This notification, S.O. 3284(E), issued by the Ministry of Labour and Employment on December 7, 2015, exempts several Coal India Limited subsidiaries from a previous notification (S.O. 2063, dated June 21, 1988) regarding the employment of contract labor. The exemption applies to Eastern Coalfields Limited, Central Coalfields Limited, Bharat Coking Coal Limited, Western Coalfields Limited, South Eastern Coalfields Limited, Northern Coalfields Limited, and Mahanadi Coalfields Limited, specifically for contract labor employed in works outlined in serial numbers 1 to 3 of the Schedule to the 1988 notification. This exemption is granted for a period of five years from the date of publication in the Official Gazette and is subject to the following conditions: protection of the interests of the workmen involved, payment of wages and benefits as per the recommendations of the Coal India Limited high-powered committee and rates notified on February 13, 2013, and the right of the Central Advisory Contract Labour Board to inspect establishments to ensure compliance with wage and benefit provisions. NOTIFICATION
New Delhi, the 7th December, 2015
S.O. 3284(E).—In exercise of the powers conferred by section 31 of the Contract Labour (Regulation
and Abolition) Act, 1970, the Central Government, after consultation with the Central Advisory Contract
Labour Board, hereby, exempts various Coal Companies under the aegis of Coal India Limited namely the
Eastern Coalfields Limited, Sanctoria; the Central Coalfields Limited, Ranchi; the Bharat Coking Coal
Limited, Dhanbad; the Western Coalfields Limited, Nagpur; the South Eastern Coalfields Limited, Bilaspur;
the Northern Coalfields Limited, Singhaurali and the Mahanadi Coalfields Limited, Sambalpur from the
applicability of notification of the Government of India in the Ministry of Labour, number S.O. 2063 dated
the 21st June, 1988, published in the Gazette of India, Part-II, section 3, sub-section (ii), in respect of
employment of contract labour in the works specified in the Schedule to the notification, at serial numbers 1
to 3, for a period of five years with effect from the date of publication of this notification in the Official
Gazette subject to the conditions that –
(i) the interest of the workmen engaged in the above mentioned jobs be protected;
(ii) such workmen be paid wages and other benefits as per the recommendations of the high
powered committee appointed by the Coal India Limited, Ministry of Coal, Government of
India and the rates notified by the Coal India Limited on the 13th February, 2013; and
(iii) the Central Advisory Contract Labour Board will have the right to inspect the establishment to
ensure and check whether such wages and benefits are given to such workers in Coal India
Limited and its subsidiary concerned.
