the date of receipt by him of the amount) and periodic pension, if any, received by him under the Employees’ Pension Scheme, 1995 attributable to any period before date of notification of Tamil Nadu Grama Bank (Employees’) Pension (Amendment) Regulations, 2024 in the Official Gazette but without, in either case, requiring to pay interest on such amounts from the date of receipt of such amounts to the date of refund: Provided that an employee, who is required to refund the amounts, under this clause may authorise the Bank to adjust these amounts from the amounts payable by the Bank to the employee. (2) The family of the employee covered under clauses (a) and (c) of sub-regulation (1), shall be entitled to family pension under these regulations when the family of such deceased employee refunded or refunds within thirty days[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 5 from the date of notification of Tamil Nadu Grama Bank (Employees’) Pension (Amendment) Regulations, 2024 in the Official Gazette, the entire final amounts received by the deceased employee or as the case may be the family, the corpus comprising of Bank’s contribution to provident fund under the Employees’ Pension Scheme, 1995, and interest accrued thereon till the date of receipt of the amount by the deceased employee or, as the case may be, the family of a deceased employee and pension or family pension, if any, received by the employee or the family of the deceased employee under the Employees’ Pension Scheme, 1995, but in either case without requiring to pay interest from the date of receipt to the date of refund. Provided that a family of the deceased employee, who is required to refund the amounts under this clause may authorise the Bank to adjust these amounts from the amounts payable by the Bank to the employee. (3) Notwithstanding anything contained in this regulation, any employee who joined the service of the Bank on or after the 1st April, 2010 shall be covered by the National Pension System”. 4. In regulation 20 of the said regulations, after sub-regulation (1), the following proviso shall be inserted, namely:- “Provided that there would no forfeiture of service for employees covered under clause (c) of sub-regulation (1) of regulation 3”. 5. In regulation 32 of the said regulations, the following regulation shall be substituted namely:- “Payment of pension or family pension in respect of certain employees.- (1) Employees who have retired from the service of the Bank between the 1st September, 1987 and the 31st October, 1993 shall be eligible for pension from the effective date. (2) The family of a deceased employee, who was in service between the 1st September, 1987 and the 31st October, 1993 and died before the 31st October, 1993 shall be eligible for payment of family pension from the effective date”. 6. In regulation 50 of the said regulations, the following regulation shall be substituted, namely:- “Date from which pension becomes payable.- (1) Except in the case of an employee to whom the provisions of sub- regulation (1) of regulations 32, or 41, or 44 apply a pension other than the family pension shall become payable from the date following the date on which an employee retires or, as the case may be, resigns or opts not to join the transferee bank under clause (b) of sub-section (3) of section 23A of the Act on refund or refunding or authorising adjustment of the entire amounts specified under sub-regulation (1) of regulation 3 within the time stipulated under Tamil Nadu Grama Bank (Employees’) Pension (Amendment) Regulations, 2024. (2) Except in the case of an employee to whom the provisions of sub-regulation (1) of regulations 32, or 41, or 44 apply, family pension shall become payable from the date following the date of death of the employee, on refunding or authorising adjustment of the entire amounts specified under sub-regulation (2) of regulation 3 within the time stipulated under Tamil Nadu Grama Bank (Employees’) Pension (Amendment) Regulations, 2024. (3) Notwithstanding anything contained in these regulations, in case of an employee, or as the case may be, family of the deceased employee who was eligible to opt for pension, or as the case may be, family pension under the said regulations but did not opt or opted but did not refund the money, but refunds or authorise adjustment of money under clause (a) of sub-regulation (1) of regulation (3), or as the case may be, under sub-regulation (2) of regulation 3 on or after notification of Tamil Nadu Grama Bank (Employees’) Pension (Amendment) Regulations, 2024 shall be entitled for pension, family pension, or as the case may be, from date of refund or adjustment under clause (c) of sub- regulation (1) of regulation 3, or as the case may be, sub-regulation (2) of regulation 3, or the date of retirement or resignation, or death, as the case may be, whichever is later.” MANI SUBRAMANIAN, Chairman [ADVT.-III/4/Exty./619/2024-25] Note : The principal notification of erstwhile Pallavan Grama Bank (Employees’) Pension Regulations was published vide number 194504 dated the 21.12.2018 in the Gazette of India, Extraordinary, Part III, section 4, dated the 01.01.2019 and the principal notification of erstwhile Pandyan Grama Bank (Employees’) Pension Regulations was published vide number 194193 dated the 18.12.2018 in the Gazette of India, Extraordinary, Part III, section 4, dated the 27.12.2018.
