ग. “बौनापन” से अिभ!ेत ह-ै एक मिे डकल या आनुवंिशक ि’थित िजसके प(cid:23)रणाम’ वBप (cid:4)कसी वय’ क क(cid:31) ऊंचाई 4 फ(cid:31)ट 10 इंच (147 स-टीमीटर) या इसस ेकम हो;¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 3 घ. “मासं पेशीय िड’ Lाफ(cid:31)” स े अिभ!ेत ह-ै आनुवंिशक मासं पेशी रोग का एक ऐसा समूह जो उन मासं पिे शय% को कमजोर करता ह,ै जो मानव शरीर का संचालन करती ह,ै और ब)ल िड’ Lाफ(cid:31) वाल े M यि$य% के पास उनके जी]स म- गलत और गायब सूचना होती ह ैजो उ]ह -ऐसे !ोटी]स बनान ेस ेरोकती ह,ै िजनक(cid:31) ’ व’ थ मासं पिे शय% के िलए आवR यकता होती ह।ै इसके ल2ण ह-N !गामी ’क ै(cid:6)ट न मांसपेशी क(cid:31) कमजोरी, मासं पेशी !ोटी]स म- दोष और मांसपेिशय% के कोशाणOु तथा ऊतक% क(cid:31) म"ृ य ।ु ङ. “तेजाब !हार पीिडत” से अिभ!ेत ह-ै तेजाब या इसी !कार के स2ं ारक पदाथ(cid:12) फ-के जाने से pहसं क !हार के कारण कोई िवBिपत Mय ि$। ख. चा2ुष 2ित- (क) “ने<हीनता” से अिभ!ेत ह-ै एक ऐसी ि’थित, जहां (cid:4)कसी Mय ि$ म -सवq"त म सधु ार के पR चात भी िन9 निलिखत म- स े कोई ि’थित हो : (i) दिृ Z का पूण (cid:12)अभाव; या (ii) सवq"त म संभव सुधार के साथ बेहतर आंख म- 3/6 से कम या 10/200 से कम (’ नेलन) चा2ुष ती2णता हो; या (iii) दिृZ के 2े< क(cid:31) वह सीमा, जो 10 िडrी से कम का कोण क2ांत(cid:23)रत करती हो। (ख) “िन9न दिृ Z” स ेएक ऐसी ि’थित अिभ!ेत ह,ै जहा ं(cid:4)कसी Mय ि$ म -िन9 निलिखत म- स ेकोई ि’थित हो, नामत: (i) सवq"त म सभं व सुधारके साथ बेहतर आंख म -अिधक स ेअिधक चा2ुष तीs णता 6/18 या 20/60 स ेकम, 3/60 तक या 10/200 (’न ेलन) हो; या (ii) दिृ Z के 2े< क(cid:31) वह सीमा, जो 40 िडrी से कम 10 िडrी तक का कोण क2ांत(cid:23)रत करती हो। (ग) Xवण 2ित- (क) “बिधर” स ेऐसे Mय ि$ अिभ!ेत ह,ै िज] ह -दोन% कान% म -वाक् t(cid:31)c व-सीज म -70 डीबी Xवण 2ित हो; (ख) “कम सुनन े वाला” स े ऐसा Mय ि$ अिभ!ेत ह,ै िजसे दोन% कान% म - वाक् t(cid:31)c व-सीज म- 60 डीबी से 70 डीबी क(cid:31) Xवण 2ित हो। (घ) “वाक् और भाषा िवकलांगता” स े अिभ!ेत ह-ै आिं गक या तंि<का संबंधी कारण% से वाक् और भाषा के एक स े अिधक सघं टक% को !भािवत करने वाली ’ वरयं< उFछ ेदन या वाचाघात जसै ी ि’थितय% से उ" प] न एक ’ थायी िवकलांगता। 2. बौिVक िवकलांगता एक ऐसी ि’थित ह,ै िजसके ल2ण हN- बौिVक काय(cid:12)चालन (तक(cid:12)णा, (cid:21)ानाज(cid:12)न, सम’ या समाधान) और अनकु ूली Mय वहार दोन% म -मह"व पूण(cid:12) सीमा, जो (cid:4)दन !ित (cid:4)दन के सामािजक और M यावहा(cid:23)रक कौशल% क(cid:31) एक र-ज कवर करती ह,ै िजसम- िन9न िलिखत शािमल ह N: (क) “िविनSदK(cid:12) ट (cid:21)ानाजन(cid:12) िवकलांगताए”ं स े अिभ!ेत ह ै ऐसी ि’थितय% का एक िवजातीय समूह, िजसम- भाषा, बोली जाने वाली या िलिखत, !ोसेpसंग म- कोई ऐसी कमी ह,ै जो समझन,े बोलन,े पढ़ने, िलखन,े िहv जे करने या गिणतीय प(cid:23)रकलन करन े म- एक क(cid:23)ठनाई के Bप म- ’ वयं को अिभwc त कर सकती ह ै और इसम- बोधा"म क िवकलांगताए,ं िड’ल िे cसया, िड’ग र्ा (cid:4)फया, िड’क लकूिलया, िड’ !ािcसया और िवकासा"म क वाचाघात जैसी ि’थितयां शािमल ह;N (ख) “आ"म िवमोह ’प ेcL म िवकृित” से अिभ!ेत ह-ै जीवन के पहले तीन वषx म- अलग !कार से !कट होने वाली एक तंि<का- िवकासा"म क ि’थित जो Mय ि$ क(cid:31) संसिू चत करन,े (cid:23)रR ते समझने और अ] य के साथ जोड़न े क(cid:31) योTय ता को पया(cid:12)Dत Bप स े !भािवत करती ह ै और असामा] य या अप(cid:23)रवत(cid:12)नीय धा(cid:19)मक(cid:12) कृ" य% या M यवहार% के साथ बार-बार संबV ह।ै4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC 4] 3. मानिसक Mय वहार- “मानिसक रोग” से अिभ!ते ह-ै िवचारण, मनोदशा, अवबोधन, अिभमुखीकरण या ’म रण शि$, जो जीवन क(cid:31) सामा]य मांगे पूरी करन े क(cid:31) योT यता या वा’ तिवकता को ’ वीकार करने क(cid:31) योTय ता, M यवहार, िनण(cid:12)य को भारी मा<ा म- 2ित प)चं ाती ह ै परंत ु इसम - ऐसी मंदता शािमल नहz ह ै जो (cid:4)कसी M यि$ के मि’तK क के अवरोध या अपूण(cid:12) िवकास क(cid:31) एक ि’थित ह,ै िजसका िवशषे ल2ण, बुिV क(cid:31) उप-असामा]य ता ह।ै 4. िन9न िलिखत के कारण िवकलांगता- (क) िचरकािलक तिं <का संबंधी ि’थितया,ं जैस-े (i) “ब)ल ऊतक दढ़ृ न” स े अिभ!ेत ह-ै एक !दाहक, तंि<का !णाली रोग, िजसम - मि’तK क और रीढ़ क(cid:31) ह{ी क(cid:31) तंि<का कोिशकाO के अ2ततं ुO के आस-पास क(cid:31) मेBमv जा आF छादन 2ितr’ त हो जाते ह,N िजसके प(cid:23)रणाम’व Bप िडमाइलोएशन हो जाता ह ैऔर एक दसू रे के साथ सचं ा(cid:23)रत करने के िलए मि’तK क और रीढ़ क(cid:31) ह{ी म- तंि<का कोिशकाO क(cid:31) 2मता !भािवत हो जाती ह;ै (ii) “पाSक(cid:12)]स न रोग” से अिभ!ेत ह-ै मि’तK क के आधारीय गंगिलया के िवकार और तंि<का सचं ारी डोपामाइन क(cid:31) (cid:4)कसी कमी के साथ जुड़ी, मु|य त: म} य आय ु वाले और बुजुगx को !भािवत करन े वाली, ~मू र, मासं पेशी क(cid:31) दढ़ृ ता और धीमी, अ’प Kट गित के ल2ण% वाली तं<ीय !णाली का एक !गामी रोग। (ख) रcत िवकृित- (i) “अिधरcत (cid:127)ाव” से अिभ!ेत ह-ै एक वंशानुगत रोग, जो आमतौर पर केवल पBु ष% को !भािवत करता ह ै परंतु मिहलाO ारा अपने पुBष बFच % म- सचं ा(cid:23)रत (cid:4)कया जाता ह ैिजनके ल2ण ह-N रcत क(cid:31) सामा] य जमाव 2मता क(cid:31) 2ित या हािन, िजसस े(cid:4)कसी अवय’क को घातक रc त(cid:127)ाव हो सकता ह;ै (ii) “थालासीिमया” से अिभ!ेत ह-ै वंशानुगत िवकृितय% का एक ऐसा समूह, िजसके ल2ण ह-ै िहमोT लोिबन क(cid:31) घटी )ई मा<ा या उसका अभाव। (iii) “िसकल सैल रोग” से अिभ!ेत ह-ै िचरकािलक रc ता(cid:6) यतता, कK टदायक प(cid:23)रणाम% और संलT न ऊतक तथा अगं 2ित के कारण िविभ]न ज(cid:23)टलताO के ल2ण वाली एक हमे ोलाइ(cid:23)टक िवकृित; न-िभ? न िवकलांगता(cid:14) के िलए प’रकिलत 1कया गया हो। इस फामू(cid:18)ले का इ3 तेमाल बpल िवकलांगता(cid:14) वाले मामल+ म(cid:23) 1कया जाए और (cid:31) यि! िवशेष के मामले म(cid:23) मौजूद िविश(cid:19) ट िवकलांगता(cid:14) के अनुसार दािखले और/या आर/ण के संबंध म(cid:23) अनुशंसा क(cid:22) जाए। BOARD OF GOVERNORS IN SUPER SESSION OF MEDICAL COUNCIL OF INDIA NOTIFICATION New Delhi, the 13th March, 2019 No.MCI-_18(1)/2018-Med./187262.—In exercise of the powers conferred by Section 33 of the Indian Medical Council Act, 1956 (102 of 1956), the Board of Governors in Super-session of Medical Council of India with the previous sanction of the Central Government, hereby makes the following Regulations to further amend the “Postgraduate Medical Education Regulations, 2000”, namely: - 1. (i) These Regulations may be called the “Postgraduate Medical EducationRegulations(Amendment), 2019. (ii) They shall come into force from the date of their publication in the Official Gazette. 2. In the “Postgraduate Medical Education Regulations, 2000”, under the heading of “Selection of Postgraduate Students” clause 9 (5) shall be substituted as under:- Provided further that 5% of the annual sanctioned intake capacity in Government or Government aided higher educational institutions shall be filled up by candidates with benchmark disabilities in accordance with the provisions of the Rights of Persons with Disabilities Act, 2016, based on the merit list of ‘National Eligibility-cum-Entrance Test’ for admission to Postgraduate Medical Courses. For this purpose, the “Specified Disability” contained in the¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 9 Schedule to the Rights of Persons with Disabilities Act, 2016 is annexed in Appendix ‘III’ and the eligibility of candidates to pursue a course in medicine with specified disability shall be in accordance with Appendix ‘IV’. If the seats reserved for the persons with disabilities in a particular category remain unfilled on account of unavailability of candidates, the seats should be included in the annual sanctioned seats for the respective Category. In order to be eligible for admission to Postgraduate Course for an academic year, it shall be necessary for a candidate to obtain minimum of marks at 50thpercentile in the ‘National Eligibility-Cum-Entrance Test for Postgraduate courses’ held for the said academic year. However, in respect of candidates belonging to Scheduled Castes, Scheduled Tribes, and Other Backward Classes, the minimum marks shall be at 40th percentile. In respect of candidates with benchmark disabilities specified under the Rights of Persons with Disabilities Act, 2016, the minimum marks shall be at 45th percentile for General Category and 40th percentile for SC/ST/OBC. Physical disability A. Locomotor disability (a person's inability to execute distinctive activities associated with movement of self and objects resulting from affliction of musculoskeletal or nervous system or both), including— (a) "leprosy cured person" means a person who has been cured of leprosy but is suffering from— (i) loss of sensation in hands or feet as well as loss of sensation and paresis in the eye and eye-lid but with no manifest deformity; (ii) manifest deformity and paresis but having sufficient mobility in their hands and feet to enable them to engage in normal economic activity; (iii) extreme physical deformity as well as advanced age which prevents him/her from undertaking any gainful occupation, and the expression "leprosy cured" shall construed accordingly; (b) "cerebral palsy" means a Group of non-progressive neurological condition affecting body movements and muscle coordination, caused by damage to one or more specific areas of the brain, usually occurring before, during or shortly after birth; (c) "dwarfism" means a medical or genetic condition resulting in an adult height of 4 feet 10 inches (147 centimeters) or less; (d) "muscular dystrophy" means a group of hereditary genetic muscle disease that weakens the muscles that move the human body and persons with multiple dystrophy have incorrect and missing information in their genes, which prevents them from making the proteins they need for healthy muscles. It is characterized by progressive skeletal muscle weakness, defects in muscle proteins, and the death of muscle cells and tissue; (e) "acid attack victims" means a person disfigured due to violent assaults by throwing of acid or similar corrosive substance. B. Visual impairment— (a) "blindness" means a condition where a person has any of the following conditions, after best correction— (i) total absence of sight; or (ii) visual acuity less than 3/60 or less than 10/200 (Snellen) in the better eye with best possible correction; or (iii) limitation of the field of vision subtending an angle of less than 10 degree. (b) "low-vision" means a condition where a person has any of the following conditions, namely:— (i) visual acuity not exceeding 6/18 or less than 20/60 upto 3/60 or upto 10/200 (Snellen) in the better eye with best possible corrections; or (ii) limitation of the field of vision subtending an angle of less than 40 degree up to 10 degree.10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC 4] C. Hearing impairment - (a) "deaf" means persons having 70 DB hearing loss in speech frequencies in both ears; (b) "hard of hearing" means person having 60 DB to 70 DB hearing loss in speech frequencies in both ears; D. "speech and language disability" means a permanent disability arising out of conditions such as laryngectomy or aphasia affecting one or more components of speech and language due to organic or neurological causes. 2. Intellectual disability, a condition characterized by significant limitation both in intellectual functioning (reasoning, learning, problem solving) and in adaptive behavior which covers a range of every day, social and practical skills, including— (a) "specific learning disabilities" means a heterogeneous group of conditions wherein there is a deficit in processing language, spoken or written, that may manifest itself as a difficulty to comprehend, speak, read, write, spell, or to do mathematical calculations and includes such conditions as perceptual disabilities, dyslexia, dysgraphia, dyscalculia, dyspraxia and developmental aphasia; (b) "autism spectrum disorder" means a neuro-developmental condition typically appearing in the first three years of life that significantly affects a person's ability to communicate, understand relationships and relate to others, and is frequently associated with unusual or stereotypical rituals or behaviours. 3. Mental behaviour,— "mental illness" means a substantial disorder of thinking, mood, perception, orientation or memory that grossly impairs judgment, behaviour, capacity to recognize reality or ability to meet the ordinary demands of life, but does not include retardation which is a condition of arrested or incomplete development of mind of a person, specially characterized by subnormality of intelligence. 4. Disability caused due to— (a) chronic neurological conditions, such as— (i) "multiple sclerosis" means an inflammatory, nervous system disease in which the myelin sheaths around the axons of nerve cells of the brain and spinal cord are damaged, leading to demyelination and affecting the ability of nerve cells in the brain and spinal cord to communicate with each other; (ii) "parkinson's disease" means a progressive disease of the nervous system marked by tremor, muscular rigidity, and slow, imprecise movement, chiefly affecting middle-aged and elderly people associated with degeneration of the basal ganglia of the brain and a deficiency of the neurotransmitter dopamine. (b) Blood disorder— (i) "haemophilia" means an inheritable disease, usually affecting only male but transmitted by women to their male children, characterized by loss or impairment of the normal clotting ability of blood so that a minor would may result in fatal bleeding; (ii) "thalassemia" means a group of inherited disorders characterized by reduced or absent amounts of haemoglobin. (iii) "sickle cell disease" means a hemolytic disorder characterized by chronic anemia, painful events, and various complications due to associated tissue and organ damage; "hemolytic" refers to the destruction of the cell membrane of red blood cells resulting in the release of hemoglobin. 5. Multiple Disabilities (more than one of the above specified disabilities) including deaf blindness which means a condition in which a person may have combination of hearing and visual impairments causing severe communication, developmental, and educational problems. 6. Any other category as may be notified by the Central Government. Note: Any amendment to the Schedule to the RPWD Act, 2016, shall consequently stand amended in the above schedule. Appendix “IV” Guidelines regarding admission of students with “Specified Disabilities” under the Rights of Persons with Disabilities Act, 2016 with respect to admission in Postgraduate Courses in Modern Medicine Note 1. The “Certificate of Disability” shall be issued in accordance with the Rights of Persons with Disabilities Rules, 2017 notified in the Gazette of India by the Ministry of Social Justice and Empowerment [Department of Empowerment of Persons with Disabilities (Divyangjan)] on 15th June 2017. 2. The extent of “specified disability” in a person shall be assessed in accordance with the “Guidelines for the purpose of assessing the extent of specified disability in a person included under the Rights of Persons with Disabilities Act, 2016¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 11 (49 of 2016)” notified in the Gazette of India by the Ministry of Social Justice and Empowerment [Department of Empowerment of Persons with Disabilities (Divyangjan)] on 4th January 2018. 3. The minimum degree of disability should be 40% (Benchmark Disability) in order to be eligible for availing reservation for persons with specified disability. 4.
