NOTIFICATION
New Delhi, the 6th March, 2018
S.O. 1370(E).—In exercise of the powers conferred by sub- section (2) of section 38 of the
Insecticides Act, 1968 (46 of 1968), the Central Government hereby exempts the National Accreditation
Board for Testing and Calibration Laboratories (NABL) accredited laboratories of the following organizations
shall be exempted from the provisions of said Act, namely:-
i. Indian Council for Agricultural Research (ICAR);
ii. State Agriculture Universities (SAU’s);
iii. Institutions of Department of Agriculture, Cooperation and Farmers Welfare;
iv. Department of Science and Technology (DST); and
v. Department of Scientific and Industrial Research (DSIR).
2. The above exemption referred to in paragraph 1 shall be for the purpose of importing insecticides or
pesticides to the tune of up to ten kilograms in a calendar year, for Research and Development activities and
registration related data generation, subject to following conditions, namely: -
i. The authorized signatory of the laboratories shall inform the Central Insecticides Board &
Registration Committee regarding the import details as specified in the format annexed to this
notification.
ii. The laboratory shall inform about the Research & Development work carried out with the imported
quantum of insecticides or pesticides.
iii. The laboratories shall give an undertaking that the imported quantity of insecticides or pesticides shall
be used only for research and development activities and registration related data generation and shall
not be used in any manner for commercial activities, failing which the laboratories shall be liable to
prosecuted under the provisions of Insecticides Act, 1968 and the Insecticides Rules, 1971.
3. This notification shall come into force on the date of their publication in the Official Gazette.
