1. संजक्षप्त नाम और प्रारम्भ.—(1) इन पररजनयमों का संजक्षप् त नाम राष्ट्रीय जडिाइन संस्ट्थान, आंध्र प्रदेि पररजनयम, 2023 ह।ै

(2) ये रािपत्र म ें प्रकािन की तारीख को प्रिृत्त होंगे।

2. पररभाषाए:ं- (1) इन पररजनयमों म,ें िब तक कक संदभ व स े अन्यथा अपेजक्षत न हो.- (क) अजधजनयम" स े समय-समय पर यथा-संिोजधत, राष्ट्रीय जडिाइन संस्ट्थान अजधजनयम, 2014 (2014 का

18) अजभप्रेत ह।ै (ख) "कियाकलाप" म ें संस्ट्थान के संबंध म,ें जिक्षा, अनुसंधान और प्रकािन, एकीकृत जडिाइन सेिाएं, आउटरीच कायविम, उद्योग कायविम, सूचना प्रौद्योजगकी सेिाए ं और अन्य ऐसे कृत्य िो िासी पररषद के अनुमोदन स े 2482 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] जनदेिक द्वारा जिजनजित ककए िाए, के संबंध म ें बहुआयामी कृत्यों का अिलोकन करन े के जलए िैजक्षक और सहायक इकाई सजम्मजलत ह;ै (ग) "कियाकलाप अध्यक्ष” स े पररजनयम 22 के अधीन कियाकलाप अध्यक्ष के रूप म ें संस्ट्थान का नाजमत संकाय सदस्ट्य अजभप्रेत ह;ै (घ) "जिभाग" स े संस्ट्थान के दैजनक कियाकलापों जिसके अधीन साधारण प्रिासन, अकादजमक प्रिासन, लेखा और जित्त भी ह ैतथा ऐस ेअन्य कृत्यों िो िासी पररषद द्वारा जिजनजित ककए िाए, की सहायता करने िाला अनुभाग, प्रकोष्ठ या ईकाई के साथ या उससे रजहत प्रिासजनक कियाकलापों का समूह अजभप्रेत ह,ै (ङ) "जिद्यािाखा प्रमुख” स े पररजनयम 29 के अधीन जिद्यािाखा प्रमुख के रूप म ें नाजमत संकाय सदस्ट्य अजभप्रते ह;ै (च) "जिद्यािाखा” या “कायविम” स े एक जिजिष्ट संकाय िाखा के अधीन संस्ट्थान द्वारा प्रस्ट्थाजपत अध्ययन और अनुसंधान स ेसंबंजधत िैजक्षक कायविम या पाठ्यिम की एक िाखा, अजभप्रेत ह।ै (छ) "संकाय" स े जिक्षण, अनुसंधान अथिा संस्ट्थान के जिकास कियाकलापों अिजस्ट्थजत के जलए जनयुि कमवचारी अजभप्रेत ह;ै (ि) “संकाय िाखा" स े संस्ट्थान की अकादजमक ईकाई अजभप्रेत ह,ै िो ऐस े अकादजमक कियाकलापों िैसे पररकल्पना जिक्षा, अनुसंधान तथा जिकास और जिजभन्न जिद्यािाखा रखने िाला परामि व म ेंलगी हुई हों;

(झ) "जिभागाध्यक्ष" म ें जिभाग का प्रिासजनक प्रमुख अजभप्रेत ह ै (ञ) “संस्ट्थान” स े राष्ट्रीय जडिाइन सस्ट्ं थान, आंध्र प्रदेि अजभप्रेत ह;ै (ट) “स्ट्थायी सजमजत” स े पररजनयम 10 के अधीन गरित िासी पररषद की स्ट्थाई सजमजत अजभप्रेत ह,ै (ि) “कायविाला या प्रयोगिाला या स्ट्टूजडयो अथिा प्रकोष्ठ" संस्ट्थान के संबंध म,ें संकाय िाखाओं, पररकल्पना जिद्यािाखाओं अनुसंधान और जिजभन्न जिकास कियाकलापों तथा संस्ट्थान के अन्य संबंजधत कृत्यों को प्रदान की िाने िाली, तकनीकी, प्रौद्योजगकी, पररकल्पना प्रबंध, बौजिक संपदा अजधकारों और अन्य सहायक सेिाए ं म ें लगी हुई संस्ट्थान की सहायक, ईकाइया ं अजभप्रेत ह,ै (ड) "सहायक संकाय" स े संस्ट्थान के जिक्षण, अनुसंधान या जिकास कियाकलापों के जलए एक जिजिष्ट अिजध के जलए लग े हुए कुिल िृजत्तकों, सेिारत या सेिाजनिृत्त दोनों सजहत उद्योग म ें एक जििेषज्ञ या प्रजतजष्ठत जडिाइनर अजभप्रेत ह;ै (ढ़) "अजतजथ संकाय" स े जडिाइनर, अकादजमक, कुिल िृजत्तकों सजहत ऐसा जििेषज्ञ िो जिजिष्ट पाठ्यिमों के जलए एक जििेषज्ञ ह ैऔर उन जिजिष्ट पाठ्यिमों को पढ़ाने म ेंसलं ग्न, अजभप्रेत ह।ै

(2) उन िब्द ों और पदों के, िो इसम ें प्रयुक् त ह,ैं और पररभाजषत नहीं ह ैं ककन् तु अजधजनयम में पररभाजषत ह,ैं के िही अथ व होंगे िो उन अजधजनयम म ें िमिः ह।ैं

3. सस्ट्ं थान के प्राजधकारी - जनम्नजलजखत संस्ट्थान म ेंप्राजधकारी होंगे, अथावत,

(i) अजधजनयम की धारा 11 के अधीन यथा गरित िासी पररषद;

(ii) अजधजनयम की धारा 15 के अधीन यथा गरित सीनेट;[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3

(iii) अजधजनयम की धारा 18 के अधीन यथा जनयुि जनदेिक,

(iv) िासी पररषद की स्ट्थाई सजमजत; और

(v) सभी कियाकलाप अध्यक्ष, संस्ट्थान पररसरों के संकायाध्यक्ष , रजिस्ट्रार, जिभागाध्यक्ष और अन्य जिद्यािाखा प्रमुख।

4. िासी पररषद और उसकी बिै क.—(1) अजधजनयम की धारा 13 के उपबंधों के अध्ययधीन रहते हुए, िासी पररषद, उसके कारबार के संव्यिहार के जलए तब-तब बैिक कर सकेगी िब-िब अध्यक्ष द्वारा आिश्यक समझा िाए।

(2) िासी पररषद की बैिक, अध्यक्ष द्वारा या तो उसके स्ट्िय ं के प्रस्ट्ताि पर या जनदिे क के अनुरोध पर या िासी जनकाय के छ: स ेअन्यनू सदस्ट्यों द्वारा हस्ट्ताक्षररत अध्यापेक्षा पर आयोजित की िाएगी।

(3) िासी पररषद की बैिक की गणपूर्त व तीन सदस्ट्य होगी अथिा िास्ट्तजिक सदस्ट्यों का एक जतहाई, िो भी अजधक हो, होगी।

(4) िासी पररषद की बैिक म ें सदस्ट्य, अध्यक्ष के पूि व अनमु ोदन प्राप्त करन े के पिात ् िीजडयो सम्मेलन या जडजिटल माध्यम के द्वारा भी बैिक म ें भाग ल े सकेग ें तथा ऐसा िीजडयो सम्मेलन या जडजिटल माध्यम के द्वारा भाग लने ा गणपूर्त व के प्रयोिन के जलए जहसाब में जलया िाएगा।

(5) िासी पररषद की बैिक म ें जिचार ककए गए सभी प्रश्नों का जिजनिय उपजस्ट्थत सदस्ट्यों के मतों के बहुमत द्वारा जिजनजित ककए िाएंगे और यकद मत समान रूप म ेंजिभाजित हो, तो अध्यक्ष मत दगे ा।

(6) िासी पररषद के प्रत्येक बैिक की अध्यक्षता, अध्यक्ष करेगा, परंत ु अध्यक्ष की अनुपजस्ट्थजत म,ें िासी पररषद के उपजस्ट्थत सदस्ट्य, बैिक की अध्यक्षता करने के जलए उनम ें स े ककसी को सदस्ट्य को चुनगे ें।

(7) प्रत्येक बैिक की जलजखत सूचना, रजिस्ट्रार द्वारा बैिक की तारीख स े कम स े कम पंद्रह कदिस पूिव, बैिक के स्ट्थान, तारीख़ और समय का उल्लेख करत े हुए प्रत्येक सदस्ट्य को भेिी िाएगी: परंतु अध्यक्ष अत्यािश्यक मामले पर जिचार करने के जलए संजक्षप्त सूचना, यहां तक कक पंद्रह कदिस की अिजध स े कम भी, देकर िासी पररषद की जििेष बैिक बुला सकेगा।

(8) सूचना, प्रत्येक सदस्ट्य के िासी पररषद के कायावलय म ें यथा अजभजलजखत पते पर दस्ट्ती, रजिस्ट्रीकृत डाक द्वारा या ई-मेल अथिा फैक्स द्वारा पररदत्त की िाएगी और यकद इस प्रकार सूचना भेि दी िाती ह,ै तो ऐसे समय जिसम ें डाक के साधारण अनुिम सूचना पररदत्त की िानी थी और ई-मेल या फैक्स की दिा म,ें िब उन्ह ें पारेजषत ककया था, पर सम्यक रूप पररदत्त की गई समझी िाएगी

(9) बैिक का एिेंडा सभी सदस्ट्यों को रजिस्ट्रार द्वारा अजिम म ें पररचाजलत ककया िाएगा

(10) यकद एक सदस्ट्य, पदेन सदस्ट्यों के अलािा, अनुपजस्ट्थजत की छुट्टी के जबना लगातार तीन बैिकों म ें भाग लने े के जलए जिफल रहता ह,ै तो उसकी पररषद की सदस्ट्यता खाररि कर दी िाएगी

(11) बैिक की कायवसूची म ें ककसी भी मद को सजम्मजलत ककए िान े के प्रस्ट्तािों की सूचना, रजिस्ट्रार को बैिक स े कम स े कम एक सप्ताह पहल े भिे नी होंगी। परंत ु अध्यक्ष, सम्यक सूचना न जमलन े की जस्ट्थजत म ें भी, ककसी भी मद को सजम्मजलत करन े की अनुमजत दे सकता ह।ै

(12) प्रकिया के सभी प्रश्नों के सबं ंध म,ें अध्यक्ष का फैसला अंजतम होगा।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(13) कोई भी मामला, जिसके जलए िासी पररषद के अनुमोदन की अपेक्षा होगी और िहां अल्प सूचना पर िासी पररषद की बैिक बलु ाना संभि नहीं ह,ै ऐस े मामलों पर, अध्यक्ष के अनुमोदन स े िासी पररषद द्वारा संकल्प के माध्यम स े पररचालन द्वारा उन पर जिचार ककया िा सकता ह।ै

(14) िासी पररषद की बैिक की कायविाही का कायविृत्त अध्यक्ष के अनुमोदन स े रजिस्ट्रार द्वारा तैयार ककया िाएगा, और सात काय व कदिसों की अिजध के भीतर िासी पररषद के सभी सदस्ट्यों को पररचाजलत ककया िाएगा, कायविृत्त पर रटप्पणी मागं ी िाएगी और यकद कायविृत्त प्राप्त होने के सात कदनों के भीतर कोई रटप्पणी प्राप्त नहीं होती ह,ै तो अध्यक्ष द्वारा हस्ट्ताक्षर ककए िान े के बाद इसे अंजतम माना िाएगा।

(15) ककसी बैिक की कायविाही के कायविृत्त, सुझाए गए ककसी भी संिोधन के साथ, िासी पररषद की अगली बैिक म ें पुजष्ट के जलए रखा िाएगा और पररितनव , यकद कोई हो, की पुजष्ट की िाती ह ैऔर अध्यक्ष द्वारा हस्ट्ताक्षररत करन े के पिात् ऐसी हर बैिक के समापन के पंद्रह कदनों के भीतर रजिस्ट्रार द्वारा उन्ह ें कायविृत्त पस्ट्ु तक म ें अजभजलजखत ककया िाएगा।

(16) कायविृत्त पुजस्ट्तका सदस्ट्यों के जनरीक्षण के जलए कायावलय समय के दौरान हर समय खुली रखी िाएगी।

5. िासी पररषद के अजधकार- (1) अजधजनयम की धारा 14 की उप-धारा (1) के अधीन प्रदत्त िजियों के अजतररि िासी पररषद के पास जनम्नजलजखत िजियां होंगी, अथावत:- (क) अजधजनयम की धारा 18 के अधीन, जनदेिक की जनयुजि की प्रकिया म ें केन्द्रीय सरकार की सहायता करना। (ख) जनदेिक के पद के जसिाय ककसी पद को समाप्त, पुनः पदाजभजहत अथिा नामकरण म ेंपररितवन करना।

(2) िासी पररषद, अकादजमक और अन्य पदों पर जनयुजि करने के प्रयोिन के जलए और सकं ाय और छात्रों की संख्या का अनुपात तथा अकादजमक और गरै अकादजमक पदों, कॉडर संख्या और संकाय सदस्ट्य के अनुपात पर जिचार तथा जिजनिय कर सकेगी।

6. आपाजतक मामलों म ें अध्यक्ष की िजिया-ं आपाजतक मामलों म ें अध्यक्ष, िासी पररषद की िजियों का प्रयोग कर सकेगा और तीस कदनों की अिजध के भीतर, उसके द्वारा की गई कारविाई पर िासी पररषद स ेअनुमोदन लेगा।

7. िासी पररषद के आदिे ों का प्रमाणीकरण.—िासी पररषद के सभी आदेिों और जिजनियों को जनदेिक या रजिस्ट्रार या िासी पररषद द्वारा इस संबंध म ें प्राजधकृत ककसी व्यजि के हस्ट्ताक्षर द्वारा अजधप्रमाजणत ककया िाएगा।

8. सस्ट्ं थान के प्राजधकरणों के सदस्ट्यों के यात्रा भत्त.े—संस्ट्थान के प्राजधकरणों के सदस्ट्य, संस्ट्थान के आंतररक या पदेन सदस्ट्यों को छोड़कर, अपनी सबं ंजधत यात्रा भत्ते, दैजनक भत्ता और बैिकों म ें भाग लने े के जलए बैिक फीस के हकदार होंगे, िो कक केन् द्रीय सरकार के अजधकाररयों और कमवचाररयों के जलए लागू ह।ैं

9. िासी पररषद म ें दानदाताओं का प्रजतजनजधत्ि.—अजधजनयम की धारा 11 के खंड (ि) के प्रयोिन के जलए िासी पररषद के सदस्ट्य के रूप म ें नामजनदिे न की अहतव ा के जलए जित्तीय सहायता या योगदान अन्य अपेक्षाओं की अिसीमा पचास लाख या उससे अजधक होगी परंतु संस्ट्थान द्वारा संपजत्त की कोई िसीयत, दान या अंतरण स्ट्िीकार नहीं की िाएगी िो िामी पररषद की राय में संस्ट्थान की प्रिृजत और उद्देश्य के जिरुि ित ें और बाध्यताए ंअंतिर्तवत करता ह।ै

10. िासी पररषद की स्ट्थायी सजमजत.— (1) िासी पररषद स्ट्थायी सजमजत का गिन करेगी, जिसम ें जनम्नजलजखत सदस्ट्य होंगे (क) जनदेिक, िो स्ट्थायी सजमजत के अध्यक्ष होंग,े (ख) कियाकलाप अध्यक्ष (जिक्षा),[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 5 (ग) िासी पररषद के अध्यक्ष द्वारा नाजमत, िासी पररषद के दो सदस्ट्य और (घ) रजिस्ट्रार, िो स्ट्थायी सजमजत का सदस्ट्य सजचि होगा,

(2) स्ट्थायी सजमजत, अजधमानतः िासी पररषद की बैिकों स ेपहल,े एक िषव म ें कम स ेकम चार बार बैिक करेगी

(3) बैिक म ें उपजस्ट्थत स्ट्थायी सजमजत के तीन सदस्ट्य, स्ट्थायी सजमजत की बैिक के जलए गणपूर्तव का जनमावण करेग;े

(4) स्ट्थायी सजमजत के अध्यक्ष स्ट्थायी सजमजत की बैिकों की अध्यक्षता करेगा और उनकी अनुपजस्ट्थजत म,ें कियाकलाप अध्यक्ष बैिकों की अध्यक्षता करेगा

(5) िासी पररषद के बैिकों के जलए लागू काय व सूची के मद और कायविृत की पुष्टी को समाजिष्ट करते हुए बैिक की सूचना स े संबंजधत पररजनयम 4 के उपबंध, िहां तक लागू हो, स्ट्थायी सजमजत की बैिकों के संबधं म ेंअनुसररत ककय े िाएगें।

(6) एक बार िासी पररषद द्वारा गरित स्ट्थायी सजमजत, तब तक ऐसे ही काय व करेगी िब तक िासी पररषद द्वारा पुनगवरित न की िाए।

(7) सभी नीजतगत मामलों जिनम ें िासी पररषद के जिचार ि अनुमोदन अपेजक्षत ह,ै और संस्ट्थान के कमवचारी और स्ट्टॉफ की सेिा ितों स े संबंजधत सभी मामलों को, अनुमोदन के जलए िासी पररषद के समक्ष रखने स े पहल,े सिवप्रथम स्ट्थायी सजमजत के समक्ष जिचार, जसफाररिों या अनुमोदन के जलए रखा िाएगा।

(8) बिटीय सहायता चाहने िाले सभी प्रस्ट्ताि, चाह े आिती या गैर आिती हो, स्ट्थायी सजमजत द्वारा पुनरीजक्षत ककये िाएगे और सजमजत अपनी जसफाररिों को पररषद के समक्ष प्रस्ट्तुत करेगी।

(9) स्ट्थायी सजमजत, जित्त सजमजत और भिन तथा संजिदा सजमजत के रूप म ें भी काय व करेगी और सभी मुख्य भिन या जनमावण पररयोिनाओं, पूंिीगत व्यय के मुख्य मदों की बाबत संजिदा और काय व आदेिों और ऐसे मामले िो िासी पररषद द्वारा जनर्दष्व ट ककय े िाए,ं का आिजधक रूप स ेपुनरीक्षण करेगी।

(10) स्ट्थायी सजमजत ऐस े सभी जित्तीय और नीजतगत मामलों िो उसे िासी पररषद द्वारा जनर्दष्टव ककय े िाए का पुनरीक्षण करेगी और जसफाररिे देगी।

(11) स्ट्थायी सजमजत की कायविाजहयों के सभी कायविृत और स्ट्थायी सजमजत के संकल्प रटप्पणी या संिोधन अथिा जिचार के जलए िासी पररषद की आगामी बैिक म ेंरखे िाएग।ें

(12) स्ट्थायी सजमजत के सभी आदेि और जिजनिय अध्यक्ष द्वारा हस्ट्ताक्षररत ककए िाएंग े और रजिस्ट्रार या िासी पररषद द्वारा प्राजधकृत ककसी अन्य व्यजि द्वारा अजधप्रमाजणत ककए िाएंगे और सजमजत के सदस्ट्यों को पररचाजलत करेंगे।

11. जनदेिक – जनदेिक, िासी पररषद द्वारा यथा अनुमोकदत, प्रत्यायोजित प्रिासजनक और जित्तीय िजियों के अनुसार व्यय करेगा।

(2) जनदेिक, िासी पररषद द्वारा बनाई ितों के अध्यधीन, दस हिार रुपय े की सीमा तक की अप्रजतसहाय व हाजनयों और पच्चीस हिार रुपय े की सीमा तक भंडार हाजन अथिा अनुपयोगी के अप्रजतसहाय व मूल्य को बट्टे खात े म ें डाल सकता ह।ै

(3) जनदेिक, चयन सजमजत की जसफाररिों पर, अजधजनयम के अधीन, िासी पररषद के पूिव अनुमोदन स े पदधारी के प्रारंजभक िेतन को न्यनू तम िेतनमान स े उच्चतर स्ट्तर पर, जलजखत रुप म ें औजचत्य देन े के साथ, जनधावररत करेगा, जिसके जलए पदों के संबंध म ेंजनयुजि की िा सकती ह।ै

(4) जनदेिक, संस्ट्थान स े संबंजधत ककसी जिषय पर जिचार-जिमिव और जसफाररिों के जलए ऐसी सजमजतयां और पैनल गरित करेगा, िैसा आिश्यक समझा िाएगा,6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(5) जनदेिक, िासी पररषद के पूिव अनुमोदन स,े संस्ट्थान के िक्षै जणक या प्रिासजनक कमवचाररयों के एक या एक स े अजधक सदस्ट्यों को अपनी कोई िजियां या उत्तरदाजयत्ि सौंप सकता ह।ै

(6) जनदेिक संस्ट्थान के सभी कमवचाररयों के कतवव्यों और उत्तरदाजयत्िों को जनर्दष्टव करते हुए ऐसे आदेि िारी करेगा िो आिश्यक ह ैं और उन पदों के जलए सुसंगत ह ैं जिन पर उन्ह ें जनयिु ककया िा सकता ह ै और प्रिासजनक और कायावत्मक कारणों स े उनम ें कुछ िाजमल या हटाना या पररितनव कर सकता ह।ै

(7) जनदेिक - (क) ऐसी समयािजध और ऐस े ितों पर, िो आिश्यक हो, ककसी कमवचारी को अजतररि कायव या उत्तरदाजयत्ि सौंपेगाः (ख) खडं (4) म ें उजल्लजखत सजमजतयों या पैनलों स े उन्ह ेंजनर्दषव ् ट ककसी मुद्दे पर जसफाररि या ररपोटव मांगगे ा।

(8) जनदेिक ऐसी अन्य िजियों का प्रयोग करेगा िो िासी पररषद द्वारा प्रत्यायोजित ककए िाएं; और

(9) जनदेिक, िासी पररषद के पूिव अनुमोदन स,े समझौता ज्ञापन पर हस्ट्ताक्षर करेगा, दिे के ककसी भी जहस्ट्से म ें या केन् द्रीय सरकार पूि व अनुमोदन स े जिश्व के ककसी भी जहस्ट्स े म ें िैजक्षक या अन्य संस्ट्थानों या उद्योग के साथ सहयोग करन े के जलए करार करेगा, िह ऐसा संकाय सदस्ट्यों, िररष्ठ पदाजधकाररयों, जिद्वानों, छात्रों के आदान-प्रदान द्वारा परू ी तरह या आंजिक रूप स े संस्ट्थान के समान उद्देश्यों द्वारा करेगा और आम तौर पर, इस तरह स े ऐसा करेगा, िो उनके सामान्य उद्देश्यों के अनुकूल हो, और जित्तीय जनजहताथव, यकद कोई हों, तो िासी पररषद द्वारा अनुमोदन के अधीन हों,

12. सीनटे - (1) अजधजनयम की धारा 15 म ें जिजनर्दष्टव व्यजियों के अजतररि, जनम्नजलजखत सदस्ट्य सीनेट म ें िाजमल होंग,े अथावत ् (क) ककसी कियाकलाप के उत्तरदाजयत्ि िाले प्रधान जडिाइनर (प्रोफेसर) और ज्यष्ठे जडिाइनर (सहयुक्त प्रोफेसर) (ख) तीन जिभागाध्यक्ष, िो जनदेिक द्वारा नामजनर्दष्टव ककए िाएं।

(2) सीनेट के सदस्ट्यों, पदेन सदस्ट्यों स े जभन्न, की पदािजध उनके नामजनदेि की तारीख स ेदो िषव की होगी।

(3) आकजस्ट्मक ररजि को भरन े के जलए नामजनदेजित सीनेट के सदस्ट्य का कायवकाल उस सदस्ट्य की िेष अिजध तक िारी रहगे ा जिसके स्ट्थान पर उसे नामजनदेजित ककया गया ह।ै

(4)एक जनितवमान सदस्ट्य, िब तक कक सीनेट अन्यथा जनदेि ना हो,कायावलय म ें तब तक बना रहगे ा िब तक कक उसके स्ट्थान पर ककसी अन्य व्यजि को सदस्ट्य के रूप म ेंनाजमत नहीं ककया िाता ह।ै

(5) सीनेट जितनी बार आिश्यक हो, ककन् तु प्रत्येक िक्षै जणक िषव म ें कम स े कम चार बार ऐसे स्ट्थान और समय पर बैिक करेगी और अपनी बैिकों म ें कायव िासी के संबंध म ें प्रकिया के ऐसे जनयमों का पालन करेगी,िैसा कक सीनेट द्वारा जनधावररत ककया िा सकता ह।ै

(6) सीनेट की बैिक की अध्यक्षता जनदेिक द्वारा की िाएगी और उनकी अनुपजस्ट्थजत म ें सबसे िररष्ठ कियाकलाप अध्यक्ष बैिक की अध्यक्षता करेंगे।

(7) सीनेट के सदस्ट्यों की कुल सख्ं या के एक जतहाई सीनेट, उस बैिक के जलए गणपूर्त व पूरा करेगी।

(8) सीनेट की बैिक म ें जिचार ककए िाने िाल े सभी मामल े उपजस्ट्थत सदस्ट्यों के बहुमत स े तय ककए िाएगं े और यकद मत समान रूप स े जिभाजित होते ह,ैं तो अध्यक्ष जनणावयक मत करेगा।

(9) सीनेट के अध्यक्ष द्वारा प्राजधकृत रजिस्ट्रार या सीनेट का एक अन्य सदस्ट्य, सीनेट की कायविाही की कायविाही का कायविृत्त तैयार करेगा और सीनेट के अध्यक्ष द्वारा अनुमोकदत कायविृत्त की प्रजत सभी सदस्ट्यों को पररचाजलत की िाएगी।[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 7 परंतु ऐस े कायविृत्त या कायविृत्त के भाग को पररचाजलत नहीं ककया िाएगा यकद सीनेट ऐसे पररचालन को संस्ट्थान के जहतों के प्रजतकूल परीक्षकों की जनयुजि,पेपर सैटर, परीक्षा पत्रों या जडिी प्रमाणपत्र के मुद्रण िैसी प्रकृजत म ेंगोपनीयता मानती ह।ै

(10) यकद, ककसी भी आपात जस्ट्थजत होने पर सीनेट के अध्यक्ष की राय म,ें जिस पर तत्काल कारविाई की आिश्यकता ह,ै तो िह उस तरह की कारविाई कर सकता ह ै और सीनेट की अगली बैिक म ें उसे अन्य सदस्ट्यों को इसके बारे में कायोत्तर संिोधन की ररपोट वकरनी होगी।

(11) अजधजनयम की धारा 15 के खंड (घ) और (ङ) के अधीन नामजनदेजित सीनेट के सदस्ट्य, संस्ट्थान स े यात्रा भत्ता, दैजनक भत्ता और बैिक िल्ु क के हकदार होंग,े िैसा कक िासी पररषद ्द्वारा जनधावररत ककया िाएगा।

(12) सीनेट के अजधकारों और कायों म ें अन्य बातों के साथ जनम्न सजम्मजलत होंग-े (क) िैक्षजणक सलाहकार सजमजत के जसफाररिों के आधार पर जिजभन्न जिद्यािाखाओं के जलए पाठ्यिमों और जिषयों को तैयार और संिोजधत करना;

(ख) संकाय िाखा जिद्यािाखा या कायविम या पररसरों के जनमावण, पुनगविन या हटाने के संबंध म ें िासी पररषद को सुझाि देना; (ग) परीक्षा, परीक्षकों की जनयुजि, मध्यस्ट्थों, सारणीकारों और परीक्षाओं स े संबंजधत अन्य मामलों के िासी के जलए प्रबंध की देखरेख करना;

(घ) अंजतम सेमेस्ट्टर परीक्षाओं के पररणाम घोजषत करना या ऐसा करने के जलए सजमजत या अजधकारी की जनयुजि करना और जडिी, जडप्लोमा और अन्य िैक्षजणक जिजिष्टताए ं या जखताब के प्रदान करने या प्रदान करने के संबंध म ेंिासी पररषद को जसफाररिें करना;

(ङ) जिजिष्ट और महत्िपणू व िैक्षजणक मामलों पर सलाह देन े के जलए सीनेट के सदस्ट्यों, अन्य संकाय सदस्ट्यों और बाहरी जििेषज्ञों म ें से सजमजतयों या कायवकारी समूहों की जनयुजि करना; (च) िैक्षजणक सलाहकार सजमजत की जसफाररिें पर जिचार करना और िहााँ आिश्यक कारविाई करना या कारविाई की जसफाररि करना;

(छ) संस्ट्थान के जिक्षा के स्ट्तर की उत्कृष्टता बनाए रखने के जलए जिजभन्न संकाय जिधाओं या जिद्यािाखाओं के कियाकलापों की आिजधक समीक्षा करना और उजचत कारविाई करना; (ि) परामिी आउटरीच और उद्योग कायविम पररयोिनाओं के माध्यम स े क्लास रूम म ें बािार की िास्ट्तजिकताओं को लान े के जलए उन अिसरों को प्रोत्साजहत करना जिससे कक जडिाइन अनुसंधान एि ं जिकास को क्लास रूम और काय व क्षेत्रों म ें बढ़ािा जमल सके;

(झ) छात्रों के चयनीत और अन्य पाठ्येतर और कायविमों की आयोिन और समीक्षा और उसके अनुसार उपयिु सुझाि देना; (ञ) प्रयोगिाला, स्ट्टूजडयो, क्लास रूम, हॉस्ट्टल, छात्र कल्याण, सह पाियिम कियाकलापों, जिकायत तंत्र आकद के कायों की दखे - रेख करना। (ट) सीनेट के पूिव अनुमोदन स े आिश् यक समझी िाने िाली ितों के साथ छात्रिृजत्त, पदक, पुरस्ट्क ार और अन्य समान मान्यता प्रदान करना;8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (ि) िासी पररषद के पूि व अनुमोदन स े आिश्यक समझी िान े िाली ितों के साथ छात्रिृजत्त और अन्य समान मान्यता प्रदान करना;

(ड) संस्ट्थान की जिजभन्न िैक्षजणक और प्रिेि कियाकलापों की प्रगजत की आिजधक समीक्षा: (ढ) ऐसे िैक्षजणक मामल े िो इस ेिासी पररषद ्द्वारा जनर्दष्व ट ककए िा सकते ह।ै

13. मानद जडजिया ं प्रदान करना- संस्ट्थान कुछ जिलक्षण और उत्कृष्ट व्यजियों को जडिाइन और जडिाइन स े संबंजधत क्षेत्रों में योगदान के जलए मानद उपाजधयां प्रदान कर सकती ह।ै परंत ु मानक उपाजधयों के सभी प्रस्ट्ताि सीनेट द्वारा जसफाररि और िासी पररषद द्वारा अनुमोकदत ककए गय े हों।

14. सकं ाय जिधाएं:- (1) संस्ट्थान जनम्रजलजखत संकाय जिधाओं के अधीन जडिाइन जिद्यािाखाओं के माध्यम स े स्नातक, मास्ट्टर, डॉक्टरेट, एकीकृत मास्ट्टर प्रोिाम की पेिकि कर सकता ह ैअथावत:- (क) औद्योजगक जडजाइन के संकाय के जलए अिणी िैसे जििषज्ञता के जलए उत्पाद जडजाइन, फनीचर और आंतररक पररकल्पना, जसरॅजमक और ग्लॉस पररकल्पना, जखलौने और खेल जडजाइन, पररिहन तथा ऑटोमोबाइल जडजाइन और यूजनिसवल जडिाइन और संबंजधत जििेषज्ञता। (ख) संचार जडजाइन के संकाय जििेषज्ञता के जलए अिणी िैसे िाकफक जडजाइन, एनीमेिन कफल्म जडजाइन, कफल्म और िीजडयो संचार जडजाइन, फोटोिाफी और प्रदिनव ी जडजाइन और अन्य संबंजधत जििेषज्ञता। (ग) कपड़ा, पररधान,लाइफस्ट्टाइल और सामानों की जडिाइन संकाय म ें अिणी के जलए िस्त्र, कपड़ा, पररधान जडिाइन और लाइफ स्ट्टाइल सामान जडिाइन तथा अन्य संबंजधत िैसी जििेषज्ञता जलए जडिाइन ह।ै (घ) अंतर-जिद्यािाखा जडजाइन अध्ययन का संकाय म ें अिणी के जलए स्ट्रैटेजिक जडजाइन प्रबंधन और फुटकर अनुभि तथा अन्य संबंजधत जििेषज्ञता के जलए जडिाइन ह।ै

(2) इस पररजनयम म ें संिोधन करते हुए िासी पररषद सीनेट की जसफाररि पर जडिाइन जिद्यािाखाओं की ककसी संकाय जिधा या कायविम को िाजमल करन े या हटान े या संिोजधत कर सकती ह।ै

15. िक्षै जणक और प्रजिक्षण कायिव मों का नामकरण- प्रत्येक प्रमाणपत्र, जडप्लोमा, जडिी, स्नातक, परास्नातक, अनुसंधान या अन्य कायविम और जिजभन्न जडिाइन जिधाओं म ें संस्ट्थान के प्रत्येक संकाय जिधा द्वारा नामकरण िैजक्षक सलाहकार सजमजत और सीनेट की जसफाररिों पर िासी पररषद द्वारा अनुमोदन ककया िाएगा।

16. छात्र िल्ु क- िमाराजि या िल्ु क छात्रों स े िसूला िाना ह ै जिसम ें प्रिेि परीक्षा िुल्क, ट्यूिन िल्ु क, छात्रािास िुल्क और संस्ट्थान की जिजभन्न संकाय जिधाओं के अधीन िासी पररषद द्वारा जडिी, जडप्लोमा और प्रमाण-पत्र अन्य िल्ु क के जलए चाह े स्ट्िय ं या सीनेट की जसफाररि पर जनधावररत ककए िाएंगे।

17. फैलोजिप, स्ट्कालरजिप, पदक, परु स्ट्क ार, आकद की सस्ट्ं थापना- सीनेट, फैलोजिप, स्ट्कालरजिप, पदक और पुरस्ट्कार और ऐसे पुरस्ट्कारों की ित ें तथा जनबंधन िासी पररषद इस अनुमोदन के अध्यधीन, पुनरीजक्षत तथा जसफाररि की िा सकेगी। परंत ु कोई भी फैलोजिप, स्ट्कालरजिप, पदक, इनाम िो इस पररजनयम के लागू होन े स े पूिव दी िाती थी, इस पररजनयम के लाग ू होने स े पूिव तय ककए गए जनयमों और ितों के अध्यधीन िारी रहगे ा, िब तक कक िाषी पररषद के अनुमोदन स े सीनेट द्वारा उनकी समीक्षा नहीं की िाती ह।ै

18. आिास हॉल- (1) संस्ट्थान आिास हाल या छात्रािास अपने कायविमों म ें सूचीबि अपने जिद्यार्थवयों, अनुसंधान स्ट्कालर और अनुसंधान फैलोंि के जलए अपन े पररसर म ेंस्ट्थाजपत और रख-रखाि करेगा।

(2) हाल तथा छात्रािास के प्रत्येक आिासी को संस्ट्थान द्वारा अध्यापेजक्षत जनयमों का अनुपालन करेगा।[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 9

(3) संस्ट्थान, आिासीय छात्रािास और हाल के कुिल प्रबंधन के जलए यथाअपेजक्षत एक या अजधक िाडवन और अन्य सहायक कमवचाररिृंद जनयिु करेगा।

(4) हाल के आिासी और छात्रािास म ें छात्रों को िाजसत करने िाले जनयम और जिजनयम सीनेट द्वारा अनुमोकदत ककए िाएंगे।

19. अकादजमक सलाहकार सजमजत - (1) अकादजमक सलाहकार सजमजत म ें जनम्नजलजखत सदस्ट्य होंग,े अथावत ् (क) कियाकलाप अध्यक्ष (जिक्षा) सजमजत के अध्यक्ष होंग;े (ख) संस्ट्थान पररसर के संकायाध्यक्ष; (ग) प्रत्येक संकाय जिधा म ें स े एक जिद्यािाखा प्रमुख और (घ) जनदेिक द्वारा यथा नामजनर्दष्टव सीनेट के दो सदस्ट्यः

(2) अकादजमक सलाहकार सजमजत के दाजयत्ि: (क) जिजभन्न जिद्यािाखाओं हते ु अध्ययन के जिषयों के पाठ्यिम की समीक्षा और संिोधन के प्रस्ट्ताि; (ख) सम्बजन्धत संकाय प्रमुखों के साथ सभी जडिाइन जिद्यािाखाओं के अध्ययन की समीक्षा और कायविम और मल्ू यांकन;

(ग) सभी जिद्यािाखाओं के पाठ्यिम की संरचना और जितरण पर, सभी जहतधारकों स े जिचार और सुझाि प्राप्त करना; (घ) अध्ययन के सभी मामलों म ें भागीदारी लेन े हते ु आतं ररक और बाहरी जिक्षकों और छात्रों को प्रोत्साजहत करना;

(ङ) सीनेट के समक्ष संकाय समूह और प्रत्येक जिद्यािाखाओं के िैक्षजणक मामलों को प्रस्ट्ततु करना; (च) सीनेट के समक्ष स्नातक, स्नातकोत्तर, पीएचडी म ें प्रिेि के जलए िरूरी िैक्षजणक इकििालेन्स्ट्स के प्रबंधन और संिोधन हते ु प्रस्ट्तुत करना;

(छ) जिजभन्न संकाय जिद्यािाखाओं या जिषयों की कियाकलापयों की आिजधक समीक्षा की व्यिस्ट्था करना और संस्ट्थान के जिक्षा के स्ट्तर की उत्कृष्टता बनाए रखन े के जलए उजचत कारविाई करना; (ि) क्लास रूम और संबंजधत क्षेत्रों म ें जडजाइन अनुसंधान एिं जिकास को बढ़ािा देने के जलए उपाय करना और परामिी, आउटरीच और उद्योग कायविम पररयोिनाओं के माध्यम स े क्लास रूम म ें बािार कियाकलापयों संबंधी िास्ट्तजिकता लाने के अिसरों को बढ़ािा देना;

(झ) उत्कृष्टता के जलए जिक्षा रणनीजतयों के कायावन्ियन स े संबंजधत ककसी भी तरह के मामल े के संबंध म ें समीक्षा करना और उस पर जसफाररि प्रस्ट्तुत करना िैसा कक सीनेट द्वारा बताया गया;

(3) जितनी बार अपेजक्षत हो िक्षै जणक सलाहकार सजमजत की बैिक करना तथा एक सेमेस्ट्टर म ें कम स े कम दो बार बैिक आयोजित करना।

20. संकाय फोरम- (1) िाषी पररषद द्वारा एक फैकल्टी फॉरम का गिन ककया िाएगा जिसम ें संस्ट्थान और उसके पररसरों के सभी जिक्षण संकाय सदस्ट्य सजम्मजलत होंगे।10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(2) िैक्षजणक सत्र की िुरूआत स े पहले संकाय फॉरम की एक िषव म ें कम स े कम दो बैिकें आयोजित की िाएगं ी और इन बैिकों म ें संस्ट्थान की िैक्षजणक कायविमों पर जििन बनाने हते ु सभी िैक्षजणक मामलों, फैकल्टी िुप की चचंताओं और उनके योगदान पर जिचार करना, पाठ्यिम को बेहतर बनाने के जलए और उसे प्रस्ट्तुत करने के जलए तथा सभी ज िद्यािाखाओं तथा कायविमों के िैक्षजणक मानकों को जनरंतर बढ़ाने तथा पाठ्यिम तैयार करन,े उसके मूल्यांकन तथा िरू ी के संबंध म ें सीनेट को फीडबैक प्रदान करना।

(3) संकाय फोरम की अध्यक्षता, जनदेिक द्वारा और उनकी अनपु जस्ट्थजत म ें कियाकलाप अध्यक्ष (जिक्षा) या संस्ट्थान के संकायाध्यक्ष द्वारा की िाएगी।

(4) संकाय फोरम के फीडबैक जिचार जिमि व और उस पर उजचत कारविाई हते ु सीनेट के समक्ष रखे िाएाँगे।

21. सस्ट्ं थान के सकं ायाध्यक्ष - (1) अजधजनयम की धारा 19 के अधीन प्रत्येक संस्ट्थान पररसर के जलए संकायाध्यक्ष, जनदेिक द्वारा संस्ट्थान के संकाय सदस्ट्यों म ें से एक, पदानुसार िररष्ठ जडजाइनर के पद स े नीच े नहीं, रोटेिन के आधार पर, तीन िषव

(3) तक की अिजध के जलए नामजनर्दष्टव ककए िाएंग े ि सीनेट द्वारा आिजधक समीक्षा के अंतगतव होंग:े परंत ु ककसी भी प्रिासजनक या िैजक्षक आपात जस्ट्थजत के मामले म,ें जनदेिक, पररसर के संकायाध्यक्ष के रूप म,ें कायवकाल से पहल,े िैक्षजणक िष व के अंत म,ें अन्य ककसी को भी नाजमत कर सकते ह।ैं

(2) संस्ट्थान पररसर के संकायाध्यक्ष अकादजमक संबंधी मामलों पर कियाकलाप अध्यक्ष (जिक्षा) के साथ परामि व करके और प्रिासजनक तथा जित्तीय मामलों म ें जनदेिक के साथ परामिव करके और पररसर के सभी िैक्षजणक और प्रिासजनक मामलों पर जनयंत्रण का कायव करेंगे।

(3) संस्ट्थान पररसर के संकायाध्यक्ष सीनेट, जनदेिक, स्ट्थायी सजमजत और िासी पररषद के सभी नीजत जनदेिों को जनष्पाकदत करेंगे।

(4) संस्ट्थान पररसर के संकायाध् यक्ष पयविेक्षण और पररसर स े संबंजधत सभी अजभलेख रखेंगे तथा कियाकलाप अध्यक्ष (जिक्षा) और जनदेिक को आिजधक ररपोट वभेिेंगे।

(5) पररसर के संकायाध्यक्ष, पररसर के सभी िैजक्षक कायविमों के बाबत, िैजक्षक और प्रिासजनक मानकों के अनुसार उत्कृष्टता प्राप्त करन े म,ें जनदेिक और कियाकलाप अध्यक्ष (जिक्षा) की सहायता करेंगे।

(6) पररसर के संकायाध्यक्ष, िासी पररषद द्वारा िो उस े प्रत्यायोजित की िाए, ऐसी प्रिासजनक ि जित्तीय िजियों का प्रयोग करेंगे।

22. कियाकलाप अध्यक्ष – संस्ट्थान के जिजभन्न कियाकलापों और उद्देश्यों हते ु कियाकलाप अध्यक्ष, जनदेिक द्वारा नामजनर्दष्व ट ककए िाएंग,े अथातव ्:- (क) कियाकलाप अध्यक्ष (जिक्षा); (ख) कियाकलाप अध्यक्ष (अनुसंधान और प्रकािन);

(ग) कियाकलाप अध्यक्ष (एकीकृत जडिाइन सेिाए)ं ; (घ) कियाकलाप अध्यक्ष (आउटरीच); (ड.) कियाकलाप अध्यक्ष (ज्ञान प्रबंधन प्रणाली); (च) कियाकलाप अध्यक्ष (उद्योग कायविम और ऑनलाइन जिक्षा); (छ) कियाकलाप अध्यक्ष (अंतराष्ट्रव ीय कायविम);

(ि) कोई अन्य कियाकलाप अध्यक्ष।[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 11

(2) कियाकलाप अध्यक्ष को उनके नामजनदेिन की तारीख स े तीन िषव की अिजध के जलए चिानुिम के आधार पर िो ज्य ष्े ि जडिाइनर (सह-आचाय)व की पंजि स ेनीच े न हों, संस्ट्थान के संकाय सदस्ट्यों म ें स ेनामजनर्दष्व ट ककया िाएगा।

(3) ककसी भी प्रिासजनक या िैजक्षक आपात जस्ट्थजत की दिा म,ें जनदेिक ककसी कियाकलाप अध्यक्ष की पदािजध की समाजप्त स े पहल,े अन्य ककसी पदाजधकारी को ऐसे कियाकलाप अध्यक्ष के रूप म ेंनामजनर्दष्व ट कर सकेंगे।

23. कियाकलाप अध्यक्ष (जिक्षा) का काय व और िजिया-ं (1) कियाकलाप अध्यक्ष (जिक्षा) सभी संकाय और कायविम के बाबत संस्ट् थान के सभी प्रिासजनक और िैजक्षक कियाकलापों के प्रभारी होंगे।

(2) कियाकलाप अध्यक्ष (जिक्षा), जिक्षा के मानकों जिसके अंतगतव संस्ट्थान और संस्ट् थान पररसर के छात्रों के अनुिासजनक जिषयों संबंधी और जिकायत ें भी ह,ै म ें उत् कृष्ट ता रखन े के जलए उत्तरदायी होगा जिसके जलए िह सीनेट, जनदेिक, स्ट् थायी सजमजत पररषद और िासी पररषद के परामि वस े समुजचत कारविाई करेगा।

(3) सभी संकायाध्यक्ष, संकाय प्रमुख, जिद्यािाखा प्रमुख, प्रयोगिाला या स्ट्टूजडयो समन्ियक और जिद्याओं या कायविमों के संकाय सदस्ट् य और जिक्षा और िैजक्षकों स े संबंजधत सभी सलाहकार सजमजतयां, संस्ट् थान के मानकों के िैजक्षक जितरण और रखरखाि के जलए कियाकलाप अध्यक्ष के प्रजत उत्तरदायी होंगे।

(4) कियाकलाप अध्यक्ष (जिक्षा) ऐसी सजमजतयों और पनै लों की िो जनदेिक द्वारा नामजनर्दष्टव की िाए, अध्यक्षता करेंग े और उन सभी कायों को िो जनदेिक द्वारा उन्ह ें सौंप े िाए पूरा करेंगे।

(5) कियाकलाप अध्यक्ष (जिक्षा) िो िासी पररषद द्वारा उनको प्रत्यायोजित की िाए ऐसी िजियों का प्रयोग करेंगे।

24. अन्य कियाकलाप अध्यक्षों के काय:व- (1) पररजनयम 22 के खंड (1) के उपखडं (ख) स े उपखडं (छ) म ें जनर्दष्व ट कियाकलाप अध्यक्ष संस्ट्थान और उसके पररसरों के सभी संकाय धारा और जिद्याओं स े सम् बि कियाकलापों के प्रभारी होंग े और ऐस े कृत् यों और कियाकलाप की अजभिृजि करन े के जलए उत्तरदाजयत् िों, िो जनदेिक द्वारा उनको सौंप े िाए का जनिवहन करेंगे।

(2) कियाकलाप अध्यक्ष ऐसी अन् य िजियों का िो िासी पररषद द्वारा उनको प्रत्यायोजित की िाए प्रयोग करेंगे।

25. उपाध्य क्ष-(1) सभी कियाकलाप अध्यक्ष को सहयुक्त ज्य ष्ठे जडजाइनर (सहायक आचाय)व या जडजाइनर (संकाय) के स्ट्तर पर संकाय समूह म ेंस े जनदिे क द्वारा नामजनर्दष्व ट उपाध् यक्ष द्वारा सहयोग कदया िाएगा।

(2) उपाध् यक्ष, कियाकलाप अध्यक्ष की अनुपजस्ट्थजत म,ें कियाकलाप अध्यक्ष के रूप म ें काय व करेंगे और ककसी भी कारण स े अनपु लब्धता की जस्ट्थजत में, जनदेिक ज्य ष्ठे जडजाइनर (सहयुक्त आचाय)व या सहयक्ु त ज्य ष्ठे जडजाइनर (सहायक आचायव) के पद पर कायवरत सकं ाय सदस्ट्य को नामजनर्दष्व ट करेंग,े िो उसकी अनपु जस्ट्थजत के दौरान कियाकलाप अध्यक्ष के रूप म ेंस्ट्थ ानापन् न होंग े और ऐसे स्ट् थानापन्न कियाकलाप अध्यक्ष के पास कियाकलाप अध्यक्ष के समान ही िजिया ाँहोंगी।

26. रजिस्ट्रार- (1) संस्ट्थान के रजिस्ट्रार को िासी पररषद द्वारा प्रजतजनयुजि के आधार पर जनयुि ककया िाएगा, जिसके न हो सकने पर संजिदा पर तीन िषव की अिजध के जलए जिसे िार्षवक आधार पर पांच िष व की कुल अिजध तक बढ़ाया िा सकता ह।ै

(2) रजिस्ट्रार संस्ट्थान के सभी िैजक्षक प्रिासन के प्रभारी होंगे और सभी िैजक्षक और छात्र संबंधी मामलों के बाबत केन् द्रीय सरकार के जनदिे ो को कायावजन्ित करने के जलए उत्तरदायी होंग े और प्रिेि, पाठ्यिम जितरण, जनधावरण, मूल्यांकन, श्रेजणयों का प्रदान करना या जडप्लोमा या जडजियों स े संबंजधत िैजक्षक प्रिासन मामलों म ें और ऐसे अन् य िैजक्षक प्रिासन स े संबंजधत काय व और उत्तरदाजयत् िों का िो जनदिे क द्वारा उन् ह ें सौंप े िाए कियाकलाप अध्यक्ष (जिक्षा) समन्ि य करेंगे।12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(3) िब िासी पररषद के एक संकल्प द्वारा प्राजधकृत या जनदिे क द्वारा अनुमोकदत हो, रजिस्ट्रार संस्ट्थान के जलए और संस्ट्थान की ओर स े सभी संजिदाओं और जिजधक दस्ट्तािेिों को जनष्पाकदत करेगा, ऐसी संजिदा और जिजधक दस्ट् तािेिों आकद के संबंध म ें व्यजिगत रूप स े उत्तरदायी नहीं होंगे।

(4) रजिस्ट्रार छात्रों और िैजक्षक मामलों स े संबंजधत डाटा और अजभलेखों को सृजित करन े और रखरखाि के जलए उत्तरदायी होंगे।

(5) रजिस्ट्रार संस्ट् थान और संस्ट्थ ान पररसरों की सभी िैजक्षक संबंधी कायो और सुजिधाओं के जलए प्रिासजनक सहयोग हते ु सभी जिभागाध् यक्षों, संस्ट्थान पररसरों के संकायाध्यक्षों और जिद्यािाखा प्रमुखों स े समन्िय करेगा और कियाकलाप अध्यक्ष (जिक्षा) के परामिव स े उपरोक्त के जलए व् यिस्ट् था करेगा।

(6) रजिस्ट्रार, ऐसी सजमजतयों और पैनलों की अध्यक्षता करेंग े जिसके जलए िह जनदेिक द्वारा नामजनर्दष्टव ककया िाए तथा ऐसे अन्य कायों को पूरा करेंगे िो जनदेिक द्वारा उसे सौंपे िाए ं और ऐसी िजिया ं िो िासी पररषद द्वारा उस े प्रत्यायोजित की िाए, का भी प्रयोग करेंगे।

27. मख्ु य प्रिासजनक अजधकारी- (1) िासी पररषद ् द्वारा एक मुख्य प्रिासजनक अजधकारी जनयुि ककया िाएगा, िो संस्ट्थान के स्ट्थापन मामलों और साधारण प्रिासन के जलए केन्द्रीय सरकार और जिजभन्न जनदिे ों के कायावन्ियन संबंधी अन्य प्राजधकाररयों के साथ संपकव तथा कार्मवक और स्ट्थापना सेिाओं, सुरक्षा और हाउसकीचपंग सेिाओं, भूजम या भिन रख- रखाि, खरीद और भंडार तथा ऐसे अन्य साधारण प्रिासजनक सेिाओं और अन्य प्रिाजसक उत्तरदाजयत्ि िो जनदेिक द्वारा उसे सौंपे िाए,ं प्रभारी होंगे ।

28. जित्त और लखे ा के जनयत्रं क- (1) िासी पररषद ् द्वारा एक जित्त और लेखा जनयंत्रक जनयुि ककया िाएगा, िो संस्ट्थान और संस्ट्थान पररसरों के केन्द्रीय सरकार और जित्तीय अनदु ान लेखा और लेखा परीक्षा मामलों स े संबंजधत अन्य प्राजधकरणों से संपकव के जलए प्रभारी होंगे।

(2) जित्त और लेखा जनयंत्रक, लेखाओं और जित्तीय सेिाओं, कराधानों, रख-रखाि और लेखाओं के प्रस्ट्ततु ीकरण के जलए कानूनी अपेक्षाओं के अनुपालन के जलए और अनुदानों की सभी ितों के अनपु ालन और जनदेिक और जित्तीय डेटा तैयार करने म ें सहायता करने और स्ट्थायी सजमजत या िासी पररषद ्के प्रस्ट्ततु ीकरण और ऐसे उत्तरदाजयत्िों िो जनदेिक द्वारा उस े सौंपे िाए ं के पालन के जलए भी उत्तरदायी होगा।

29. जिद्यािाखा प्रमखु - (1) स्नातक या स्नातकोत्तर पाठ्यिमों म ें प्रत्येक जडिाइन जिद्यािाखा म ें कियाकलाप अध्यक्ष (जिक्षा), संकायाध्यक्ष और सीनेट से जनकट समन्िय म ें संस्ट्थान और संस्ट्थ ान पररसरों के जिक्षा कियाकलापों म ें सभी छात्र कायव के पाठ्यिम जितरण, जनधावरण, श्रेणीकरण और मल्ू यांकन िूरी के जलए संकाय और छात्रों के साथ संपकव करने के जलए जिद्यािाखा प्रमुख होगा।

(2) जिद्यािाखा प्रमुख ऐसे नाम जनदेिन की तारीख स े तीन िषव की अिजध के जलए चिानुिम के आधार पर सहयुि ज्येष्ठ जडिाइनर (सह-आचायव) स े अजनम्न पंजि के संस्ट्थान के संबि जडिाइन जिद्या स े संकाय सदस्ट्य म ें स े जनदेिक द्वारा नामजनर्दष्टव ककया िाएगा। परंत ु ककसी भी प्रिासजनक या िैजक्षक अत्यािश्यकताओं के जलए, जनदेिक उि अिजध की समाजप्त स े पहल,े िैजक्षक िषव के अतं म ेंजिद्यािाखा समन्ियक के रूप म ेंअन्य पदाजधकारी को नामजनर्दष्टव कर सकेगा।

(3) जिद्यािाखा प्रमुख, िैजक्षक कलडें रों को बनान,े जिद्या से संबंजधत पाठ्यिमों के समय स े पूरे होन,े जिद्या के संकाय सदस्ट्यों या अजतजथ संकाय के साथ जनकट समन्िय म ें िजै क्षक कलेंडर और समय सारणी के अनुसार पररक्षा िूरी का संचालन और जनधावरण तथा मल्ू यांकन की व्यिस्ट्था करने और उनके द्वारा समजन्ित जडिाइन जिद्या के बाबत संस्ट्थान और संस्ट्थान पररसरों के िैजक्षक मानकों को बनाए रखन े और इस संबंध म ें कियाकलाप अध्यक्ष और सीनेट के जनदिे ों के कायावन्यिन के जलए उत्तरदायी होगा।[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 13

(4) जिद्यािाखा प्रमुख जिद्यािाखा की बैिकों की व्यिस्ट्था करेंग े और ऐसी सजमजतयों और पैनलों म ें भाग लगें े जिसके जलए िह जनदेिक या कियाकलाप अध्यक्ष द्वारा नाम जनर्दष्टव ह ै और ऐस े अन्य काय व और कृत्यों को िो जनदेिक द्वारा उसे सौंपे िाए,ं पूरा करेंगे।

(5) जिद्यािाखा प्रमुख िो िासी पररषद ्द्वारा उसे प्रत्यायोजित ककए िाए ऐसी अन्य िजियों का प्रयोग करेंगे।

(6) जिद्यािाखा प्रमुख को ऐसी अिजध के जलए िो आिश्यक समझी िाए चिानुिम के आधार पर समुजचत स्ट्तर के संकाय या तकनीकी स्ट्टॉफ म ें स े जनदेिक द्वारा नाम जनर्दष्टव स्ट्टूजडयो, प्रयोगिाला या कायविाला प्रमुखों द्वारा सहायता प्रदान की िाएगी और ऐसा स्ट्टूजडयो, प्रयोगिाला या कायविाला समन्ियक संस्ट्थान के सभी िैजक्षक कियाकलापों म ें प्रभािी और समय स े सेिा प्रदान करन ेऔर स्ट्टूजडयो, प्रयोगिाला या कायविाला के रख-रखाि का उत्तरदायी होगा।

30. सस्ट्ं थान के स्ट्टॉफ का िगीकरणः संस्ट्थान के स्ट्टॉफ के सदस्ट्यों को जनम्नजलजखत रूप म ेंिगीकृत ककया िाएगा: - (क) संकाय सदस्ट्य जिसमें जनदेिक, प्रधान जडिाइनर (आचायव), ज्येष्ठ जडजाइनर (सह-आचायव), सहयुि ज्यष्ठे जडिाइनर (सहायक आचाय)व , प्रधान तकनीकी जिक्षक, ज्येष्ठ तकनीकी जिक्षक, जडजाइनर (संकाय), ज्येष्ठ जडिाइन जिक्षक और ऐसे अन्य िैजक्षक पद िैसा सीनेट द्वारा जसफाररि तथा िासी पररषद द्वारा अनुमोकदत ककए गए, सजम्मजलत होंगे। (ख) तकनीकी स्ट्टाफ सदस्ट्य जिसम ें सहयुि ज्यष्ठे तकनीकी जिक्षक, सहयुि ज्येष्ठ जडिाइन जिक्षक, जडिाइन जिक्षक, तकनीकी जिक्षक, ज्येष्ठ इंिीजनयर (भूजम, भिन और रखरखाि), उप इंिीजनयर (जिद्युत), सहायक इंिीजनयर (जसजिल), सहायक इंिीजनयर (सूचना तकनीकी), पयविेक्षक (जिद्युत या सुरक्षा), तकनीकी सहयुि और स्ट्टूजडयो या प्रयोगिालाओं या कायविालाओं या जिभागों के संचालन के जलए अपजे क्षत ऐसे अन्य तकनीकी कमवचारी िसै ा सीनेट द्वारा जसफाररि और िासी पररषद ् द्वारा अनुमोकदत ककए गए हों, सजम्मजलत होंगे। (ग) प्रिासजनक और अन्य स्ट्टाफ सदस्ट्य जिनम ें रजिस्ट्रार, मुख्य प्रिासजनक अजधकारी, जित्त और लेखा जनयंत्रक, उप रजिस्ट्रार, प्रधान पुस्ट्तकालयाध्यक्ष या संसाधन केंद्र, प्रिासजनक अजधकारी, ज्येष्ठ लेखा अजधकारी, ज्येष्ठ सहायक पुस्ट्तकालयाध्यक्ष, ज्येष्ठ अधीक्षक, सहायक प्रिासजनक कायावलय, प्रधान सुरक्षा सिे ाएाँ, अधीक्षक, ज्येष्ठ सहायक, ज्येष्ठ पुस्ट्तकालय सहायक, ज्येष्ठ सहायक (प्रिासन या स्ट्टूजडयो), िाडवन, सहायक (लेखा, प्रिासन या पुस्ट्तकालय) और प्रिासजनक, स्ट्थापना, िैजक्षक, लेखा और जित्त, ज्ञान प्रबंधन कायों के जलए अपेजक्षत ऐसे अन्य कमवचारी िसै ा कक सीनेट द्वारा जसफाररि और िासी पररषद द्वारा अनुमोकदत ककए गए हों, सजम्मजलत होंगे ।

31. स्ट्टॉफ की जनयजु ि की पिजत- (1) अजधकाररयों, जिक्षकों और स्ट्टॉफ के अन्य सदस्ट्यों की जनयुजि या तो सीधी भती द्वारा, प्रोन्नजत द्वारा, प्रजतजनयुजि (जिसके अंतगवत अल्पकाजलक संजिदा भी ह)ै , द्वारा, आमेलन द्वारा, पुनर्नवयोिन द्वारा या जनयुजि प्राजधकारी द्वारा गरित चयन सजमजत की जसफाररिों पर संजिदा द्वारा की िाएगी।

(2) सभी प्रिगों म ेंजनयुजियां स्ट्िीकृत पदों के सामन ेकी िाएंगी।

(3) सीधी भती के माध्यम स े जनयुजि प्रथम अनुसूची म ें यथाजिजनर्दष्टव लागू िेतन और भत्तों पर उपलब्ध पदों के सामने जनयजमत कमवचारी के रूप म ें होगी।

(4) संजिदा के आधार पर जनयजु ि प्रथम अनुसूची म ें यथाजनर्दष्टव िेतनमान और भत्तों पर और स्ट्थायी सजमजत की जसफाररि पर िासी पररषद द्वारा अनुमोकदत जनबंधनों और ितों पर तीन िषव तक की जनयत अिजध के जलए (िार्षवक आधार पर दो िष व के जलए बढ़ाई िा सकती ह)ै होगी।

(5) स्ट्िीकृत पदों पर जनयुजि के जलए अनुसररत की िान े िाली प्रकिया जनम्नानुसार होगी: -14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (क) संस्ट्थान के सभी पद इसकी िेबसाइट, मुद्रण और इलैक्रॉजनक मीजडया पर तथा ऐसे अन्य माध्यम िो बृहद ् प्रचार सुजनजित करने के जलए उजचत समझे िाएं, पर अजधसचू ना के माध्यम स े अजखल भारतीय आधार पर जिज्ञापन द्वारा भरे िाएंगे। (ख) जनयुजि करत े समय, संस्ट्थान केंद्रीय सरकार द्वारा समय-समय पर कदए गए जनदेिों के अनुसार पदों के आरक्षण का आिश्यक उपबंध करेगा। (ग) सभी भर्तवयों के बाबत जनयुजि पत्र रजिस्ट्रार या ऐसा अजधकारी िो जनदेिक द्वारा ऐसा करने के जलए जिजनर्दष्टव रूप स े प्राजधकृत ककया िाए द्वारा सक्षम प्राजधकारी के अनुमोदन के पिात ् जिसम ें ित े और जनबंधन, काय व तथा दाजयत्ि और अन्य ब्यौरे हों, िारी ककए िाएंगे।

(6) चयन सजमजत का कोई काय व या कायविाही चयन सजमजत के ककसी सदस्ट्य या सदस्ट्यों की अनुपजस्ट्थजत के आधार पर प्रश्नगत नहीं की िा सकेगी।

(7) संस्ट्थान के अधीन पद के जलए चयजनत या चयजनत सूची के अभ्यथी को ऐस े यात्रा भत्त ेिो िासी पररषद ्द्वारा अिधाररत ककए िाए,ं प्रदत्त ककए िाएंगे।

(8) संस्ट्थान द्वारा की गई सभी जनयुजियों की सूचना िासी पररषद ्की अगली बैिक म ेंदी िाएगी।

(9) संस्ट्थान के अधीन पदों पर सभी जनयुजियां, दो िषव की अिजध के जलए पररिीक्षा पर की िाएंगी, जिसके पिात जनयुि व्यजि की पुजष्ट होने पर, उस मास के अंत तक अपने पद पर बना रहगे ा, जिसम ें िह अजधिर्षवता की आय ु प्राप्त करता ह,ै अथावत उसकी आय ु के साि िष व या उसस े पहले यकद िह जचककत्सकीय रूप स े अनुपयिु पाया िाता ह ै या अनुिासनात्मक आधार पर समाप्त ककया िाता ह।ै

(10) संकाय की दिा म,ें सेिाजनिृजत्त उस सेमेस्ट्टर के अतं म ें जिसम ें संकाय अजधिर्षवता की आयु प्राप्त करता ह,ै म ें प्रभािी होगी जिससे ऐस े संकाय सदस्ट्य को सौंपे गए िैजक्षक काय व और पाठ्यिम के बाबत दाजयत्िों को सेमेस्ट्टर के मध्य म ें बाजधत न हो।

(11) संस्ट्थान सहायक संकाय को समेककत िेतन के आधार पर और अजतजथ संकाय को प्रजत सत्र या प्रजतकदन मानदेय के आधार पर अपेक्षा के अनुसार और िासी पररषद द्वारा अनुमोकदत जनबंधनों और ितों पर जनयुि कर सकेगा।

(12) जनदेिक, उजचत मामल े म,ें िासी पररषद के पूि-व अनुमोदन स,े जिषय जििेषज्ञ या िृजतकों या तकनीकी जििेषज्ञ या परामिवदाता जनयत पाररश्रजमक पर संजिदा सेिा के आधार पर जिजनर्दष्टव प्रायोजित पररयोिना तथा परामिी पररयोिना के जलए एक जिजनर्दष्टव अिजध के हते ु रख सकेगा और इन जनयुजियों के जलए पाररश्रजमक संबंजधत प्रायोजित पररयोिना म ें संदत्त ककए िाएगं े। परंत ु ऐसी जनयुजि के जनबंधन ऐसे प्रायोजित या परामिी पररयोिना की अिजध स ेअजधक नहीं होगी।

32. पदों का सृिन—(1) िासी पररषद ् संकाय और संकाय म ें गैर-संकाय के अनुपात की जसफाररि कर सकेगा, िो िीक समझे, स्ट्टॉफ के िमि: िगव म ेंनए पदों के सृिन के जलए मागदव िी जसिांत के रूप म ेंकाय व करेगा।

(2) कोई पद िासी पररषद ् के अनुमोदन के जबना सृजित नहीं ककया िाएगा िो तथा ऐसा करते समय जित्तीय समझ ध्यान म ें रखी िाएगी और इस संबंध म ें केन्द्रीय सरकार द्वारा िारी अनुदेिों के अनपु ालन को भी सुजनजित ककया िाएगा।

33. जनयुजि के जलए चयन सजमजत—(1) संस्ट्थान म ेंपदों पर जनयुजि करत े समय, जनयुजि प्राजधकारी जिजभन्न प्रकार के पदों के जलए चयन सजमजत जनम्नजलजखत रीजत स ेगरित की िाएगी अथावत्ः— (क) संकाय - संकाय सदस्ट्यों की जनयुजि के जलए चयन सजमजत का गिन जनम्न प्रकार होगा -

(i) जनदेिक, राष्ट्रीय जडिाइन संस्ट्थान - अध्यक्ष;[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 15

(ii) कियाकलाप अध्यक्ष (जिक्षा) - सदस्ट्य;

(iii) एक अन्य कियाकलाप अध्यक्ष या संकायाध्यक्ष - सदस्ट्य;

(iv) संबंजधत जिषय का बाह्य जििेषज्ञ - सदस्ट्य

(v) मुख्य प्रिासजनक अजधकारी - सजचि परंत ु सदस्ट्य, चयन के जलए जिचाराधीन पद स े कम स ेकम एक स्ट्तर ऊपर होना चाजहए: परंतु यह और कक संस्ट्थान म ें उपयुि स्ट्तर के कमवचारी उपलब्ध न होने की जस्ट्थजत म,ें उसे अन्य राष्ट्रीय जडिाइन संस्ट्थानों या अन्य राष्ट्रीय महत्ि के संस्ट्थानों स,े िासी पररषद के अनुमोदन स,े नामजनर्दष्टव ककया िा सकेगा। (ख) तकनीकी और प्रिासजनक स्ट्टॉफ- (1) तकनीकी स्ट्टाफ सदस्ट्यों या प्रिासजनक और अन्य स्ट्टाफ सदस्ट्यों की जनयुजि के जलए चयन सजमजत म ें जनम्नजलजखत सजम्मजलत होंग-े

(i) जनदेिक, राष्ट्रीय जडिाइन संस्ट्थान - अध्यक्ष;

(ii) कियाकलाप अध्यक्ष (जिक्षा) - सदस्ट्य;

(iii) संस्ट्थान पररसर के जिभागाध्यक्ष या संकायाध्यक्ष - सदस्ट्य;

(iv) रजिस्ट्रार - सदस्ट्य

(v) मुख्य प्रिासजनक अजधकारी – सजचि

(2) रजिस्ट्रार या मुख्य प्रिासजनक अजधकारी के चयन की दिा म,ें जनदेिक द्वारा नामजनर्दष्टव कोई अन्य कमवचारी िमिः सदस्ट्य और सजचि होगा: परंत ु सदस्ट्य चयन के जलए जिचाराधीन पद स े कम स ेकम एक स्ट्तर ऊपर का होना चाजहए:

परंतु यह और कक संस्ट्थान म ें उपयुि स्ट्तर के कमवचारी उपलब्ध नहीं होने की जस्ट्थजत म,ें उसे अन्य राष्ट्रीय जडिाइन संस्ट्थानों या राष्ट्रीय महत्ि के अन्य संस्ट्थानों स े िासी पररषद के अनुमोदन स ेनामजनर्दष्टव ककया िा सकेगा।

34. प्रदिनव अकं न प्रणाली- (1) सभी संकाय सदस्ट्यों को स्ट्िय ं स्ट्ितंत्र रूप स े स्ट्िय ं के प्रदिवन का अंकन भरना अपेजक्षत होगा और िासी पररषद द्वारा अनुमोकदत रूपजिधान और रीजत म ें अंकन चि की अिजध के जलए उनके योगदान को प्रधानता स े कदखाना होगा।

(2) केन्द्रीय सरकार द्वारा समय-समय पर जिजहत मागदव िवक जसिांतों को ध्यान म ें रखते हुए, िासी पररषद द्वारा अनुमोकदत रूपजिधान और रीजत म ें मूल्यांकन चि की अिजध के जलए उनके योगदान को प्रधानता स े कदखाना होगा और अन्य सभी तकनीकी स्ट्टॉफ और प्रिासजनक स्ट्टॉफ को स्ट्ितंत्र रूप स े स्ट्िय ंके प्रदिवन का मूल् याकं न भरना अपेजक्षत होगा।

35. जिकायत सजमजत- (1) संस्ट्थान एक जिकायत सजमजत का गिन करेगा िो संकाय, तकनीकी और प्रिासजनक स्ट्टॉफ, यकद कोई हो, प्रदिवन अंकन संबंधी मामलों स े जभन्न जिकायतों की परीक्षा करेगी।

(2) सजमजत द्वारा प्राप्त ककसी भी जिकायत को मामल े के गणु ागुण के आधार पर और व्यजथत कमवचारी के जलए व्यजिगत सुनिाई प्रदान कर िीघ्रता स े जनपटाया िाएगा।

(3) जिकायत सजमजत की संरचना म ें अध्यक्ष के रूप म ें कियाकलाप अध्यक्ष (जिक्षा) या संस्ट्थान पररसर के संकायाध्यक्ष, सदस्ट्य के रूप म ें रजिस्ट्रार और जित्त और लखे ा जनयंत्रक और सदस्ट्य सजचि के रूप म ें मुख्य प्रिासजनक अजधकारी सजम्मजलत होंगे।16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(4) जिकायत सजमजत की ररपोट व जनदेिक को प्रस्ट्तुत की िाएगी िो जिकायत सजमजत के जनष्कषव के आधार पर मामले का जिजनिय करेगी।

NOTIFICATION Vijayawada, the 17th April, 2023 F. No. 24024/59/2022-IPR-V.—In exercise of the powers conferred by sections 28 and 29 of the National Institute of Design Act, 2014 (18 of 2014), the Governing Council of the National Institute of Design, Andhra Pradesh, with the prior approval of the Visitor, hereby makes the following first Statutes of the National Institute of Design, Andhra Pradesh, namely:-

1. Short title and commencement. — (1) These Statutes may be called National Institute of Design, Andhra Pradesh Statutes, 2023.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions. — (1) In these Statutes, unless the context otherwise requires, -

(a) “Act” means the National Institute of Design Act, 2014 (18 of 2014), as amended from time to time;

(b) “activity” in relation to the Institute, includes academic and allied, overviewing the multidisciplinary functions in respect of education, research and publication, integrated design services, outreach programmes, industry programmes, Information Technology services, and such other functions as may be decided by the Director with the approval of the Governing Council;

(c) “Activity Chairperson” means a faculty member of the Institute nominated as an Activity Chairperson under Statute 22;

(d) "Department" means a group of administrative activities, with or without sections, cells or units, supporting the day-to-day functions of the Institute including general administration, academic administration, accounts and finance, and such other functions as may be decided by the Governing Council;

(e) “Discipline Lead” means a faculty member nominated as a Discipline Lead under Statute 29;18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(f) “disciplines” or “programmes” means a branch of educational programmes or courses related to studies and research offered by the Institute under a particular faculty stream;

(g) “faculty” means an employee appointed for the position of teaching, research or developmental activities of the Institute;

(h) “Faculty Stream” means an academic unit of the Institute engaged in such academic activities as design education, research and development and consultancy having multiple design disciplines;

(i) “Head of Department” means the administrative Head of a Department;

(j) “Institute” means the National Institute of Design, Andhra Pradesh;

(k) “Standing Committee” means the Standing Committee of the Governing Council constituted under Statute 10;

(l) “workshops or labs or studios or cells” in relation to the Institute, means auxiliary units of the Institute engaged in technical, technological, design management, intellectual property rights and other support services provided to the Faculty Streams, design disciplines, research and various developmental activities and other related functions of the Institute;

(m) “adjunct faculty” means an expert or reputed designers in the industry, including skilled professionals, both serving or retired, engaged for a specific period for the teaching, research or development activities of the Institute;

(n) “visiting faculty” means an expert including a designer, academic, skilled professional who is an expert for specific courses and is engaged to teach those specific courses.

(2) Words and expressions used herein and not defined but defined in the Act shall have the meanings respectively assigned to them in the Act.

3. Authorities of the Institute. —The following shall be the authorities of the Institute, namely: -

(i) the Governing Council as constituted under section 11 of the Act;

(ii) the Senate as constituted under section 15 of the Act;

(iii) the Director as appointed under section 18 of the Act;

(iv) the Standing Committee of the Governing Council; and

(v) all Activity Chairpersons, Dean of Institute campuses, Registrar, Heads of Departments and Discipline Leads.

4. Governing Council and meetings thereof. — (1) Subject to the provisions of section 13 of the Act, the Governing Council shall meet as often as may be considered necessary by the Chairperson for transaction of its business.

(2) Meetings of the Governing Council shall be convened by the Chairperson, either on his own motion or at the request of the Director or on a requisition signed by not less than six members of the Governing Council.

(3) Three members or one third of actual strength, whichever is higher, shall form a quorum for a meeting of the Governing Council.

(4) Members may participate in the meeting of the Governing Council through video conference or digital medium after obtaining the prior approval of the Chairperson and such participation through video conference or digital medium shall be counted for the purpose of the quorum.

(5) All questions considered at the meetings of the Governing Council shall be decided by a majority of the votes of the members present and if the votes be equally divided, the Chairperson shall have a casting vote.

(6) The Chairperson shall preside over every meeting of the Governing Council:

Provided that in the absence of the Chairperson, the members of the Governing Council present shall elect a member from amongst themselves to preside over the meeting.

(7) A written notice of every meeting shall be sent by the Registrar to every member at least fifteen days before the date of the meeting mentioning therein the place, date and time of the meeting:

Provided that the Chairperson may call a special meeting of the Governing Council at short notice of even less than fifteen days to consider urgent issues.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 19

(8) The notice of a meeting may be delivered either by hand or sent by registered post or E-mail or Fax, at the address of each member as recorded in the office of the Governing Council and if so sent, shall be deemed to be duly delivered at the time at which notice would be delivered in the ordinary course of post, or in case of email or fax, when the same is transmitted.

(9) Agenda of a meeting shall be circulated in advance by the Registrar to all members.

(10) If a member, other than ex-officio member, of the Governing Council fails to attend three consecutive meetings without leave of absence from the Chairperson, he shall cease to be a member of the Governing Council.

(11) Notices of motions for inclusion of any item on the agenda must reach to the Registrar at least one week

before the meeting:

Provided that the Chairperson may permit inclusion of any item for which due notice has not been received.

(12) The ruling of the Chairperson regarding any question of procedure shall be final.

(13) Any matter, which would require approval of the Governing Council and where it is not possible to convene the meeting of the Governing Council at short notice, such matters may be considered by the Governing Council by means of resolution by circulation, with the approval of Chairperson.

(14) The minutes of the proceedings of a meeting of the Governing Council shall be drawn up by the Registrar with the approval of the Chairperson, and circulated to all members of the Governing Council within a period of seven working days, seeking comments on the minutes and if no comments are received within seven days of receipt of minutes, the same shall be treated as final after it is signed by the Chairperson.

(15) The minutes of the proceedings, along with any modification suggested, shall be placed for confirmation at the next meeting of the Governing Council and the changes, if any, are confirmed and signed by the Chairperson, they shall be recorded in the minute book by the Registrar within fifteen days of conclusion of every such meeting.

(16) The minute book shall be kept open for inspection of the members at all times during office hours.

5. Powers of Governing Council. — (1) The Governing Council shall have the following powers in addition to the powers under sub-section (1) of section 14 of the Act, namely:-

(a) assist the Central Government in the process of appointment of the Director under section 18 of the Act;

(b) abolish, re-designate or change the nomenclature of any post except that of the Director, with the prior approval of Central Government.

(2) The Governing Council shall, for the purposes of making appointment to academic and other posts, take into consideration the ratio of faculty and student strength, academic and non-academic post and the cadre strength of faculty members.

6. Powers of the Chairperson in emergent cases. — The Chairperson may, in emergent cases, exercise the powers of the Governing Council and obtain the approval of the Governing Council on such action taken by him, within a period of thirty days.

7. Authentication of orders of Governing Council. — All orders and decisions of the Governing Council shall be authenticated by the signature of the Registrar or any person authorised by the Governing Council in this behalf.

8. Travelling allowances of members of authorities of Institute. — The members comprising the authorities of the Institute, except internal or ex officio members of the Institute shall be entitled to travelling allowances, daily allowance and sitting fee for attending their respective meetings on the same rates as are applicable to the officers and employees of the Central Government.

9. Representation of donors in Governing Council. — For the purpose of clause (l) of section 11 of the Act, the threshold of financial assistance or contribution and other requirements to qualify for nomination as member of Governing Council, shall be fifty lakh rupees or more:

Provided that no bequest, donation or transfer of any property shall be accepted by the Institute, which in the opinion of the Governing Council involves conditions or obligations opposed to the spirit and objects of the Institute.

10. Standing Committee of Governing Council. — (1) The Governing Council shall constitute Standing Committee consisting of the following members, namely:-

(a) the Director, who shall be the Chairperson of the Standing Committee;

(b) Activity Chairperson (Education);

(c) two members of the Governing Council nominated by the Chairperson of the Governing Council; and20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(d) the Registrar, who shall be Member Secretary of the Standing Committee.

(2) the Standing Committee shall meet at least four times in a year preferably before the meetings of the Governing Council.

(3) Three members of the Standing Committee present in the meeting shall form a quorum for a meeting of the Standing Committee.

(4) The Chairperson of the Standing Committee, shall preside over the meetings of the Standing Committees and in his absence, the Activity Chairperson shall preside over the meetings.

(5) The provisions of Statute 4 relating to notices of the meeting, inclusion of items in the agenda and confirmation of the minutes applicable to the meetings of the Governing Council shall, so far as applicable, be followed in connection with the meetings of the Standing Committee.

(6) The Standing Committee, once constituted by the Governing Council, shall function till such time it is reconstituted by the Governing Council.

(7) All policy matters requiring consideration and approval of the Governing Council and all matters pertaining to service conditions of the employee and staff of the Institute shall be first placed before the Standing Committee for consideration, recommendations before they are placed before the Governing Council for approval.

(8) All proposals seeking budgetary support, whether recurring or non- recurring, shall be reviewed by the Standing Committee and recommendations shall be made by the Committee to the Governing Council.

(9) The Standing Committee shall also function as the Finance Committee and Building and Contracts Committee and shall review periodically all building or construction projects, contracts and work orders in respect of items of capital expenditure, and such other matters as may be referred to it by the Governing Council.

(10) The Standing Committee shall review and give recommendations on all such financial and policy matters as may be referred to it by the Governing Council.

(11) All minutes of the proceedings of the Standing Committee or Resolutions of the Standing Committee shall be placed before the ensuing meeting of the Governing Council for noting or ratification or consideration.

(12) All orders and decisions of the Standing Committee shall be signed by the Chairperson and authenticated and circulated by the Registrar or any other person authorised by the Governing Council to the members of the Committee.

11. Director. — (1) The Director shall incur expenditure in accordance with the delegation of administrative and financial powers as approved by the Governing Council.

(2) The Director may write off irrecoverable losses up to a limit of ten thousands rupees and of irrecoverable value of stores lost or rendered unserviceable up to a limit of twenty five thousands rupees, subject to such conditions as may be made by the Governing Council.

(3) The Director shall, with the prior approval of the Governing Council, fix the initial pay of an incumbent at a stage higher than the minimum of the scale with written justification for doing so in respect of posts of which appointment can be made by him under the provision of the Act, on the recommendations of the Selection Committee.

(4) The Director shall constitute such committees or panels for deliberations and recommendations on any matter concerning the Institute as may be considered necessary.

(5) The Director may, with the approval of the Governing Council, delegate any of his powers or responsibilities to one or more members of academic or administrative staff of the Institute.

(6) The Director shall issue such orders specifying the duties and responsibilities of all employees of the Institute as are required and relevant to the positions to which they are appointed and make additions or deletions or alterations thereof for administrative and functional reasons.

(7) The Director may -

(a) assign additional tasks or responsibilities to any employee for such period of time and on such terms as may be necessary;

(b) seek recommendations or reports on any matter referred to the Committees or panels referred to in clause(4).[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 21

(8) The Director shall exercise such other powers as may be delegated to him by the Governing Council; and

(9) The Director shall, with the prior approval of the Governing Council, sign Memorandum of Understanding, agreements to cooperate with educational or other institutions or industry in any part of the country, or any part of the world with the prior approval of the Central Government, having objects wholly or partly similar to those of the Institute by exchange of faculty members, senior functionaries, scholars, students and generally, in such manner as may be conducive to their common objectives, subject to the approval of financial implication, if any, by the Governing Council.

12. Senate. – (1) In addition to the persons specified in section 15 of the Act, the Senate shall also consist of the following members, namely:- a. the Principal Designers (Professor) and Senior Designers (Associate Professor) entrusted with the responsibility of any activity;

b. three Heads of Department, to be nominated by the Director.

(2) The term of office of the members of the Senate, other than ex-officio members, shall be two years from the date of their nomination.

(3) The term of office of a member of the Senate nominated to fill a casual vacancy shall continue for the remainder of the term of the member in whose place he has been nominated.

(4) An outgoing member shall, unless the Senate otherwise directs, continue in office until another person is nominated as member in his place.

(5) The Senate shall meet as often as necessary, but not less than four times in each academic year, at such place and time and observe such rules of procedure in regard to the transaction of business at its meetings, as may be determined by the Senate.

(6) The meeting of the Senate shall be presided over by the Director and in his absence, the senior most Activity Chairperson shall preside over the meeting.

(7) One third of the total number of members of the Senate shall form a quorum for a meeting of the Senate.

(8) all matters considered at the meetings of the Senate shall be decided by a majority of the votes of the members present and if the votes are equally divided, the chairperson shall have casting vote.

(9) The Registrar or another member of the Senate as authorised by the Chairperson of the Senate, shall prepare minutes of the proceedings of the Senate and the copy of the minutes as approved by the Chairperson of the

Senate shall be circulated to all members of the Senate:

Provided that such minutes or portions of the minutes shall not be circulated if the Senate considers such circulation prejudicial to the interests of the Institute or confidential in the nature like appointment of examiners, paper setters, printing of examination papers or degree certificates.

(10) If, in the opinion of the Chairperson of the Senate, any emergency has arisen which requires immediate action, he may take such action as he deems necessary and shall report the same in the next meeting of the Senate for post facto ratification.

(11) The members of the Senate nominated under clauses (d) and (e) of section 15 of the Act, shall be entitled to travelling allowance, daily allowance and sitting fee from the Institute as may be laid down by the Governing Council.

(12) The powers and functions of the Senate shall include, –

(a) framing and revising curriculum and syllabus for the courses of studies for various disciplines, as per the recommendations of the Academic Advisory Committee;

(b) making recommendations to the Governing Council with regard to the creation, restructuring or abolition of Faculty Streams, Disciplines or Programmes or Campuses;

(c) overseeing the arrangements for the conduct of examinations, appointment of examiners, moderators, tabulators and other matters relating to the examinations;

(d) declaring the results of final semester examinations or appointing committees or officers to do so and making recommendations to the Governing Council regarding conferment or grant of degrees, diplomas and other academic distinctions or titles;22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(e) appointing committees or working Groups from amongst the members of the Senate, other faculty members and experts from outside to advise on specific and important academic matters;

(f) considering recommendations by the Academic Advisory Committee and taking action or recommending a course of action;

(g) periodical review of activities of various faculty streams or disciplines and taking appropriate action for maintaining the excellence of standards of education of the Institute;

(h) promoting design research and development in classrooms and fields as also encouraging opportunities for bringing in market realities to the classrooms through consultancy, outreach and industry programme projects;

(i) planning and reviewing electives and other extracurricular programmes of students and making appropriate recommendations;

(j) overseeing the functioning of labs, studios, classrooms, hostels, student welfare, co-curricular activities and grievance mechanisms;

(k) awarding stipends, medals, prizes and other similar recognitions with such conditions as may be deemed necessary with the prior approval of Senate;

(l) awarding scholarships and other similar recognitions with such conditions as may be deemed necessary with the prior approval of Governing Council;

(m) periodical review of the progress of various academic and admission activities of the Institute; and

(n) Such other academic matters as may be referred to it by the Governing Council.

13. Conferment of Honorary Degrees. —The Institute may confer honorary degrees for a few exceptional and

outstanding individuals for their illustrious contribution in design and design related fields:

Provided that all proposals for the conferment of honorary degrees shall be recommended by Senate and approved by the Governing Council.

14. Faculty Streams.—(1) The Institute may offer bachelor’s, master’s, doctoral, integrated master’s programmes through design disciplines, under the following Faculty Streams, namely: -

(a) Faculty of Industrial Design leading to specialisation such as Product Design, Furniture and Interior Design, Ceramic and Glass Design, Toy and Game Design, Transportation and Automobile Design and Universal Design and other related specialisations;

(b) Faculty of Communication Design leading to specialisation such as Graphic Design, Animation Film Design, Film and Video Communication Design, Photography and Exhibition Design and other related specialisation;

(c) Faculty of Textile, Apparel, Lifestyle and Accessory Design leading to specialisation such as Textile, Apparel design and Life style Accessory Design and other related specialisations;

(d) Faculty of Inter-Disciplinary Design Studies leading to specialisation such as Strategic Design Management and Design for Retail Experience and other related specialisations.

(2) The Governing Council may, on the recommendation of the Senate, add or delete or modify any faculty streams of design disciplines or programmes by amending this Statute.

15. Nomenclature of education and training programmes.—Every certificate, diploma, degree, graduate, postgraduate, research or other programmes and its nomenclatures offered by each Faculty Stream at the Institute in different design disciplines shall be approved by the Governing Council on recommendations of the Academic Advisory Committee and the Senate.

16. Student fee.—The deposits or the fee to be charged from the students including fee for the admission tests, tuition fee, examination fee, hostel fee and other fee for the degree, diploma and certificate under various Faculty Streams of the Institute shall be determined by the Governing Council, either on its own or on the recommendations of the Senate.

17. Institution of fellowship, scholarships, medals, prizes, etc.— The senate may review and recommend, subject to the approval by the Governing Council, thresholds for institution of fellowships, scholarships, medal and

prizes and the terms and conditions governing such awards:

Provided that any fellowship, scholarship, medal, prize, which has been Instituted prior to the coming into force of this Statute shall continue to be awarded subject to the terms and conditions as has been fixed prior to coming into force of this Statute till they are reviewed by Senate with approval of Governing Council.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 23

18. Halls of residence.-(1) The Institute may establish and maintain halls of residence or hostels at its campuses for students, research scholars and research fellows enrolled in its programmes.

(2) Every resident in the halls and hostels shall comply with to the rules laid down by the Institute.

(3) The Institute shall appoint one or more wardens and other support staff as may be required for efficient management of the hostels and halls of residence.

(4) The rules and regulations governing the residence of students at the halls of residence and hostels shall be approved by the Senate.

19. Academic Advisory Committee.—(1) There shall be constituted by the Governing Council an Academic Advisory Committee consisting of the following members, namely:-

(a) the Activity Chairperson (Education) shall be the Chairperson of the committee;

(b) the Deans of the Institute Campuses;

(c) one Discipline Lead from each Faculty Stream; and

(d) two members of the Senate as nominated by the Director.

(2) The Academic Advisory Committee shall;-

(a) initiate proposals for review and development of curriculum for the course of studies for various disciplines;

(b) review programmes delivery and evaluation of all design discipline studies with the concerned Discipline Leads;

(c) seek views and suggestions from all stakeholders on the structure and delivery of curriculum of all disciplines;

(d) encourage inter and intra faculty and students participation in all matters of study;

(e) place recommendations on academic matters of Faculty Streams or disciplines before the Senate;

(f) place recommendations on academic equivalences for admissions to undergraduate, post-graduate, doctorate and other academic programmes before the Senate;

(g) arrange periodical review of activities of various faculty streams or disciplines and make appropriate action for maintaining the excellence of standards of education of the Institute;

(h) suggest measures to promote design research and development in classrooms and fields as also encourage opportunities for bringing in market realities to the classrooms through consultancy, outreach and industry programme projects; and

(i) review and make recommendations on such other matters relating to implementation of education strategies for excellence as may be referred to it by the Senate or the Director.

(3) The Academic Advisory Committee may hold meetings as frequently as may be necessary but shall meet at least twice in a semester.

20. Faculty forum.—(1) There shall be constituted by the Governing Council a Faculty Forum consisting of all teaching faculty members of the Institute and its campuses.

(2) The Faculty Forum shall meet at least twice in a year preferably prior to the beginning of the academic semester and deliberate on all academic matters for forming vision on the educational programmes of the Institute, concerns and contributions of the faculty group, programmes and activities to be strengthened or to be introduced for strengthening curriculum and consistently raising educational standards of all disciplines and programmes and give feedback to the Senate on the course delivery, evaluation and juries.

(3) The Faculty Forum shall be chaired by the Director and in his absence, by the Activity Chairperson

(Education) or Dean of the Institute.

(4) The feedback of the Faculty Forum shall be placed before the Senate for consideration and recommendation of appropriate action.

21. Deans of Institute Campuses.—(1) The Dean of the Institute campus under section 19 of the Act shall be nominated by the Director from amongst the faculty members of the Institute not below the rank of Senior Designer, on a rotation basis, for a term of up to three years from the date of his nomination, subject to periodical review by the

Provided that in case of any administrative or academic emergencies, the Director may nominate, before the expiry of the term, another incumbent as Dean of the Campus, at the end of the academic year.

(2) The Dean of the Institute campus shall exercise control over all academic and administrative matters of the campus in consultation with the Activity Chairperson(Education) on academic related matters and in consultation with the Director in administrative and financial related matters.

(3) The Dean of the Institute campus shall execute all policy directions of the Senate, Director, Standing Committee and Governing Council.

(4) The Dean of the Institute campus shall supervise and maintain all records related to the campus, sending periodical reports to the Activity Chairperson (Education) and the Director.

(5) The Dean of the Institute campus shall assist the Director and the Activity Chairperson (Education) in achieving excellence in academic and administrative standards in respect of all educational programmes of the campus.

(6) The Dean of the Institute campus shall exercise such administrative and financial powers as may be delegated to him by the Governing Council.

22. Activity Chairpersons.— (1) There shall be nominated by the Director, the following Activity Chairpersons for various activities and objectives of the Institute, namely-

(a) Activity Chairperson (Education);

(b) Activity Chairperson (Research and Publication);

(c) Activity Chairperson (Integrated Design Services);

(d) Activity Chairperson (Outreach);

(e) Activity Chairperson (Knowledge Management Centre);

(f) Activity Chairperson (Industry and Online Programmes);

(g) Activity Chairperson (International Programmes);

(h) Any other Activity Chairperson.

(2) The Activity Chairpersons shall be nominated from amongst faculty members of the institute not below the rank of Senior Designers (Associate Professors) on rotation basis for a term of three years from the date of their nomination.

(3) In case of any administrative or academic emergencies, the Director may, before the expiry of the term of any Activity Chairperson, nominate another incumbent as such Activity Chairperson.

23. Functions and powers of Activity Chairperson (Education).–(1) The Activity Chairperson (Education) shall be in charge of all administrative and academic activities of educational programmes of the Institute in respect of all Faculty Streams and programmes.

(2) The Activity Chairperson (Education) shall be responsible for maintaining excellence in standards of education, including students disciplinary matter and grievances, of the Institute and Institute campuses for which he shall take appropriate action in consultation with the Senate, Director, Council’s Standing Committee and the Governing Council.

(3) All Deans, faculty heads, Discipline Leads, lab or studio coordinators and faculty members across the disciplines or programmes and all Advisory Committees related to education and academics shall be responsible to the Activity Chairperson (Education) for delivery and maintenance of academic standards of the Institute.

(4) The Activity Chairperson (Education) shall chair such committees and panels as may be nominated by the Director and carry out such other functions as may be entrusted to him by the Director.

(5) The Activity Chairperson (Education) shall exercise such powers as may be delegated to him by the Governing Council.

24. Functions of other Activity Chairpersons.—(1) The Activity Chairpersons referred to in clauses (b) to (g) of Statute 22 shall be in charge of the concerned activity of the Institute and its campuses across all Faculty Streams and disciplines and shall discharge such functions, tasks and responsibilities for promoting the activity, as may be entrusted to them by the Director.

(2) The Activity Chairpersons shall exercise such other powers as may be delegated to them by the Governing Council.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 25

25. Vice-Chair.-(1) All Activity Chairpersons may be assisted by a Vice-Chair nominated by the Director from amongst the faculty at the level of Associate Senior Designer (Assistant Professor) or Designer (Faculty).

(2) The Vice-Chair shall, in the absence of the Activity Chairperson, officiate as Activity Chairperson and in the event of non-availability of Vice-Chair for any reasons, the Director shall nominate a faculty member of the level of Senior Designer (Associate Professor) or Associate Senior Designer (Assistant Professor) to officiate as Activity Chairperson during his absence and such officiating Activity Chairperson shall have the same powers as of Activity Chairperson.

26. Registrar.—(1) The Registrar of the Institute shall be appointed by the Governing Council on deputation failing which on contract, for a period of three years extendable on yearly basis for a total period of five years.

(2) The Registrar shall be in charge of all academic administration of the Institute and responsible for implementing directives of the Central Government in respect of all academic and student matters and shall coordinate with the Activity Chairperson (Education) in academic administration matters relating to admission, course delivery, assessment, evaluation, award of grades or diplomas or degrees and such other academic administration related tasks and responsibilities as may be entrusted by the Director.

(3) The Registrar shall execute all contracts and legal documents for and on behalf of the Institute, when authorised by a resolution of the Governing Council or approved by the Director and shall not be personally liable in respect of anything under such contract or legal document.

(4) The Registrar shall be responsible for generating and maintaining data and records related to students and academic matters.

(5) The Registrar shall coordinate with all Heads of Departments, Deans of Institute campuses and Discipline Leads for administrative support for all academic related works and facilities of the Institute and Institute Campuses and arrange for the same in consultation with the Activity Chairperson (Education).

(6) The Registrar shall chair such committees and panels for which he may be nominated by the Director and carry out such other functions as may be entrusted to him by the Director and shall also exercise such powers as may be delegated to him by the Governing Council.

27. Chief Administrative Officer.– (1) There shall be appointed by the Governing Council a Chief Administrative Officer, who shall be in charge of the establishment matters, general administration matters of the Institute, liaison with the Central Government and other authorities on implementation of various directives, heading personnel and establishment services, security and housekeeping services, land or building or maintenance services, purchase and stores and such other general administration services and other administrative responsibilities as may be entrusted to him by the Director.

28. Controller of Finance and Accounts.–(1) There shall be appointed by the Governing Council a Controller of Finance and Accounts, who shall be in charge of the finance and accounts matters of the Institute and Institute campuses, liaison with the Central Government and other authorities on finance, grants, accounts and audit matters.

(2) The Controller of Finance and Accounts shall also be responsible for accounts and finance services, taxations, complying with statutory requirements for maintenance and presentation of accounts and compliance of all conditions of grants and assist the Director in preparing financial data and presentation for the Standing Committee or the Governing Council and perform such other responsibilities as may be entrusted to him by the Director.

29. Discipline Leads.—(1) Every design discipline in under graduate or postgraduate courses shall have a Discipline Lead to liaison with the faculty and students for course delivery, assessment, grading and evaluation juries of all student work in education activities of the Institute and Institute campuses in close coordination with the office of the Activity Chairperson (Education), Dean and Senate.

(2) The Discipline Leads shall be nominated by the Director from amongst the faculty members from the concerned design discipline of the Institute not below the rank of Associate Senior Designer (Assistant Professor), on

a rotation basis for a term of three years from the date of such nomination:

Provided that for any administrative or academic exigencies, the Director may nominate, before expiry of the said term, another incumbent as Discipline Coordinator at the end of the academic year.

(3) The Discipline Leads shall be responsible for making of academic calendars, timely delivery of courses pertaining to the discipline, conducting exams juries and arranging assessment and evaluation in close coordination with the faculty members of the discipline or visiting faculty in accordance with the academic calendar and time table and in maintaining standards of education of the Institute and Institute campuses in respect of the design discipline coordinated by him and implementation of the directions of the Activity Chairperson and Senate in this regard.26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(4) The Discipline Leads shall arrange the discipline meetings and participate in meetings of such committees and panels for which he is nominated by the Director or Activity Chairperson and carry out such other tasks and functions as may be entrusted to him by the Director or Activity Chairperson.

(5) The Discipline Leads shall exercise such other powers as may be delegated to him by the Governing Council.

(6) The Discipline Leads shall be assisted by studio, lab or workshop Heads nominated by the Director from amongst the faculty or technical staff of appropriate level on a rotation basis for such periods as may be deemed necessary and such studio, lab or workshop coordinators shall be responsible for providing effective and timely services to all academic activities of the Institute and in upkeep and maintenance of the studio, lab or workshop.

30. Classification of the Members of the Staff of the Institute.-(1) The members of the staff of the Institute

shall be classified as under:-

(a) Faculty members which shall include Director, Principal Designer (Professor), Senior Designer (Associate Professor), Associate Senior Designer (Assistant Professor), Principal Technical Instructor, Senior Technical Instructor, Designer (Faculty), Senior Design Instructor and such other academic posts as recommended by the Senate and approved by the Governing Council.

(b) Technical Staff members which shall include Associate Senior Technical Instructor, Associate Senior Design Instructor, Design Instructor, Technical Instructor, Senior Engineer (Land, Building and Maintenance), Deputy Engineer (Electrical), Assistant Engineer (Civil), Assistant Engineer (IT), Supervisor (Electrical/Security), Technical Assistant and such other technical hands required for manning studios or labs or workshops or departments, as recommended by the Senate and approved by the Governing Council.

(c) Administrative and other staff which shall include Registrar, Chief Administrative Officer, Controller of Finance and Accounts, Deputy Registrar, Head Librarian/Resource Centre, Administrative Officer, Senior Accounts Officer, Senior Assistant Librarian, Senior Superintendent, Assistant Admin Officer, Head Security Services, Superintendent, Senior Assistant, Senior Library Assistant, Senior Assistant (Admn./studio), Warden, Assistant (Accounts/Admn./Library) and such other staff required for manning administrative, establishment, Academic, accounts and finance, knowledge management tasks as recommended by Senate and approved by the Governing Council.

31. Method of appointment of staffs.-(1) The officers, teachers and other staffs shall be appointed either by direct recruitment, by promotion, by deputation (including short-term-contract), by absorption, by re-employment or by contract on the recommendations of the Selection Committee constituted by the appointing authority.

(2) Appointments in all the categories shall be made against sanctioned posts.

(3) The appointment through direct recruitment shall be as regular employee against available posts on applicable pay and allowances as specified in the First Schedule.

(4) The appointment on contract basis shall be for a fixed period up to three years (extendable for further two years, on yearly basis) on applicable pay scales and allowances as specified in the First Schedule and terms and conditions as approved by the Governing Council on recommendation of Standing Committee.

(5) The procedure to be followed for appointment against sanctioned posts shall be as under:-

(a) all post in the Institute shall be filled by advertisement on all India basis through a notification on its website, print and electronic media and such other means as may be deemed appropriate to ensure wide publicity;

(b) while making appointments, the Institute shall make necessary provisions for the reservation of posts as per the directives of the Central Government from time to time.

(c) in respect of all recruitments, appointment letters detailing the terms and conditions, tasks and responsibilities and other details shall be issued, after approval of the competent authority, by the Registrar or such officer as may be specifically authorised to do so by the Director.

(6) No act or proceeding of any Selection Committee shall be called in question on the ground of absence of any member or members of the Selection Committee.

(7) The candidates selected or shortlisted for a post under the Institute may be paid such travelling allowances as may be determined by the Governing Council.

(8) All appointments made by the Institute shall be reported to the Governing Council at its next meeting.

(9) All appointments to posts under the Institute shall be made on probation for a period of two years after which the appointee, if confirmed, shall continue to hold his office till the end of the month in which he attains the age of[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 27 superannuation, that is to say the sixty years of his age or earlier if he is found medically unfit or terminated on disciplinary grounds.

(10) In case of faculty, retirement would be effective from the end of the semester in which faculty reaches the age of superannuation so that educational tasks and responsibilities in respect of courses assigned to such faculty members do not get disrupted in the mid-semester.

(11) The Institute may engage Adjunct Faculty on a consolidated pay basis and Visiting Faculty on per session or per day honorarium basis as per the requirements and on such terms and conditions as approved by Governing Council.

(12) The Director, in appropriate cases, with the prior approval of the Governing Council, may engage subject experts or professionals or technical experts or consultants on the fixed remuneration contract service basis for specific sponsored project and consultancy projects for a specific period and the remuneration to these appointments shall be

paid from the respective sponsored projects:

Provided that the term of such appointment shall not exceed the duration of such sponsored or consultancy projects.

32. Creation of posts.–(1)The Governing Council may recommend the ratios of faculty to student and faculty to non-faculty, as deem appropriate, that will serve as the guiding principle for creation of new posts in the respective class of the staff.

(2) No new posts shall be created without the prior approval of the Governing Council and the Central Government, which shall keep financial prudence in mind in doing so and shall also ensure compliance of the instructions issued by the Central Government in this regard.

33. Selection Committee for appointments.— (1) While making appointments to the posts in the Institute, the

appointing authority shall constitute the Selection Committees for various posts in the following manner namely: -

(a) Faculty.– The selection committee for the appointment of the faulty members shall consist of- i. the Director, National Institute of Design – Chairperson; ii. the Activity Chairperson (Education) – Member;

iii. one other Activity Chairperson or Dean – Member; iv. one external Expert in relevant subject – Member; v. the Chief Administrative Officer –Secretary:

Provided, the members should be of at least one level higher than the post under consideration for selection:

Provided further that in case staff of appropriate level not available in the Institute, the same may be nominated from other National Institutes of Design or other Institutes of national importance with the approval of the Governing Council.

(b) Technical Staff and Administrative Staff.– (1) The Selection Committee for the appointment of technical staff members or administrative and other staff members shall consist of– i. the Director, National Institute of Design –Chairman ii. the Activity Chairperson, Education- Member iii. the Head of the Department or Dean –Member iv. the Registrar- Member;

v. the Chief Administrative Officer –Secretary

(2) In case of selection of the Registrar or the Chief Administrative Officer, any other staff nominated by the Director shall be the member and Secretary, respectively.

Provided, the members should be of at least one level higher than the post under consideration for selection:

Provided further that in case staff of appropriate level not available in the Institute, same may be nominated from other National Institutes of Design or other Institutes of national importance with the approval of Governing Council.

34. Performance Appraisal System.—(1) All the Faculty Members shall be required to fill in self-appraisals evaluating own performance independently and highlighting their contribution for the period of cycle of evaluation in the format and manner approved by the Governing Council.28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(2) All other Technical Staffs and Administrative Staffs shall be required to fill in self-appraisals evaluating own performance independently and highlighting their contribution for the period of cycle of evaluation in the format and manner approved by the Governing Council, keeping in view the guidelines prescribed by Central Government from time to time.

35. Grievances Committee.–(1) The Institute shall constitute a Grievances Committee to examine grievances other than performance appraisal related matters, if any, of the faculty, technical and administrative staff.

(2) Any grievance received by the Committee shall be expeditiously dealt with on the merits of the case and upon providing personal hearing for the aggrieved employee.

(3) The composition of the Grievances Committee shall include the Activity Chairperson (Education) or Dean as Chairperson, Registrar and Controller of Finance and Accounts as Members and the Chief Administrative Officer as Member Secretary.

(4) The report of the Grievances Committee shall be submitted to the Director who shall take decision in the matter on the basis of the findings of the Grievances Committee.

(5) An employee aggrieved by the decision of the Director may prefer appeal to the Standing Committee, excluding the Director.

36. Provident Fund and Pension Schemes.-Employees of the Institute shall be governed by the New Pension Scheme of the Central Government.

37. General Service rules, regulations and delegation of administrative and financial powers.– The rules, regulations, instructions, guidelines, delegation of financial powers approved by the Governing Council, and adopted by the Institute prior to the commencement of these Statutes providing for general conditions of service, conduct and discipline rules, norms or guidelines for perks or facilitates, provident fund, gratuity, advances and loans shall continue to remain in force, to the extent they are not inconsistent with the provisions of these statutes, till such time

they are amended or modified with the approval of the Governing Council:
