Other than various ecological functions, such as flood control, habitat for biodiversity, water quality improvement, this area is significant for the socio-cultural sentiments of the people of the city. However, the river at present is in a state of plight because of various existing insensitive anthropogenic activities and the stretch is nothing more than a dirty backyard to the city. In order to ensure conservation, protection and rejuvenation of river Yamuna and to promote and secure the requisite development activities in/on/along the river, its floodplains, and its watershed, the DDA in exercise of powers conferred under Section 5A of the Delhi Development Act does hereby set up Unified Centre for Rejuvenation of River Yamuna (UCRRY) (restoration & beautification). These regulations shall come into force immediately from the date of their publication in the Official Gazette. DEFINITIONS In these Regulations unless there is anything inconsistent with the context or meaning:- − “Act” means the Delhi Development Act 1957 (61of 1957). − “Authority” means the Delhi Development Authority constituted under section 3 of the Act. − "Unified Centre for Rejuvenation of River Yamuna (Restoration & Beautification)" as UCRRY means the committee constituted by the Authority under section 5 A of the Act. − "Members" shall mean the members of the Unified Centre for Rejuvenation of River Yamuna (UCRRY) (Restoration & Beautification) BYE–LAWS FOR THE UNIFIED CENTRE FOR REJUVENATION OF RIVER YAMUNA (UCRRY) (RESTORATION & BEAUTIFICATION) 01. Name The name of the Centre shall be “Unified Centre for Rejuvenation of River Yamuna (UCRRY) (Restoration & Beautification) 02. Office The office of the Centre (UCRRY) shall be located in Vikas Minar, DDA office, New Delhi. 03. Aims and Objectives The aim of the Centre is to ensure conservation, protection and rejuvenation of river Yamuna and to promote and secure the requisite development activities in/on/along the river, its floodplains, and its watershed, within the NCT, Delhi by use of sustainable practices only. The objectives of the UCRRY shall be- i. To formulate such policies, norms, guidelines and undertake such projects on the floodplains and its watershed which aim : a. To restore, protect and conserve the riverine ecosystem and its functions such as flood control, habitat protection, ground water recharge, etc. b. To develop and rejuvenate floodplains with mosaic of wetlands, preserving aquatic life and aquatic resources besides preservation of siltation of reservoirs, recharging of ground water, water purification etc. c. To provide recreational and cultural facilities while making the river physically and visually accessible to the people.¹Hkkx IIµ[k.M 3 (ii)º Hkkjr dk jkti=k % vlk/kj.k 7 d. To protect the floodplain ecosystem from adverse effects of development. e. To promote eco-tourism. ii. To promote and complement practices of augmentation of water and cleaning of water of the river as well as feeder drains. iii. To coordinate environmental and infrastructure aspects of various development projects related to the river and its watershed. iv. To act as a repository for sharing of plans/database/information/digitization and website development. v. To promote education on environmental awareness and nature conservation. vi. To evaluate the impact of the projects on the ecological value of the floodplains. vii. Evaluation - Public Participation – Feedback. viii. To take up other related activities as may be considered appropriate by the Centre including co-ordination, capacity building and training. 04. Constitution of the Centre (UCRRY) The Governing Body of the Centre (UCRRY) shall comprise the following members: (i). Hon’ble L.G., Delhi - Chairman (ii). Director (LS) - Member Secretary The Governing Body can co-opt experts from other organizations like SPA, IIT- Delhi, NGOs and other such institutions in the field of Water Management, Solid Waste Management/Environmental Engineering, Environmental Planning, Environmental Impact Assessment, Ecology, Botany, Biodiversity, Hydrology, Landscape Architecture, Architecture, Zoology etc. The meeting of the Governing Body shall be normally held every three months.8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 05. Functions of the Centre (UCRRY) In view of Aims and Objectives defined in clause 03 the Centre (UCRRY) shall perform the following functions:- i. Research a. To collect relevant data from time-to-time from concerned agencies and create a database for all future studies and research. b. To study and analyze the different aspects of the revival and development of the river and its floodplains, viz. hydrology, environmental pollution, biodiversity, ecology, water use and reuse, sustainable use of the river and the river front, etc. to identify critical issues and feed into the policy framework. c. To study the works undertaken by various concerned agencies pertaining to conservation, protection and rejuvenation of River and the floodplains and development of the same such as DJB, I&FC, DTTDC, CGWB, DMRC, PWD, Forest Department, etc. d. To study the best practices involved for revival and development of the river and its floodplains. ii. Formulation of policy and required plans a. To develop a integrated policies and prepare an integrated plan for a perspective year (and revise it periodically) addressing the following aspects - water quality and quantity, biodiversity, flood, water use and reuse, transportation and navigation, ground water recharge, riverfront development, or any other matter pertaining to revival and development of the River and its floodplains - based on feedback received from concerned agencies and based on public participation. b. The plan should address the related issues in the entire watershed/basin and prepare policies for the same. c. To prepare an Action Plan based on the Integrated Plan detailing out the projects to be taken by the Centre itself or by various agencies as directed by the Governing Body, along withits time frame. iii. Implementation a. To implement/execute the policies/plan prepared by the Centre. b. To review and give suggestions to the projects made by various agencies based on pre-defined parameters. c. To follow up with and coordinate various agencies to implement their project. d. Inter-sectoral coordination for planning and implementation. e. Facilitate resolution of disputes or any contradictory works among different stakeholders iv. Monitoring - To periodically monitor the works undertaken by Centre itself, and coordinate with other agencies and guide the same in taking requisite actions if so required. v. Miscellaneous Aspects a. Any other matter, which it may decide to meet the Object of the Centre. b. The Technical Support of Staff and secretarial assistance to this Centre shall be provided by the Authority. 06. Meetings of the Centre (UCRRY) The meetings of the Centre (UCRRY) shall be held as and when required. The Centre (UCRRY) shall have the powers to regulate its own procedure. The Member – Secretary shall keep the records of the meetings and take the required follow up actions. 07. Powers of the Chairman of the Centre (UCRRY) The Chairman shall have all the powers to direct the concerned to take necessary steps as he may deem fit within the framework of these regulations. 08. Powers of the Co Chairman of the Centre (UCRRY) The Co-Chairman shall work in Coordination with the Chairman and oversee the general functions of the Centre.¹Hkkx IIµ[k.M 3 (ii)º Hkkjr dk jkti=k % vlk/kj.k 9 09. Powers of the Member – Secretary of the Centre The Member Secretary shall perform all the administrative duties connected with the functioning of the Centre. 10. Constitution of the Committees i. Executive Committee and Groups: For smooth day to day functioning of Centre (UCRRY) there shall be an Executive Committee comprising of the following: a. Vice Chairman, DDA - Chairman b. Finance Member, DDA - Member c. Engineer member, DDA - Member d. Commissioner (Plg), DDA - Member e. Commissioner (LM), DDA - Member f. Addl. Commissioner. (LS) DDA - Member g. Director Horticulture, DDA - Member h. Director (LS) - Member Secretary The Executive Committee will exercise such powers may be delegated to it by the Centre (UCRRY). ii. The Centre may constitute working groups for day to day work under the chairmanship of Engineer Member, DDA which can appoint consultants such as Landscape Architects, Hydrologist, Ecologist/Botanist /Biologist/ Zoologist, Environmental Engineers, Environmental Planner, Geo-morphologist, Conservation/Heritage Expert, Urban Designer and Architects. iii. The Centre may in addition, constitute any other committee as it may consider necessary to oversee and perform functions pertaining to implementation of specific projects that may be undertaken by the UCRRY from time to time. 11. Budget, Finance & Accounts i. The expenses for setting up of the Centre (UCRRY) and its operational activities shall be met by the Delhi Development Authority, Grants and Loans given by Govt. of India, GNCTD/Local Bodies and donations etc. ii. The revised and budget estimates in respect of the Centre (UCRRY) shall be placed before the Authority for its approval. iii. The modalities of financing and processing funds for the centre will be prescribed by the Authority. A Separate Bank Account shall be opened to record various receipts and payments relating to the Centre (UCRRY). iv. The Centre (UCRRY) shall maintain proper accounts and other relevant records and prepare annual statement of accounts including the balance sheet in such form as the Authority may prescribe. 12. Operation of Accounts The Account of the Centre (UCRRY) shall be operated by an officer so authorized by the Centre. 13. Powers to Incur Expenses The Centre (UCRRY) shall have the power to sanction such expenses from time to time as it considers necessary for the prootion and achieving of the aims and objectives of the Centre (UCRRY). 14. Powers for Engagement of Staff All Ministerial Staff and Accounts Staff will be posted in the Centre (UCRRY) shall be inducted as per the Delhi Development Act, 1957. 15. Audit The audit of Accounts of the Centre, UCRRY shall be conducted as provided under the provisions of the Delhi Development Act, 1957.10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 16. Honorarium for Attending Meetings The non –official members will be given an honorarium as may be decided from time to time for attending the meeting of the Centre (UCRRY). 17. Disputes The decisions of the Lt. Governor, Delhi who is the Chairman of the Centre (UCRRY) on any dispute shall be final 18. Legal Proceedings No suit against the Centre (UCRRY) shall lie in any Court outside the NCT, Delhi. 19. Applicability of Delhi Development Act, 1957 The provision of the Delhi Development Authority Act, 1957 as amended from time to time will apply. 20. Repeal and Saving On and from the date of commencement of these Regulations, the Centre (UCRRY) shall act accordingly, provided that the actions already taken for and by the Centre (UCRRY) shall not be affected.
